In this paper, we make explicit the changing configurations of power relations that currently characterize the Brazilian Emergency Care System (SAMU) team in Belo Horizonte, Brazil. The SAMU is a recent innovation in Brazilian healthcare service delivery. A qualitative case study methodology was used to explore SAMU’s current organizational arrangements, specifically the power relations that have developed and that demonstrate internal team struggles over space and defense of particular occupational interests. The argument advanced in this paper is that these professionals (...) are developing their work in conditions of exposure, that is, they are always being observed by someone, and that such observational exposure provides the conditions whereby everyday emergency care practices are enacted such that practice is shaped by, as well as shapes, particular, yet recognizable power relationships. Data were collected through the observation of the SAMU’s work processes and through semi‐structured interviews. Research materials were analyzed using discourse analysis. In the emergency care process of work, visibility is actually embedded in the disciplinary context and can thus be analyzed as a technique applied to produce disciplined individuals through the simple mechanisms elaborated by Foucault such as hierarchical surveillance, normalizing judgment, and the examination. ResumoEste ensaio examina a sobrevida textual de uma cabeça — a de Antônio Vicente Mendes Maciel, o Antônio Conselheiro (1830-1897), a partir de sua morte na Guerra de Canudos (1896-1897). Traçam-se as figurações do crânio de Conselheiro na imprensa brasileira do fim do século XIX e nos trabalhos do médico legista Raimundo Nina Rodrigues e do engenheiro e escritor Euclides da Cunha. Embora ambos esperassem que o crânio de Conselheiro apresentasse evidências físicas de degeneração racial, as observações craniométricas de Nina (...) Rodrigues revelaram um crânio normal. Argumenta-se que esse fracasso da aproximação materialista à psique humana deu proeminência a explicações sociológicas para o fenômeno de Canudos, além de levantar questões sobre visibilidade, raça e racismo científico na virada do século XX e no mundo contemporâneo.Palavras-chave: Raça. AbstractThis essay examines the textual afterlife of a head—that of Antônio Vicente Mendes Maciel (Antônio Conselheiro [1830-1897]), after his death in the Canudos War (1896-1897). It traces figurations of Conselheiro’s skull in the late nineteenth-century Brazilian press and in the works of Raimundo Nina Rodrigues and Euclides da Cunha. Although these two social scientists expected Conselheiro’s skull to display physical evidence of racial degeneration, Nina Rodrigues’s craniometric measurements and observations revealed a perfectly normal skull. It is argued that this failure of a materialist approach to the human psyche allowed a stronger reliance on sociological explanations for the Canudos phenomenon that opens up questions on scientific racism and the visibility of race in the turn of the twentieth century and in contemporary times.Keywords: Race. This article discusses the main arguments of Hedwig Conrad-Martius against the worldview of idealism in connection to her phenomenological idea of reality. The discussion focuses on her most far-reaching critical argument concerning the damage caused by idealism to the possibility for metaphysics by turning the real into the ideal, thereby reducing reality to an idea. This article analyses Conrad-Martius’ understanding of the evolution of idealism and of her criticism regarding the metaphysical absolutizing of the ideal in idealism. The purpose of this article is to understand how academic integrity educational tutorials are administered across Canadian higher education. Results are shared from a survey of publicly funded Canadian higher education institutions, including universities and colleges, across ten provinces where English is the primary language of instruction. The survey contained 29 items addressing institutional demographic details, as well as academic integrity education questions. Results showed that academic integrity tutorials are inconsistent across Canadian higher education, with further differences evident within the (...) university and college sectors. (shrink)

This article deals with the relationship between philosophy and science in the writings of Karl Jaspers and with its reception in the wider scholarly literature. The problem discussed is how to characterize the relationship that exists between science—defined on pure Kantian grounds as a universally valid knowledge of phenomenal objects—and philosophy—conceived by Jaspers as the transcending mode of thinking of personal Existenz rising towards the totality and unity of Being. Two solutions to that problem arise from Jaspers’s writings. The oppositionist (...) view is based in his earlier philosophy of Existenz. It describes the discrepancy between determinateness, bestowed by science to its objects, and freedom of self-determination, which is both a synonym and a condition of possibility for Existenz. The reciprocal view is based in Jaspers’s later works, where he focuses on exploration of his concept of Being (das Umgreifende). By contrast with most of Jaspers’s commentators, the present interpretation is anchored in a developmentaland contextual understanding of Jaspers’s thought. Showing the transcendental background of this topic, the proposed interpretation allows us to abstain from viewing the two solutions as incoherent or contradictory and instead to see them as constitutive of a single philosophical course. El objetivo de este estudio fue analizar los desafíos de la desinstitucionalización en salud mental en el contexto de las políticas públicas brasileñas a través de una revisión integrativa de la literatura entre 2018 y 2022 en bases de datos como SciELO, BIREME, EBSCO y MEDLINE, utilizando palabras clave como políticas públicas, salud mental, desinstitucionalización, CAPS y RAPS. Los criterios de inclusión abarcaron artículos que trataran mecanismos de desinstitucionalización propuestos en la política pública brasileña, excluyendo estudios de revisión, tesis y (...) editoriales. De los 69 materiales encontrados, se incluyeron 14 después de aplicar los criterios de inclusión y exclusión. Del análisis de estos materiales surgieron tres categorías temáticas: percepciones de los usuarios, prácticas profesionales y políticas públicas. En las percepciones de los usuarios, los estudios revelaron avances en términos de personalización del entorno del paciente, satisfaciendo su necesidad de pertenencia. En las prácticas profesionales, se destacó la importancia del trabajo interdisciplinario y de comportamientos que promueven la autonomía del paciente, contribuyendo a la reinserción social efectiva, o que se centran en la comodidad profesional en lugar del desarrollo psicosocial de los pacientes. Por último, en las políticas públicas, se destacaron mecanismos de desinstitucionalización como el "Programa de Regreso a Casa", los Servicios de Residencias Terapéuticas y el Centro de Atención Psicosocial. En conclusión, el desafío de la desinstitucionalización se relaciona con la fragmentación entre marcos teóricos y prácticas profesionales. Aunque las políticas públicas proporcionan fundamentos teóricos, su operacionalización carece de la implementación efectiva de servicios y equipos hospitalarios sustitutos. Además, la formación profesional requiere reflexionar sobre el saber-hacer en salud mental para garantizar que las prácticas estén comprometidas con la reinserción social, el empoderamiento de los usuarios y su emancipación. In recent decades, developing and middle-income countries around the globe have adopted path-breaking reforms to their social protection systems. Latin America has been a pioneer region, expanding the state’s commitment on behalf of low-income citizens in key policy areas in many countries. This paper undertakes two tasks. First, it documents the surprising extension of noncontributory social protection policies across many Latin American countries, highlighting how tax-financed programs have come to play a central role in a variety of settings. Second, it (...) examines citizen-level preferences that support this trend, arguing that employment vulnerability and threats to income continuity play a decisive role in shaping demand for public, rather than private, social protection. Survey data on labor-market risks and social policy preferences from eighteen countries corroborate these claims. Our findings suggest that other countries undergoing labor-market strains may experience similar demands for a “return of the state” as a guarantor of social protection in the coming years. (shrink)

In this paper we investigate risk prediction of criminal re-offense among juvenile defendants using general-purpose machine learning algorithms. We show that in our dataset, containing hundreds of cases, ML models achieve better predictive power than a structured professional risk assessment tool, the Structured Assessment of Violence Risk in Youth, at the expense of not satisfying relevant group fairness metrics that SAVRY does satisfy. We explore in more detail two possible causes of this algorithmic bias that are related to biases in (...) the data with respect to two protected groups, foreigners and women. In particular, we look at the differences in the prevalence of re-offense between protected groups and the influence of protected group or correlated features in the prediction. Our experiments show that both can lead to disparity between groups on the considered group fairness metrics. We observe that methods to mitigate the influence of either cause do not guarantee fair outcomes. An analysis of feature importance using LIME, a machine learning interpretability method, shows that some mitigation methods can shift the set of features that ML techniques rely on away from demographics and criminal history which are highly correlated with sensitive features. Señala el olvido de la perspectiva de género, mainstreaming, en el diseño de las políticas públicas familiares de los estados de bienestar europeos. Apunta a que tras ese olvido se esconde la división sexual del trabajo: hombres espacio productivo, mujeres tareas domésticas y la no consideración del trabajo doméstico y de los cuidados como trabajo. Finalmente, el artículo hace una revisión crítica de los (...) diez años de política de conciliación en España y distingue dos tipos de políticas públicas familiares: políticas de conciliación y políticas de igualdad. The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

Developments in professional practice can be related to ongoing changes in relations of power among professionals, which often lead to changes in the boundaries of practices. The differing contexts of practices also influence these changing relations among health professionals. Legislation governing professional practice also differs from country to country. In Brazil, over the past 12 years, in a climate of deep disagreement, a new law to regulate medical practice has been discussed. It was sanctioned, or made into law, but with (...) some notable changes, in July 2013. Of interest to us in this paper are the ways the proposed legislation, by setting out the boundaries and scope of medical practice, ‘interfered’ in the practices of other health professions, undermining many ‘independent’ practices that have developed over time. However, even taking into account the multiple routes through which practices are established and developed, the role of legislation that seems able to contradict and deny the historical realities of multiple, intersecting practices should be critically interrogated. In this paper, we use the theoretical resources of poststructuralist thinking to explore gaps, ambiguities, and power relations implicit in the discourses that constituted this law. We argue that although the new law can be understood as a social and political device that will interfere in the organization of other health professions’ practices, such legislation is only part of what constitutes change in a consolidated professional practice. And while it is important to understand the effects of such legislation, healthcare practices are also realized or ‘made real’ through ongoing relations of knowledge and power, including, as we will see in this case, activities of resistance. The problem, then, is to understand the practical arrangements, including legislation, traditions and routines, values and knowledge that come to shape the practices of nursing in a particular context. This article proposes a new theorization of the concept of framing or framework, in which the argumentation plays a fundamental role. When we talk about making decisions, framing a matter involves offering the audience a prominent and therefore possibly paramount premise in a deliberative process that allows to substantiate as much of the decision as the action. The analysis focuses on the case of The Public Policy Controversy, which, over the years, became a socio-environmental movement and which, in September 2013, (...) culminated in the most important protests that have been experienced in Romania since the 1989 Revolution. Based on the concept of framing that Entman understands as "selection and emphasis", several framing strategies are identified and commented on illustrating three main mechanisms. The way "selection and emphasis" operates through a series of argument schemes within a deliberative decision-making process to produce framing effects (including possibly collective mobilization) is illustrated by examples from the 2013 campaign and protests (slogans, websites, blogs, and newsnotes). In this study, we analyzed the academic integrity policies of colleges in Ontario, Canada, casting a specific lens on contract cheating. We extracted data from 28 individual documents from 22-publicly-funded colleges including policies and procedures (n = 27) and code of conduct (n = 1). We analyzed the characteristics of the documents from three perspectives: (a) document type and titles; (b) policy language; and (c) policy principles. Then we examined five core elements of the documentation including (a) access; (b) approach; (...) (c) responsibility; (d) detail; and (e) support. Key findings revealed that specific and direct language pertaining to contract cheating was largely absent from the policy documents, that underlying policy principles lacked clear definition, and that exemplary policy has yet to be developed in this context. We conclude with recommendations for increased policy research in the area of academic integrity and a call for policy revision in Canadian higher education institutions to more explicitly address the issue of contract cheating, as well as provide more support to students and other campus stakeholders to better understand how contract cheating impacts and impedes teaching and learning. Multicultural cities in the Global North are rapidly developing and releasing urban food policies that outline municipal visions of sustainable food systems. In turn, these policies shape conceptions of food citizenship in the city. While these policies largely absorb activities previously associated with “alternative” food systems, little is known about how they respond to critical food and race scholars who have noted that these food practices and spaces have historically marginalized immigrants. A critical discourse analysis of 22 urban food policies (...) from Global North cities reveals that most policies do not meaningfully consider immigrant foodscapes, foodways, and food-related labour. Many promote hegemonic and/or ethno-nationalistic understandings of “healthy” and “sustainable” food without recognizing immigrants’ food-related knowledge and skills. Policies largely fail to connect the topic of immigrant labour with goals like shortening supply chains, subject immigrant neighbourhoods to stigmatizing health discourses, and lack acknowledgement of the barriers immigrants may face to participating in sustainable food systems. Relatedly, policy discourses articulate forms of food citizenship that emphasize individual obligations over rights related to food. This jeopardizes the potential for immigrants to be seen as belonging to dominant political urban food communities and benefitting from the symbolic and material rewards associated with them. In this essay, I fill this gap in knowledge by arguing that the central object of Fanonian dialectics is violence (anticolonial guerilla warfare), the achievement of the decolonized Black nation and the eventual creation of a new anti-colonial (Pan-African) world order over and against its dialectical negation: Neo-colonialism via colonial counterinsurgency. Furthermore, I argue that Fanon’s dialectical thought helped lay the basis for the emergence of a new theory of revolution against US empire coined by Huey P. Newton as intercommunalism. (...) The complementarity and conceptual harmony between Fanon’s and Newton’s dialectical thinking about US/colonial empire, counterinsurgency, the imperative of creating new forms of humanism, and the lumpen masses as primary agents in the revolutionary transformation of society comprise what I call the ‘empire as pacification’ thesis. This article combines a pragma-dialectical conception of argumentation, a sociological conception of legitimacy and a sociological theory of the political field. In particular, it draws on the theorization of the political field developed by Pierre Bourdieu and tries to determine what new insights into the concept of strategic maneuvering might be offered by a sociological analysis of the political field. I analyze a speech made by the President of Romania, Traian Băsescu, following his suspension by Parliament in April 2007. I (...) suggest that the argument developed in this speech can be regarded as an example of adjudication and I discuss its specificity as an adjudication in the political field in an electoral campaign. I also try to relate legitimation as political strategy to strategic maneuvering oriented to meeting the contradictory demands of the political field, which I see—following Bourdieu—as involving a double political game, a game of democratic representation and a game of power. _Husserl and Other Phenomenologists_ addresses a fundamental question: what is it in the thinking of the founding father of phenomenology, Edmund Husserl, that on the one hand enables the huge variety in the phenomenological discourse and, at the same time, necessitates relying on his phenomenology as a point of departure and an object before which philosophizing is conducted. The contributors to this volume, each with his or her own focus on a specific figure in the phenomenological school vis-à-vis Husserl's thinking, (...) demonstrate that every reference to Husserl is necessarily bound up with modifying his ideas and crossing the boundaries of his phenomenology. In this sense, and given the insight that Husserlian phenomenology is already imbued with the potential modifications and revisions, the post-Husserlian phenomenologies may be included together with Husserl in one so-called ‘Phenomenological Movement’. The discussions in the book open for philosophers and intellectuals a window upon phenomenology, which has been one of the richest and most influential cultural phenomena since its very appearance at the beginning of the twentieth century. The book also conveys the complex interpretive dynamic within which a given framework of ideas becomes a sort of magnetic field, with attracting and repelling forces acting on its participants, and thanks to which the great ideas of modernity maintain their vitality and relevance a hundred years after their first appearance. The question „what is reality?“ that opens Realontologie (1923), the establishing book in Hedwig Conrad-Martius’s (CM) oeuvre, establishes her realistic metaphysics. In her opinion, the firmly established „blinding insight“ in modern philosophy regarding the unfathomable contrast between the ideal and the real blocks any access to the question of reality. Her realontological philosophy seeks the „gate of reality“, meaning the datum-point where things „elevate“ themselves from non-existence or mere ideal existence but do not yet arrive at „operative Being“ or realistic (...) fulfillment. CM identifies three characteristics of the real by which it meets the „task of Being“ imposed upon it to personally describe and fulfill the essence inherent in it: formationality (Leibhaftigkeit), self-standing and primordiality. The suggested interpretation of each of these three seeks to unravel the seeming contrast between the real and the ideal in favor of what she regards as the only genuine and primordial opposition that separates the real from nonexistence. This essay conducts a diachronic examination of the thought of W.E.B. Du Bois. In so doing, it reveals a corpus that is marked by a tradition of thinking rarely acknowledged by scholars today: Black nationalism. Du Bois’s early focus on the relationship between racism and imperialism and ideological conflicts with Booker T. Washington and Marcus Garvey laid the basis for his intellectual maturation around the concept of self-determination. After synthesizing the insights of his former ideological rivals, this essay will show (...) that Du Bois affected a revolution in Black nationalist (and human) thought by making the common humanity and autonomy of African/African-descended peoples (and all colonized people) thinkable through the ideology of Pan-Africanism: a truly universal idea of freedom which was antagonistic to Westernism (Liberal Capitalist and Marxist thought). According to Brehm's intensity of emotion theory, if an emotion has motivational properties, its intensity should be non-monotonically affected by factors similar to those determining the intensity of motivational states. These factors are called deterrents. In the case of emotion, one category of deterrents consists of factors that can potentially interfere with feeling the emotion, such as reasons for not feeling the emotion. Two experiments were carried out to examine whether happiness is a motivational state and, thus, if its intensity (...) is non-monotonically determined by the importance of reasons for not feeling happy. We expected happiness to be reduced by a low importance reason for not feeling happy, to remain high in the presence of a moderately important reason, and to be reduced or eliminated by a very important reason. Both experiments supported the cubic function that results from these expectations, and when the results of the two studies were combined, each of the individual legs of the cubic function was found to be reliable along with the cubic function itself. She was a prominent figure in the Munich-Göttingen Circle, the first generation of phenomenology after Edmund Husserl, and was known as the “first lady of German philosophy”. This article aims to identify the main cultural factors that have contributed to East Timor’s conflict with Indonesia by increasing vulnerability, instability and violence and at presenting the structural fazes of the conflict. Please note that despite being grouped into categories, many of the cultural conflict factors are, infact, closely inter - linked and often act to reinforce one another.

The pivotal insight that paved Conrad-Martius’ (1880–1966) (CM) way in elucidating the ontological exclusivity of the I, denoted as “I-adhering being” (Ichhaftes Sein), is that despite its peculiarity and incomparability to any other mode of being, only the ontological foundations of the real being in general might enable a faithful comprehension of the I. The phenomenological interpretation suggested in this article presents CM’s ontological understanding of the I vis-a-vis her philosophy of Being, in particular in regard to three of its (...) general characteristics – existence, intelligibility, and self-adherence (Sichheit/Selbsthaftigkeit) – which provide the critical approach to the ontological study of the I. Finally, the understanding of the ontological exclusivity of the I-adhering being is achieved by means of an explication of the joining together of its typical affinities and discrepancies in regard to Being in general. An increase in the number of older people with dementia is currently a trend around the world. In low and middle countries, effective public health services are not yet well‐developed, and family care‐givers may be overwhelmed by the requirements of care. This paper has two purposes: to share findings from an ethnographic study about family dementia care practices in Brazil and to draw attention to the significance of the materiality of care practices in the family context. The study was conducted (...) in Belo Horizonte, Brazil. We describe the care trajectory of one family and, analysing data using the insights of Actor Network Theory, show the significance of objects in a networked relation of care. In particular, we show how incontinence products such as adult diapers assume different positions in the network, acting as either mediator or intermediary of care in relation to other elements of the network composed of family members and their living situation, the person with dementia herself, the doctor, and Brazilian health policies. Although the diaper is often seen as an ordinary object for care providers, its participation in a care network shapes relations, activating conflict, financial constraint, and disciplining the body of the person with dementia. This article addresses a basic question: what elements in Husserl’s phenomenology can account for the variety of post-Husserlian phenomenologies? The answer, I suggest, is that Husserl’s idea of reality, particularly his notion of givenness vis-à-vis self-givenness, facilitated the work of his followers by offering them at once a firm ground and a point of departure for their inquiries. However, adopting Husserl’s phenomenology as their starting point did not prevent his followers from developing their own independent phenomenological theory. Moreover, despite the (...) elusive particulars that shape one’s individual experience of the world, so it transpires, Husserl’s thinking which was different and beyond their own observations and actual experiences, namely, transcendent, appears to have been a genuine guide along their path to achieve meaning.
