Using Shahzad Bashir’s open-access publication A New Vision for Islamic Pasts and Futures as a baseline, this symposium debates whether and how intellectual history can be done otherwise. Mohamed ‘Arafa follows Bashir’s invitation to explore the potential of open-ended historiographies when he thinks about the viability of a flexible method to interpret Sharī ʿ a. Nader El-Bizri interrogates whether the assemblage of personal experiential accounts offered by Bashir can be framed within the discourse of intellectual history at all. Nauman (...) Faizi reads Bashir’s approach as a radical attempt to open up hermeneutical possibilities. Lena Salaymeh suggests that modern aesthetics can contribute to neo-colonial distortions of the Islamic tradition, rather than offering alternatives to positivist historiography. Bashir proposes in his response that academics adopt generosity as an analytical gesture in their academic writing, a generosity that would enable different ways of being human in the world. Tri-parent baby technology is an assisted reproductive treatment which aims to minimize or eliminate maternal inheritance of mutated mitochondrial DNA. The technology became popular following the move by the United Kingdom in granting license to a group of researchers from the Newcastle Fertility Centre, Newcastle University to conduct research on the symptoms of defective mtDNA. This technology differs from other assisted reproductive technology because it involves the use of gamete components retrieved from three different individuals. Indirectly, it affects the preservation (...) of lineage which is important from an Islamic point of view. This paper aims to analyze and discuss the implications of the tri-parent technology on preservation of lineage from the perspective of Maqasid al-Shari’ah based the Islamic bioethics. The analysis shows that there are a few violations of the preservation of lineage, hence the tri-parent baby technology should not be permitted. (shrink)

Governance of biomedical research in the United States has been characterized by ethical individualism, a mode of reasoning that treats the individual person as the center of moral concern and analysis. However, genomics research raises ethics issues that uniquely affect certain genetically related communities as collectives, not merely as aggregates of individuals. This is especially true of identifiable populations—including Indigenous Peoples—that are often minoritized, socially marginalized, or geographically isolated. We propose an alternative, complementary framework based on the United Nations Declaration (...) on the Rights of Indigenous Peoples (UNDRIP) (2007), which explicitly recognizes both individual and collective rights. We use the CARE Principles for Indigenous Data Governance as a case study to show how this UNDRIP‐based framework can complement the individual‐focused national standard for research oversight represented by the Belmont principles, thereby better protecting Indigenous Peoples’ rights and interests in genomic data. In this paper an Artificial Neural Network (ANN) model, for predicting the category of a tumor was developed and tested. Taking patients’ tests, a number of information gained that influence the classification of the tumor. Such information as age, sex, histologic-type, degree-of-diffe, status of bone, bone-marrow, lung, pleura, peritoneum, liver, brain, skin, neck, supraclavicular, axillar, mediastinum, and abdominal. They were used as input variables for the ANN model. A model based on the Multilayer Perceptron Topology was established and trained using (...) data set which its title is “primary tumor” and was obtained from the University Medical Centre, Institute of Oncology, Ljubljana, Yugoslavia Test data evaluation shows that the ANN model is able to correctly predict the tumor category with 76.67 % accuracy. This article, using methods from corpus linguistics and critical discourse analysis, reports the findings of a research project that aimed to explore the representations of Syrian asylum seekers in the Turkish press from March 2011, when the first Syrians arrived in Turkey, to December 2015, when the project ended. Using a corpus of 2321 texts collected from five Turkish daily newspapers, concordances of the words Syrian, refugee and asylum seeker were examined and grouped along patterns through which discourses on and (...) around Syrian asylum seekers were uncovered. We found differing discourses that framed asylum seekers as ‘our brothers’, ‘victims’, ‘needy people’ and/or ‘threat’, ‘criminals’ and so on. Newspapers maintained one or a combination of these discourses to construct their own reality about the refugee crisis in Turkey. The analysis also reveals that Turkish newspapers use pertinent terms interchangeably, leading to an ambiguity which reflects the political as well as daily usage of the terms. (shrink)

One of William Lane Craig's key arguments for the finitude of the past is the Successive Addition Argument (SAA). Malpass (2021) has recently developed a novel challenge to the SAA, utilising a thought experiment from the work of Fred Dretske, which is meant to show that it is possible to count to infinity, to argue that there is a counterexample to the SAA's second premise. In this paper, I contend that the Malpass‐Dretske counterexample should not worry advocates of the SAA. (...) First, I argue that one objection Malpass considers—the Potential Infinite Objection—reveals an interesting fact: the SAA's second premise is unnecessarily strong and can be weakened whilst still yielding the same conclusion. Second, I show how another one of the objections considered by Malpass—the Accumulation Objection—is successful, provided some clarification to the SAA's premises. The upshot of both analyses is that we generate two ‘new’ Successive Addition arguments that not only move the dialectic forward, but shed light on deeper assumptions and motivating intuitions concerning the Kalām. Şâfiî müctehidlerin muteber şahsiyetlerinden biri olan Râfiî el-Kazvînî, ilk olarak babası Muhammed b. Abdilkerîm el-Kazvînî (ö. 580/1184) ve annesinin dayısı Ebü’l-Hayr Ahmed et-Tâlkânî’nin (ö. 589/1193) rahle-i tedrisinde bulunduktan sonra alanında uzman birçok kişiden tefsir, hadis ve fıkıh sahasına ilişkin seviyeli bir eğitim almıştır. Yaşadığı asrın ileri gelen ulemasından İslâmî ilimleri okuyarak fıkıh ilminde ihtisas sahibi olan Râfiî, Kazvîn’de ders halkaları oluşturarak tedris faaliyetinde bulunmuş; dönemin halifeleri tarafından Şam ve Mısır baş kadılık görevine atanan Ahmed b. Halîl el-Mühellebî (ö. 638/1240), Zekiyyüddin (...) el-Münzirî (656/1258) ve İbn Sükkerî (ö.713/1313) gibi önemli simalar yetiştirmiştir. Zekâsı, aklı ve özellikle haiz olduğu fıkhî meseleleri ayırt etme yetisiyle Râfiî, doktrin içerisinde yer alan dağınık görüşleri toplayarak ilgili görüşlerden hangisinin daha kuvvetli olabileceğine dair tespitlerde bulunup mezhebi tahrîr/tenkîh etmiş, bir bakıma mezhebin görüşlerini ilmî elekten geçirip ayıklamıştır. Mezhep içerisindeki görüşleri inceleyerek farklı tarikleri birleştirme ve dağınık bilgileri ayıklayıp mezhep birikimini veciz ifadelerle yansıtma faaliyetinden dolayı ulemanın dikkatini üzerine çeken Râfiî, mezhepte iki otoriteden biri anlamına gelen Şeyhân’dan biri olma -diğeri ise Nevevî (ö. 676/1277)- unvanına layık görülmüştür. Bu yüzden onun hayatına ve ilmî kişiliğine Şâfiî terâcim eserlerinde oldukça yer verilmiştir. Rapid developments in science and technology have resulted in novel discoveries, leading to new questions particularly related to human values and ethics. Every discovery and technology has positive and negative implications and affects human lives either directly or indirectly, involving all walks of life. Bioethical discourse in Malaysia must consider the multiracial and multireligious background of Malaysia and especially the Islamic view as the majority of Malaysians are Muslims and Islam is the religion of the federation. This article discusses several (...) selected bioethical issues in Malaysia by studying the application of maṣlaḥah (the public good) and mafsadah (evil and harms) in Malaysian Islamic rulings (fatwas). This article uses the critical interpretation approach, as this is an ethical, interpretive, textual, and contextual analysis. In a situation when there is a conflict between maṣlaḥah and avoidance of mafsadah, it is preferred to attempt to address both needs. However, if maṣlaḥah and avoidance of mafsadah are mutually exclusive, the decision to choose must be made by weighing (tarjīḥ) and choosing the one which is superior. The maṣlaḥah and mafsadah concepts play vital and significant roles in bioethical discourse to realize human essential interests, namely faith, life, lineage, intellect, and property, thus achieving maqāṣid al-sharīʿah (the ultimate goal of sharia). This concept helps in guiding bioethical discussions, especially in determining the priority between achieving benefits and avoiding harms. The application of this concept will also assist Malaysian authorities in formulating appropriate rulings, especially bioethical issues related to Malaysian Muslims’ lives. (shrink)

Bu çalışmada, İslâm hukukunun ibadetler bölümü içerisinde konu edinen, fukaha tarafından yer yer müstakil başlık altında incelenen istihâre namazına ilişkin ileri sürülen bazı hükümler nitel araştırma ve istidlâl yöntemleri kullanılarak ele alınmıştır. İstihâre namazı hakkında varit olan birtakım rivâyetlerde Hz. Peygamber’in –kendisi kılmamasına rağmen- sahâbîlere söz konusu namazı tavsiye ettiği görülmüştür. Binaenaleyh istihâre namazının meşruiyeti, şer‘î deliller içerisinde sünnete dayanmaktadır. Meşrûiyeti hususunda herhangi bir hilaf söz konusu olmamasına rağmen istihâre namazına dair rivâyet edilen birtakım nasların senedinin tenkite tabi tutulduğu, ilgili (...) naslarda yer alan bazı kavramların da te’vile açık olduğu tespit edilmiştir. Bu ve benzeri hususlar, istihâre namazının hükmü yanında istihâre namazının rekât sayısı, istihâre duasının nerede okunacağı, hangi işler hakkında uygulanabilir olduğu, namaz kılınması mekruh sayılan vakitlerde kılınıp kılınamayacağı gibi bazı fıkhî meselelerin ortaya çıkmasına yol açmıştır. Bu durum ise, doktrin içerisinde kayda değer muhtelif görüş ve fikirlerin tezahür etmesine sebebiyet vermiştir. Dolayısıyla ele alınan bu çalışmada müctehidlerin istihâre namazı ve buna taalluk eden bazı fıkhî meselelere dair ileri sürdükleri görüşler, olabildiğince delilleriyle birlikte sunulmuş; meselelere ilişkin serdedilen rivâyetler cerh ve ta‘dîl açısından tahlil edilerek mezkûr konular bir bütünlük içerisinde incelenmeye çalışılmıştır. How do the flexibilized scenes of cruel optimism crystallize and resonate with the situational displays of crises as a governmental oversight? Centering around this question, the paper aims to offer a critical fulcrum for problematic attachments toward future-mediated fantasies in the aftermath of the Kahramanmaras earthquakes. It starts with evaluating how the pastoral mode was applied as a cruel diagram of positivity by the Turkish government through the omnipresent prowess of the media, which presents an ‘ordinaryizing’ affect in regularizing the (...) fatalistic discourses and relief efforts. It then continues to analyze the retributive discourses by the politicians and officials that triggered the oscillatory porosity among varied (de)subjectivities, toggling between sovereign misrecognitions and exclusions, as well as spiritually vivifying the optimistic barriers of cruelty. Lastly, it discusses in what ways the hopeful projections reconciled with the preemption by the dominant scientific narratives paradoxically prolong the preexistence of uncertainty and trust. The purpose of this paper is to determine whether there is a relationship between a person's degree of religiousness and corporate social responsibility orientation. A total of 411 managers and 506 students from seven universities were surveyed. The statistical analysis showed that religiousness does influence students' orientation toward the economic, ethical, and philanthropic responsibilities of business. It does not, however, have a significant impact upon the managers' attitudes. When the "low religiousness" students and managers were compared, differences were found with (...) respect to the economic, ethical, and philanthropic components of corporate social responsibility. Similar results were obtained when the "high religiousness" students and managers were compared. The implications of these findings are discussed. (shrink)

This article extends previous research by investigating the basis for attitudes toward codes of ethics. Specifically, its purposes are threefold. First, to examine business managers' attitudes toward codes of ethics. Second, to ascertain whether gender differences do exist with respect to these attitudes. Third, to provide a benchmark for future studies of attitudes toward codes of ethics. A survey of 286 managers revealed significant differences between the female and male managers with respect to six of the eight variables studied.

ABSTRACT An ethical analysis of Jordan's Clinical Research Law, which became effective in 2001, was performed. Accordingly, this paper discusses the major components, key strengths and weaknesses of this law. As an initial effort, the Law addresses important aspects of research ethics and, hence, should serve as an example for other Arab Countries in the Middle East. Unique aspects of the Law include the requirement that those conducting any study have insurance that can compensate for research injuries and a system (...) of fines and punishments for noncompliance with the Law. There are, however, some key items missing in the Jordanian Law. For example, the Law does not mention the requirement of a favourable assessment of risks and benefits, the fair selection of subjects, or articles regarding the protection of the rights and welfare of children and other vulnerable subjects participating in research. The paper concludes with the suggestion that new amendments should be considered for future revisions of the Clinical Research Law in Jordan. (shrink)

This paper is an evaluation and expansion of William Hasker’s transcendental argument against determinism. Hasker’s argument attempts to show that determinism is logically incompatible with rationality and justified belief. Hasker claims this argument to be conclusive given two independent qualifications: first that the argument only applies to a specific form of determinism, and second that the argument rests on a specific conception of rationality. My aim in this paper will be to modify and expand Hasker’s argument such that it (1) (...) applies to the more general deterministic thesis (as defined below), and (2), rests on a modified epistemic conception of rationally unaffirmable beliefs. I will attempt to do (2) by modeling Hasker’s argument after one of Alvin Plantinga’s epistemological arguments against naturalism, and hope to show that such an argumentative model is superior for the conclusion Hasker wishes to bring out. I will begin by explicating Hasker’s argument, and then I will move to the modification and expansion of the argument. (shrink)

Often, semantic accounts of ethical statements wherein those statements have their truth-conditions linked in some capacity to the mental state of an agent face the difficulty of explaining how it is that moral agents and communities genuinely disagree. However, there are––I shall argue––such semantic theories of ethical statements we can construct that avoid this explanatory deficit, insofar as they are both absolute and dispositional theories. In this paper, I will (i) explore and analyze one such semantic theory, Roderick Firth (1952)’s (...) ‘ideal observer theory’, and its relation to the problem of genuine moral disagreement, and (ii) argue that the theory successfully accounts for genuine moral disagreement in virtue of its being absolute and dispositional. Bu çalışmada Herakleitos’un DK1 numaralı fragmanı ve filozofun felsefesinin temel kavramı olan logos terimi üzerinde inceleme yapılmıştır. Çalışmada ayrıca Herakleitos’un fragmanda kul-landığı sözcükler, kurduğu cümleler ve kullandığı üsluptan hareketle filozof olmasının yanı sıra aynı zamanda bir kâhin ya da peygamber olarak da nitelendirilebileceği iddia edilmiştir. Buna göre bu çalışma şu hususların ele alınmasından oluşmaktadır: DK1 numaralı fragmanın üç başlık altında incelenmesi suretiyle Herakleitos düşüncesinin merkezini oluşturan logos terimini anla-mak amaçlanmıştır. Logos terimini anlama noktasında sözcüğün sözlükteki anlamları üzerinde durularak ilgili fragmanda (...) sözcüğe yüklenen anlamlar tespit edilmiştir. Böylelikle Dk1 numaralı fragmanda Herakleitos’un logos sözcüğüne yüklediği temel anlamların, akıl, söz, rasyonel pren-sip, yönetici ilke türünden anlamlar olduğu tespit edilmiştir. Çalışmada ayrıca filozofun frag-manda kullandığı üslubun filozof olmasının yanı sıra kâhinlere veya peygamberlere özgü olduğu iddiasında bulunulmuştur. Bu iddia ise fragmanı oluşturan cümlelerin ve sözcüklerin dile getiri-lişindeki üslup ve jargondan hareketle ve rütbeli Herakleitos yorumcularının ifadeleri ile gerek-çelendirilmeye çalışılmıştır. The menace of conflicts and natural disasters in different states of the world had spiralled into a global phenomenon of Internally Displaced Persons. These are groups of humans who had helplessly drifted away from their natural and ancestral home due to conflicts and disasters but had not crossed international boundaries into another country. They merely take solace by the protection offered by the spirit and letters of relevant international laws which have domesticated by member states. This paper seeks to answer (...) the question regarding the extent to which the IDPs have become a menace in Nigeria. The paper reveals that many governments’ actions are the primary and the root cause of the IDPs while others are recipient of the domino effect. The paper relies on a panel data elicited from thirteen out of the thirty six states in Nigeria. The paper reveals the need for urgent measures by government to douse the upsurge in the number of IDPs. The political settlement analysis was used to proffer a better way of culminating the crises. There is a sizeable group of self-described Christian companies which have declared their belief in the successful merging of biblical principles with business activities. As these companies have become more visible, an increasing number of anecdotal newspaper and magazine articles about these companies have appeared. Surprisingly, no rigorous research has been conducted prior to our recent study. This article provides national estimates of the size and predominant characteristics of self-identified Christian companies. The results of a survey of 272 practicing accountants and 374 accounting students enrolled in six universities are analyzed. Differences and similarities between the two groups with regard to their attitudes toward corporate social responsibility are examined. The results indicate that the students exhibit greater concern about the ethical and discretionary components of corporate responsibility and a weaker orientation toward economic performance. No significant differences between the two groups were observed with respect to the legal dimension of corporate social responsibility. (...) Zihnî temsillerin onto-epistemolojik statüsü İbn Sînâ sonrası felsefenin en tartışmalı problemleri arasında görülebilir. Problemin kökenleri bir yandan İbn Sînâ’nın farklı varlık düzlemleri arasında yüklemsel birlik elde etme teşebbüsünde, diğer yandan Fahreddin er-Râzî’nin zihnî varlık ve zihnî misallerin tümelliği eleştirisinde bulunur. Fahreddin er-Râzî’nin eleştirileri İbn Sînâ’nın önde gelen takipçilerini, İbn Sînâ’nın mahiyetlerin farklı varlık seviyelerinde korunumu ilkesini ve onun bilgiyi doğanın gayrimaddi temsili olarak tanımlamasını yeniden düşünmeye sevk etmiştir. Fahreddin er-Râzî’nin eleştirilerine karşı Nasîrüddin et-Tûsî mahiyetlerin ontolojik kapsamını daraltmış ve tümel yüklemlemeyi (...) yeniden tanımlamıştır. Kutbüddin er-Râzî’nin tartışmaya dâhil olması daraltma çabalarını daha ileri bir seviyeye taşımıştır. Tûsî’nin mahiyetlere sadece epistemolojik bir rol vererek onların ontolojik kapsamında yaptığı daraltmaya ilaveten Kutbüddin er- Râzî mahiyetlerin epistemolojik kapsamında da daraltmaya gitmiş ve İbn Sînâ’nın aklî suretlerini, hiçbir şekilde tümel olması mümkün olmayan, tikel bir zihindeki tikel suretler olarak değerlendirmiştir. Ayrıca Tûsî’yle birlikte, kendinde mahiyetlerin hariçteki fertler arasında müşterek varlığını reddeden Kutbüddin er-Râzî, bu iki adımdan yola çıkarak mutabakat ve tümellik tasavvurlarını yeniden tanımlamış, İbn Sînâ’nın hilomorfik cevher teorisi için mereolojik olmayan bir yorum geliştirmiştir. Bu makale İbn Sînâcı felsefede on üçüncü yüzyıldan itibaren ortaya çıkan bu adımları, İbn Sînâ’ya özgü gerçekçiliğin dönüşümü olarak okumakta ve bu dönüşüme giderek artan zihinselci bir eğilimin eşlik ettiğini öne sürmektedir. Recent years have witnessed the proliferation of “Christian” companies in the U.S. These firms declare their belief in, and active pursuit of, the successful merging of biblical principles with business activities. Economic success, hard work, and biblical values are seen as capable of existing together in harmony. While the number of such businesses appears to be growing, there has been a dearth of any scientific study of these companies. No empirical research has been conducted to determine whether these religious (...) values and behaviors have any significant impact on a company’s performance. The present study is designed to partially fill this gap. Specifically, it seeks to determine whether there are differences in long-term performance between self-proclaimed “Christian-based” businesses and their secular counterparts. Data were collected from 312 companies. A multivariate analysis of variance (MANOVA), followed by univariate ANOVAs, found significant differences between these two groups of firms on three of the four performance variables that were analyzed. İbn Sînâ sonrası İslam felsefe geleneğini meşgul eden en canlı tartışmalardan biri mahiyetlerin dışta nasıl bulunduğu ve onlara dair tümel bilgimiz ile haricî varlık arasındaki mutabakat ilişkisinin nasıl kurulacağıyla ilgilidir. Özellikle Fahreddin er-Râzî’nin İbn Sînâcı zihnî temsil anlayışına yönelttiği ve akıldaki suretlerin dıştaki mücerred tabiatları yansıtmadığını öne süren eleştiri neticesinde, temsil teorisini sürdürmeyi amaçlayan düşünürler İbn Sînâ’nın metafiziksel gerçekçiliğinden uzaklaşan yeni bir tutum geliştirmişlerdir. Bu tutum etrafında onlar tikel cevherlerin duyulur yüzü altında, duyulur olmayan ve aynı türe ait tikel cevherlerin (...) tümünde ortak olan bir tabiatın mevcut olduğu anlayışını terk ederek dış varlıkta yalnızca tikel cevherlerin bulunduğunu savunmaya başlamışlardır. İbn Sînâ’nın dışta tikellerin parçası olarak mevcut olduğunu söylediği doğal tümelin haricî varlığını reddetme anlamına gelen bu yaklaşıma ilaveten onlar, tümel tabiatların dışta değil yalnızca zihinde bulunduğunu öne sürmüştür. Tümel tabiatların zihinde ortaya çıkışını tikeller ve onların duyulur özellikleri arasındaki bir mukayese ertesinde meydana gelen aklî suret üzerindeki zihinsel işlemlerle açıklayan bu tutum, zihin ve dış arasındaki mutabakatı da aklî suret ile hariçteki suret arasındaki mutabakat ilişkisinden çıkartarak yeni bir yoruma tâbi tutmuştur. Tabiatların haricî varlığını reddederek İbn Sînâ’nın metafiziksel gerçekliğinin ontolojik yönünü, tabiat denildiğinde aslında tikellerin kastedildiğini öne sürerek semantik yönünü, bildiğimiz şeylerin dıştaki bu tabiat değil tikeller arasındaki ortak özellikler olduğunu ve tümel tabiatların yalnızca zihinde bulunduğunu savunarak da epistemolojik yönünü budayan bu yeni tutum, metafizik gerçekçiliğin hârice bakan kısmını zayıflatıp zihne bakan kısmını güçlendirdiği için zihinselci eğilim olarak adlandırılmıştır. Bu makalede Nasîruddin et-Tûsî ile başlayıp Kutbüddin er-Râzî ile zirvesine çıkan zihinselci eğilimin on beşinci yüzyılda Ali Kuşçu tarafından nasıl sürdürüldüğü gösterilecek, söz konusu eğilimin bir İbn Sînâ yorumu olmaktan uzaklaşarak nasıl bağımsız yeni bir felsefî tutuma evrildiği tartışılacaktır. The thesis examines the origins and function of legal theory within the context of the development of early Islamic law. I argue against the depiction of the development of law as a series of compromises between traditionalism and rationalism. Rather, by evading the demands of traditionalism, law evolved into a complex doctrinal entity rooted in the social structures of third-century Abbasid society. This revision of the development of law provides a context to evaluate early works of legal theory. Maqasid al-Shariah based Islamic bioethics is an Islamic bioethics concept which uses the objectives of the Shariah as its approach in analysing and assessing bioethical issues. Analysis based on maqasid al-Shariah based Islamic bioethics will examine any bioethical issues from three main aspects namely intention, method, and output or final goal of the studied issues. Then, the evaluation will be analysed from human interest hierarchy, inclusivity, and degree of certainty. The Islamic bioethics concept is a manifestation of dynamic Islamic jurisprudence (...) which can overcome new complex and complicated bioethical issues such as tri-parent baby technology issues. Therefore, this article will introduce and explain the concept of maqasid al-Shariah based Islamic bioethics and outline a general guidance of maqasid al-Shariah based Islamic bioethics to determine a maqṣad based on standards of human good or well-being and harm. In the study of _Lawāmiʿ al-Naẓar_, Ibrahim Safri presents a history of rational sciences in the Maghribī tradition in the seventeenth and eighteenth century. He also presents a critical edition of the work, which can be considered as an introduction to post-Avicennian studies in North Africa.

The principle of modal continuity has become an increasingly popular bit of modal epistemology, featuring prominently in debates about mereology, value, causation, and theism. It claims, roughly, that degreed properties are modally unified. So, if the property of being three inches tall is exemplifiable, so is the property of being four inches tall, and five inches tall, etc. Despite its plausibility, in this paper I show that there is a class of counterexamples to modal continuity: what I call ‘powered properties.’ (...) More surprisingly, I show that an instance of these powered properties is entailed by another widely popular family of modal principles: the Lewisian patchwork principles, also known as cut-and-paste, or recombination, principles. Thus, despite appearing to be similar, and motivated by plenitudinous intuitions about the nature of modality, it turns out that the continuity and recombination approaches to modality rely on crucially different pictures of plenitude. The primary and secondary sources of Islamic law often assume a binary distinction between ijtihād and taqlīd, ignoring a third level of engagement with the sources, which was conceptualized by some jurists as forming a distinct category. In this article I discuss the evolution of the terms ijtihād, taqlīd, and ittibāʿ, using a conceptual-historical approach. I argue that the use of taqlīd to mean “precedent-following” did not emerge as a technical term until after the time of al-Shāfiʿī. The distinction between (...) precedent-following and verifiable-following did not appear in legal discourse until the time of Aḥmad b. Ḥanbal. I also demonstrate that there were three approaches to these terms in legal discourse after the time of Ibn Ḥanbal, with three groups of jurists defining them in ways that advanced their different visions of law-making. I conclude with a discussion of the debate over the meanings of these terms in the eighteenth and nineteenth centuries. (shrink)
