This contribution provides theoretical insights into a planned dissertation project which discusses the mass media as a stakeholder of a company, suggesting that a complex understanding of the mass media, their public-sphere function and their mode of operation is crucial for analyzing the media’s role in conferring corporate legitimacy. Terms such as ‘corporate citizen’ or ‘stakeholder democracy’ or the notion of corporations as civil or political actors imply a link to the public sphere, which in modern democracies is primarily constituted (...) through the mass media. However, up to now, there has been hardly any discussion about the role of the mass media and the public sphere in the realm of stakeholder theory. (shrink)

Corporate success is understood as stakeholder value, which is based on three licenses: the licenses to innovate, to compete, and to operate. Stakeholders contribute to these three licenses through their benefit and risk potentials. Based on four cases, a stakeholder value management system is developed which provides managers with a tool to systematically use the benefit potentials that lie in stakeholder relations. The links between corporate value creation and stakeholders are identified.

Euthanasia and assisted suicide have been legally possible in the Netherlands since 2001, provided that statutory due care criteria are met, including: voluntary and well-considered request; unbearable suffering without prospect of improvement; informing the patient; lack of a reasonable alternative; independent second physician’s opinion. ‘Unbearable suffering’ must have a medical basis, either somatic or psychiatric, but there is no requirement of limited life expectancy. All EAS cases must be reported and are scrutinised by regional review committees. The purpose of this (...) study was to investigate whether any particular difficulties arise when the EAS due care criteria are applied to patients with an intellectual disability and/or autism spectrum disorder. The 416 case summaries available on the RTE website were searched for intellectual disability and autism spectrum disorder. Direct content analysis was used on these nine cases. Assessment of decisional capacity was mentioned in eight cases, but few details given; in two cases, there had been uncertainty or disagreement about capacity. Two patients had progressive somatic conditions. For most, suffering was due to an inability to cope with changing circumstances or increasing dependency; in several cases, suffering was described in terms of characteristics of living with an autism spectrum disorder, rather than an acquired medical condition. Some physicians struggled to understand the patient’s perspective. Treatment refusal was a common theme, leading physicians to conclude that EAS was the only remaining option. There was a lack of detail on social circumstances and how patients were informed about their prognosis. Autonomy and decisional capacity are highly complex for patients with intellectual disabilities and difficult to assess; capacity tests in these cases did not appear sufficiently stringent. Assessment of suffering is particularly difficult for patients who have experienced life-long disability. The sometimes brief time frames and limited number of physician-patient meetings may not be sufficient to make a decision as serious as EAS. The Dutch EAS due care criteria are not easily applied to people with intellectual disabilities and/or autism spectrum disorder, and do not appear to act as adequate safeguards. (shrink)

With an aim to bring caring back into economic theory, this work draws upon the work of Aristotle and Amartya Sen's notions of capability and commitment, to propose an alternative methodology to utilitarianism that is not normative.

Whether copyrights should exist in content generated by an artificial intelligence is a frequently discussed issue in the legal literature. Most of the discussion focuses on economic rights, whereas the relationship of artificial intelligence and moral rights remains relatively obscure. However, as moral rights traditionally aim at protecting the author’s “personal sphere”, the question whether the law should recognize such protection in the content produced by machines is pressing; this is especially true considering that artificial intelligence is continuously further developed (...) and increasingly hard to comprehend for human beings. This paper first provides the background on the protection of moral rights under existing international, U.S. and European copyright laws. On this basis, the paper then proceeds to highlight special issues in connection with moral rights and content produced by artificial intelligence, in particular whether an artificial intelligence itself, the creator or users of an artificial intelligence should be considered as owners of moral rights. Finally, the present research discusses possible future solutions, in particular alternative forms of attribution rights or the introduction of related rights. (shrink)

The aim of this article was to obtain an understanding of what is experienced as human dignity by nurses in surgical practice. In order to obtain experiences from practice, the critical incident technique was chosen. A total of 11 nurses from surgical practice wrote 49 stories about positive and negative incidents. The text was analysed using hermeneutical text interpretation. The findings revealed patient dignity in terms of preserved dignity, that is, healthcare professionals paid attention to the patient. Nurses experienced preserved (...) dignity when healthcare professionals allowed the patient to tell their story, allowed themselves to get close to the patient and in turn received the patient’s trust. Violated dignity included circumstances when the nurses were forced to see what they did not want to see. Nurses experienced violated dignity when healthcare professionals behaved rudely towards the patient, acted as if he or she was invisible or humiliated the patient at the end of life. (shrink)

Numerosity perception is a key ability for human and non-human species, probably mediated by dedicated brain mechanisms. Electrophysiological studies revealed the existence of both early and mid-latency components of the Electrophysiological (EEG) signal sensitive to numerosity changes. However, it is still unknown whether these components respond to physical or perceived variation in numerical attributes. We here tackled this point by recording electrophysiological signal while participants performed a numerosity adaptation task, a robust psychophysical method yielding changes in perceived numerosity judgments despite (...) physical numerosity invariance. Behavioral measures confirmed that the test stimulus was consistently underestimated when presented after a high numerous adaptor while perceived as veridical when presented after a neutral adaptor. Congruently, EEG results revealed a potential at around 200 ms (P2p) which was reduced when the test stimulus was presented after the high numerous adaptor. This result was much prominent over the left posterior cluster of electrodes and correlated significantly with the amount of adaptation. No earlier modulations were retrievable when changes in numerosity were illusory while both early and mid-latency modulations occurred for physical changes. Taken together, our results reveal that mid-latency P2p mainly reflects perceived changes in numerical attributes, while earlier components are likely to be bounded to the physical characteristics of the stimuli. These results suggest that short-term plastic mechanisms induced by numerosity adaptation may involve a relatively late processing stage of the visual hierarchy likely engaging cortical areas beyond the primary visual cortex. Furthermore, these results also indicate mid-latency electrophysiological correlates as a signature of the internal representation of numerical information. (shrink)

Annotated logics were introduced by V.S. Subrahmanian as logical foundations for computer programming. One of the difficulties of these systems from the logical point of view is that they are not structural, i.e., their consequence relations are not closed under substitutions. In this paper we give systems of annotated logics that are equivalent to those of Subrahmanian in the sense that everything provable in one type of system has a translation that is provable in the other. Moreover these new systems (...) are structural. We prove that these systems are weakly congruential, namely, they have an infinite system of congruence 1-formulas. Moreover, we prove that an annotated logic is algebraizable (i.e., it has a finite system of congruence formulas,) if and only if the lattice of annotation constants is finite. (shrink)

Both the USA and Europe limit access to care by undocumented immigrants. In the debate over what level of access to confer to IMs, there are various public policy rationales operating either explicitly, or below the surface, ranging from minimalist humanitarianism to full cosmopolitan equality, with several intermediate positions between these two poles. This article informs the international debate by providing a conceptual mapping of these underlying policy rationales. Each position is based on different lines of reasoning or bodies of (...) evidence, and each leads to somewhat different conclusions about the extent to which IMs should have access to different types of health care. It is unlikely that broad consensus will be achieved in this ongoing debate. However, by articulating the ethical, legal, pragmatic and conceptual reasons to support or oppose various positions, we hope to help determine where in the landscape of reasoned argument various positions lie, and how each position might be best supported or refuted. In particular, we see in this debate an illustration of Michael Walzer’s classic analysis of competing spheres of justice. Various positions depend to a considerable extent on whether their advocates approach this issue from the health policy sphere rather than the sphere of immigration policy, or whether they attempt to blend the two spheres. We live in an increasingly globalizing world, in which countries are closely linked by international trade and investment ties. Cross-cultural comparative studies of national values and ethics have attracted growing research interest in recent years, because shared practices, values and ethical standards depend on shared beliefs. However, the findings of such studies have been unable to reach a consensus on the impact of culture on ethics-related attitudes and behavior. Empirically, many "cross–cultural" differences reported by previous studies might actually stem from (...) cross-national differences. In order to partially fill this gap, this study advocates an analytical framework that isolates the role of cultural and national differences in order to test their relationship to individual level variables. Within this framework, we test competing hypotheses based on both cultural and national contexts by comparing groups of Chinese and American respondents together with a "bridging group" of Chinese Chinese-Americans. Theoretically, this contextual approach helps resolve the debate on the role of culture, by showing that culture plays a far more important role in shaping value orientations than the national background. Specifically, the two ethnic Chinese groups had many cultural values in common, and differed significantly from the Caucasian group. Implications are discussed. (shrink)

BackgroundAdvances in biomedicine can substantially change human life. However, progress is not always followed by ethical reflection on its consequences or scientists’ responsibility for their creations. The humanities can help health sciences students learn to critically analyse these issues; in particular, literature can aid discussions about ethical principles in biomedical research. Mary Shelley’sFrankenstein; or, the modern Prometheus(1818) is an example of a classic novel presenting complex scenarios that could be used to stimulate discussion.Main textWithin the framework of the 200th anniversary (...) of the novel, we searched PubMed to identify works that explore and discuss its value in teaching health sciences. Our search yielded 56 articles, but only two of these reported empirical findings. Our analysis of these articles identified three main approaches to usingFrankensteinin teaching health sciences: discussing the relationship between literature and science, analysing ethical issues in biomedical research, and examining the importance of empathy and compassion in healthcare and research. After a critical discussion of the articles, we propose usingFrankensteinas a teaching tool to prompt students to critically analyse ethical aspects of scientific and technological progress, the need for compassion and empathy in medical research, and scientists’ responsibility for their discoveries.ConclusionFrankensteincan help students reflect on the personal and social limits of science, the connection between curiosity and scientific progress, and scientists’ responsibilities. Its potential usefulness in teaching derives from the interconnectedness of science, ethics, and compassion.Frankensteincan be a useful tool for analysing bioethical issues related to scientific and technological advances, such as artificial intelligence, genetic engineering, and cloning. We introduce a family of matrices that define logics in which paraconsistency and/or paracompleteness occurs only at the level of literals, that is, formulas that are propositional letters or their iterated negations. We give a sound and complete axiomatization for the logic defined by the class of all these matrices, we give conditions for the maximality of these logics and we study in detail several relevant examples.

For cognitivist accounts of aesthetic appreciation, appreciation requires an agent (1) to perceptually respond to the relevant aesthetic features of an object o on good evidential grounds, (2) to have an autonomous grasp of the reasons that make the claim about the aesthetic features of o true by pointing out the connection between non-aesthetic features and the aesthetic features of o, (3) to be able to provide an explanation of why those features contribute to the overall aesthetic value of o. (...) In this framework, aesthetic emotions have traditionally been confined to the level of aesthetic perception (1) and dismissed from the process of reason-giving (2, 3). I argue that this dismissal is due, firstly, to a questionable perceptual reading of the connection between emotional experience and value, and, secondly, to a narrow focus on the basic emotions. My argument will reveal that the non-standard or ‘intellectual’ emotions, the emotions which are in fact most important to appreciation, can play a significant epistemic role in our appreciative practices. They can do this because they (a) help us to deliberately focus our attention and (b) place the appreciator in a state of second-order awareness of their mental states. I conclude the paper by showing how these two epistemic tools (a, b) can help the appreciator to meet the explanatory/justificatory conditions (2) and (3). (shrink)

This introductory chapter provides an overview of the chapters making up the book, which are grouped into six sections: challenges and alternatives to the causal theory of memory; activity and passivity in remembering; the affective dimension of memory; memory in groups; memory failures: concepts and ethical implications; and the content and phenomenology of episodic and semantic memory.

Cet essai aborde la question phénoménologique fondamentale de la donation de l’apparaître. L’auteur commence par noter que la distinction husserlienne entre l’apparaître comme vécu (Erscheinen als Erleben) et ce qui apparaît (das Erscheinende) ou phénomène a été critiquée à partir de deux perspectives différentes dont Patočka et Henry sont, respectivement, deux représentants importants. Quoique tous deux critiquent la même distinction husserlienne, l’auteur montre cependant que leurs critiques prennent en réalité des directions opposées. Patočka entend développer une phénoménologie asubjective dans laquelle (...) la donation fondamentale de toute apparence se trouve dans le « se-montrer-soi-même » (Sich-selbst-zeigen) des êtres. Plutôt que dans le domaine de l’auto-donation du vécu de l’expérience (Erleben), cette phénoménologie fonde l’apparence dans la sphère phénoménologique globale du monde. Henry, quant à lui, ne rejette pas le domaine subjectif mais renforce bien plutôt son importance en radicalisant la distinction husserlienne entre l’expérience et le phénomène et en la remplaçant par la différence qu’il établit entre révélation et manifestation. La manifestation suppose toujours la distance et l’intentionnalité. La révélation, en revanche, peut être comprise comme une radicalisation de l’expérience husserlienne, puisqu’elle est un mode d’apparaître qui n’implique pas une forme de pensée (meinen) et d’intentionnalité. Elle est, en tant que telle, exempte de la distance que Henry exclut du domaine d’intériorité où se produit la révélation. L’auteur discute alors ce contraste entre Patočka et Henry et montre à quel point l’accent mis sur le monde dans l’explication de la donation donnée par le premier diffère de la relation à soi subjective qui est au cœur de l’explication de la donation offerte par le second. Roger Bacon is a remarkable figure for his theory of the sign. According to the new reading hypothesis presented in this article, the whole theory is grounded on the relational nature of the sign. Every sign is involved in two relations: one to the interpreter, the other to the significate, the first being “more essential” than the second. The hypothesis allows for a better understanding of Bacon’s central claim that speakers constantly re-impose words in colloquial practice, as well as of (...) its main technical developments. In his whole semantics, Bacon’s focus is not so much on entities as on relations holding between entities. From a comparative point of view, the paper offers considerations on the theological background of Bacon’s ideas. (shrink)

Background: Human rights are an important part of nursing care, and nurses deal with human rights matter daily. Despite their relevance and acknowledgement of their importance, human rights issues remain limited in nursing education. Aim: The study’s aim was to describe how human rights education has been addressed in nursing education. Method: A scoping review was conducted according to the Preferred Reporting Items for Scoping reviews (PRISMA-ScR) and Joanna Briggs Institute (JBI) recommendations. The search was conducted in March 2023, with (...) an updated search in February 2024. We searched in the following databases provided by EBSCO: Academic Search Elite, CINAHL, Education Source, ERIC, ScienceDirect and MEDLINE. Additionally, we also searched in Embase via Ovia and Scopus. The papers were screened for eligibility by title, abstract and full text independently by at least two reviewers, and the whole research team was involved in this process. Ethical considerations: The scoping review was guided by ethical conduct and scientific guidelines. Findings: Nine papers matched the inclusion criteria. Three thematic groups were identified: (a) focus of human rights education, (b) the learning design of the coursework and (c) learning outcomes in human rights education. Conclusion: Human rights education can benefit from being tailored to the students’ experiences and including voices from the rights-holders. Bringing in the students’ experiences and rights-holders’ voices can enable self-reflection and discussion regarding human rights concerns. Hence, if the intention is to support nursing students to develop an awareness and act upon human rights concerns, the curriculum ought to include opportunities for reflection and discussion around human rights concerns and experiences in the students’ own context. This article argues that to gain a more complete understanding of how lesbian families experience parenthood outside of the heterosexual context, scholars must consider how co-parents negotiate a parental identity, rather than presuming that women parents want to mother. Drawing on in-depth interviews with 17 women in a state that denies them parental legal rights, this article asks how a non—biologically related and non—legally related woman parent determines a parental identity in a social system that continually reminds her of her (...) liminal position. Interviewees divided roughly evenly into the self-identified categories of “mother” and “father” and a collectively generated category of “mather,” a hybrid of the two words. The word mather served to anchor co-parents in otherwise uncertain seas, but the other groups felt their parental identity was significantly constrained by ill-fitting role expectations based on gender. We conclude by addressing the possibility for alternative family forms to transform the institution of gendered parenting. (shrink)

The aim of this volume is to critically assess the philosophical importance of phenomenology as a method for studying the normativity of meaning and its transcendental conditions. Using the pioneering work of Steven Crowell as a springboard, phenomenologists from all over the world examine the promise of phenomenology for illuminating long-standing problems in epistemology, the philosophy of mind, action theory, the philosophy of religion, and moral psychology. The essays are unique in that they engage with the phenomenological tradition not as (...) a collection of authorities to whom we must defer, or a set of historical artifacts we must preserve, but rather as a community of interlocutors with views that bear on important issues in contemporary philosophy. -/- The book is divided into three thematic sections, each examining different clusters of issues aimed at moving the phenomenological project forward. The first section explores the connection between normativity and meaning, and asks us to rethink the relation between the factual realm and the categories of validity in terms of which things can show up as what they are. The second section examines the nature of the self that is capable of experiencing meaning. It includes essays on intentionality, agency, consciousness, naturalism, and moral normativity. The third section addresses questions of philosophical methodology, examining if and why phenomenology should have priority in the analysis of meaning. The increase in the spread of conversational agents urgently requires to tackle the ethical issues linked to their design. In fact, developers frequently include in their products cues that trigger social biases in order to maximize the performance and the quality of human-machine interactions. The present paper discusses whether and to what extent it is ethically sound to intentionally trigger gender biases through the design of virtually embodied conversational agents. After outlining the complex dynamics involving social biases, social robots, and (...) design, we evaluate the ethics of integrating gender cues in conversational agents, analysing four different approaches to the problem. Finally, we suggest which approach in our opinion might have the best chances to reduce the negative effects of biases and discriminatory visions of gender dynamics. (shrink)

Background Making appropriate end-of-life decisions in the intensive care unit (ICU) requires shared interprofessional decision-making. Thus, a decision-making climate that values the contributions of all team members, addresses diverse opinions and seeks consensus among team members is necessary. Little is known about religion’s influence on ethical decision-making climates. Therefore, this study aimed to examine the association between religious belief and ethical decision-making climates. Methods The study was a cross-sectional analytical observation study as a part of the prospective observational DISPROPRICUS study. (...) A total of 2,275 nurses and 717 physicians from 68 ICUs representing 12 countries in Europe and the US participated. All participants were asked which religion (if any) they belonged to and how important their religion (if any) was for their professional attitude towards end-of-life care. Perceptions of ethical decision-making climates were evaluated using a validated, 35-item self-assessment questionnaire that evaluates seven factors. Using cluster analysis, ICUs were categorised into four ethical decision-making climates: good, average (with nurses’ involvement at the end of life), average (without nurses’ involvement at the end of life) and poor. Results Of the 2,992 participants, 453 (15%) were religious (had religious convictions and found them important or very important for their attitude towards end-of-life care). The remaining 2,539 were non-religious (i.e. had religious convictions but assessed that they were not important for their attitude towards end-of-life care). When adjusting for country and ICU, the overall perception of the four ethical climates was associated with religious beliefs, with non-religious healthcare providers having more positive perceptions of the ethical climates compared to religious healthcare providers (p < 0.01). Within good climates, non-religious healthcare providers rated leadership by physicians (p < 0.01), interdisciplinary reflection (p = 0.049) and active decision-making by physicians (p = 0.02) as more positive compared to religious participants. In poor climates, religious healthcare providers had a more positive perception of the active involvement of nurses (p = 0.01). Within the other climates, no differences were found. Conclusions Overall perceptions of ethical decision-making climates were associated with religious beliefs, with non-religious healthcare providers generally having a more positive perception of the ethical climates than religious healthcare providers. In this paper a first order theory for the logics defined through literal paraconsistent-paracomplete matrices is developed. These logics are intended to model situations in which the ground level information may be contradictory or incomplete, but it is treated within a classical framework. This means that literal formulas, i.e. atomic formulas and their iterated negations, may behave poorly specially regarding their negations, but more complex formulas, i.e. formulas that include a binary connective are well behaved.
