In recent years, the advancements made in the field of neuroscience have been echoed in criminal law, reigniting the discussion on culpability from the viewpoint of if it actually exists, considering the echoes of determinism on the re-found non-existence of free will. This discussion has triggered, once again, the issue of the boundaries and inter-relations between law and science, namely on whether normative or legal concepts and categories should acknowledge scientific breakthroughs. Bringing forth the theme of the limits of the (...) law, this discussion is able to provide insight, with reference to a specific problem, as to whether there are plausible legal answers in the context of the ascription of liability if the subject of law ceases to be a responsible—and thus free—person. Taking into consideration evolution both of science and criminal law dogmatic, we aim to argue that in the particular case of culpability, the desired autonomy of law has its limitations, and that without such limitations the ascription of liability would not have a correct answer. For this argument we will firstly approach the meaning of culpability as a milestone of subjective responsibility in criminal law, so that we can then analyse some arguments made regarding the impact of neuroscience on the maintenance of a concept of culpability with the meaning given above, so that lastly we can proceed to the rebuttal of the overarching impact of science on the law and advocate the autonomy of culpability within the necessary limits imposed by the needs of a plausible legal answer. Based on the theoretical reconstruction of neglected post-WWI writings and political action of W. E. B. Du Bois, this volume offers a normative account of transnational cosmopolitanism. Pointing out the limitations of Kant's cosmopolitanism through a novel contextual account of Perpetual Peace, Transnational Cosmopolitanism shows how these limits remain in neo-Kantian scholarship. Inés Valdez's framework overcomes these limitations in a methodologically unique way, taking Du Bois's writings and his coalitional political action both as text that should inform our theorization and (...) normative insights. The cosmopolitanism proposed in this work is an original contribution that questions the contemporary currency of Kant's canonical approach and enlists overlooked resources to radicalize, democratize, and transnationalize cosmopolitanism. O ensaio propõe a leitura de duas estórias de Guimarães Rosa, “A terceira margemdo rio”, de Primeiras estórias, e “Desenredo”, de Tutameia, as quais, em algum momento, serãocotejadas com Bartleby, o escrivão, de Melville. Partindo dos títulos rosianos, deduzir-se-ãoduas potências, uma neutralizadora que abdica de tudo, a outra, também neutralizadora, quequer tudo, propondo, por fim, uma ideia de leitura que se encerra nas estórias.

Como se aprende? O que é uma imagem sem imagens? Estas questões são o ponto de partida para o estudo das relações das imagens com a aprendizagem. Propomo-nos pensar que a aprendizagem não se pode fazer sem uma unidade de conexão, um processo criador virtual-actual. Aprender é uma “tarefa infinita” e transformadora dos movimentos do corpo, do pensamento e do espaço-tempo conjugados, que exige um encontro concreto feito de uma “familiaridade prática” experimental. Selon Damásio, le moi conscient se crée à partir de la capacité du cerveau à raconter, c’est-à-dire à transformer en récit les signaux et messages produits par ses diverses couches. Les mythes donnent au monde une cohérence significative qui provient de l’organisation des éléments que ses récits produisent. Les rapports au monde de toutes les espèces vivantes sont contenus dans les limites de leurs possibilités phylogénétiques qui résultent déjà d’une relation continuée pendant des millions d’années. La capacité humaine de créer (...) des récits sur le réel doit intégrer ces éléments phylogénétiques qui se manifestent même dans les parties non conscientes du cerveau intégrées pourtant dans le récit qui construit un moi. Ce dépôt venu du fond des âges est une des causes de l’excès de sens que nous poursuivons toujours et qui est, au niveau de l’imaginaire « premier » la voix de ce fonds dans ces rapports avec le texte du monde. Un récit est ainsi une façon de donner à voir l’invisible, et cette invisibilité produit un excès de sens qui cherche toujours à se manifester. Il est marqué par les cohérences et consistances des images de cet imaginaire premier qui médiatise toujours nos relations au monde et aux autres, et auquel s’ajoute les cohérences des imaginaires « seconds » des individus et des cultures. According to Damásio, the self-conscious arises from the ability of the brain to tell, i.e. turn into a story the signals and messages produced by its various layers. Myths give the world a significant consistency that comes from the organization of the elements produced by its stories. The relationships of all living species with the world are contained within the limits of their phylogenetic opportunities resulting from a relationship continued for millions of years. The human ability to create stories about reality must incorporate these phylogenetic elements into the narrative that builds self-awareness. This unknown repository coming from the depths of time is one of the causes of the excess of meaning that we always pursue and is, at the level of the basic imaginary, one that Gilbert Durand considered the heritage of sapiens, the voice of these assets in their links with the text of the world. A narrative is thus a means of seeing the invisible, and this invisibility produces an excess of meaning which always seeks to manifest itself. It is marked by the coherence and consistency of the images of this basic imaginary which always mediates our relationship to the world and to others, and to which is added the coherences of the secondary imaginary coming from individuals and cultures. Para tanto, traça uma problematização sobre as condições materiais e ideológicas em que se dá o ensino de literatura em um curso de Licenciatura em Letras – Português e Inglês, fazendo uma revisão de dois textos seminais de Antonio Candido, “A literatura e a formação do homem” (1977) e “O direito à literatura” (1988) e as leituras que se construíram em torno (...) deles, principalmente o recente estudo publicado por Paulo Caetano e Luiz Penido. Tal discussão dá-se mediante problematizações acerca do estatuto da universidade no século XXI, da precarização do trabalho e a sublimação do complexo internético e das TIC’s no contexto do “rumo a um mundo pós-capitalista”, de acordo com Jonathan Crary, e uma crítica à cultura informacional, partindo da discussão com Glaucia Dunley. Von der Antike bis in die Gegenwart partizipiert die Antigone an disparaten Denkmodellen geschlechtlicher, verwandtschaftlicher und ethisch-moralischer Konzepte. Aus literatur-und kulturwissenschaftlicher Perspektive betrachtet, lassen sich die Konstruktionen dieser Konzepte kritisch hinterfragen. Ines Böker untersucht die Entstehungsmöglichkeiten, Wandlungsprozesse und (kritischen) Implikationen von Antigone-Transformationen in dem Spannungsfeld der vielschichtigen theoretischen und literarischen Rezeptionsgeschichte. Trotz unterschiedlicher Positionen enthüllen die Untersuchungen der Antigone-Transformationen das, was die Antigone selbst aktiv gestaltet: Die Ethik der Widersetzlichkeit.

Através de uma leitura densa das fontes hagiográficas jesuítas que celebraram a vida de um jesuíta napolitano, Marcelo Mastrilli (1603-1637), procuro mostrar que as visões e narrativas proféticas foram importantes lugares de comunicação social, memória colectiva e mobilização política. O reposicionamento profético foi uma linguagem específica da tecnologia do eu, a partir da qual o sujeito fabricava a sua própria identidade, dentro e contra os limites externos da autoridade e das instituições. Marcelo Mastrilli – que viajou pela Itália, Espanha, Portugal, (...) Goa, Malaca, Filipinas e Japão – construiu a sua própria subjectividade e acção através de uma visão profética de São Francisco Xavier. Logo que a sua experiência pessoal foi impressa, atingindo um público mais vasto, mobilizou outros actores a imitá-lo, citá-lo, ou a fazer uso dele nos seus percursos individuais e sociais. O que se podia transportar de um continente para outro não eram, claro, visões pessoais mas a sua corporização numa série de textos e imagens materiais. E a verdade é que mesmo depois da sua morte, em 1637, as suas visões foram retomadas pelo padre António Vieira e integradas no seu discurso legitimador da dinastia de Bragança e do papel que os jesuítas aí desempenhavam. ABSTRACTPrevious research has revealed a stable preference for words with inward consonantal-articulation patterns, over outward-words. Following the oral approach-avoidance account suggesting that the in–out effect is due to the resemblance between consonantal-articulations patterns and ingestion/expectoration, recent findings have shown that when judging inward-outward names for objects with particular oral functions, valence did not modulate the effect while the oral function did. To replicate and examine further the role of edibility and valence in shaping the in–out effect, we asked participants to (...) rate inward and outward names for edible and non-edible products while controlling for valence. Results revealed that the motor-to-affect link was only observed for edible products, regardless of valence. (shrink)

In recent years, many researchers engaged in diverse areas and approaches of “cultural-historical activity theory” (CHAT) realized an increasing international interest in Lev S. Vygotsky’s, A. N. Leont’ev’s, and A. Luria’s work and its continuations. Not so long ago, Yrjö Engeström noted that the activity approach was still “the best-held secret of academia” (p. 64) and highlighted the “impressive dimension of theorizing behind” it. Certainly, this remark reflects a time when CHAT was off the beaten tracks. But if this situation (...) begins to change today, in which direction will CHAT be heading? Will it continue to be one of those projects “unique for its practical, political, and civic engagement” committed “to ideals of social justice, equality, and social change” as it was in the beginning (Stetsenko & Arievitch, 2004, p. 58)? Although a positive future of CHAT seems to lie ahead, we consider in this article some of the problematics that may challenge all those who want to pass the “impressive dimensions of theorizing” from “insider” circles to a larger audience and from one generation to another as well as encourage newcomers to become part of this tradition through critical engagement in its theory and practice. A key to these engagements, we suggest, is not only the comprehensive empirical and philosophical basis, but also the role of dialectics as both topic and method. Therefore, the challenge for newcomers (as well as for “old-timers”) to take on the tradition of CHAT is not a small one indeed. We assume that a major reason for the increasing interest in CHAT lies in its potential to provide a non-reductionist approach to human development, which is due to its affinity to dialectics; however, the close interrelation to a tradition that reaches back to the theories of Georg W.F. Hegel and Karl Marx, among others, is not the easiest to master. In consideration of these difficulties, the purpose of this article is to investigate how contemporary approaches within CHAT can continue to provide a dialectical framework to preserve and renew the critical intention of this tradition, and how we run the risk of losing this sting. Thereby, we sensitize researchers to the problem of developing a cultural-historical approach within a historical situation that confronts us with new, unanswered questions. In this light, we also problematize the use of scientific language, for it may lead us to speak and argue un-dialectically when in fact we intend or ought to think dialectically. This article seeks to convey insights and arguments of how we can relate our theoretical approaches to a tradition of dialectical thinking and in what ways this is paramount for a critical engagement in theory and practice. In the first part, we therefore discuss not only some major theorems in Hegel’s and Marx’s work but also, and above all, Vygotsky’s way of developing the cultural-historical approach of psychology. Second, we argue that the contemporary, widely known version of CHAT, related to Yrjö Engeström’s theoretical and empirical work, neglects different aspects of dialectical thinking and consequently narrows its potential to a socio-critical approach to societal practice and human development. A crucial question of this scrutiny will be the notion of contradictions and how development is supposed to be achieved. In general, our intention is not only to clarify the role of dialectics as a method for activity theory but also to problematize the role of the subjects of research in CHAT and to confront ourselves with the problems of practicing and developing a critical science in face of a complex and challenging societal world. This paper proposes an account of neurocognitive activity without leveraging the notion of neural representation. Neural representation is a concept that results from assuming that the properties of the models used in computational cognitive neuroscience must literally exist the system being modelled. Computational models are important tools to test a theory about how the collected data has been generated. While the usefulness of computational models is unquestionable, it does not follow that neurocognitive activity should literally entail the properties construed in (...) the model. While this is an assumption present in computationalist accounts, it is not held across the board in neuroscience. In the last section, the paper offers a dynamical account of neurocognitive activity with Dynamical Causal Modelling that combines dynamical systems theory mathematical formalisms with the theoretical contextualisation provided by Embodied and Enactive Cognitive Science. This aim of this paper is two-fold: it critically analyses and rejects accounts blending active inference as theory of mind and enactivism; and it advances an enactivist-dynamic understanding of social cognition that is compatible with active inference. While some social cognition theories seemingly take an enactive perspective on social cognition, they explain it as the attribution of mental states to other people, by assuming representational structures, in line with the classic Theory of Mind. Holding both enactivism and ToM, we argue, (...) entails contradiction and confusion due to two ToM assumptions widely known to be rejected by enactivism: that social cognition reduces to mental representation and social cognition is a hardwired contentful ‘toolkit’ or ‘starter pack’ that fuels the model-like theorising supposed in. The paper offers a positive alternative, one that avoids contradictions or confusion. After rejecting ToM-inspired theories of social cognition and clarifying the profile of social cognition under enactivism, that is without assumptions and, the last section advances an enactivist-dynamic model of cognition as dynamic, real-time, fluid, contextual social action, where we use the formalisms of dynamical systems theory to explain the origins of socio-cognitive novelty in developmental change and active inference as a tool to demonstrate social understanding as generalised synchronisation. One of the criteria to a strong principle in natural sciences is simplicity. This paper claims that the Free Energy Principle (FEP), by virtue of unifying particles with mind, is the simplest. Motivated by Hilbert’s 24th problem of simplicity, the argument is made that the FEP takes a seemingly mathematical complex domain and reduces it to something simple. More specifically, it is attempted to show that every ‘thing’, from particles to mind, can be partitioned into systemic states by virtue of (...) self-organising symmetry break, i.e. self-entropy in terms of the balance between risk and ambiguity to achieve epistemic gain. By virtue of its explanatory reach, the FEP becomes the simplest principle under quantum, statistical and classical mechanics conditions. (shrink)

This paper aims to show how clinical pragmatics can fruitfully inform the classical theoretical models proposed by philosophical pragmatics. In the first part of the paper I argue that theories proposed in the domain of philosophical pragmatics, as those elaborated by Austin and Grice, are not plausible from a cognitive point of view and that for this reason they cannot be useful to understand pragmatic deficits. In the second part, I show that Relevance Theory overcomes this limitation, but I also (...) argue that it offers a restricted view of human communication which has to be integrated with a model of language use that takes into account a central pragmatic property: coherence of discourse. Vergílio Ferreira even declares ata certam pomt in his literary and essayist trajectory that the influence of Husserl’s phenomenology was large in his work and especially noticed retrospectively. He who for a long period declared himself a Hegelian who had moved on to existentiabsm via unhappy consciousness will link Hegel to Husserl’s phenomenology revealing a trajectory justifying the coherence of his work.

Admiration and adoration have been considered as emotions with the power to change people, yet our knowledge of the specific nature and function of these emotions is quite limited. From an interdisciplinary perspective, we present a prototype approach to admiration and what has variously been labelled adoration, worship, or reverence. Both admiration and adoration contribute to the formation of personal and collective ideals, values, and identities, but their workings differ. We offer a detailed theoretical account of commonalities and differences in (...) the appraisal patterns and action tendencies associated with the two emotions. This analysis reveals that admiration motivates the internalisation and emulation of ideals embodied by an outstanding role model. Adoration motivates adherence to the teachings and expectations of a meaning maker and benefactor perceived as superhuman or sacred. Thus, the primary function of admiration is to promote individual learning and change, whereas adoration primarily serves to bind communities together. (shrink)

When someone masters a skill, their performance looks to us like second nature: it looks as if their actions are smoothly performed without explicit, knowledge-driven, online monitoring of their performance. Contemporary computational models in motor control theory, however, are instructionist: that is, they cast skillful performance as a knowledge-driven process. Optimal motor control theory, as representative par excellence of such approaches, casts skillful performance as an instruction, instantiated in the brain, that needs to be executed—a motor command. This paper aims (...) to show the limitations of such instructionist approaches to skillful performance. We specifically address the question of whether the assumption of control-theoretic models is warranted. The first section of this paper examines the instructionist assumption, according to which skillful performance consists of the execution of theoretical instructions harnessed in motor representations. The second and third sections characterize the implementation of motor representations as motor commands, with a special focus on formulations from OMCT. The final sections of this paper examine predictive coding and active inference—behavioral modeling frameworks that descend, but are distinct, from OMCT—and argue that the instructionist, control-theoretic assumptions are ill-motivated in light of new developments in active inference. The aim of this paper is twofold: (1) to assess whether the construct of neural representations plays an explanatory role under the variational free-energy principle and its corollary process theory, active inference; and (2) if so, to assess which philosophical stance - in relation to the ontological and epistemological status of representations - is most appropriate. We focus on non-realist (deflationary and fictionalist-instrumentalist) approaches. We consider a deflationary account of mental representation, according to which the explanatorily relevant contents of neural (...) representations are mathematical, rather than cognitive, and a fictionalist or instrumentalist account, according to which representations are scientifically useful fictions that serve explanatory (and other) aims. After reviewing the free-energy principle and active inference, we argue that the model of adaptive phenotypes under the free-energy principle can be used to furnish a formal semantics, enabling us to assign semantic content to specific phenotypic states (the internal states of a Markovian system that exists far from equilibrium). We propose a modified fictionalist account: an organism-centered fictionalism or instrumentalism. We argue that, under the free-energy principle, pursuing even a deflationary account of the content of neural representations licenses the appeal to the kind of semantic content involved in the aboutness or intentionality of cognitive systems; our position is thus coherent with, but rests on distinct assumptions from, the realist position. We argue that the free-energy principle thereby explains the aboutness or intentionality in living systems and hence their capacity to parse their sensory stream using an ontology or set of semantic factors. In European science and technology policy, various styles have been developed and institutionalised to govern the ethical challenges of science and technology innovations. In this paper, we give an account of the most dominant styles of the past 30 years, particularly in Europe, seeking to show their specific merits and problems. We focus on three styles of governance: a technocratic style, an applied ethics style, and a public participation style. We discuss their merits and deficits, and use this analysis to (...) assess the potential of the recently established governance approach of ‘Responsible Research and Innovation’. This article explores the distinctions among European peoples’ character established in Kant’s anthropology and their connection with his politics. These aspects are neglected relative to the analysis of race between Europeans and non-Europeans, but Kant’s anthropological works portray the people of Mediterranean Europe as not capable of civilization because of the dominance of passion in their faculty of desire, which he ties to ‘Oriental’ influences in blood or government. Kant then superimposes this racialized anthropology over the historical geopolitics of Europe, (...) obscuring the indebtedness of Northern European trade dominance to Mediterranean historical tactics and financial wealth. By relegating the Mediterranean to the margins and dismissing contentious commercial exchange in the region as mere violence spearheaded by North African corsairs, Kant gives us an elitist cosmopolitanism unable to cope with hierarchy and inequality, diminishing its potential for egalitarian global projects today. This essay brings together political theories of empire and racial capitalism to clarify the entanglements between socialist and imperial discourse at the turn of the twentieth century. I show that white labor activists and intellectuals in the United States and the British settler colonies borrowed from imperial scripts to mark non-white workers as a threat. This discourse was thus both imperial and popular, because it absorbed the white working class into settler projects and enlisted its support in defense of imperial (...) logics of labor control. While white workers’ demands of enfranchisement were part of a transnational imagination that was both imperial and narrowly emancipatory, this discourse reemerged as one of popular sovereignty and found channels and paths to institutionalization through national states. These institutional formations arose out of the encounter between capitalists interested in facilitating mobility of racialized laboring subjects around the globe, elite projects invested in sheltering settler spaces, and white workers concerned with protecting their own labor from competition by excluding exploitable non-white workers. White labor’s embrace of racial prejudice and the exclusion of workers of color created segregated labor spaces that fit neatly with both capitalist goals of labor control and the protection of the settler status of emerging polities. Bringing to the forefront the imperial genealogy of popular sovereignty and immigration control disrupts liberal political theory frameworks that condemn restrictions as well as those that find migration restrictions permissible. Background: The recent COVID-19 pandemic has highlighted the deficiencies that characterize the functioning of the Italian national health system. Prisons have always mirrored the most radical expressions of these weaknesses. During the early stages of the pandemic, prison facilities across Italy underwent a series of changes dictated by the need to ensure the safety of the prisoners and staff. The adoption of these rules contributed to a total or partial redefinition of many central facets of life in prison, such as (...) intake procedures for new arrivals and the ways prisoners were allowed to communicate with their families.Objectives: The aim of this qualitative study was to analyze the testimony of penitentiary healthcare workers in prisons throughout Italy to determine the impact of COVID-19 on their professional and personal lives.Participants: Thirty-eight participants were contacted and 20 decided to participate in the interview. The sample was made up of 10 women and 10 men. All the participants were members of the healthcare staff of a penitentiary facility. All were recruited through an Italian association whose mission is the development, promotion, and implementation of social solidarity projects including prisoners' social and health care. This study was facilitated through representatives serving in nine different regions of Italy. The participants were divided according to their professional roles in prisons.Method: In-depth interviews were conducted by telephone or online using telecommunication platforms. The transcribed texts underwent thematic analysis using the Atlas.ti software to identify patterns of meaning across the dataset.Results: Four main themes emerged from the analysis: Interpersonal difficulties, management and operational difficulties, the personal distress and bereavement of healthcare workers, and the distress of inmates. The importance of relationship management skills when interacting with prisoners emerged as a key topic in many interviews, and the participants highlighted the need for adequate training. The increase in prisoners' anxiety made communication more difficult.Conclusions: The findings suggest that healthcare workers in jails need emergency-oriented training. Participants described their feeling of loneliness and quasi-abandonment when carrying out their duties during the pandemic. In particular, they underscored the need for psychological guidance to better manage altered reactions with prisoners and colleagues as a result of heightened death anxiety and isolation. (shrink)

His limit theorem – which is implicit in Penrose (1952) and for which he gave no rigorous proof – says that, in simple weighted voting games, if the number of voters increases indefinitely while the quota is pegged at half the total weight, then – under certain conditions – the ratio between the voting powers (as measured by (...) him) of any two voters converges to the ratio between their weights. We conjecture that the theorem holds, under rather general conditions, for large classes of variously defined weighted voting games, other values of the quota, and other measures of voting power. Porém esse modelo náo dá conta da fala, do contexto, limita-se à sentença proposicional. Após a virada pragmática, subjetividade e linguagem se relacionam num outro nível, a questáo passa a ser a intersubjetividade, e nesse sentido, sujeito e linguagem náo se excluem. É o que se pode depreender da concepçáo de jogos de linguagem de Wittgenstein, de racionalidade comunicativa de Habermas e de crítica à representaçáo de Rorty, através de suas respectivas noções de formas de vida, entendimento comunicativo e uso de discursos. Na Guiné-Bissau, a luta armada de libertação nacional desencadeada entre os anos 1960 e 1970 conseguiu aglutinar em torno de uma causa comum os diferentes povos. Nesse processo, as mulheres participaram ativamente. No entanto, a questão que se coloca é a de saber em que se traduziu a participação feminina nesse processo e quais foram as reivindicações nele geradas. Quais foram as conquistas e os limites da independência e o seu impacto nas mulheres? O texto procura discutir, a partir de (...) algumas narrativas de mulheres que participaram de forma direta ou indireta no processo de independência, e com base em uma análise documental e bibliográfica e em perspectiva de gênero, os principais momento da construção da cidadania e de uma cultura política entre as mulheres guineenses. This article presents an analysis of contractual relations in sport from the standpoint of the Croatian legislative system. Due to the complexity of the subject matter, the author considers only a small fragment of it - the significance and the role of sport in Croatian society and the law of contracts „as a cornerstone on which „sports law“ has been built and which is of primary importance in most areas where there is an interface between sport and the law, irrespective (...) of whether the sport is being played at an elite level or at a more humble one“. Bearing in mind the limited extent of this article, the autor tries to provide some clarifications and some guidance on how to deal with the designation and the determination of the applicable law for contracts in the sporting context. Considering that there are different legal regimes which may come into play with regard to the designation of the law applicable to contracts in the sporting context, the author first presents the determination of the applicable law according to the Rome I Regulation and then according to the Croatian Arbitration Act, Swiss Private International Law Act and the CAS Code of Sports-related Arbitration, as the most common in sports practice. Then, the author deals with contracts concluded with minor athletes and the determination of the law applicable to some preliminary questions. Finally, the author presents her perception of the problems encountered and some suggestions for the improvement of the existing legal framework. (shrink)

How is admiration different from adoration? We provided one answer to this question by examining the pathways through which admiration and adoration linked to self-expansion in a questionnaire and an experimental (autobiographical recall of emotion episodes) study. Both emotions were associated with increased potential efficacy to accomplish goals (i.e., self-expansion), but different action tendencies accounted for these links. While our emotion inductions did not successfully distinguish between admiration and adoration, we could statistically disentangle their effects through mediator models. In both (...) studies, self-reported admiration linked to self-expansion through the tendency to emulate admired others. Adoration related to self-expansion through the tendency to affiliate with adored others. These findings were obtained after controlling for other emotions in response to the target person (awe, love, hope, benign envy) and mutuality of the relationship. Our findings also suggest that considering specific emotions (rather than undifferentiated positive affect) helps uncover different pathways to self-expansion. (shrink)

As Hilbert wrote, he had considered including this problem in his famous problem list for the International Congress of Mathematicians in Paris in 1900.

This article discusses Dutch visiting (district) nurses’ moral considerations of their daily work. It is based on an empirical study using extensive semistructured interviews. The study is informed by the theoretical debate on the ‘ethics of care’ and the ‘ethics of justice’. It is argued that this debate easily turns into an unfruitful contest between these two perspectives: which one is best? The results suggest that visiting nurses’ moral considerations of their day-to-day work can be described well in terms of (...) an ethic of care. At the same time, however, concepts and issues central to an ethic of justice are also of crucial importance to their considerations. Nurses’ ways of managing to combine both perspectives, even in situations of apparent conflict between them, are described. Thus, clues are provided on how the debate on the ethics of care and the ethics of justice may be carried out in a more fruitful way apart from through hierarchically opposing both perspectives. The adoption of Big Data analytics in insurance has proved controversial but there has been little analysis specifying how insurance practices are changing. Is insurance passively subject to the forces of disruptive innovation, moving away from the pooling of risk towards its personalisation or individualisation, and what might that mean in practice? This special theme situates disruptive innovations, particularly the experimental practices of behaviour-based personalisation, in the context of the practice and regulation of contemporary insurance. BDAs are changing how insurance governs risk; how it knows, classifies, manages, prices and sells it, in ways that are more opaque and more extensive than the black boxes of in-car telematics.
