The debate concerning the legitimacy of awarding reparations for historical injustices focuses on the issue of finding a proper moral justification for granting reparations to the descendants of the victims of injustices which took place in the remote past. Regarding the case of Romanian communism as a more recent injustice, and analyzing the moral problems entailed by this historical lapse, within this paper I argue that overcoming such a legacy cannot be carried out, as in the case of historical injustices (...) situated more remotely in time, through the means of selective reparations, such as restitutions or compensations. For, even though they are justified from the perspective of rectificatory justice, selective reparations do not fulfill the requirements of social justice. Rather, I argue that the fall of the Romanian communist regime should have been followed by an equal distribution of all properties illegitimately seized by the state, to all adult Romanian citizens at that time, in order to attain the imperative of equal distribution of property among all citizens. The equal distribution thesis is the only way through which the Romanian society could have complied, at that moment of political and social renewal, with the requirements of justice. I also aim at explaining why other principles of justice, which either have or could have been implemented, cannot be properly justified. Finally, I analyze two main objections which could be invoked against my thesis, namely the economic efficiency objection and the legal realist objection. (shrink)

A fluent economical collaboration between countries is a major need. European flows of trade and people are supported by efficient connections between main localities from a geographic region, in many cases overriding national borders. This paper introduces three traveling salesmen problem instances based on freely available geographic coordinates of the main cities of France, Portugal and Spain. These instances are unified, generating other four larger instances: three with all pairs of countries and one instance with the settlements from all the (...) three countries. The study includes an analysis of quality of solutions for a version of branch & cut algorithm and some hybrid heuristics including the Lin–Kernighan algorithm. $Bor\mathring{u}vka$, Quick$Bor\mathring{u}vka$ and Greedy algorithms are also used in the hybrid approaches in order to obtain a potential beneficent initial solution for the Lin–Kernighan algorithm. Concorde solver, nowadays state-of-the-art exact software, together with the already mentioned algorithms, is used to test and furthermore analyze the new TSP instances. Some results are represented using online services such as Google Maps, showing the potential integration of the Concorde’s optimum results into commercial routing applications. The very good results provided by the Lin–Kernighan method allow its usage for real medium-sized routing instances. (shrink)

The present study aims to carry out an analysis of the relation between the Bibles of Samuil Micu and Andrei Șaguna from an isagogic perspective, with a particular focus on the canon and canonicity of the books of the Holy Scripture. We believe that, through such an analysis, we can observe what they have in common, but also what differentiates the two Transylvanian editions of the Holy Scripture so that we can help those interested in understanding the reasons behind the (...) current controversies as to the relation between them. Although these controversies refer to the biblical text of the two Scriptural editions, the fact that the attitude towards it was caused by denominational factors, whose doctrinal background is represented by two different traditions of understanding the biblical canon, has been overlooked. This is why we find that the evaluation of how the two Romanian editions of the Holy Scripture (the Bible of Samuil Micu, 1795, and the Bible of Andrei Șaguna, 1856-1858) relate to the canonical tradition of each Church and cultivate their isagogics is fundamental for the establishment and understanding of the relation between them. Cases of poor care have been documented across the world. Contrary to professional requirements, evidence indicates that these sometimes go unaddressed. For patients, the outcomes of this inaction are invariably negative. Previous work has either focused on why poor care occurs and what might be done to prevent it, or on the reasons why those who are witness to it find it difficult to raise their concerns. Here, we build on this work but specifically foreground the responsibilities of registrants and (...) students who witness poor care. Acknowledging the challenges associated with raising concerns, we make the case that failure to address poor care is a breach of moral expectation, professional requirement and, sometimes, legal frameworks. We argue that reporting will be more likely to take place if those who wish to enter the profession have a realistic view of the challenges they may encounter. When nurses are provided with robust and applied education on ethics, when “real‐world” cases and exemplars are used in practice and when steps are taken to develop and encourage individual moral courage, we may begin to see positive change. Ultimately however, significant change is only likely to take place where practice cultures invite and welcome feedback, promote critical reflection, and where strong, clear leadership support is shown by those in positions of influence across organisations. Violence is signaled by a mark of discontinuity, interruption, rupture. The tripartite temporality of violence, with its strong focus on the present, points to the originary violence. Moreover, the violent event is structuring the order of the action sequences in an actual violent (embodied) interaction. The interactional dynamics in violent encounters between co-present actors shapes the specific forms of the experiencing in (and of) the violent interaction. Based on how violence is experienced in an interactive situation, the phenomenon of violence (...) articulates itself according to three coordinates: directedness, co-performativity and de-capabilisation. The outlining of the structure of the lived experience of violence is revealing something irreducible in it. To understand the experience of violence as such, I propose that we accept the idea of violence per se and depart from the idea that the acts of violence are essentially moral actions. The core of the ethical-moral discussion concerning violence should be grounded instead on the moment of conversion identifiable when we take into account the reaction to violence. (shrink)

In this commentary, I will argue that the componential and emergent views of cognitive control as defined by Cooper (2010) do not necessarily oppose each other, and I will try to make a case for their interdependence. First, I will use the construct of cognitive inhibition—one of the main componential control functions mentioned in the target articles—to illustrate my line of reasoning. The aim of the present paper is to provide a comparative account of the manner in which Moritz Schlick and Wilfrid Sellars treat certain aspects surrounding the topic of observational knowledge. By considering Sellars’s allusions to Schlick’s epistemological undertaking within the context of his rejection of givenness, I evaluate the extent to which Schlick can be characterized as a traditional foundationalist. By emphasizing that this is not the case and that Schlick adheres to a non-standard version of epistemological foundationalism, I (...) shed some light on those theoretical elements that allow for a convergence of opinions between the two authors to transpire. Meeting the security requests in transportation is nowadays a must. The intelligent transport systems represent the support for addressing such a challenge, due to their ability to make real-time adaptive decisions. We propose a new variant of the travelling salesman problem integrating security constraints inspired from ITSs. This optimization problem is called the secure TSP and considers a set of security constraints on its integer variables. Similarities with fuzzy logic are presented alongside the mathematical model of the introduced TSP variant.

The aim of the present paper is to situate the recent attempts devoted to the study of the phenomena of knowledge management in a larger epistemological context. More precisely, I intend to ascertain the entire affair from the perspective of the philosophy of the humanities. This involves understanding it as an endeavor concerned with the search for regularities. As a result, key notions figuring in the repertoire of this kind of undertaking, primarily those of notes and notebooks, are scrutinized for (...) the purpose of revealing their theoretical function. This points towards some ontological issues, such as the idea of taking notes as cultural kinds, namely something analogous to the idea of natural kinds. (shrink)

This study was conducted with the purpose of analyzing the combined and mediating effect of actor’s withdrawal–partner’s demand conflict resolution strategies between avoidance attachment dimension and relationship satisfaction. We conducted a dyadic study with 175 heterosexual couples who filled in the questionnaires. Six hypotheses were tested using the actor–partner interdependence model with mediation analysis. Results showed that the avoidance dimension of attachment was more strongly associated with actor’s withdrawal strategy than with demand/aggression strategy. Furthermore, avoidance attachment was negatively associated with (...) both actor’s and partner’s relationship satisfaction, the actor effect being higher. Withdrawal strategy was a mediator between actor’s avoidance and actor’s relationship satisfaction, but it was not a mediator for partner’s relationship satisfaction. The interactive pattern of actor’s withdrawal–partner’s demand/aggression was associated with low levels of both actor’s and partner’s relationship satisfaction. These results point out to the need of discerning the interactive pattern of conflict-solving strategies as well as their intertwined effect on relationship satisfaction. (shrink)

This paper tries to show that the naturalistic view of addiction is mired in contradictions that stem from reducing the addict to a weak-willed subject who loses control over his or her body. From a phenomenological perspective, addiction reveals itself to be a habit which eventually becomes harmful, but has its primary sources in the embodied needs of a worldly subject. The aim of this paper is to uncover the dimensions of the lived addiction that are neglected in the contemporary (...) naturalistic discourse: the lived-body and the worldly context of the addict. Firstly, we try to do justice to the variety of addictions by underlying that their new and surprising forms are determined by the intersubjective tissue wherein the subject operates. Secondly, the loss of control in addiction, how the subject deals with the tendency to satisfy a need, is experienced as powerlessness, as expressed in the accounts of ecstasy addicts regarding altered states of mind. The last section of this paper will argue that this sense of powerlessness cannot be equated with a weakness of the will because a strong, forceful will engenders the same vertigo of being prey to strange powers. The embodied aspect of addiction and the spontaneous, bodily need it saturates will clarify further this claim. (shrink)

The aim of this paper is to argue in favor of the idea that it is possible not only to give a special place to reason in our life and in society, but also to offer an integrative rational framework, in in which human ends and goals find their rational expression. The text has three parts. The first describes Alfred Schutz's practical-hermeneutical approach to law and normativity, while making room for a subjective practice of reason. The second proposes to reveal, (...) through the description of knowledge in the world of ordinary life, a form of rationality which offers us practical but consistent ways of making a decision. Ultimately, the third aims at the practical-hermeneutical reconstruction of the law, in order to integrate into the core of legal reasoning references to ends and purposes without prejudicing the objectivity of the reasoning itself. The study aims to make a contribution to the problem of dedifferentiation and positivism of practice in the modern world. Le but de ce papier est d’argumenter en la faveur de l’idée qu’il est possible non seulement de donner une place particulière à la raison dans notre vie et dans la société, mais aussi d’offrir un cadre rationnel intégratif, dans lequel les fins et buts humains trouvent leur expression rationnelle. Le texte comporte trois parties. La première décrit l’approche pratique-herméneutique d’Alfred Schutz à l’égard de la loi et de la normativité, tout en faisant place à une pratique subjective de la raison. La deuxième se propose de dévoiler, à travers la description de la connaissance dans le monde de la vie ordinaire, une forme de rationalité qui nous offre des voies pratiques mais consistantes de prendre une décision. En fin de compte, la troisième vise la reconstruction pratique-herméneutique de la loi, afin d’intégrer dans le noyau du raisonnement légal des références à des fins et buts sans porter préjudice à l’objectivité du raisonnement lui-même. My paper tackles the generic relationship between philosophy and law, the necessity of applying philosophy to law, the legitimacy and range of such an approach, the configuration of the way in which philosophy has left its mark in the juridical sphere. It surveys, in a chronological order, as well as in terms of their co-existence, the various stages of the relationship between philosophy and law. 1. Although both have been “within the walls”, law secludes itself, relatively speaking, in “the world (...) taken as a whole”, to shape its own identity, to survive as a self-sufficient, distinct technique (F. Geny), or it does it in a doctrinary way (positivism). 2. The representatives of philosophy in the juridical sphere are doing their best to uphold law’s struggle for knowledge, to have it gain recognition as a “science”, renounce its one-sidedness and harmonize with the others. 3. Juridical norms are not untouchable in relation with philosophy. Philosophy may work within juridical norms if it has an affinity with the content of juridical normativeness and respects its specificity. 4. The conclusion I reach is that we must try to cultivate a joint area bringing together philosophy and law, an area wherein the specific features of the two distinct fields reach a consensus for the sake of the human condition – hic et nunc. Philosophy bestows coherence and casts light on “law for man’s sake”, while the philosophically founded law appears to be the “normative project of the human”, a human practice inextricably connected with other types of practice, with man as a whole. The practical way to fulfil this goal, like the goal itself, will always be liable to criticism and improvement, open to debates and various options in a concrete socio-historical context. (shrink)

Since its inception philosophical thought has been fixated by death. Death, as much as life, has been the unrelenting driving force behind some of history’s greatest thinkers. Yet, for Emil Cioran, a Romanian-French philosopher, even philosophy cannot attempt to understand nor contain the inevitable unknown. Considered to be an anti-philosopher, Cioran approached and reflected on the human experience with a despairing pessimism. His works are characterised by a brooding, fatalistic temperament that reveals and defines itself in his irony, black humour (...) and inimitable style. Although Cioran’s later works have received much scholarly recognition, little attention has been paid to the texts he wrote in his adolescent. Grounded in the historical context of interwar Romania, this book presents for the first time an analysis of the little-known works of this pioneering Romanian thinker. Deeply affected by his upbringing, this book offers a glimpse into Cioran’s first attempts to delve into philosophical enterprise, before turning its attention to his later works, On the Heights of Despair (1934), The Transfiguration of Romania (1936) and Twilight of thoughts (1940; written in France). Using both the French and Romanian editions of these works, but also their original manuscripts, this volume seeks to provide a re-reading that takes language rather than a social or political critique as its focal point. As an important and provocative contribution to the existing literature on Cioran, this book will be an essential point of reference for students and researchers, alike. (shrink)

This book is a rediscovery and examination of the thinking of Vasile Băncilă, a philosopher forbidden by the totalitarian regime of Nicolae Ceaușescu. The philosopher Lucian Blaga saw Băncilă as a threat to the spirit of the highest Romanian culture. It is estimated that Băncilă's work extends to 32 volumes, 17 of which have been published so far. With such a significant opus, Vasile Băncilă is, indisputably, a key figure in contemporary Romanian culture, particularly in the sphere of philosophy. The (...) book has eleven chapters and is divided into two parts. The first part deals with the hermeneutics of the author's youthful works. His reflections on the purpose of philosophy for life are important, about the role of this discipline in the education of adolescents and students, the relationship between irony and education, his thoughts of one of the greatest Romanian poets, Mihai Eminescu, and the philosophy of Descartes and of Schopenhauer. In the second part, the book looks at Băncilă's aim of structuring a possible system of philosophy; more precisely, an ethnic-spiritualist metaphysics which, when it was elaborated, contradicted the official ideology of the totalitarian regime. Finally, the book covers the philosopher's work, analysing step-by-step the relation between the part and the whole (pars pro toto), as well as between existence and metaphysics, and the philosopher's conclusions about Romanian existence. The paper argues that Brentano was the exponent of a methodological monism, which is based on the requirement that science should be grounded on experience, and not on a speculative-idealistic principle, as in the case of German idealism. In Brentano’s psychological writings, this methodological requirement concretized in two different theses: The method of psychology is identical with the method of natural science; The method of psychology is inspired by the method of natural science. The thesis of this study is that (...) an important part of Psychology from an Empirical Standpoint is elaborated in accordance with T1. By contrast, Brentano’s Descriptive Psychology illustrates the subsequent decision to give up this idea. In its place, the aforementioned requirement is elaborated in the spirit of a methodological particularism that recommends the scientist elaborate his methods according to the specificity of the phenomena under investigation and to the difficulties that need to be overcome when approaching them.
