The increasing use of digital image recording devices, whether they are digital cameras or mobile phone cameras, has democratised clinical photography in the UK. However, when non-professional clinical photographers take photographs of patients the issues of consent and confidentiality are either ignored or given scant attention.Whatever the status of the clinician, the taking of clinical photographs must be practised within the context of a professional etiquette. Best practice recognises the need for informed consent and the constraints associated with confidentiality. Against (...) the background of the poverty of the current discourse of these issues, as presented during the Valentine GMC Fitness to Practice1 hearing, the paper considers the need for orthopraxy in the use of clinical photography. The fundamental question in the Marxist theory of revolution is that of the socioeconomic and class content of a revolution. Under today's conditions this question takes on primary significance and is central to the ideological struggle. Compelled to recognize the role of revolution in the development of society, bourgeois sociologists strive, however, to give the concept of revolution a new content, eliminating its class essence. Inasmuch as the revolution in science and technology now in progress is significantly changing the face (...) of the contemporary world, it is characteristic of leading Western sociologists that they seek to present the changes resulting from the technological revolution as a qualitative change in the existing system, a "transformation" of capitalism. "It is a fact," writes the prominent American sociologist and economist Adolph Berle, "that during and after the First World War the entire world was steeped in revolution, and that its base was substantially more technological than social." Technological and not social changes in society are thus proclaimed to be the most important problem of our time. (shrink)

This paper provides an examination of some problems caused by the concentration of influence in the capital markets of developed countries. In particular, I argue that large asset managers exercise quasi-political power that is not democratically legitimate. In section two, I will examine the economic driver behind the size and power of the big asset managers: the passive investing revolution. I will discuss several respects in which this revolution has fundamentally changed capital markets, most notably by making a large share (...) of investors universal owners. In the third section, I argue for my central analytical conjecture: asset managers exercise quasi-political power. They use their influence to shape the rules of the game in public capital markets in order to implement social and environmental policies that have traditionally been the exclusive purview of states. “Asset manager capitalism” is a recent term coined to refer to the contemporary system of corporate governance that succeeded the Berle and Means corporation with its dispersed ownership; the argument of this section is that asset manager capitalism is also a new political-economic regime. In the fourth section I defend my central normative claim: asset manager capitalism is an untenable and illegitimate political-economic arrangement, for at least two reasons. First, the power of asset managers is not checked by any institutional constraints, and is not rendered legitimate by any democratic process. More fundamental than this procedural critique is an argument that the interests of asset managers could not be aligned with the public interest, given the fact that the distribution of capital is highly unequal. I conclude by discussing several proposals to reform asset manager capitalism. (shrink)

By Aloysius Pieris, S. J. Maryknoll: Orbis Books, 1996. Aloysius Pieris, Jesuit priest and Buddhist scholar, is well known in theological and interreligious dialogue circles in Asia, and this is the third collection of essays of his to (...) be published in the Faith Meets Faith Series of Orbis Books. The eighteen essays which make up this book, all previously published elsewhere, are conveniently put together in three sections, under the following headings: 1) Women and Religion: Buddhist and Christian Appropriation of Feminist Criticism; 2) issues in Theology, Religion and Society; and 3) questions of Spirituality and Human Liberation. To merely summarize the content of the essays and offer a third-party critique would do injustice to the book, and could even mislead one who peruses such a summary into thinking one thereby "knows" what the book or Pieris is about. Such a hasty conclusion would deprive a would-be reader of the powerful experience that awaits in wrestling with Pieris through each essay of this volume. Judith Berling puts it well in her blurb at the back, pointing out that the author "uses poetry, evocative symbolism, and humor to offer a theological call to action in a voice that is liberationist, Asian, and feminist." Indeed, this volume invites one to a way of seeing that can also transform one's way of being in this world marked by increasing violence, poverty, and a systemic kind of oppression dehumanizing to both the perpetrators as well as the victims.The title of the present volume, Fire and Water, alludes to a dynamic dipolarity, masterfully sketched for the reader by Paul Knitter in his foreword, which underlies the author's vision of reality and vivifies much of his writing. The masculine and the feminine, the (Buddhist) gnostic and the (Christian) agapeic, the metacosmic (transcendent) [End Page 311] and the cosmic (immanent), the prophetic and the mystical, are different ways of naming this dipolarity. The way to ultimate liberation is in the effective embrace of both poles in complementarity and mutual interplay, whereas taking one pole in preference over the other results in a warped vision or mode of being, in imbalance, or even in abuse.In this review I would like to simply echo some key themes that will jump at one perusing the essays, reiterating that the very act of reading them can of itself be a transformative experience for an open-minded, open-hearted, and open-handed reader.The thrust of the six essays comprising the first section can perhaps be summed up in the thesis as formulated by the author himself: "Religion cannot survive in the future without appropriating the feminist critique, just as feminism cannot achieve its liberative goal without the aid of a religion so critiqued" (p. 62). Behind this statement is Pieris' emphatically critical stance, on the one hand, against all forms of patriarchal religion, whether Christian, Buddhist, Hindu, or other, which has justified, lent a hand in, or continued to perpetrate the physical, psychological, and especially religious abuse of women, and on the other hand, against secularist (or anti-religious) kinds of feminist theory that take off on what he enumerates as "five false starts" (pp. 50-51), which only result in unnecessary dichotomies that truncate the understanding of the goal of liberation, and consequently of the human as such.Pieris offers a vision of liberation centered on what he terms the humanum. This refers to the point of ultimate perfection to which the human, that is, "whatever pertains to men and women as self-conscious, other-oriented, and dreaming components of the cosmos," has the capacity to carry the cosmos. In this context, the human is no other than "this self-transcendent capacity immanent in the cosmos, this power to unfold within itself the Other, which is ever present from the first moment of evolution." The sciences of kalam and fiqh, which have a special importance in the history of Islamic thought and science, became prominent with their interactions with other sciences in their formation processes and their contributions to the evolution of religious thought. In the literature, the field representing the linguistic, religious, mental and practical aspects of fiqh has become widespread with the concepts of usūl-i fiqh and fürū-i fiqh, and the part about creed as usūlü'd-dīn or fiqhu'l-akbar. It has drawn our attention (...) that Imam Abū Ḥanīfa and Imam Shāfiʿī's ijtihads, fatwas and thoughts have remained up to date in every century without exception in the vortex of overdoing and understatement in these two disciplines. However, there are some narrations stating that although these imams were interested in kalam, they kept a distance from it. Their, famous students also indicated that they gave them advice in this sense. Therefore, this study has been prepared in order to examine the background of the aforementioned issues. For this purpose, the reasons why two imams preferred the science of fiqh in the main axis of the subject were subjected to a general criticism. Consequently, it has been seen that both imams had similar concerns and their ideas have been overlapping in the face of the creed developments of the period. (shrink)

It is a pleasure to comment on Giulia Cavaliere’s ‘ Gestation, Equality and Freedom: Ectogenesis as a Political Perspective’ in what one might say is ‘enthusiastic disagreement’. The enthusiastic part is because the article is deserving of much praise for adding an important feminist and political theoretical perspective on ectogenesis. The disagreement may come more from disciplinary differences or disposition. As I understand her argument, Cavaliere intends to attack two common arguments in favour of research into ectogenesis—that is, gestation of (...) a human fetus outside the womb—one that sounds in the potential of the technology to promote equality, the other that it has the potential to promote liberty. On the first her critique is that the risks and burdens of gestation for women are most pronounced for the worst off, but ectogenesis is unlikely to be used by them. On the second her critique is, i nter alia, that treating ‘ectogenesis as a means to address workplace inequalities calls for solutions that change the way society reproduces itself rather than a labour market …. L'objectiu de l'estudi que es presenta és mostrar el marc històric i institucional —la funció instructora d'ateneus com el Centre de Lectura reusenc— en què es produeix l'evolució de la concepció positivista de la realitat. La recerca se situa en el context contemporani que abocarà a la industrialització (...) i a l'emergència del moviment obrer i republicà. Pel que fa a l'àmbit del pensament econòmic, el volum estudia el programa de Pere Estasén —relació entre política econòmica i territori—, que duu a plantejar la irrupció del positivisme a Catalunya com una estratègia explicativa que vincula les idees generals a la situació de la vida nacional, tant políticament (catalanisme regeneracionista) com econòmicament (proteccionisme com a via de modernització de les estructures productives). Open peer commentary on the article “What Can the Global Observer Know?” by Diana Gasparyan. Upshot: I introduce some distinctions that I hold to be useful for understanding the global observer problem and then sketch a hypothetical scenario that suggests the existence of an observer that is as good as a global one.

Posidonius was a major intellectual figure of the Hellenistic world whose interests and contribution spread over the whole intellectual field: philosophy, history, the sciences. His writings are of interest not only to philosophers and classicists, but also to historians and history of science. His work survives only in fragments. The text of these fragments, collected and edited by L. Edelstein and I. G. Kidd, was published in 1972, with a second edition in 1989. This collection, along with Vol. II The (...) Commentary by I.G. Kidd, has become established as the definitive modern edition. However, many of the fragments are extremely difficult to translate, and this volume of translations has been compiled to make this interesting material more easily accessible to scholars and students. The translations are accompanied by contextual introductions and explanatory notes where necessary. An Introduction summarises the importance of Posidonius and his work. (shrink)

Socrates' analogy between the city and the soul in the Republic is a crucial part of the dialogue, since it forms the basis for the interlocutors' definition of justice. Critics allege that there are structural inconsistencies between the city and the soul, and that even if they were somehow structurally analogous, they are nevertheless different. Why, then, would one expect that justice in one would be enlightening for the discovery of justice in the other? This paper examines the passages in (...) which the analogy is developed and finds that Socrates' claims regarding similarities between the city and the soul are not as far-fetched as critics assert. Criticisms of the analogy are shown to be misunderstandings arising from an unwillingness to accept the political implications of Socrates' plan. Ultimately, the analogy rests on important structural similarities between the city and the soul, and is a powerful tool towards an understanding of the individual, of the city and of justice.
