Bu çalışmada, İslâm hukukunun ibadetler bölümü içerisinde konu edinen, fukaha tarafından yer yer müstakil başlık altında incelenen istihâre namazına ilişkin ileri sürülen bazı hükümler nitel araştırma ve istidlâl yöntemleri kullanılarak ele alınmıştır. İstihâre namazı hakkında varit olan birtakım rivâyetlerde Hz. Peygamber’in –kendisi kılmamasına rağmen- sahâbîlere söz konusu namazı tavsiye ettiği görülmüştür. Binaenaleyh istihâre namazının meşruiyeti, şer‘î deliller içerisinde sünnete dayanmaktadır. Meşrûiyeti hususunda herhangi bir hilaf söz konusu olmamasına rağmen istihâre namazına dair rivâyet edilen birtakım nasların senedinin tenkite tabi tutulduğu, ilgili (...) naslarda yer alan bazı kavramların da te’vile açık olduğu tespit edilmiştir. Bu ve benzeri hususlar, istihâre namazının hükmü yanında istihâre namazının rekât sayısı, istihâre duasının nerede okunacağı, hangi işler hakkında uygulanabilir olduğu, namaz kılınması mekruh sayılan vakitlerde kılınıp kılınamayacağı gibi bazı fıkhî meselelerin ortaya çıkmasına yol açmıştır. Bu durum ise, doktrin içerisinde kayda değer muhtelif görüş ve fikirlerin tezahür etmesine sebebiyet vermiştir. Dolayısıyla ele alınan bu çalışmada müctehidlerin istihâre namazı ve buna taalluk eden bazı fıkhî meselelere dair ileri sürdükleri görüşler, olabildiğince delilleriyle birlikte sunulmuş; meselelere ilişkin serdedilen rivâyetler cerh ve ta‘dîl açısından tahlil edilerek mezkûr konular bir bütünlük içerisinde incelenmeye çalışılmıştır. There is a sizeable group of self-described Christian companies which have declared their belief in the successful merging of biblical principles with business activities. As these companies have become more visible, an increasing number of anecdotal newspaper and magazine articles about these companies have appeared. Surprisingly, no rigorous research has been conducted prior to our recent study. This article provides national estimates of the size and predominant characteristics of self-identified Christian companies. Mitochondrial replacement technology (MRT) is an emerging and complex bioethical issue. This treatment aims to eliminate maternal inherited mitochondrial DNA (mtDNA) disorders. For Muslims, its introduction affects every aspect of human life, especially the five essential interests of human beings—namely, religion, life, lineage, intellect, and property. Thus, this technology must be assessed using a comprehensive and holistic approach addressing these human essential interests. Consequently, this article analyses and assesses tri-parent baby technology from the perspective of Maqasidic bioethics—that is, Islamic bioethics (...) based on the framework of Maqasid al-Shariah. Using this analysis, this article suggests that tri-parent baby technology should not be permitted for Muslims due to the existence of third-party cell gametes which lead to lineage mixing and due to the uncertain safety of the therapy itself and because the major aim of the technology is to fulfil the affected couples interest to conceive their own genetically healthy child, not to treat and cure mtDNA disorders sufferers. In this paper an Artificial Neural Network (ANN) model, for predicting the category of a tumor was developed and tested. Taking patients’ tests, a number of information gained that influence the classification of the tumor. Such information as age, sex, histologic-type, degree-of-diffe, status of bone, bone-marrow, lung, pleura, peritoneum, liver, brain, skin, neck, supraclavicular, axillar, mediastinum, and abdominal. They were used as input variables for the ANN model. A model based on the Multilayer Perceptron Topology was established and trained using (...) data set which its title is “primary tumor” and was obtained from the University Medical Centre, Institute of Oncology, Ljubljana, Yugoslavia Test data evaluation shows that the ANN model is able to correctly predict the tumor category with 76.67 % accuracy. The thesis examines the origins and function of legal theory within the context of the development of early Islamic law. I argue against the depiction of the development of law as a series of compromises between traditionalism and rationalism. Rather, by evading the demands of traditionalism, law evolved into a complex doctrinal entity rooted in the social structures of third-century Abbasid society. This revision of the development of law provides a context to evaluate early works of legal theory. Background In the dynamic landscape of healthcare, nurses play a crucial role as ethical stewards, responsible for whistleblowing, nurse advocacy, and patient safety. Their duties involve ensuring patient well-being through ethical practices and advocacy initiatives. Aim This study investigates the ethical responsibilities of nurses regarding whistleblowing and advocacy in reporting concerns about patient safety. Research Design A cross-sectional study utilized cluster and simple random sampling to gather a representative sample of actively practicing registered nurses. Data collection involved a demographic form, (...) Nurse Whistleblowing Intentions Scale, Nursing Advocacy Scale, and Clinical Decision-Making Scale. Participants and Research Context The study utilizing a robust sample size determination formula for reliable findings included 96 diverse nurses, predominantly females. Engaged actively in direct patient care across various outpatients clinics. The recruitment process specifically sought individuals with expertise in safety protocols and reporting, contributing to a nuanced understanding of the study’s focus. Ethical Considerations Ethical approval was obtained from the ethics committee of the university and the hospitals involved. Written consent was obtained from the participants. A thorough ethical review was conducted to guarantee participant protection and adherence to ethical principles. Results Surveyed nurses demonstrated positive whistleblowing (Overall Mean Score: 3.58), high advocacy (Overall Mean Score: 12.2), and nuanced ethical decision-making for patient safety (Overall Mean Score: 15.78). Demographic factors, such as nationality and ethical training, significantly impacted whistleblowing intentions, while age, gender, and ethical training correlated with nursing advocacy behavior. Associations with experience and qualification emerged in ethical decision-making. Conclusion The gained insights foster targeted interventions, improving ethical practices, advocacy, and informed decision-making in nursing. This study explores the intricate link between demographics and ethical considerations among surveyed nurses, acting as a catalyst for ongoing initiatives to strengthen the ethical foundation in healthcare sector. This study investigates the effectiveness of experiential learning strategies in enhancing science subject competence among fifth-grade elementary students in Anbar Governorate, where traditional teaching methods dominate. Prior research indicates a lack of engagement and critical thinking among students, emphasizing the need for pedagogical approaches that promote active learning and real-world experiences. Employing a descriptive and experimental design, this research included two groups: an experimental group receiving instruction through experiential learning and a control group taught via traditional methods. The sample consisted (...) of 65 fifth-grade students from Al-Mu'min Primary School, chosen to ensure representativeness. Pre-experimental assessments ensured equivalence in variables such as age, intelligence, and previous academic achievement. The study's impact was evaluated using a post-test composed of 40 multiple-choice questions aligned with the science curriculum. Statistical analysis revealed a significant difference in mean achievement test scores between the groups, with the experimental group achieving a higher average score of 29.90 compared to the control group's 22.55. The calculated t-value was 10.11, surpassing the critical t-value of 2.00 at the 0.05 significance level, indicating strong evidence for the effectiveness of experiential learning strategies. Furthermore, the effect size measured using eta squared (η² = 0.63) confirmed a large impact on student achievement. The findings signify that experiential learning strategies substantially enhance science subject competence among elementary students, fostering greater engagement and understanding of scientific concepts. These results advocate for the integration of experiential learning methodologies in science education, reflecting a shift away from traditional teaching practices to more effective, student-centered approaches that promote critical thinking and real-world application of knowledge. This book is the culmination of over twenty years of work toward a pedagogical theory that promotes experiential learning of model-laden theory and inquiry in science.

Employing manifold symbolic, iconic, and indexical signs – whether linguistic or extralinguistic – along with their polysemic and multimodular features, edusemiotics is an integrative and interdisciplinary conceptual framework that surmounts learning processes where learners find significance and meaning under the assumed responsibility of English language teachers for the provision of such a participative environment. Allowing for the salience of intonation despite its intricate nature, thus its inevitable underrepresentation in course books and teaching practices, this article intends to propose a novel (...) means of intonation instruction as well as its components (i.e., stress, pitch, and juncture) for English language teacher education (henceforth ELTE) contexts within the edusemiotic framework. Promoting the importance of edusemiotic teaching of intonation, this article further aims to add to our understanding of how signs and sign systems can be benefitted in ELTE settings and their potential exploitation across various other disciplines. It concludes with suggestions for future research on more practical aspects of edusemiotic tools and learner and teacher attitudes toward integrating them within the teaching program. (shrink)

Governance of biomedical research in the United States has been characterized by ethical individualism, a mode of reasoning that treats the individual person as the center of moral concern and analysis. However, genomics research raises ethics issues that uniquely affect certain genetically related communities as collectives, not merely as aggregates of individuals. This is especially true of identifiable populations—including Indigenous Peoples—that are often minoritized, socially marginalized, or geographically isolated. We propose an alternative, complementary framework based on the United Nations Declaration (...) on the Rights of Indigenous Peoples (UNDRIP) (2007), which explicitly recognizes both individual and collective rights. We use the CARE Principles for Indigenous Data Governance as a case study to show how this UNDRIP‐based framework can complement the individual‐focused national standard for research oversight represented by the Belmont principles, thereby better protecting Indigenous Peoples’ rights and interests in genomic data. The ability to bear witness to human trauma and devastation through technologies in the new media age endorses suffering as a form of mass spectacle which can negotiate distance between an exterior world as well as the unfamiliar and the unknown. Our engagements with these forms of mediated suffering in postmodernity can be public and complex and conditioned by both media power and our ability to domesticate suffering in the private confines of our homes. This article reviews the domestication of (...) suffering historically in mainstream media. It contends that mediated suffering has become an entrenched ritual in the media landscape and is a multi-faceted device which can be functionalist and therapeutic yet too pervasive to be rendered meaningful in people’s everyday lives. ABSTRACT An ethical analysis of Jordan's Clinical Research Law, which became effective in 2001, was performed. Accordingly, this paper discusses the major components, key strengths and weaknesses of this law. As an initial effort, the Law addresses important aspects of research ethics and, hence, should serve as an example for other Arab Countries in the Middle East. Unique aspects of the Law include the requirement that those conducting any study have insurance that can compensate for research injuries and a system (...) of fines and punishments for noncompliance with the Law. There are, however, some key items missing in the Jordanian Law. For example, the Law does not mention the requirement of a favourable assessment of risks and benefits, the fair selection of subjects, or articles regarding the protection of the rights and welfare of children and other vulnerable subjects participating in research. The paper concludes with the suggestion that new amendments should be considered for future revisions of the Clinical Research Law in Jordan. (shrink)

Rapid development in the area of assisted reproductive technology, has benefited mankind by addressing reproductive problems. However, the emergence of new technologies and techniques raises various issues and discussions among physicians and the masses, especially on issues related to bioethics. Apart from solutions provided using conventional bioethics framework, solutions can also be derived via a complementary framework of bioethics based on the Higher Objectives of the Divine Law in tackling these problems. In the study of _Lawāmiʿ al-Naẓar_, Ibrahim Safri presents a history of rational sciences in the Maghribī tradition in the seventeenth and eighteenth century. He also presents a critical edition of the work, which can be considered as an introduction to post-Avicennian studies in North Africa.

This article extends previous research by investigating the basis for attitudes toward codes of ethics. Specifically, its purposes are threefold. First, to examine business managers' attitudes toward codes of ethics. Second, to ascertain whether gender differences do exist with respect to these attitudes. Third, to provide a benchmark for future studies of attitudes toward codes of ethics. A survey of 286 managers revealed significant differences between the female and male managers with respect to six of the eight variables studied.

İbn Sînâ sonrası İslam felsefe geleneğini meşgul eden en canlı tartışmalardan biri mahiyetlerin dışta nasıl bulunduğu ve onlara dair tümel bilgimiz ile haricî varlık arasındaki mutabakat ilişkisinin nasıl kurulacağıyla ilgilidir. Özellikle Fahreddin er-Râzî’nin İbn Sînâcı zihnî temsil anlayışına yönelttiği ve akıldaki suretlerin dıştaki mücerred tabiatları yansıtmadığını öne süren eleştiri neticesinde, temsil teorisini sürdürmeyi amaçlayan düşünürler İbn Sînâ’nın metafiziksel gerçekçiliğinden uzaklaşan yeni bir tutum geliştirmişlerdir. Bu tutum etrafında onlar tikel cevherlerin duyulur yüzü altında, duyulur olmayan ve aynı türe ait tikel cevherlerin (...) tümünde ortak olan bir tabiatın mevcut olduğu anlayışını terk ederek dış varlıkta yalnızca tikel cevherlerin bulunduğunu savunmaya başlamışlardır. İbn Sînâ’nın dışta tikellerin parçası olarak mevcut olduğunu söylediği doğal tümelin haricî varlığını reddetme anlamına gelen bu yaklaşıma ilaveten onlar, tümel tabiatların dışta değil yalnızca zihinde bulunduğunu öne sürmüştür. Tümel tabiatların zihinde ortaya çıkışını tikeller ve onların duyulur özellikleri arasındaki bir mukayese ertesinde meydana gelen aklî suret üzerindeki zihinsel işlemlerle açıklayan bu tutum, zihin ve dış arasındaki mutabakatı da aklî suret ile hariçteki suret arasındaki mutabakat ilişkisinden çıkartarak yeni bir yoruma tâbi tutmuştur. Tabiatların haricî varlığını reddederek İbn Sînâ’nın metafiziksel gerçekliğinin ontolojik yönünü, tabiat denildiğinde aslında tikellerin kastedildiğini öne sürerek semantik yönünü, bildiğimiz şeylerin dıştaki bu tabiat değil tikeller arasındaki ortak özellikler olduğunu ve tümel tabiatların yalnızca zihinde bulunduğunu savunarak da epistemolojik yönünü budayan bu yeni tutum, metafizik gerçekçiliğin hârice bakan kısmını zayıflatıp zihne bakan kısmını güçlendirdiği için zihinselci eğilim olarak adlandırılmıştır. Bu makalede Nasîruddin et-Tûsî ile başlayıp Kutbüddin er-Râzî ile zirvesine çıkan zihinselci eğilimin on beşinci yüzyılda Ali Kuşçu tarafından nasıl sürdürüldüğü gösterilecek, söz konusu eğilimin bir İbn Sînâ yorumu olmaktan uzaklaşarak nasıl bağımsız yeni bir felsefî tutuma evrildiği tartışılacaktır. In the history of Islamic philosophy, one period that attracts researchers' attention, particularly in recent times, is the Safavid era. This is because the Safavid period witnessed a resurgence in philosophical thought within Islamic tradition after a period of stagnation following the classical stage that lasted several centuries. Until the middle of the last century, Western scholars, and before them orientalists, often viewed Islamic philosophy as having concluded after Ibn Rushd, due to Ghazali’s refutations. However, intellectual activities during the Safavid (...) era proved these assumptions incorrect. During the Safavid period, particularly after Shah Abbas I ascended to power and fostered a conducive environment, figures like Mir Damad and Sheikh Bahai, who enjoyed the Shah's patronage, sought to advance their intellectual perspectives. The philosophical milieu they cultivated in the Safavid capital, Isfahan, is now recognized as the Isfahan School of Philosophy. This school, characterized by its syncretic nature, endeavored to reconcile various strands of classical Islamic thought. Sadraddin Shirazi, the most renowned figure of the Isfahan School of Philosophy, succeeded in achieving this aim through his philosophical endeavors. Sadraddin Shirazi synthesized various methods of knowledge acquisition available in Islamic philosophy -whether religious, philosophical, or gnostic-and attempted to demonstrate that apparent contradictions among them were not inherent. This paper explores the scientific and philosophical environment of the Safavid period, focusing on the emergence of the Isfahan School of Philosophy and its foremost representative, Sadraddin Shirazi. This study examines the impact of corporate governance on the financial performance of Asia Pacific stocks in three Asian countries: Malaysia, Thailand and Singapore. By including a sample of 159 firms listed on three Asian stock markets from 2013 to 2017, this study found that the effects of corporate governance mechanisms vary significantly among the three Asian markets. Specifically, this study shows that board size has positively influenced listed firms' financial performance in the Singapore Exchange. However, our findings show that (...) board size has negatively affected listed firms' financial performance in Thailand's Stock Exchange. In addition, our results reveal that board independence has negatively influenced listed firms' financial performance in Bursa Malaysia. Finally, this study provides implications for regulatory authorities in the Asian stock markets to separate between chairman and CEO roles since most Asian firms are owned and directed by business families. Intersecting authority-language-and-symbolic power, this article tells the story of a group of continental Francophone African youth who find themselves in an urban French-language high school in southwestern Ontario, Canada. Through their narrative, one is confronted by the trauma of one's own language being declared an illegitimate child, hence becoming a ‘deceptive fluency’ in the ‘eyes of power’ thanks to race and post-coloniality. They are fully consciousness of this situation and their ‘linguistic return’, thus gazing back at the eyes of power (...) and declaring themselves ‘subjects’ capable of love and desire. I briefly address questions of hospitality and language ownership and conclude by addressing the need to re-think the connection between race, power and language. (shrink)

In the ancient civilizations, the sky has been observed in order to understand the motions of the celestial bodies above the horizon. The study of faiths and practices dealing with the sky in the past has been attributed to the sun, the moon, and the prominent stars. The alignment and orientation of constructions to significant celestial objects were a common practice. The orientation was an important component of the religious structure design. Religious buildings often have an intentional orientation to fix (...) the praying direction. In Islam, a sacred direction towards Kaaba located in the courtyard in the Sacred Mosque in Mecca has been used for praying and fulfilling varied ritual tasks. Therefore, the mosques had then to orientate towards the Qibla direction, being designated by a focal niche in the Qibla-wall, wherever they were built on Earth. In this study, the orientations of the historical Grand mosques in Turkey are surveyed with regard to the folk astronomy derived from pre-Islamic Arabian sources, early traditions of the Islamic period, and geometric-trigonometric computation in mathematical astronomy inherited and developed mostly from Greek sources according to the Islamic view of the World geography. This paper examines public accountants' perceptions of the relative importance of business ethics as a selection criterion for entry-level public accounting positions. Also, it seeks to determine whether gender differences do exist with respect to these perceptions. The data were collected through a survey of 335 professional accountants in four southeastern states. The results show that, among the eight selection factors that were studied, technical competence in accounting, communication skills, and interpersonal skills were the most influential, while professionalism and leadership (...) abilities were the least important. Ethics was ranked fourth by the females and sixth by the males. A multivariate analysis of variance revealed significant differences between the genders with respect to five of the eight factors. The females' scores were higher for ethics and interpersonal skills and lower for conceptual aptitude, strategic thinking, and leadership abilities. Implications for accounting educators and practitioners are discussed. (shrink)

Maqasid al-Shariah based Islamic bioethics is an Islamic bioethics concept which uses the objectives of the Shariah as its approach in analysing and assessing bioethical issues. Analysis based on maqasid al-Shariah based Islamic bioethics will examine any bioethical issues from three main aspects namely intention, method, and output or final goal of the studied issues. Then, the evaluation will be analysed from human interest hierarchy, inclusivity, and degree of certainty. The Islamic bioethics concept is a manifestation of dynamic Islamic jurisprudence (...) which can overcome new complex and complicated bioethical issues such as tri-parent baby technology issues. Therefore, this article will introduce and explain the concept of maqasid al-Shariah based Islamic bioethics and outline a general guidance of maqasid al-Shariah based Islamic bioethics to determine a maqṣad based on standards of human good or well-being and harm. The Qur'an depicts fluctuating relations between Muslims and non-Muslims. While at times such relations can be conciliatory and harmonious, at others they are inimical, uneasy, or distant. Still, the Qur'an acknowledges the necessary ontological reality of the human difference. This is evidenced in many verses. Thus, I will argue that an “attentive” and “worldly” reading of the Qur'an is crucial to curb misunderstanding of the way ‘difference’ is perceived in Islam by Muslims and non-Muslims alike. A close reading is primarily (...) a multiple form of communication. It is needed to resist the networked systems of power and control dominated by images and mass media in the Arab world and Western. It is exceptionally important to free the interpretation of Qur'an from the grip of Muslim and non-Muslim extremists and Islamophobes who read some of its verses as evidence of essentialized enmity harbored by Muslims towards all non-Muslims. This article, using methods from corpus linguistics and critical discourse analysis, reports the findings of a research project that aimed to explore the representations of Syrian asylum seekers in the Turkish press from March 2011, when the first Syrians arrived in Turkey, to December 2015, when the project ended. Using a corpus of 2321 texts collected from five Turkish daily newspapers, concordances of the words Syrian, refugee and asylum seeker were examined and grouped along patterns through which discourses on and (...) around Syrian asylum seekers were uncovered. We found differing discourses that framed asylum seekers as ‘our brothers’, ‘victims’, ‘needy people’ and/or ‘threat’, ‘criminals’ and so on. Newspapers maintained one or a combination of these discourses to construct their own reality about the refugee crisis in Turkey. The analysis also reveals that Turkish newspapers use pertinent terms interchangeably, leading to an ambiguity which reflects the political as well as daily usage of the terms. (shrink)

This study explores the history of the Hagia Sophia Mosque and its religious music forms, with a particular focus on how these forms are applied in the newly reopened Hagia Sophia. All genres performed here are executed by imams and muezzins who are highly skilled in their fields, making it a model for both contemporary performers and future generations. The study examines the types of mosque music performed during the five daily prayers, Fridays, holy days, and religious holidays in Hagia (...) Sophia, which has functioned as a mosque since 2020.Analysis reveals that some of these forms are unique to Hagia Sophia in terms of both structure and execution, underscoring the importance of bringing them to light. To this end, extensive research, observation, recording, and notation processes were carried out to document these unique styles. The article provides detailed insights into the maqam (musical mode) dimensions, performance styles, timing, and duration of various mosque music forms, including Qur’ān Tilāwah, Adhān, Ṣalā/Ṣalawāt, Iqāmah, Ilāhī, Mawlid, Miʿrācīyah, Qaṣīdah, Istighfār, Tasbīḥ, and others. The distinct and improvised characteristics of certain forms are also discussed. Furthermore, specific to the Hagia Sophia Mosque, the article includes the notations of the Tasbīḥāt recited at the mihrab after the Fajr prayer on Fridays, Saturdays, and Sundays, as well as the notations of various Istighfār recited in different maqams collectively by the muezzins after each obligatory prayer. The menace of conflicts and natural disasters in different states of the world had spiralled into a global phenomenon of Internally Displaced Persons. These are groups of humans who had helplessly drifted away from their natural and ancestral home due to conflicts and disasters but had not crossed international boundaries into another country. They merely take solace by the protection offered by the spirit and letters of relevant international laws which have domesticated by member states. This paper seeks to answer (...) the question regarding the extent to which the IDPs have become a menace in Nigeria. The paper reveals that many governments’ actions are the primary and the root cause of the IDPs while others are recipient of the domino effect. The paper relies on a panel data elicited from thirteen out of the thirty six states in Nigeria. The paper reveals the need for urgent measures by government to douse the upsurge in the number of IDPs. The political settlement analysis was used to proffer a better way of culminating the crises. Recommendations are directed to the individuals, civil societies and the government at all levels. (shrink)
