Life insurance settlements, or life settlements, are life insurance policies owned by investor-beneficiaries on the lives of unrelated individuals. With life settlements, investors make substantial payments to the insured individuals upon purchasing such policies, pay any remaining premius, and collect the death benefits upon the demise of the insured individuals. Transactions involving life settlements seem poised to become a major source of profits for investment banks, comparable in dollar amount to subprime mortgages. With life settlements, the insured individuals suffer no (...) immediate harm, and the sale of a policy an individual owns is permissible under current law. Nevertheless, moral questions can be posed about the social values expressed by these practices, the effect of these practices on the virtue of charity, and the overall loss of social utility that will result from life settlements. We consider life settlements from utilitarian and libertarian perspectives, and then consider the effects of life settlements on social values and on individual character. On balance, we favor legislative changes in insurance and tax laws to discourage life settlements, and argue that certain forms of life settlements should be banned outright. (shrink)

Un aspecto poco estudiado del argumento de Michael Sandel en contra del carácter neutral de la justicia como equidad, es el modo en que funda sus conclusiones en el entendimiento que tiene de otros tres aspectos de la concepción rawlsiana de justicia: su carácter deontológico, el equilibrio reflexivo, y la posición original. Nuestro objetivo es mostrar que Sandel no ha cometido cuatro errores independientes, sino que poseer un entendimiento equivocado del carácter deontológico de la teoría lo ha llevado a caracterizar (...) mal en qué consiste el equilibrio reflexivo y esto -finalmente- lo ha conducido a una errónea interpretación de lo que se encuentra modelado en la posición original y -en última instancia- a sostener la falta de neutralidad de la concepción de justicia. Concentrarnos en este asunto nos permitirá apreciar cómo se articulan y complementan las distintas réplicas que Brian Barry, Samuel Freeman y el mismo John Rawls han dirigido contra Sandel. One aspect of Michael Sandel´s argument against the neutral character of justice as fairness on which little research has been done is the way in which he founds his conclusions on the basis of the understanding he has about three other aspects of the Rawlsian conception of justice: its deontological character, the reflective equilibrium and the original position. It is my aim to prove that Sandel has not made four independent mistakes but, on the contrary, to have a wrong understanding of the deontological character of the theory has driven him to a wrong characterization of what the reflective equilibrium consists of and this, in turn, has taken him to a wrong interpretation of what is modelled in the original position and, at large, to hold the idea that justice as fairness lacks neutrality. Focusing on this issue will allow us to appreciate how the different responses made by Brian Barry, Samuel Freeman and John Rawls himself against Sandel are articulated and complement one another. Much evidence has accumulated in favor of such a dual view of reasoning. There is however some vagueness in the way the two systems are characterized. Instead of a principled distinction, we are presented with a bundle of contrasting features - slow/fast, automatic/controlled, explicit/implicit, associationist/rule based, modular/central - that, depending on the specific dual process theory, are attributed more or less exclusively to one of the two systems. As Evans states in a recent review, “it would then be helpful to (...) have some clear basis for this distinction”; he also suggests that “we might be better off talking about type 1 and type 2 processes” rather than systems. We share the intuitions that drove the development of dual system theories. Our goal here is to propose in the same spirit a principled distinction between two types of inferences: ‘intuitive inference’ and ‘reflective inference’. We ground this distinction in a massively modular view of the human mind where metarepresentational modules play an important role in explaining the peculiarities of human psychological evolution. We defend the hypothesis that the main function of reflective inference is to produce and evaluate arguments occurring in interpersonal communication. This function, we claim, helps explain important aspects of reasoning. We review some of the existing evidence and argue that it gives support to this approach. (shrink)

The Belnap–Dunn logic is a well-known and well-studied four-valued logic, but until recently little has been known about its extensions, i.e. stronger logics in the same language, called super-Belnap logics here. We give an overview of several results on these logics which have been proved in recent works by Přenosil and Rivieccio. We present Hilbert-style axiomatizations, describe reduced matrix models, and give a description of the lattice of super-Belnap logics and its connections with graph theory. We adopt the point of (...) view ofAlgebraic Logic, exploring applications of the general theory of algebraization of logics to the super-Belnap family. In this respect we establish a number of new results, including a description of the algebraic counterparts, Leibniz filters, and strong versions of super-Belnap logics, as well as the classification of these logics within the Leibniz and Frege hierarchies. This collection of essays examines the ways in which disputes and controversies about the application of scientific knowledge are resolved. Four concrete examples of public controversy are considered in detail: the efficacy of Laetrile, the classification of homosexuality as a disease, the setting of safety standards in the workplace, and the utility of nuclear energy as a source of power. The essays in this volume show that debates about these cases are not confined to matters of empirical fact. Sismografias tenta então reconhecer, na postura e no desenvolvimento dessa letra “A”, a forma como o trabalho de Derrida abala pela base o território dos (...) conceitos, convocando a urgência e a responsabilidade da filosofia, da escrita e do pensamento. Nesse sentido, trata-se aqui de acompanhar as linhas de desenvolvimento de uma letra motriz, que pontuou, do início ao fim e em todas as direções, o pensamento de Derrida como idioma, como revolução filosófica, como sismografia.: This text departs from the letter A, in its importance and its centrality in Derrida’s deconstruction. Because reasoning allows us to justify our beliefs and evaluate these justifications it is central to folk epistemology. Following Sperber, and contrary to classical views, it will be argued that reasoning evolved not to complement individual cognition but as an argumentative device. This hypothesis is more consistent with the prevalence of the confirmation and disconfirmation biases. It will be suggested that these biases render the individual use of reasoning hazardous, but that when reasoning is used in its natural, argumentative, context (...) they can represent a smart way to divide labor without loosing epistemic value. Modern societies depend on a growing production of scientific knowledge, which is based on the functional differentiation of science into still more specialised scientific disciplines and subdisciplines. This is the basis for the paradox of scientific expertise: The growth of science leads to a fragmentation of scientific expertise. To resolve this paradox, the present paper investigates three hypotheses: 1) All scientific knowledge is perspectival. 2) The perspectival structure of science leads to specific forms of knowledge asymmetries. 3) Such perspectival knowledge (...) asymmetries must be handled through second order perspectives. We substantiate these hypotheses on the basis of a perspectivist philosophy of science grounded in Peircean semiotics and autopoietic systems theory. Perspectival knowledge asymmetries are an unavoidable and necessary part of the growth of scientific knowledge, and more awareness of this fact can help avoid blind and futile struggles between scientific perspectives, and direct efforts toward more appropriate ways of handling these fundamental knowledge asymmetries. Concretely, we show how different kinds of scientific knowledge, expertise, disagreement and learning can be correlated to the perspectival structure of science, and propose how polyocular communication based on observations of the observations made by specialised perspectives can be used to handle such perspectival knowledge asymmetries. This can help overcome the observed problems in carrying out cross-disciplinary research and in the collective use of different kinds of scientific expertise, and thereby make society better able to solve complex, real-world problems. Nature quality in relation to farming is a complex field. It involves different traditions and interests, different views of what nature is, and different ways of valuing nature. Furthermore there is a general lack of empirical data on many aspects of nature quality in the farmed landscape. In this paper we discuss nature quality from the perspective of organic farming, which has its own values and goals in relation to nature – the Ecologist View of Nature. This is in contrast (...) to the Culturist View characteristic of much conventional agriculture and the Naturalist View characteristic of the traditional biological approach to nature quality. This threefold distinction forms a framework for exploration of nature quality criteria in the farmed landscape. The traditional work on nature quality has mainly focused on biological interests based on a Naturalist View of Nature. In this paper we will explore how criteria for nature quality based on the Ecologist View can be developed and thereby feed into the ongoing discussion of the development of the organic farming practices. We suggest additional criteria for nature quality based on an Ecologist View of Nature: biodiversity, habitat diversity, extent and structure, functional integrity of habitats and agro-ecosystems, landscape integrity, accessibility, and experientiality. The larger set of Naturalist and Ecologist criteria can provide a wider and more balanced basis for developing nature quality indicators that are relevant in the farmed landscapes. This broader approach to nature quality is also expected to benefit the general societal discussions and decisions on farming and nature. (shrink)

Delayed responses are a common phenomenon in experience sampling studies. Yet no consensus exists on whether they should be excluded from the analysis or what the threshold for exclusion should be. Delayed responses could introduce bias, but previous investigations of systematic differences between delayed and timely responses have offered unclear results. To investigate differences as a function of delay, we conducted secondary analyses of nine paper and pencil based experience sampling studies including 1,528 individuals with different clinical statuses. In all (...) participants, there were significant decreases in positive and increases in negative affect as a function of delay. In addition, delayed answers of participants without depression showed higher within-person variability and an initial strengthening in the relationships between contextual stress and affect. Participants with depression mostly showed the opposite pattern. Delayed responses seem qualitatively different from timely responses. Further research is needed to understand the mechanisms underlying these differences. (shrink)

Também será explorada a resistência de Paul Ricoeur ao reducionismo neurobiológico, bem como uma improvável presença de um enquadramento naturalista na base de sua antropologia filosófica. (...) Die Fragestellungen der Metaphysik, so scheint es, sind nicht mehr zeitgemäß. Der Begriff erinnert an abgehobene Systeme ohne jeden Realitätssinn. Dabei gibt es kein Denken ohne Metaphysik. Unter Bezugnahme auf die Traditionen der Phänomenologie und der französischen Philosophie versteht Robert Hugo Ziegler Endlichkeit als eine positive Auszeichnung, während der Begriff der Zeitlichkeit die erste Dimension von Sein beschreibt. Sein grundlegender Beitrag zur Reflexion über Mensch und Welt zeigt, wie sich die Philosophie selbstbewusst einer Erneuerung der Metaphysik stellen kann.

The situation-dependent lateralization of sympathetic electrodermal arousal during real-life stress (Picard, Fedor, & Ayzenberg, 2016) may challenge a unitary notion of arousal, and call into question the practice of unilateral electrodermal recording, but there are broader implications. Here we consider a potential relationship between stress-induced lateralized shifts in electrodermal activity, and a theory concerning lateralized emotion-induced cardiac arrhythmia.

Putnam argues rightly that, if scientism were true, values and intentionality would be eliminable from a description of the world as it really is. But these are not eliminable, since science itself depends on them. But he wrongly believes that, if there were any viable form of metaphysics, it would have to be scientism. This article argues that, if one applies Putnam's insights and corrects his oversights, a metaphysics is possible, which, while it is based on the methods of science, (...) is not scientism, and can accommodate intentionality and value. Durch den Essentialismus-Verdacht schien der Begriff bereits für die Philosophie disqualifiziert. Doch Robert Hugo Ziegler zeigt, gestützt unter anderem auf Lukrez und Spinoza, dass die Natur, sobald man sie ernsthaft ins Auge fasst, alles andere als essentialistisch ist. Background The learning process about dignity and how undergraduate nursing students experience and use this ethical knowledge is an under-represented field in nursing research. To overcome the lack of conceptual clarity, it is important to understand what processes and dimensions students develop to support this learning outcome. Objective This study aimed to explain the process of learning about dignity by undergraduate nursing students. Research design and methods A qualitative study was conducted using the grounded theory method. Participants and research context (...) Data was collected through free reports and in-depth semi-structured interviews with 20 participants. A focus group was held for the selective coding. Sampling began purposefully and evolved into theoretical. Reflective and theoretical memos were generated from the data collection and constant comparison. Data analysis was performed using qualitative data analysis software using Corbin and Strauss’ method. Ethical considerations The research was approved by a specialized research ethics committee from a Health School. Findings The process of learning about dignity by undergraduate nursing students revealed ‘recognition of dignity’ as the core category, supported by five main categories: ‘proto-conscience of dignity’, ‘pathway to nursing’, ‘consciousness of dignity’, ‘ways of learning’, and ‘becoming capable’. These categories illustrate the processes and dimensions involved in nursing students’ concept translation of dignity learning, allowing a theory to emerge. Conclusions The ‘Recognition of Dignity’ theory aims to contribute to developing educational, training, and supervision processes for nursing programs. It seeks to enhance the ethical and moral development of undergraduate nursing students by helping them understand the concept of dignity and its fundamental importance in nursing. (shrink)
