My paper tackles the generic relationship between philosophy and law, the necessity of applying philosophy to law, the legitimacy and range of such an approach, the configuration of the way in which philosophy has left its mark in the juridical sphere. It surveys, in a chronological order, as well as in terms of their co-existence, the various stages of the relationship between philosophy and law. 1. Although both have been “within the walls”, law secludes itself, relatively speaking, in “the world (...) taken as a whole”, to shape its own identity, to survive as a self-sufficient, distinct technique (F. Geny), or it does it in a doctrinary way (positivism). 2. The representatives of philosophy in the juridical sphere are doing their best to uphold law’s struggle for knowledge, to have it gain recognition as a “science”, renounce its one-sidedness and harmonize with the others. 3. Juridical norms are not untouchable in relation with philosophy. Philosophy may work within juridical norms if it has an affinity with the content of juridical normativeness and respects its specificity. 4. The conclusion I reach is that we must try to cultivate a joint area bringing together philosophy and law, an area wherein the specific features of the two distinct fields reach a consensus for the sake of the human condition – hic et nunc. Philosophy bestows coherence and casts light on “law for man’s sake”, while the philosophically founded law appears to be the “normative project of the human”, a human practice inextricably connected with other types of practice, with man as a whole. The practical way to fulfil this goal, like the goal itself, will always be liable to criticism and improvement, open to debates and various options in a concrete socio-historical context. (shrink)

The paper outlines Schutz’s phenomenology of law in the context of the transformation of positivistic practices in a post-totalitarian society. His major contribution is seen in the disentanglement of social phenomena from any form of naturalness by incorporating the dimension of meaning and interpretation into them. This philosophical gesture is made possible by renouncing any theory of transcendent ground(s) of a pre-formed order (Section 1) and leads to an interpretive concept of law, in which the reciprocity of perspectives play the (...) major role. There are many ways of interpreting the behaviours related to substance misuse and addiction, which can be sort out as three basic models: biomedical, legal, and social. They are corresponding to approaches built in different epistemic and professional frameworks, such as medicine, law, and social work. Confronted with the experience of addiction, these models appear as pre-determined by a specific scientific or professional ideology; they presuppose a pre-understanding of the phenomena. I directed, therefore, my investigation on those phenomenological paths that (...) might lead to, and circumscribe the experience of addiction and I propose an analytical framework based on three major phenomenological perspectives: descriptive, genetic, and inter-relational. This paper argues in favour of defining addiction without making reference to a form of failure, psycho-somatic or existential. On the contrary, it concludes that there is a need to adopt a definition of addiction which holds at its core the idea of empowering addicted persons, of re-constructing their capacity to take decisions about their own lives. Cases of poor care have been documented across the world. Contrary to professional requirements, evidence indicates that these sometimes go unaddressed. For patients, the outcomes of this inaction are invariably negative. Previous work has either focused on why poor care occurs and what might be done to prevent it, or on the reasons why those who are witness to it find it difficult to raise their concerns. Here, we build on this work but specifically foreground the responsibilities of registrants and (...) students who witness poor care. Acknowledging the challenges associated with raising concerns, we make the case that failure to address poor care is a breach of moral expectation, professional requirement and, sometimes, legal frameworks. We argue that reporting will be more likely to take place if those who wish to enter the profession have a realistic view of the challenges they may encounter. When nurses are provided with robust and applied education on ethics, when “real‐world” cases and exemplars are used in practice and when steps are taken to develop and encourage individual moral courage, we may begin to see positive change. Ultimately however, significant change is only likely to take place where practice cultures invite and welcome feedback, promote critical reflection, and where strong, clear leadership support is shown by those in positions of influence across organisations. Since its inception philosophical thought has been fixated by death. Death, as much as life, has been the unrelenting driving force behind some of history’s greatest thinkers. Yet, for Emil Cioran, a Romanian-French philosopher, even philosophy cannot attempt to understand nor contain the inevitable unknown. Considered to be an anti-philosopher, Cioran approached and reflected on the human experience with a despairing pessimism. His works are characterised by a brooding, fatalistic temperament that reveals and defines itself in his irony, black humour (...) and inimitable style. Although Cioran’s later works have received much scholarly recognition, little attention has been paid to the texts he wrote in his adolescent. Grounded in the historical context of interwar Romania, this book presents for the first time an analysis of the little-known works of this pioneering Romanian thinker. Deeply affected by his upbringing, this book offers a glimpse into Cioran’s first attempts to delve into philosophical enterprise, before turning its attention to his later works, On the Heights of Despair (1934), The Transfiguration of Romania (1936) and Twilight of thoughts (1940; written in France). Using both the French and Romanian editions of these works, but also their original manuscripts, this volume seeks to provide a re-reading that takes language rather than a social or political critique as its focal point. As an important and provocative contribution to the existing literature on Cioran, this book will be an essential point of reference for students and researchers, alike. (shrink)

This book is a rediscovery and examination of the thinking of Vasile Băncilă, a philosopher forbidden by the totalitarian regime of Nicolae Ceaușescu. The philosopher Lucian Blaga saw Băncilă as a threat to the spirit of the highest Romanian culture. It is estimated that Băncilă's work extends to 32 volumes, 17 of which have been published so far. With such a significant opus, Vasile Băncilă is, indisputably, a key figure in contemporary Romanian culture, particularly in the sphere of philosophy. The (...) book has eleven chapters and is divided into two parts. The first part deals with the hermeneutics of the author's youthful works. His reflections on the purpose of philosophy for life are important, about the role of this discipline in the education of adolescents and students, the relationship between irony and education, his thoughts of one of the greatest Romanian poets, Mihai Eminescu, and the philosophy of Descartes and of Schopenhauer. In the second part, the book looks at Băncilă's aim of structuring a possible system of philosophy; more precisely, an ethnic-spiritualist metaphysics which, when it was elaborated, contradicted the official ideology of the totalitarian regime. Finally, the book covers the philosopher's work, analysing step-by-step the relation between the part and the whole (pars pro toto), as well as between existence and metaphysics, and the philosopher's conclusions about Romanian existence. Das Buch betrachtet Brentanos Psychologie vom empirischen Standpunkt als eine methodologische Schrift, die einen wichtigen Beitrag zur positiven Philosophie des 19. Jahrhunderts leistet und gegenüber seiner Deskriptiven Psychologie ein selbstständiges Projekt ausmacht. Es untersucht auch Themen Brentanos, die für die Phänomenologie Heideggers und Husserls relevant sind: das veritative Seiende, die Phantasievorstellung und die Intentionalität.

The two works this paper focuses on (Anastasios Yannopoulos, Orthodoxy and the Problems of Contemporary World and Georgios Mantzaridis, Globalization and Universality. Phantom and Truth) represent a thorough analysis of contemporary history, in which globalization is the direction and purpose of the new vision in human relations and community. The lost of the individuality of these relations is considered to be a disease which has very strong religious and anthropological effects. ArgumentThis text is a reflection on the fate of a special kind of scientific object - anatomy collections - and their place in contemporary times. Though the phenomenon of keeping and displaying such collections is generally dying out, those specimens which survive continue to puzzle and fascinate us. To understand the current status of such collections, and the nostalgia evoked by the specimens within them, I argue, we should approach them as modern ruins. This allows us to think of them (...) as places of absence, pointing to unfinished lives and unfinished scientific projects. The paper begins with the story of a preserved human face from the Francis I. Rainer anatomical-anthropological collection (Bucharest), and continues by discussing the fate of that collection, and of anatomy collections more widely. Ultimately, the paper asks, what is it that we want to preserve: specimens, practices, or research philosophies? (shrink)

Le plus ancien exemple de l'utilisation de statues féminines pour remplacer des colonnes se trouvant à Delphes, l'article suggère que ce sont les exigences du sanctuaire, avec son espace réduit, qui sont en quelque sorte à l'origine de ce type. Ces figures peuvent être mises en relation avec un petit groupe de trésors éoliques et ioniques de Delphes qui étaient ornés d'une profusion de moulures au décor élaboré. La richesse de l'architecture y était rehaussée par l'addition de la sculpture et (...) par l'introduction d'une frise ionique sculptée continue à la place des denticules. La grande taille des moulures suggère qu'à Delphes les architectes ioniens tentèrent de reproduire en miniature la profusion et l'élégance des grands temples monumentaux de leur patrie. C'est dans le cadre de ce processus de miniaturisation que la figure féminine isolée aurait été introduite, à la place des tambours de colonnes sculptés utilisés dans les temples colossaux d'Ionie de l'Est. L'idée, reprise ensuite par l'architecte de l'Érechthéion, se serait répandue à partir d'Athènes. (shrink)

Le lien entre l’expérience acquise par Machiavel au service de la République florentine (1498-1512) et l’œuvre politique écrite après son éloignement forcé des affaires est explicite. Tous les commentateurs se sont attachés à déceler, dans la correspondance diplomatique et les écrits mineurs ante res perditas, les thèmes qui réapparaîtront de manière aboutie dans les textes majeurs de Machiavel. Cependant, le passage de la pratique à la « théorie » n’est pas immédiat. Le ritratto, composé d’extraits d’expérience regroupés autour d’une question (...) particulière, permet une problématisation originale de l’histoire présente et s’inscrit dans l’écart qui se creuse, tout au long de l’activité diplomatique de Machiavel, entre la politique florentine qu’il est censé servir et sa propre vision des choses. Aussi le traité du Prince se fonde-t-il, non sur une réalité brute, mais sur une expérience déjà disposée dans un certain nombre de ritratti. Un immense effort pour rationaliser la politique à partir du particulier est ainsi entrepris par Machiavel, sans pour autant sacrifier ce qui précisément déclenche cette entreprise et la rend interminable, à savoir, l’irréductibilité de la fortune.
