According to some Foucault' proposals, this paper deals with the historical constitution of individual identity forms through juridic practices, concretely the results of the transformation of modern law from the state monopo-lization of the legislative functions, a process considered to be based on so-cial contract theories -the constitution of social order according to a successive scheme: from the pre-social individuals to supra-individual society. The juridical individualism derives from this model, and the critical ap-proach on it is made from the contemporary (...) sciences of human behavior. (shrink)

Many philosophers hold that generics (i.e., unquantified generalizations) are pervasive in communication and that when they are about social groups, this may offend and polarize people because generics gloss over variations between individuals. Generics about social groups might be particularly common on Twitter (X). This remains unexplored, however. Using machine learning (ML) techniques, we therefore developed an automatic classifier for social generics, applied it to 1.1 million tweets about people, and analyzed the tweets. While it is often suggested that generics (...) are ubiquitous in everyday communication, we found that most tweets (78%) about people contained no generics. However, tweets with generics received more “likes” and retweets. Furthermore, while recent psychological research may lead to the prediction that tweets with generics about political groups are more common than tweets with generics about ethnic groups, we found the opposite. However, consistent with recent claims that political animosity is less constrained by social norms than animosity against gender and ethnic groups, negative tweets with generics about political groups were significantly more prevalent and retweeted than negative tweets about ethnic groups. Our study provides the first ML-based insights into the use and impact of social generics on Twitter. (shrink)

El presente trabajo procura analizar la lectura de Jean-Luc Marion sobre el concepto de αἰτíα de Dionisio Areopagita, haciendo hincapié en su interpretación de una causalidad concebida desde un plano lingüístico. En primer lugar, proponemos una lectura general del concepto de causalidad en la tradición neoplatónica y su versión específica en la obra de Dionisio Areopagita. En segundo lugar, examinamos las primeras lecturas ofrecidas por Marion sobre la αἰτíα dionisiana a la luz del concepto de alabanza (ὑμνεῖν), tal como puede (...) encontrarse en su temprano artículo “Distance et Louange” (1971), y su obra L´ idole et la distance (1977). En tercer lugar, estudiamos su interpretación de la obra dionisiana como una “teología pragmática de la ausencia” en De surcroît (2001). Finalmente, mostramos tensiones entre esta interpretación y diversas formulaciones de Marion sobre la causalidad en Étant donné y De surcroît. (shrink)

The three‐dimensional structures adopted by RNA molecules are crucial to their biological functions. The nucleotides of an RNA molecule interact to form characteristic secondary‐structure mctifs. Tertiary interactions orient these secondary‐structure elements with respect to each other to form the functional RNA. Here we describe the basic structural elements with special emphasis on a novel tertiary motif, the pseudoknot.

I argue that there are different orders of mechanisms with different constitutive relevance and individuation conditions. In common first-order mechanistic explanations, constitutive relevance norms are captured by the matched-interlevel-experiments condition (Craver et al. (2021) Synthese 199:8807–8828). Regarding individuation, we say that any two mechanisms are of the same type when they have the same concrete components performing the same activities in the same arrangement. By contrast, in higher-order mechanistic explanations, we formulate the decompositions in terms of generalized basic components (GBCs). (...) These GBCs (e.g., logic gates) possess causal properties that are common to a set of physical systems. Mechanistic explanations formulated in terms of GBCs embody the epistemic value of horizontal integration, which aims to explain as many phenomena as possible with a minimal amount of abstract components (Wajnerman Paz (2017a) Philos Psychol 30:213–234). Two higher-order mechanisms are of the same type when they share all the same GBCs, and they are organized as performing the same activities with the same interactions. I use this notion of mechanistic order to enhance the mechanistic account of computation (MAC) and provide an account of the epistemic norms of computational explanation and the nature of medium-independent functional properties and mechanisms. Finally, I use these new conceptual tools to address four criticisms of the MAC. (shrink)

A distinguishing feature of neural computation and information processing is that it fits models that describe the most efficient strategies for performing different cognitive tasks. Efficiency determines a distinctive sense of teleology involving optimal performance and resource management through a specific strategy. I articulate this kind of teleology and call it efficient teleological function. I argue that efficient teleological function is compatible with mechanistic explanation and, most likely, neural computational mechanisms are efficiently functional in this sense. They are members of (...) a distinctive class of computational mechanisms whose efficiency is intertwined with their functionality. This is illustrated by widely discussed approaches to mind, such as Barlow’s efficient coding hypothesis or the ones associated with the so-called “predictive mind”, which propose that the brain employs highly efficient coding strategies to save energy resources that are critical to the organism’s survival. RESUMEN La filosofia de Sócrates posee un carácter muy peculiar debido a la ausencia de doctrinas bien establecidas y a la inseparable vinculación entre vida y pensamiento. Por este motivo, el filosofar socrático debe entenderse unido a sus andanzas callejeras y a la revisión constante de cualquier planteamiento. Partiendo de esta hipótesis, el artículo pretende mostrar tanto la originalidad del pensamiento socrático y su concepción de la filosofía como la enorme influencia que ejerce en los textos de Platón, que emplean (...) de manera sutil esos extravíos y divagaciones con el propósito de enriquecer la conversación, de dotar de profundidad a las argumentaciones y de obligar al lector a recorrer ese mismo camino sinuoso que es el de la reflexión filosófica. Con ello, ambos pensadores muestran que la filosofía no es tanto un saber sino una actividad. ABSTRACT Socrates' philosophy has a very peculiar character due to the absence of well-established doctrines and the unbreakable bond between life and thought. For this reason, Socratic philosophy must be understood along with his street wanderings and the constant revision of any intellectual approach. Starting from this hypothesis, this paper aims to show both the originality of Socratic thought and his notion of philosophy, as well as the enormous influence he exerts on Plato, who subtly employs these wanderings and digressions in his texts to enrich the dialogue, providing depth to the arguments, and forcing the reader to travel that same winding road that is philosophical thought. Thus, both thinkers show that philosophy is not so much a kind of knowledge as it is an activity. (shrink)

This essay traces the genealogy and evolution of the category of the subject as it developed in the thought of Louis Althusser, Michel Foucault, and Alain Badiou. As will be seen, within the fruitful and complementary dialogue about the subject and subjectivity formation among these three French thinkers, there are major discrepancies in their approaches, from Althusser’s seemingly passive view of the subject as a victim of state oppression, to Foucault’s one, embedded in power but with the capacity of resistance, (...) and, finally, to Badiou’s understanding, in his book Théorie du sujet (Theory of the Subject, 1982), of the subject as the one who courageously takes risks to put into practice the truth brought about by the event in order to radically transform the present situation. El acceso al Derecho y a unos servicios jurídicos básicos constituye una exigencia fundamental del Estado de Derecho. El desarrollo de aplicaciones de inteligencia artificial jurídica capaces de proporcionar un mejor conocimiento y comprensión del Derecho aplicable en cada situación particular ha difuminado, llegando incluso a eliminar en algunas áreas de la práctica legal, la distinción entre “información jurídica” y "asesoramiento legal”. A partir de ahí, la conjunción de la inteligencia artificial jurídica, la computación en la nube y las TICs (...) para producir conocimiento jurídico “customizado” y distribuirlo masivamente a través de la red está generando formas disruptivas de prestación de los servicios jurídicos que pueden ayudar a colmar bolsas hasta ahora desatendidas de necesidades jurídicas básicas. Ello requiere, sin embargo, un nuevoenfoque regulador de los servicios legales. (shrink)

El problema de la posverdad permite auscultar nuestro presente y mostrar lo que tiene de vacua insustancialidad. Trazar su genealogía y remontarse a su supuesta procedencia nietzscheana puede ayudar a interpretar de manera menos apresurada los textos de este autor, de modo que sean de utilidad para tratar de construir nuestro futuro más inmediato con otras bases distintas a las de la posverdad. La crítica al dogmatismo en el terreno de la verdad no ha de conducir a la equiparación de (...) todas las verdades —ni, por tanto, a la supresión pura y simple de la verdad. Más bien es una oportunidad para que se abra espacio a una concepción de verdad que, dirigida por la virtud de la Redlichkeit, tenga la valentía de aceptar que la pluralidad de perspectivas y la incertidumbre que de ella se deriva son ingredientes intrínsecos al mundo. La hermenéutica ha reivindicado un concepto especial de comprensión. El concepto de aplicación - apropiación es la cifra de ese especial modo de comprender. Si “comprender es aplicar” (Gadamer), es porque la aplicación es el remedio contra una extrañeza, una distancia, una lejanía que tiene aspectos gnoseológicos y existenciales. En este trabajo, rastreo y analizo las raíces del concepto hermenéutico de aplicación haciendo hincapié en su aspecto práctico existencial. Lo que nos enseña la categoría de aplicación es que el criterio (...) mismo de la comprensión, al menos para ciertas expresiones (y ciertos textos) es el efecto que causa en nuestra forma de ver el mundo (o una porción de él). Conceptos como “salvación” (raíz religiosa), “disposición afectiva y cognitiva” (raíz ética), “persuasión” (raíz retórica), y “catarsis” (raíz estética) dejan ver la necesidad del sujeto de apropiarse de un saber que modificará su modo de ver el mundo, su modo de estar en él. La inteligencia artificial transforma el derecho. No es solo un modo de facilitar la actividad jurídica. Tiene implicaciones epistemológicas y sociales. El derecho se reduce a datos y a cálculos. Prospera un jurista maquinal. Se empobrece la racionalidad jurídica. Se olvida que la clave del derecho no es el procesamiento de datos sino la creación de sentido.

Responses to outbreaks, epidemics and pandemics involves a heterogeneous set of activities that aim to address threats to public health. In addition to research, non-research activities, such as prevention and control interventions, and surveillance, are conducted. The boundaries between research and non-research responses can rapidly blur during a public health emergency such as the COVID-19 pandemic. There may be common elements between these types of activities, and they may draw on the same resources and infrastructure. Non-research activities, such as surveillance (...) and emergency non-research use of unproven interventions, and research activities must all be undertaken in an ethical manner as components of emergency response. However, care is needed to distinguish between non-research public health activities and research, because research often has considerations and requirements for its ethical conduct which are distinct from non-research public health activities. Research aims to produce generalizable knowledge, and mechanisms such as participant consent and independent ethics review aim to ensure that the rights and interests of research participants are respected. Ensuring that research and non-research activities are appropriately distinguished can additionally promote proper coordination of such activities, and increase trust and social accountability in pandemic responses. Consequently, it is important to distinguish between these different activities on the basis of their primary aim, and to consider whether their implementation is justifiable, based on their aims and the relevant ethical framework for each type of activity, and how they are coordinated as part of the larger collective activity of emergency response and management. Complex questions arise about how the different stakeholders involved in decision-making should make valid and justifiable decisions about whether the response activity is research or non-research. The cases in this chapter invite consideration about how such decisions should be made, and their implications, in the context of applications to conduct retrospective research into the outcomes of emergency uses of unproven interventions outside clinical trials, and of characterising antibody-testing initiatives and systematic data collection activities as surveillance or research. El impacto de los movimientos emancipatorios en las sociedades contemporáneas es incuestionable; alcanza incluso al ámbito académico, donde se busca comprender las experiencias que los motivan y se llega a tomar partido por sus causas. Sin embargo, estos movimientos están orientados a la consecución de derechos para identidades concretas, como las personas no binarias, de forma que se consiga paliar o incluso eliminar la situación de desigualdad que las oprime. Así, podría parecer que las causas de los grupos oprimidos resultan (...) «ajenas» para los grupos dominantes, los cuales no tienen que luchar por sus derechos, pues ya disfrutan de ellos, lo que confinaría el discurso acerca de las reivindicaciones y las experiencias que las motivan exclusivamente a los colectivos oprimidos. Abordaremos la polémica cuestión de hablar de una causa ajena desde la epistemología feminista del punto de vista y las literaturas sobre opresión e injusticia epistémica. A grandes rasgos, siguiendo la línea iniciada por Gayatri Chakravorty Spivak (1988), quien se distancia de autores como Michel Foucault o Gilles Deleuze, a quienes acusa de rechazar el hablar por otros asumiendo falsamente que las personas oprimidas pueden representar de manera transparente sus propios intereses, entenderemos el hablar de una causa ajena como un hablar con. Frente a la oposición escuchar versus hablar por, apostaremos por un informado hablar con que no participe de la esencialización de los oprimidos como sujetos no ideológicamente construidos. Parecería haber una oposición entre el amor a sí mismo, el amor a los demás y el amor a Dios. Por un lado, el amor sui deviene en un egoísmo individualista; por otro, se olvida de sí mismo para entregarse desinteresadamente a los otros. Sin embargo, un análisis profundo de estos distintos amores, como el que nos proponemos en este trabajo, siguiendo las huellas de santo Tomás, muestra su profunda armonía e integración.

L. Polo es un buen maestro, más preocupado por descubrir la verdad que por ser entendido. Su pensar es paciente, la atención, concentrada. Mantiene la congruencia entre el nivel del método cognoscitivo que emplea y los temas reales conocidos que estudia. En él destacan tres cualidades: la audacia en el buscar, la convivencia con la verdad y la apertura universal al saber.

As the founder of mathematical logic he severely examindes the syllogisms on which arithmetic is built up. In doing so, Frege recognized that our colloquial language is inadequate to define logic structures. His notional language corresponded to the artaivicial logical language demandes by Leibniz. Frege's achievement in the field of logic were so important, that they radiated into the domain of philosophy and influenced the development of mathematical logic decisively. (shrink)

The debate over the improvement of moral capacity or moral enhancement through pharmacology has gained momentum in the last decade as a result of advances in neuroscience. These advances have led to the discovery and allowed the alteration of patterns of human behavior, and have permitted direct interventions on the neuronal structure of behavior. In recent years, this analysis has deepened regarding the anthropological foundations of morality and the reasons that would justify the acceptance or rejection of such technology. We (...) present a review of proposals for pharmacological interventions directed directly towards moral enhancement. In addition, we identify the ethical dilemmas that such interventions may generate, as well as the moral assessment of the authors of these studies. There is a moderate consensus on the risks of any intervention on the intimate structure of the human condition, its autonomy and identity, but there are large differences in explaining the reasons for this concern and especially in justifying such interventions. These findings show that it is necessary to investigate the moral assessment of authors and the ethical dimension within the field of pharmacology in order to identify future trends. (shrink)

Para sostener esta idea Husserl sugiere el paralelismo entre la percepción externa y la percepción de los valores. El objetivo de este trabajo es clarificar tal paralelismo enfatizando un problema particular del análisis husserliano: la tonalidad afectiva del objeto de valor y su relación con la apercepción sentimental involucrada en la experiencia de los valores.According to husserlian phenomenology the primordial experience of value lays in emotive (...) lived-experiences. In order to sustain his Idea Husserl suggest a parallelism between the external perception and the perception of values. The aim of this work is to clarify such parallelism stressing a particular problem of husserlian analysis: the affective tonality of the object of value and its relation to the feeling apperception involved in the experience of values. The topic of divine providence is back on the theological agenda. Even a cursory review of the recent debates will reveal an increasing interest in this issue. A closer look at the literature of the last five or so decades indicates, however, that there is a considerable disagreement about the conceptualisation of providence and, consequently, how to approach the topic best. The term “innovation” or “innovative care” has recently gained attention in the context of the use of novel and not yet fully validated medical interventions and technologies. Most notably, there have been various incidences of medical activities insufficiently validated for its regular use in healthcare that fall into this category, such as stem cell treatments, genome sequencing for diagnostic purposes, or novel reproductive technologies. Latin American countries are among the places where new and non-validated medical activities take place, notably due (...) to a lack of clear regulations and the poor support of authorities of existent legal and ethical guidelines, which is driven by “hidden battles” on the moral status of certain interventions. The increasing importance of innovative care underlines the importance of developing a general framework for these practices. Therefore, the present chapter scrutinizes this nascent field of inquiry in Latin America and offers a conceptual framework for innovation as well as its ethical justification. As we will argue, an important use of the term “innovation” or “innovative care” is best interpreted as “new non-validated practice” and not as a research activity. Then, we will defend that responsible innovation understood as responsible new non-validated practice is ethically permissible and poses an acceptable medical option if done in exceptional circumstances—where no reasonable alternatives can be provided to an individual patient—and following special ethical principles. Finally, we focus on the peculiarities and specific difficulties the concept of new non-validated practice poses to the Latin American context. We will conclude the chapter by some remarks and recommendations we draw from our analysis for individual patients, doctors, and societies in Latin America. (shrink)

After a description of the method of mathematics and empirical sciences, brief but explicit enough to show their limits with philosophical and theological reflection, I comment the harmonic relations of mutual help among them, and also, unfortunately, the historical occasions in which these limits have been trespassed. And after a fast view of the image of the world–matter and life–presented to us by nowadays established science, I recall the main items of opposition to faith posed by science, although sometimes just (...) promised science. I show that today’s science is in complete harmony with faith and that these items only show the opposition with faith of the materialistic philosophical points of view of some of the divulgators, not really opposition of established science. Finally we discuss that Aristotelian hylomorphism, posing form in matter, is more suited to dialog with present science than philosophies of Kantian inspiration posing form only in our knowledge or in our scientific theories. Because of its capacity to characterize mathematical concepts and structures?a capacity which first-order languages clearly lack?second-order languages recommend themselves as a convenient framework for much of mathematics, including set theory. This paper is about the credentials of second-order logic:the reasons for it to be considered logic, its relations with set theory, and especially the efficacy with which it performs its role of the underlying logic of set theory.

In this paper I argue that the Integrated Information Theory of Consciousness has an underlying emergentist metaphysics, specifically of a kind that has received minimal attention and we may call functionalist emergentism. I will try to show that in this scientific theory conscious experience is a functional-role property possessed by the whole system, not by their parts, which is dependent on, but also (purportedly) causally powerful over and above, the properties of the parts. However, I will argue that depicting conscious (...) experience as a functional-role emergent property threatens the whole coherence of the theory because, by definition, functional-realizers do all the causal work associated with the instantiation of any functional-role property on any occasion. Hence, to preserve the causal power of consciousness, which, as we will see, is one of the fundamental building blocks of the theory, linked to the assertion of the very existence of consciousness, phenomenal properties should be re-thought as realizers of the relevant informationally integrated causal-roles. Since the nineteenth century, the debate around the process of professionalization of higher education has been characterized by two extreme positions. For some critics the process carries the risks of instrumentalizing knowledge and of leading the university to succumb under the demands of the market or the state; for other theorists it represents a concrete opportunity for the university to open up to the real needs of society and for reorienting theoretical and fragmented disciplines towards the resolution of concrete and (...) challenging problems. This article pursues three objectives. Firstly, we show that the debate is usefully informed not only by ideas of what a university is, but also by ideas of a profession. We suggest that both ideas help to overcome the conflict between the two afore-mentioned antagonist perspectives. Secondly, we demonstrate that a certain understanding of a profession can prevent the risk of viewing knowledge exclusively as scientific expertise and reducing training to the acquisition of technical skills. The position on professions adopted here is inspired by the Scottish philosopher Alasdair MacIntyre, whose work is instructive in understanding professions as “rational practical activities”, embedded in a social context with their own internal goods. Our third objective, therefore, is to argue, with MacIntyre, that the presence of professions within the university opens up the opportunity to rescue forms of rationality that are oriented towards action and, by implication, promotes spaces of training that are resistant to exclusively corporate or governmental interests and criteria of mere effectiveness. This study investigates how essential retailers responded to the COVID-19 pandemic through stakeholder communications. Based on a comprehensive text analysis of the corporate websites of the 20 largest U.S. essential retailers during the first 19 months of the crisis, we categorize the public health measures communicated by these retailers and assess how these retailers adapted their messaging to address the concerns of different stakeholders over time. This analysis allowed us to create a framework for understanding the flow of retailer/stakeholder communication (...) during a health crisis, highlighting the important role businesses can play in alleviating stakeholder concerns when public health is on the line. We discuss the implications of our findings for retailers and public policy, aiming to enhance preparedness and response for future health emergencies. (shrink)

History, as most people understand it, is the product of an intense effort to describe in an objective way and in rigorous chronological order events which have occurred in past time. Before the Renaissance the historian compiled traditions, chronicles, and statements, with no concern to verify the correctness of his data; thus legend was mixed with truth in confused and picturesque narration. Now, however, the investigator, established as a judge of inquiry, begins research on a chosen subject within his competence (...) by unleashing his critical judgment, rather like a hound on the trail of suppositions. He unearths documents and confronts them, weeding out the false from the authentic, subjects the most diverse witnesses to close comparison, and then with great patience, whether gifted or inept, he presents his thesis to the assembly of the learned. These, like a jury, either accept his conclusions, admit only a part of them, or reject them completely. Thus, from the time of the humanists who cleared the way up to the present day, an extraordinary legion of specialists, as patient as the ancient Benedictines are said to have been, have made efforts to clarify past events to establish the bases of an objective text of what has actually taken place. Hence the work of the great historian consisted in joining and fusing this labor into a homogeneous unit that would be the approximate reflection of the epoch under study. (shrink)

El artículo explora las nociones de afectividad, movimiento corporal y mundo de la vida en el pensamiento filosófico de Ludwig Landgrebe. El objetivo es mostrar cómo la unidad del proyecto fenomenológico de Landgrebe descansa en el entrelazamiento de las diferentes dimensiones de la afectividad corporal con el origen de la intencio-nalidad y la formación del sentido del mundo de la vida. Después de mostrar la unidad entre el carácter proyectivo de la vida afectiva y el movimiento corporal, así como su (...) relación con el devenir his-tórico, se destaca la importancia del pensamiento de Landgrebe en las tareas actuales de la investigación fenomenológica.The paper explores the unity of Ludwig Landgrebe´s philosophical thought departing from the intertwining between the notions of affectivity, bodily movement and lifeworld. The aim is to present a unitary vision of Landgrebe´s legacy and his way in phenomenology, taking in consideration his emphasis on the affective dimension of factual singularity. After pointing out the intertwining between the intentional orientation of affective life and bodily movement, in regard to the historical development, the paper ends stressing the systematic articulation importance of Landgrebe´s thought in the current tasks of phenomenological research.
