Hume’s theory of personal identity is developed in response to Locke’s account of personal identity. Yet it is striking that Hume does not emphasize Locke’s distinction between persons and human beings. It seems even more striking that Hume’s account of the self in Books 2 and 3 of the Treatise has less scope for distinguishing persons from human beings than his account in Book 1. This is puzzling, because Locke originally introduced the distinction in order to answer questions of moral (...) accountability and Hume’s discussion of the self in Book 2 provides the foundation of his moral theory in Book 3. In response to the puzzle I show that Locke and Hume hold different moral and religious views and these differences are important to explain why their theories of personal identity differ. (shrink)

Based on the theoretical reconstruction of neglected post-WWI writings and political action of W. E. B. Du Bois, this volume offers a normative account of transnational cosmopolitanism. Pointing out the limitations of Kant's cosmopolitanism through a novel contextual account of Perpetual Peace, Transnational Cosmopolitanism shows how these limits remain in neo-Kantian scholarship. Inés Valdez's framework overcomes these limitations in a methodologically unique way, taking Du Bois's writings and his coalitional political action both as text that should inform our theorization and (...) normative insights. The cosmopolitanism proposed in this work is an original contribution that questions the contemporary currency of Kant's canonical approach and enlists overlooked resources to radicalize, democratize, and transnationalize cosmopolitanism. The aim of this paper is to show that Shaftesbury’s thinking about liberty is best understood in terms of self-mastery. To examine his understanding of liberty, I turn to a painting that he commissioned on the ancient theme of the choice of Hercules and the notes that he prepared for the artist. Questions of human choice are also present in the so-called story of an amour, which addresses the difficulties of controlling human passions. Jaffro distinguishes three notions of self-control that (...) are present in the story of an amour. Although I agree with many aspects of Jaffro’s interpretation, I question his conclusion that self- control in the Stoic sense is best reserved for ‘moral heroes.’ I propose an alternative developmental interpretation, according to which all human beings are on an intellectual journey aimed at personal and moral improvement. My interpretation takes seriously that for Shaftesbury philosophy is meant to be practical and help improve our lives. I end by arguing that rather than trying to situate Shaftesbury’s concept of liberty within debates among compatibilists and incompatibilists it is more promising to understand it in terms of self- mastery and thus regard it as a version of positive liberty. John Locke accepts that every perception gives me immediate and intuitive knowledge of my own existence. However, this knowledge is limited to the present moment when I have the perception. If I want to understand the necessary and sufficient conditions of my continued existence over time, Locke argues that it is important to clarify what ‘I’ refers to. While we often do not distinguish the concept of a person from that of a human being in ordinary language, Locke emphasizes that (...) this distinction is important if we want to engage with questions of identity over time. According to Locke, persons are thinking intelligent beings who can consider themselves as extended into the past and future and who are concerned for their happiness and accountable for their actions. Moreover, for Locke a self is a person, considered from a first-personal point of view. I show that the concept of self that he develops in the context of his discussion of persons and personal identity is richer and more complex than the I-concept that he invokes in his version of the cogito. I further argue that Locke’s moral and religious views explain why he emphasizes the need for a conceptual distinction between persons and human beings. In the final section I turn to the reception of Locke’s view by some of his early critics and defenders, including Elizabeth Berkeley Burnet, an anonymous author, and Catharine Trotter Cockburn. John Locke offered a very rich and influential account of persons and personal identity in “Of Identity and Diversity,” which is chapter 27 of Book 2 of his An Essay concerning Human Understanding. He added it to the second edition in 1694 upon the recommendation of his friend William Molyneux. Locke’s theory was soon after its publication discussed by his contemporaries and has influenced many present-day discussions of personal identity. Distinctive about Locke’s theory is that he argues that the notion (...) of a person is to be distinguished from that of a human organism, or “man” to use Locke’s term, and that of a substance. By distinguishing the notion of a person from the more traditional notions of a human organism and a substance, Locke is able to address moral questions of accountability without having to take a stance on the question of whether the underlying ontological constitution of a person is material or immaterial. The chapter can be divided into two parts: in the first he outlines his general account of identity, and in the second he applies his general account of identity to persons and personal identity. The discussion of Locke’s general account of identity in the secondary literature has focused on whether Locke’s account of identity can be regarded as a version of the thesis that identity is relative and on how Locke understands modes and substances in chapter 27. The secondary literature on Locke’s account of persons and personal identity often focuses on how Locke’s claim that personal identity consists in sameness of consciousness is to be understood. However, some interpreters also draw attention to the importance of the moral and legal dimension which Locke makes explicit in his claim that “person” is a forensic term (II.xxvii.26). Moreover, some scholars have argued that Locke’s theory is to be understood in its religious context. The objections which have repeatedly been raised against Locke include the problem of circularity and the problem of transitivity; Locke’s reference to “fatal error” in II.xxvii.13 has also been regarded as a serious problem for his view. In the 20th century, psychological accounts of personal identity were often called neo-Lockean theories. It is controversial whether neo-Lockean theories differ from Locke’s own theory, and it can be asked whether the moral and religious dimension of Locke’s theory constitutes an important difference. OBJECTIVE: (a) To measure the effect of a guideline-based training on the performance of ontology developers compared with the performance after unspecific training by a competency question based evaluation; and (b) to provide empirical evidence for the applicability of competency questions in formal ontology evaluation in general. BACKGROUND: A close connection between ontology development and ontology evaluation as quality management procedure can been attained with the use of competency questions. Competency questions are often used as a semi-formal specification of requirements (...) for an ontology under development. Hence they can also be used as evaluation instruments, in order to check how far an ontology fulfills these requirements. METHODS: A randomized controlled trial was conducted with two groups of 12 students each. The intervention consisted in a differential guideline-based training on ontology development vs. unspecific training. After a group-specific training focusing on three topics per group, performance of students was assessed with 12 exercises (2 exercises per topic), in which the students had to apply their skills. Different types of competency questions were elaborated for the analysis of the students' ontologies. We used the proportion of correct answers as a measure of ontology quality. RESULTS: On single topic level, the performance of ontology developers increased after guideline-based training for two out of the six topics: it increased from a proportion of 0.46 to 0.63 for the topic Process \& Participation and from 0.44 to 0.53 for the topic Collective Material Entity. In regression analysis, a positive correlation was shown between the performance of students on untrained topics and the performance after specific guideline-based training. Moreover, in multiple regression analysis an overall effect of specific training of 0.09 was calculated (p < 0.1). CONCLUSION: The results show an effect of a specific guideline-based training on the performance of ontology developers compared to the performance after unspecific training by an increase of about 10 \% on the rate of correct competency questions. In addition, this study has shown the general applicability of competency questions in a formal ontology evaluation scenario. However, the study also shows that the training of ontology developers and their performance evaluation is a tedious task. The resulting performance of ontology developers is more dependent on the a priori individual competencies than on the specific acquired skills after training. (shrink)

Shaftesbury’s major work Characteristicks of Men, Manners, Opinions, Times was one of the most influential English works in the eighteenth century. This paper focuses on his contributions to debates about persons and personal identity and shows that Shaftesbury regards metaphysical questions of personal identity as closely connected with normative questions of character development. I argue that he is willing to accept that persons are substances and that he takes their continued existence for granted. He sees the need to supplement metaphysical (...) debates of personal identity and believes that we have to turn to the character that is realized by a substance if we want to understand who we are. For Shaftesbury persons have a particular character, can act, and govern themselves. I propose that Shaftesbury’s approach to persons has a developmental dimension, which is meant to encourage personal development and improvement of character. The developmental dimension can be understood as an intellectual journey that invites us to search for our true self, to develop our character, and to seek happiness, which ultimately involves understanding our place as persons in the order of the universe. I show that my developmental interpretation is preferable to other existing interpretations. (shrink)

The aim of this paper is twofold: (1) to assess whether the construct of neural representations plays an explanatory role under the variational free-energy principle and its corollary process theory, active inference; and (2) if so, to assess which philosophical stance - in relation to the ontological and epistemological status of representations - is most appropriate. We focus on non-realist (deflationary and fictionalist-instrumentalist) approaches. We consider a deflationary account of mental representation, according to which the explanatorily relevant contents of neural (...) representations are mathematical, rather than cognitive, and a fictionalist or instrumentalist account, according to which representations are scientifically useful fictions that serve explanatory (and other) aims. After reviewing the free-energy principle and active inference, we argue that the model of adaptive phenotypes under the free-energy principle can be used to furnish a formal semantics, enabling us to assign semantic content to specific phenotypic states (the internal states of a Markovian system that exists far from equilibrium). We propose a modified fictionalist account: an organism-centered fictionalism or instrumentalism. We argue that, under the free-energy principle, pursuing even a deflationary account of the content of neural representations licenses the appeal to the kind of semantic content involved in the aboutness or intentionality of cognitive systems; our position is thus coherent with, but rests on distinct assumptions from, the realist position. We argue that the free-energy principle thereby explains the aboutness or intentionality in living systems and hence their capacity to parse their sensory stream using an ontology or set of semantic factors. William Molyneux (1656–1698) was an Irish experimental philosopher and politician, who played a major role in the intellectual life in seventeenth-century Dublin. He became Locke’s friend and correspondent in 1692 and was probably Locke’s philosophically most significant correspondent. Locke approached Molyneux for advice for revising his Essay concerning Human Understanding as he was preparing the second and subsequent editions. Locke made several changes in response to Molyneux’s suggestions; they include major revisions of the chapter ‘Of Power’ (2.21), the addition of (...) the chapter ‘Of Identity and Diversity’ (2.27), and the addition of the so-called Molyneux Problem (2.9.8). Molyneux repeatedly requested that Locke develops his views on morality. Additionally, their correspondence turned to questions concerning education and Molyneux’s keen interest in the topic likely prompted Locke to publish Some Thoughts Concerning Education in 1693. Moreover, Molyneux drew on Locke’s anonymously published Two Treatises of Government in his The Case of Ireland’s Being Bound by Acts of Parliament in England, Stated, which was first published in the spring of 1698. Molyneux revealed Locke’s authorship of Two Treatises against Locke’s will, yet their friendship continued until Molyneux’s untimely death in October 1698. (shrink)

This Element offers the first detailed study of Catharine Trotter Cockburn's philosophy and covers her contributions to philosophical debates in epistemology, metaphysics, moral philosophy, and philosophy of religion. It examines not only Cockburn's view that sensation and reflection are the sources of knowledge, but also how she draws attention to the limitations of human understanding and how she approaches metaphysical debates through this lens. In the area of moral philosophy, this Element argues that it is helpful to take seriously Cockburn's (...) distinction between questions concerning the metaphysical foundation of morality and questions concerning the practice of morality. Moreover, this Element examines Cockburn's religious views and considers her understanding of the relation between morality and religion and her religious views concerning the resurrection and the afterlife. Firms usually need to attract debt to form and grow, but increasing financial leverage also entails increased risks and costs for stakeholders, such as customers and employees. Accordingly, past research suggests that for common commercial firms (CCFs), which prioritize profits, higher leverage leads to lower sales growth and higher employment costs. However, Certified B Corporations (CBCs) distinguish themselves by having a credible prosocial mission and, therefore, might be better insulated against the adverse effects of higher leverage. Using a European multi-country (...) matched sample of 136 CBCs and 136 CCFs, we find that the negative relationship between leverage and sales growth and the positive relationship between leverage and employment costs are weaker for CBCs than CCFs. Taken together, due to their certified prosocial mission, CBCs enjoy an advantage in debt financing compared to CCFs. (shrink)

This paper takes a new look at Francis Hutcheson's moral sense theory and examines it in light of the views of his rationalist critics and opponents who claim that there has to be an antecedent moral standard prior to any sense or affections. I examine how Gilbert Burnet, Samuel Clarke, and Catharine Trotter Cockburn each argue for the priority of reason over a moral sense and how Hutcheson responds or could respond to their views. Furthermore, I consider the proposal that (...) rather than regarding Hutcheson's moral sense theory as fundamentally opposed to moral rationalism, Hutcheson and Clarke endorse a shared moral metaphysics, as argued by Patricia Sheridan. Although I consider this proposal as too broad and believe it overlooks relevant metaphysical differences between Clarke and Hutcheson, I argue that the dispute between Hutcheson and his critics and opponents will not be settled without taking their underlying moral metaphysics into consideration. Catharine Trotter Cockburn challenges voluntarist views held by British moral philosophers during the first half of the eighteenth century. After introducing her metaphysics of morality, namely, her account of human nature, and her account of moral motivation, which for her is a matter concerning the practice of morality, I analyze her arguments against theological voluntarism. I examine, first, how Cockburn rejects the view that God can by an arbitrary act of will change what is good or evil; second, how she (...) challenges views that understand the initial creation of the world solely in terms of divine will and draws attention to the role that the divine understanding plays in God’s creation; and third, how she argues that moral obligation does not require a superior lawmaker. I conclude by highlighting how Cockburn’s arguments not only challenge voluntarist views, but also offer support for her moral fitness theory. (shrink)

My chapter examines Isaac Watts’s and Catharine Trotter Cockburn’s views concerning the metaphysics of the mind and their underlying accounts of powers and substances. In Philosophical Essays on Various Subjects Watts criticizes Locke’s account of substances and argues for his own preferred account of substance. Watts argues that there is no need to postulate an unknown substratum, as Locke does. Instead, Watts searches for a better explanation of what substances are. His proposal is that bodily substance just is solid extension (...) and that mental substance is identical with the power of thinking. This means that Watts believes that some powers can be substances. I will show how Watts defends his account of substances against various objections. Cockburn was not satisfied by Watts’s account of substance and disagrees with Watts’s understanding of powers. She believes that Watts is too quick to draw metaphysical conclusions. Cockburn takes seriously the limitations of human understanding and emphasizes that humans are ignorant about many metaphysical truths. I end by assessing the strengths and weaknesses of Watts’s and Cockburn’s accounts of powers and substances. (shrink)

In 2000, Rüdiger Thiele [1] found in a notebook of David Hilbert, kept in Hilbert's Nachlass at the University of Göttingen, a small note concerning a 24th problem. As Hilbert wrote, he had considered including this problem in his famous problem list for the International Congress of Mathematicians in Paris in 1900.

Many sentences can be interpreted both as a metaphor and as a literal claim, depending on the context. The aim of this paper is to show that there are discourse-based systematic constraints on the identification of an utterance as metaphorical, literal, or both (as in the case of twice-apt metaphors), from a normative point of view. We claim that the key is contextual coherence. In order to substantiate this claim, we introduce a novel notion of context as a rich and (...) heterogeneous body of information, including previous discourse, elements coming from the surroundings of the utterance, background information, and Questions Under Discussion (QUD) issued from these three sources. We then define contextual coherence as a relation between what we call the minimal paraphrase of the metaphor and the context, and argue that for an interpretation to be coherent two conditions must be met. First, the minimal paraphrase must address some question in the QUD stack. Second, it must be externally consistent, i.e. consistent with the available contextual information. Finally, we argue that an approach based on contextual coherence is better suited to deal with twice-true and twice-apt metaphors than traditional approaches based on semantic deviance or pragmatic lack of fit. Admiration and adoration have been considered as emotions with the power to change people, yet our knowledge of the specific nature and function of these emotions is quite limited. From an interdisciplinary perspective, we present a prototype approach to admiration and what has variously been labelled adoration, worship, or reverence. Both admiration and adoration contribute to the formation of personal and collective ideals, values, and identities, but their workings differ. We offer a detailed theoretical account of commonalities and differences in (...) the appraisal patterns and action tendencies associated with the two emotions. This analysis reveals that admiration motivates the internalisation and emulation of ideals embodied by an outstanding role model. Adoration motivates adherence to the teachings and expectations of a meaning maker and benefactor perceived as superhuman or sacred. Thus, the primary function of admiration is to promote individual learning and change, whereas adoration primarily serves to bind communities together. (shrink)

According to Locke, appropriation is a precondition for moral responsibility and thus we can expect that it plays a distinctive role in his theory. Yet it is rare to find an interpretation of Locke’s account of appropriation that does not associate it with serious problems. To make room for a more satisfying understanding of Locke’s account of appropriation we have to analyse why it was so widely misunderstood. The aim of this paper is fourfold: First, I will show that Mackie’s (...) and Winkler’s interpretations that have shaped the subsequent discussion contain serious flaws. Second, I will argue that the so-called appropriation interpretation —that is the view that appropriation is meant to provide alternative persistence conditions for persons—lacks support. Third, I will re-examine Locke’s texts and argue that we can come to a better understanding of his notion of appropriation in the Essay if we interpret it in analogy to his account of appropriation in Two Treatises. Fourth, I will offer a more fine-grained interpretation of the role of appropriation in relation to persistence conditions for persons. I conclude by showing that the advantage of this proposal is that it reconciles interpretations that have commonly been thought to be inconsistent. (shrink)

This paper aims to reconstruct Francis Hutcheson's thinking about liberty. Since he does not offer a detailed treatment of philosophical questions concerning liberty in his mature philosophical writings I turn to a textbook on metaphysics. We can assume that he prepared the textbook during the 1720s in Dublin. This textbook deserves more attention. First, it sheds light on Hutcheson's role as a teacher in Ireland and Scotland. Second, Hutcheson's contributions to metaphysical disputes are more original than sometimes assumed. To appreciate (...) his independent thinking, I argue, it is helpful to take the intellectual debates in Ireland into consideration, including William King's defence of free will and discussions of Shaftesbury's views in Robert Molesworth's intellectual circle. Rather than taking a stance on the philosophical disputes about liberty, I argue that Hutcheson aims to shift the focus of the debates towards practical questions concerning control of desire, cultivation of habits, and character development. LS Penrose was the first to propose a measure of voting power (which later came to be known as ‘the [absolute] Banzhaf index’). His limit theorem – which is implicit in Penrose (1952) and for which he gave no rigorous proof – says that, in simple weighted voting games, if the number of voters increases indefinitely while the quota is pegged at half the total weight, then – under certain conditions – the ratio between the voting powers (as measured by (...) him) of any two voters converges to the ratio between their weights. We conjecture that the theorem holds, under rather general conditions, for large classes of variously defined weighted voting games, other values of the quota, and other measures of voting power. When someone masters a skill, their performance looks to us like second nature: it looks as if their actions are smoothly performed without explicit, knowledge-driven, online monitoring of their performance. Contemporary computational models in motor control theory, however, are instructionist: that is, they cast skillful performance as a knowledge-driven process. Optimal motor control theory, as representative par excellence of such approaches, casts skillful performance as an instruction, instantiated in the brain, that needs to be executed—a motor command. This paper aims (...) to show the limitations of such instructionist approaches to skillful performance. We specifically address the question of whether the assumption of control-theoretic models is warranted. The first section of this paper examines the instructionist assumption, according to which skillful performance consists of the execution of theoretical instructions harnessed in motor representations. The second and third sections characterize the implementation of motor representations as motor commands, with a special focus on formulations from OMCT. The final sections of this paper examine predictive coding and active inference—behavioral modeling frameworks that descend, but are distinct, from OMCT—and argue that the instructionist, control-theoretic assumptions are ill-motivated in light of new developments in active inference. BACKGROUND -/- The importance of ontologies in the biomedical domain is generally recognized. However, their quality is often too poor for large-scale use in critical applications, at least partially due to insufficient training of ontology developers. -/- OBJECTIVE -/- To show the efficacy of guideline-based ontology development training on the performance of ontology developers. The hypothesis was that students who received training on top-level ontologies and design patterns perform better than those who only received training in the basic principles of (...) formal ontology engineering. -/- METHODS -/- A curriculum was implemented based on a guideline for ontology design. A randomized controlled trial on the efficacy of this curriculum was performed with 24 students from bioinformatics and related fields. After joint training on the fundamentals of ontology development the students were randomly allocated to two groups. During the intervention, each group received training on different topics in ontology development. In the assessment phase, all students were asked to solve modeling problems on topics taught differentially in the intervention phase. Primary outcome was the similarity of the students’ ontology artefacts compared with gold standard ontologies developed by the authors before the experiment; secondary outcome was the intra-group similarity of group members’ ontologies. -/- RESULTS -/- The experiment showed no significant effect of the guideline-based training on the performance of ontology developers (a) the ontologies developed after specific training were only slightly but not significantly closer to the gold standard ontologies than the ontologies developed without prior specific training; (b) although significant differences for certain ontologies were detected, the intra-group similarity was not consistently influenced in one direction by the differential training. -/- CONCLUSION -/- Methodologically limited, this study cannot be interpreted as a general failure of a guideline-based approach to ontology development. Further research is needed to increase insight into whether specific development guidelines and practices in ontology design are effective. (shrink)

This article explores the distinctions among European peoples’ character established in Kant’s anthropology and their connection with his politics. These aspects are neglected relative to the analysis of race between Europeans and non-Europeans, but Kant’s anthropological works portray the people of Mediterranean Europe as not capable of civilization because of the dominance of passion in their faculty of desire, which he ties to ‘Oriental’ influences in blood or government. Kant then superimposes this racialized anthropology over the historical geopolitics of Europe, (...) obscuring the indebtedness of Northern European trade dominance to Mediterranean historical tactics and financial wealth. By relegating the Mediterranean to the margins and dismissing contentious commercial exchange in the region as mere violence spearheaded by North African corsairs, Kant gives us an elitist cosmopolitanism unable to cope with hierarchy and inequality, diminishing its potential for egalitarian global projects today. Insurance markets have always relied on large amounts of data to assess risks and price their products. New data-driven technologies, including wearable health trackers, smartphone sensors, predictive modelling and Big Data analytics, are challenging these established practices. In tracking insurance clients’ behaviour, these innovations promise the reduction of insurance costs and more accurate pricing through the personalisation of premiums and products. Building on insights from the sociology of markets and Science and Technology Studies, this article investigates the role of economic (...) experimentation in the making of data-driven personalisation markets in insurance. We document a case study of a car insurance experiment, launched by a Belgian direct insurance company in 2016 to set up an experiment of tracking driving style behavioural data of over 5000 participants over a one-year period. Based on interviews and document analysis, we outline how this in vivo experiment was set-up, which interventions and manipulations were imposed to make the experiment successful, and how the study was evaluated by the actors. Using JL Austin’s distinction between happy and unhappy statements, we argue how the experiment, despite its failure not to provide the desired evidence, could be considered a ‘happy’ event. We conclude by highlighting the role of economic experiments ‘in the wild’ for the making of future markets of data-driven personalisation. (shrink)

A mechanism-based approach was developed focusing on the psychodynamic, psychological and neuronal mechanisms in healthy and depressed persons. In this integrative concept of depression, the self is a core dimension in depression. It is attributed to negative emotions (e.g., failure, guilt). The increased inward focus in depression is connected with a decreased environmental focus. The development of neuropsychodynamic hypotheses of the altered self-reference is based on the investigation of the emotional-cognitive interaction in depressed patients. It may be hypothesized that the (...) increased negative self-attributions—as typical characteristics of an increased self-focus in depression—may result from altered neuronal activity in subcortical-cortical midline structures in the brain, especially from hyperactivity in the cortical-subcortical midline regions and hypoactivity in the lateral regions. The increased resting state activity in depression is especially associated with an increased resting state activity in the default mode network (DMN) and a dysbalance between DMN and executive network (EN) activity. Possible therapeutic consequences of the neuropsychodynamic approach to depression involve the necessary emotional attunement in psychotherapy of depressed patients and the adequate timing of therapeutic interventions. The hypotheses which have been developed in the context of the neuropsychodynamic model of depression may be used for more specific psychotherapeutic interventions, aiming at specific mechanisms of compensation and defence, which are related to the increased resting state activity and the disturbed resting state-stimulus-interaction. This essay examines Locke’s chapter “Of Identity and Diversity” (Essay 2.27) in the context of the series of chapters on ideas of relations (Essay 2.25–28) that precede and follow it. I begin by introducing Locke’s account of how we acquire ideas of relations. Next, I consider Locke’s general approach to individuation and identity over time before I show how he applies his general account of identity over time to persons and personal identity. I draw attention to Locke’s claim that “person” (...) is a forensic term and analyse his arguments for why the sameness of a human being and the sameness of a substance or soul are neither necessary nor sufficient for personal identity. Instead, Locke argues that personal identity consists in sameness of consciousness. Locke regards persons as moral agents who are accountable for their actions. If a person now is held accountable for a past action it is important that the person now is the same person as the person who did the action. This means that moral accountability presupposes personal identity. Additionally, it will be important to consider whether the person deserves reward or punishment for the action. Locke’s account of moral relations, which he develops in Essay 2.28, addresses this issue and I show how it supplements his account of persons and personal identity. (shrink)

The adoption of Big Data analytics in insurance has proved controversial but there has been little analysis specifying how insurance practices are changing. Is insurance passively subject to the forces of disruptive innovation, moving away from the pooling of risk towards its personalisation or individualisation, and what might that mean in practice? This special theme situates disruptive innovations, particularly the experimental practices of behaviour-based personalisation, in the context of the practice and regulation of contemporary insurance. Our contributors argue that behaviour-based (...) personalisation in insurance has different and broader implications than have yet been appreciated. BDAs are changing how insurance governs risk; how it knows, classifies, manages, prices and sells it, in ways that are more opaque and more extensive than the black boxes of in-car telematics. Advancing a radically enactive account of cognition, we provide arguments in favour of the possibility that cultural factors permeate rather than penetrate cognition, such that cognition extensively and transactionally incorporates cultural factors rather than there being any question of cultural factors having to break into the restricted confines of cognition. The paper reviews the limitations of two classical cognitivist, modularist accounts of cognition and a revisionary, new order variant of cognitivism – a Predictive Processing account of Cognition, or PPC. It (...) argues that the cognitivist interpretation of PPC is conservatively and problematically attached to the idea of inner models and stored knowledge. In abandoning that way of understanding PPC, it offers a radically enactive alternative account of how cultural factors matter to cognition – one that abandons all vestiges of the idea that cultural factors might contentfully communicate with basic forms of cognition. In place of that idea, the possibility that culture permeates cognition is promoted. (shrink)

john locke argues that personal identity consists in sameness of consciousness, and he maintains that any other theory of personal identity would lead to "great Absurdities".1 This statement intimates that Locke thought carefully about alternative conceptions of personal identity and their problems. In this paper, I argue that, by understanding Locke's account of personal identity in the context of metaphysical and religious debates of his time, especially debates concerning the afterlife and the state of the soul between death and resurrection, (...) we can reveal the strengths of his view and show how his account of personal identity in terms of sameness of consciousness has the resources to avoid... This introductory article outlines the themes and aims of this special issue, which offers new perspectives on early modern debates about agency in two ways: First, it recovers writings on agency and liberty that have been widely neglected or that have received insufficient attention, including writings by Anne Conway, Henry More, Ralph Cudworth, William King, Gabrielle Suchon, Elizabeth Berkeley Burnet, Mary Astell, and Anthony Ashley Cooper, the Third Earl of Shaftesbury. This aim of this paper is two-fold: it critically analyses and rejects accounts blending active inference as theory of mind and enactivism; and it advances an enactivist-dynamic understanding of social cognition that is compatible with active inference. While some social cognition theories seemingly take an enactive perspective on social cognition, they explain it as the attribution of mental states to other people, by assuming representational structures, in line with the classic Theory of Mind. Holding both enactivism and ToM, we argue, (...) entails contradiction and confusion due to two ToM assumptions widely known to be rejected by enactivism: that social cognition reduces to mental representation and social cognition is a hardwired contentful ‘toolkit’ or ‘starter pack’ that fuels the model-like theorising supposed in. The paper offers a positive alternative, one that avoids contradictions or confusion. After rejecting ToM-inspired theories of social cognition and clarifying the profile of social cognition under enactivism, that is without assumptions and, the last section advances an enactivist-dynamic model of cognition as dynamic, real-time, fluid, contextual social action, where we use the formalisms of dynamical systems theory to explain the origins of socio-cognitive novelty in developmental change and active inference as a tool to demonstrate social understanding as generalised synchronisation. This essay brings together political theories of empire and racial capitalism to clarify the entanglements between socialist and imperial discourse at the turn of the twentieth century. I show that white labor activists and intellectuals in the United States and the British settler colonies borrowed from imperial scripts to mark non-white workers as a threat. This discourse was thus both imperial and popular, because it absorbed the white working class into settler projects and enlisted its support in defense of imperial (...) logics of labor control. While white workers’ demands of enfranchisement were part of a transnational imagination that was both imperial and narrowly emancipatory, this discourse reemerged as one of popular sovereignty and found channels and paths to institutionalization through national states. These institutional formations arose out of the encounter between capitalists interested in facilitating mobility of racialized laboring subjects around the globe, elite projects invested in sheltering settler spaces, and white workers concerned with protecting their own labor from competition by excluding exploitable non-white workers. White labor’s embrace of racial prejudice and the exclusion of workers of color created segregated labor spaces that fit neatly with both capitalist goals of labor control and the protection of the settler status of emerging polities. Bringing to the forefront the imperial genealogy of popular sovereignty and immigration control disrupts liberal political theory frameworks that condemn restrictions as well as those that find migration restrictions permissible. The analysis also illuminates contemporary immigration politics. (shrink)

This article presents an analysis of contractual relations in sport from the standpoint of the Croatian legislative system. Due to the complexity of the subject matter, the author considers only a small fragment of it - the significance and the role of sport in Croatian society and the law of contracts „as a cornerstone on which „sports law“ has been built and which is of primary importance in most areas where there is an interface between sport and the law, irrespective (...) of whether the sport is being played at an elite level or at a more humble one“. Bearing in mind the limited extent of this article, the autor tries to provide some clarifications and some guidance on how to deal with the designation and the determination of the applicable law for contracts in the sporting context. Considering that there are different legal regimes which may come into play with regard to the designation of the law applicable to contracts in the sporting context, the author first presents the determination of the applicable law according to the Rome I Regulation and then according to the Croatian Arbitration Act, Swiss Private International Law Act and the CAS Code of Sports-related Arbitration, as the most common in sports practice. Then, the author deals with contracts concluded with minor athletes and the determination of the law applicable to some preliminary questions. Finally, the author presents her perception of the problems encountered and some suggestions for the improvement of the existing legal framework. (shrink)

One of the criteria to a strong principle in natural sciences is simplicity. This paper claims that the Free Energy Principle (FEP), by virtue of unifying particles with mind, is the simplest. Motivated by Hilbert’s 24th problem of simplicity, the argument is made that the FEP takes a seemingly mathematical complex domain and reduces it to something simple. More specifically, it is attempted to show that every ‘thing’, from particles to mind, can be partitioned into systemic states by virtue of (...) self-organising symmetry break, i.e. self-entropy in terms of the balance between risk and ambiguity to achieve epistemic gain. By virtue of its explanatory reach, the FEP becomes the simplest principle under quantum, statistical and classical mechanics conditions. (shrink)
