Cases of poor care have been documented across the world. Contrary to professional requirements, evidence indicates that these sometimes go unaddressed. For patients, the outcomes of this inaction are invariably negative. Previous work has either focused on why poor care occurs and what might be done to prevent it, or on the reasons why those who are witness to it find it difficult to raise their concerns. Here, we build on this work but specifically foreground the responsibilities of registrants and (...) students who witness poor care. Acknowledging the challenges associated with raising concerns, we make the case that failure to address poor care is a breach of moral expectation, professional requirement and, sometimes, legal frameworks. We argue that reporting will be more likely to take place if those who wish to enter the profession have a realistic view of the challenges they may encounter. When nurses are provided with robust and applied education on ethics, when “real‐world” cases and exemplars are used in practice and when steps are taken to develop and encourage individual moral courage, we may begin to see positive change. Ultimately however, significant change is only likely to take place where practice cultures invite and welcome feedback, promote critical reflection, and where strong, clear leadership support is shown by those in positions of influence across organisations. My paper tackles the generic relationship between philosophy and law, the necessity of applying philosophy to law, the legitimacy and range of such an approach, the configuration of the way in which philosophy has left its mark in the juridical sphere. It surveys, in a chronological order, as well as in terms of their co-existence, the various stages of the relationship between philosophy and law. 1. Although both have been “within the walls”, law secludes itself, relatively speaking, in “the world (...) taken as a whole”, to shape its own identity, to survive as a self-sufficient, distinct technique (F. Geny), or it does it in a doctrinary way (positivism). 2. The representatives of philosophy in the juridical sphere are doing their best to uphold law’s struggle for knowledge, to have it gain recognition as a “science”, renounce its one-sidedness and harmonize with the others. 3. Juridical norms are not untouchable in relation with philosophy. Philosophy may work within juridical norms if it has an affinity with the content of juridical normativeness and respects its specificity. 4. The conclusion I reach is that we must try to cultivate a joint area bringing together philosophy and law, an area wherein the specific features of the two distinct fields reach a consensus for the sake of the human condition – hic et nunc. Philosophy bestows coherence and casts light on “law for man’s sake”, while the philosophically founded law appears to be the “normative project of the human”, a human practice inextricably connected with other types of practice, with man as a whole. The practical way to fulfil this goal, like the goal itself, will always be liable to criticism and improvement, open to debates and various options in a concrete socio-historical context. (shrink)

The identification of two Mycenaean terracotta centaurs from the excavations at Ras Shamra-Ugarit suggests a Bronze Age origin for the centaurs known from the historic periods of Greece. The Mycenaean centaurs from Ras Shamra-Ugarit are compared to the later examples from the Greek mainland. No continuous artistic tradition can be identified among the preserved examples. Since writing ceased to be used in Greece in the Iron Age and no artistic trend connecting the different representations of centaurs can be seen, it (...) is suggested here that the concept of centaurs was transmitted by way of the oral tradition. The paper argues that Brentano was the exponent of a methodological monism, which is based on the requirement that science should be grounded on experience, and not on a speculative-idealistic principle, as in the case of German idealism. In Brentano’s psychological writings, this methodological requirement concretized in two different theses: The method of psychology is identical with the method of natural science; The method of psychology is inspired by the method of natural science. The thesis of this study is that (...) an important part of Psychology from an Empirical Standpoint is elaborated in accordance with T1. By contrast, Brentano’s Descriptive Psychology illustrates the subsequent decision to give up this idea. In its place, the aforementioned requirement is elaborated in the spirit of a methodological particularism that recommends the scientist elaborate his methods according to the specificity of the phenomena under investigation and to the difficulties that need to be overcome when approaching them. This study was conducted with the purpose of analyzing the combined and mediating effect of actor’s withdrawal–partner’s demand conflict resolution strategies between avoidance attachment dimension and relationship satisfaction. We conducted a dyadic study with 175 heterosexual couples who filled in the questionnaires. Six hypotheses were tested using the actor–partner interdependence model with mediation analysis. Results showed that the avoidance dimension of attachment was more strongly associated with actor’s withdrawal strategy than with demand/aggression strategy. Furthermore, avoidance attachment was negatively associated with (...) both actor’s and partner’s relationship satisfaction, the actor effect being higher. Withdrawal strategy was a mediator between actor’s avoidance and actor’s relationship satisfaction, but it was not a mediator for partner’s relationship satisfaction. The interactive pattern of actor’s withdrawal–partner’s demand/aggression was associated with low levels of both actor’s and partner’s relationship satisfaction. These results point out to the need of discerning the interactive pattern of conflict-solving strategies as well as their intertwined effect on relationship satisfaction. (shrink)

Since its inception philosophical thought has been fixated by death. Death, as much as life, has been the unrelenting driving force behind some of history’s greatest thinkers. Yet, for Emil Cioran, a Romanian-French philosopher, even philosophy cannot attempt to understand nor contain the inevitable unknown. Considered to be an anti-philosopher, Cioran approached and reflected on the human experience with a despairing pessimism. His works are characterised by a brooding, fatalistic temperament that reveals and defines itself in his irony, black humour (...) and inimitable style. Although Cioran’s later works have received much scholarly recognition, little attention has been paid to the texts he wrote in his adolescent. Grounded in the historical context of interwar Romania, this book presents for the first time an analysis of the little-known works of this pioneering Romanian thinker. Deeply affected by his upbringing, this book offers a glimpse into Cioran’s first attempts to delve into philosophical enterprise, before turning its attention to his later works, On the Heights of Despair (1934), The Transfiguration of Romania (1936) and Twilight of thoughts (1940; written in France). Using both the French and Romanian editions of these works, but also their original manuscripts, this volume seeks to provide a re-reading that takes language rather than a social or political critique as its focal point. As an important and provocative contribution to the existing literature on Cioran, this book will be an essential point of reference for students and researchers, alike. (shrink)

This book is a rediscovery and examination of the thinking of Vasile Băncilă, a philosopher forbidden by the totalitarian regime of Nicolae Ceaușescu. The philosopher Lucian Blaga saw Băncilă as a threat to the spirit of the highest Romanian culture. It is estimated that Băncilă's work extends to 32 volumes, 17 of which have been published so far. With such a significant opus, Vasile Băncilă is, indisputably, a key figure in contemporary Romanian culture, particularly in the sphere of philosophy. The (...) book has eleven chapters and is divided into two parts. The first part deals with the hermeneutics of the author's youthful works. His reflections on the purpose of philosophy for life are important, about the role of this discipline in the education of adolescents and students, the relationship between irony and education, his thoughts of one of the greatest Romanian poets, Mihai Eminescu, and the philosophy of Descartes and of Schopenhauer. In the second part, the book looks at Băncilă's aim of structuring a possible system of philosophy; more precisely, an ethnic-spiritualist metaphysics which, when it was elaborated, contradicted the official ideology of the totalitarian regime. Finally, the book covers the philosopher's work, analysing step-by-step the relation between the part and the whole (pars pro toto), as well as between existence and metaphysics, and the philosopher's conclusions about Romanian existence. Le plus ancien exemple de l'utilisation de statues féminines pour remplacer des colonnes se trouvant à Delphes, l'article suggère que ce sont les exigences du sanctuaire, avec son espace réduit, qui sont en quelque sorte à l'origine de ce type. Ces figures peuvent être mises en relation avec un petit groupe de trésors éoliques et ioniques de Delphes qui étaient ornés d'une profusion de moulures au décor élaboré. La richesse de l'architecture y était rehaussée par l'addition de la sculpture et (...) par l'introduction d'une frise ionique sculptée continue à la place des denticules. La grande taille des moulures suggère qu'à Delphes les architectes ioniens tentèrent de reproduire en miniature la profusion et l'élégance des grands temples monumentaux de leur patrie. C'est dans le cadre de ce processus de miniaturisation que la figure féminine isolée aurait été introduite, à la place des tambours de colonnes sculptés utilisés dans les temples colossaux d'Ionie de l'Est. L'idée, reprise ensuite par l'architecte de l'Érechthéion, se serait répandue à partir d'Athènes. (shrink)

The many ways in which Cezanne's representational system deviates from the pluralistic art of the twentieth century suggests that probing his allegiance to classicism offers a unique vantage point for studying visual art, perception, and consciousness. This paper attempts at giving a definition of pluralism from a Christian point of view, concerning the construction of a Christian identity of Europe. The sources of the article range from the Economic Chart and the dialogue between Habermas and cardinal Ratzinger, to the beliefs of a Lutheran bishop, to the orthodox ecclesiology of one of the New Testament and to the reconciliation between the Catholics and the Orthodox believers.

This text is meant to bring to the fore the connection between politics and religion, as it was reflected in theory that Alexis de Tocqueville dealt to in his book entitled „De la démocratie en Amérique”. In the same time, it takes into consideration the well-known meeting between J. Habermas and J. Ratzinger (2004, January), which was carried out at the Catholic Academy in München. Here, a debate regarding the pre-political moral foundations of the state took place. The interest in (...) such a topic has streamed from what some people consider to be the „dogmatic-religious policy” concerning social philosophy, which the Bush Administration put into practice. El respeto a las decisiones autónomas de las personas se ha impuesto en la práctica médica diaria como norma reguladora de las relaciones entre profesionales y pacientes, y esto, en opinión de Alfred I. Tauber, ha puesto a la relación asistencial en una encrucijada. La ética basada en la autonomía —que es el producto de un tiempo y lugar determinados: el liberalismo inglés clásico— ha resultado tremendamente exitosa y ha sido crucial en el desarrollo de las democracias occidentales, pero a (...) juicio de Tauber es muy conflictiva en ámbitos como la medicina. El mero «traslado» de esa autonomía jurídica y liberal, casi exclusivamente preocupada por la protección de los derechos individuales, no hace sino originar un sinfín de problemas en ambos polos de la relación asistencial: genera por un lado profesionales sanitarios a la defensiva y, por otro, se convierte en muchos casos en una abstracción de dudosa utilidad para la persona enferma, pues puede hacernos olvidar la situación de desvalimiento y vulnerabilidad en que al individuo le coloca la situación de enfermedad. El objeto de este breve escrito es dejar apuntados algunos de los conflictos que surgen cuando entendemos el encuentro entre doctor y paciente en términos excesivamente «autonomistas». (shrink)

This paper tries to show that the naturalistic view of addiction is mired in contradictions that stem from reducing the addict to a weak-willed subject who loses control over his or her body. From a phenomenological perspective, addiction reveals itself to be a habit which eventually becomes harmful, but has its primary sources in the embodied needs of a worldly subject. The aim of this paper is to uncover the dimensions of the lived addiction that are neglected in the contemporary (...) naturalistic discourse: the lived-body and the worldly context of the addict. Firstly, we try to do justice to the variety of addictions by underlying that their new and surprising forms are determined by the intersubjective tissue wherein the subject operates. Secondly, the loss of control in addiction, how the subject deals with the tendency to satisfy a need, is experienced as powerlessness, as expressed in the accounts of ecstasy addicts regarding altered states of mind. The last section of this paper will argue that this sense of powerlessness cannot be equated with a weakness of the will because a strong, forceful will engenders the same vertigo of being prey to strange powers. The embodied aspect of addiction and the spontaneous, bodily need it saturates will clarify further this claim. (shrink)
