In this article, I address an uncharted topic in the scholarship on Salomon Maimon – the great influence that Bacon's philosophy had on Maimon. I suggest that by considering Maimon as a Baconian, we achieve a better understanding of Maimon's work, especially in three respects: (i) his use of natural histories to achieve philosophical insights, (ii) the employment of induction to find new propositions and establish known ones as certain but not as objectively necessary and (iii) a probabilistic view of (...) science, wherein we acknowledge that we can achieve higher degrees of certainty attributed to propositions but are unable to show that empirical propositions are objectively necessary. It is in this context that I propose to use the term ‘ladder of certainty’ and discuss how it is connected to Maimon's skeptical stance. (shrink)

How can we invent new certain knowledge in a methodical manner? This question stands at the heart of Salomon Maimon's theory of invention. Chikurel argues that Maimon's contribution to the ars inveniendi tradition lies in the methods of invention which he prescribes for mathematics. Influenced by Proclus' commentary on Elements, these methods are applied on examples taken from Euclid's Elements and Data. Centering around methodical invention and scientific genius, Maimon's philosophy is unique in an era glorifying the artistic genius, known (...) as Geniezeit. Invention, primarily defined as constructing syllogisms, has implications on the notion of being given in intuition as well as in symbolic cognition. Chikurel introduces Maimon's notion of analysis in the broader sense, grounded not only on the principle of contradiction but on intuition as well. In philosophy, ampliative analysis is based on Maimon's logical term of analysis of the object, a term that has yet to be discussed in Maimonian scholarship. Following its introduction, a new version of the question quid juris? arises. In mathematics, Chikurel demonstrates how this conception of analysis originates from practices of Greek geometrical analysis. (shrink)

Despite Hannah Arendt’s scepticism about psychoanalysis, this essay shows the relevance of Freud’s psychoanalytic notions of love and sublimation for Arendt. In her rejection of a political relevance of love, Arendt does not take into consideration the libidinal aspects of collective bonds, nor does she give an account of the passionate aspect of being together despite the crucial role of amor mundi in her work. Following Freud, I demonstrate that love and sublimation are fundamental to worldliness, central to our understanding (...) of forgiveness and the making of promises, all of which is pivotal to understanding Hannah Arendt's political thought. In Freud’s writing love and sublimation expand knowledge and creativity and enable community building. By negotiating between Arendt’s and Freud’s writings on love and politics, this article demonstrates that sublimated love mediates between the private and public spheres. The ultimate question I ask concerns the relation between love of the world and its negation by radical evil. (shrink)

The article examines how Salomon Maimon’s concept of number as ratio can be used to demonstrate that arithmetical judgments are analytical. Based on his critique of Kant’s synthetic a priori judgments, I show how this notion of number fulfills Maimon’s requirements for apodictic knowledge. Moreover, I suggest that Maimon was influenced by mathematicians who previously defined number as a ratio, such as Wallis and Newton. Following an analysis of the real definition of this concept, I conclude that within the framework (...) of Maimon’s philosophy, arithmetical judgments cannot be analytical, nor is arithmetic an objectively necessary science, but rather only subjectively necessary. We should also cast doubt on his claim that we can create real objects from pure concepts of the understanding. (shrink)

This article examines the sceptical dimension of Salomon Maimon’s theory of invention. It suggests the following: (i) Most of Maimon’s methods are intended to increase the degree of certainty that we can attribute to propositions, but not to achieve apodictic certainty. (ii) Maimon’s various forms of scepticism, for example, doubt and the antinomies, should be considered as belonging to a scale of doubt wherein degrees of certainty and probability can increase and decrease. (iii) His methods of invention offer various means (...) for increasing the degree of certainty, such as finding more connections to other propositions and analyzing whether a condition expressed in a proposition is true or whether it is only a pseudo-condition. (iv) The method of transforming problematic propositions into true propositions indicates that Maimon’s sceptical stance sometimes made way for rational dogmatic thought, since this transformation is in the opposite direction of what is usually advocated by sceptics. Prenatal screening pathways, as nowadays offered in most Western countries consist of similar tests. First, a risk-assessment test for major aneuploides is offered to pregnant women. In case of an increased risk, invasive diagnostic tests, entailing a miscarriage risk, are offered. For decades, only conventional karyotyping was used for final diagnosis. Moreover, several foetal ultrasound scans are offered to detect major congenital anomalies, but the same scans also provide relevant information for optimal support of the pregnancy and the delivery. Recent (...) developments in prenatal screening include the application of microarrays that allow for identifying a much broader range of abnomalities than karyotyping, and non-invasive prenatal testing that enables reducing the number of invasive tests for aneuploidies considerably. In the future, broad NIPT may become possible and affordable. This article will briefly address the ethical issues raised by these technological developments. First, a safe NIPT may lead to routinisation and as such challenge the central issue of informed consent and the aim of prenatal screening: to offer opportunity for autonomous reproductive choice. Widening the scope of prenatal screening also raises the question to what extent ‘reproductive autonomy’ is meant to expand. Finally, if the same test is used for two different aims, namely detection of foetal anomalies and pregnancy-related problems, non-directive counselling can no longer be taken as a standard. Our broad outline of the ethical issues is meant as an introduction into the more detailed ethical discussions about prenatal screening in the other articles of this special issue. (shrink)

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

Technoscience is increasingly present in our daily lives, establishing new social rules and patterns of communication and interaction in a physical space, which implements electronic devices and telematic systems in its design. In the race for scientific progress, the goal is making man a God, like Nietzsche’s Superman, without determining how the new human morphology will be fitted. This paradigm is treated by artists who warn of the possible fate of humanity while the technoscientific, as if he or she was (...) Prometheus, dares to defy the laws of nature. Art exposes the actual course of science, and some artists complain that the false promises of scientific discourse, which is dominated by male vision, fail to be aware of the impossibility that technology is going to improve the moral dimension of human being. Some artists say that the science sermon does not deal with humanity and that the building of our future is merely phallocentric, an excessive anthropocentric vision. (shrink)

The current human rights framework can shield people from many of the risks associated with neurotechnological applications. However, it has been argued that we need either to articulate new rights or reconceptualise existing ones in order to prevent some of these risks. In this paper, we would like to address the recent discussion about whether current reconceptualisations of the right to mental integrity identify an ethical dimension that is not covered by existing moral and/or legal rights. The main challenge of (...) these proposals is that they make mental integrity indistinguishable from autonomy. They define mental integrity in terms of the control we can have over our mental states, which seems to be part of the authenticity condition for autonomous action. Based on a fairly comprehensive notion of mental health (ie, a notion that is not limited to the mere absence of illness), we propose an alternative view according to which mental integrity can be characterised both as a positive right to (medical and non-medical) interventions that restore and sustain mental and neural function, and promote its development and a negative right protecting people from interventions that threaten or undermine these functions or their development. We will argue that this notion is dissociated from cognitive control and therefore can be adequately distinguished from autonomy. (shrink)

Mudanza (2010) es el primer libro de Verónica Gerber (1981), un libro donde la autora narra la migración que cinco artistas realizaron desde la literatura al arte. En este libro podemos encontrar una suerte de programa de los modos en que la autora ha pensado los traslados entre escritura y visualidad a lo largo de todo su trabajo. En Mudanza, los textos abren una zona de intervalo, de indeterminación, una suerte de tierra de nadie en el corazón de la palabra (...) y de la imagen, como si los escritores devenidos artistas sacrificaran los resultados de esa mudanza para poder explorar todo lo que acontece en ese traslado. Con esa misma ambigüedad escribe Gerber, componiendo textos a medio camino entre la literatura, el ensayo, la autobiografía, la escritura visual. Este artículo indaga en la pregunta por aquello que acontece cuando las imágenes y las palabras salen de sí mismas, perfilando lo que podríamos llamar una escritura figural que hace del intervalo el lugar de una potencia que trabaja en contra del estereotipo y el sentido unívoco. In recent years, different proposals articulate specific rights for the regulation of neurotechnology, also known as "neurorights". A central concern regarding neurotechnological applications is that of mental privacy. This is the idea that we should have control over access to our neural data and the information about our mental processes and states that can be obtained by analyzing them. After proposing a detailed conceptualization of mental privacy, I will argue that the protection of this right is relevant because it is (...) at the basis of two fundamental ethical and legal dimensions of persons, identity and autonomy. I claim that mental privacy is presupposed by the relational conception of identity, and that this connection allows us to identify some limitations of current data privacy regulations. I then argue that relational identity is presupposed by the notion of autonomy, and this connection highlights relational dimensions of this concept that are not adequately articulated in current relational theories of autonomous action. This implies that the protection of mental privacy is also necessary for the protection if this second ethical and legal dimension of persons. (shrink)

It is relevant to interpret the perception that students with disabilities, teachers, and managers have about an inclusive educational program, to identify and describe the facilitators and barriers during the training of those students; analyze the relevance of the inclusive program from the perceptions of the participating actors; and assess the program's supports from the perception of students with disabilities. This is a mixed investigation of sequential design and phenomenological approach carried out through surveys and in-depth interviews with the actors.

This volume presents a selection of papers from the Poincaré Project of the Center for the Philosophy of Science, University of Lisbon, bringing together an international group of scholars with new assessments of Henri Poincaré's philosophy of science-both its historical impact on the foundations of science and mathematics, and its relevance to contemporary philosophical inquiry. The work of Poincaré (1854-1912) extends over many fields within mathematics and mathematical physics. But his scientific work was inseparable from his groundbreaking philosophical reflections, and (...) the scientific ferment in which he participated was inseparable from the philosophical controversies in which he played a pre-eminent part. The subsequent history of the mathematical sciences was profoundly influenced by Poincaré's philosophical analyses of the relations between and among mathematics, logic, and physics, and, more generally, the relations between formal structures and the world of experience. The papers in this collection illuminate Poincaré's place within his own historical context as well as the implications of his work for ours. (shrink)

This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of convention (...) in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)
