Clarence Finlayson fue un pensador americano, nacido en Valparaíso y que enseñó en Medellín, Indiana, Ciudad de México y otras ciudades de América. El presente texto pretende dar cuenta de los fundamentos metafísicos de su antropología, arraigados en la corriente escolástica, pero con evidentes influencias del pensamiento contemporáneo. La concepción metafísica de Clarence Finlayson constituye una recomprensión de los principios aristotélico-tomistas pensados a partir de una articulación entre ser y nada, como polos fundamentales de todo devenir, característico de los seres (...) compuestos. Asimismo, dado que, según Finlayson, la filosofía se funda en una intuición metafísica, como esta intuición se realiza en el reconocimiento experiencial del fenómeno de la muerte en contraste con el anhelo de ser absolutamente, la filosofía es la disciplina esencial del hombre, paradójicamente, en un sentido existencial. El presente trabajo pretende establecer los fundamentos de la querella sobre el ateismo en el que se ve envuelto Fichte y que le significa ser exonerado de la Universidad de Jena. A este respecto se establece que el primado de la libertad, como carácter constitutivo del sujeto, supone no sólo una conciencia autónoma en el ámbito moral y un primado de la razón práctica, como proponía Kant, sino también la exclusión de un orden trascendente que pueda intervenir directamente sobre el (...) En lo que sigue se trata de establecer el papel del recurso irónico como eje articulador entre la filosofía y la poesía. Con este propósito se analiza el papel de la ironía tanto en los diálogos platónicos como en algunos fragmentos de Friedrich Schlegel, procurando mostrar su sentido liberador en razón de su carácter transgresor.

La hermenéutica contemporánea, en general, ha sostenido una autonomía del texto y se le ha reprochado a Schleiermacher el tener una perspectiva psicologizante. No obstante, en este artículo se pretende mostrar que el fundamento de la prioridad de la "parte psicológica", como la llama Schleiermacher, estriba en que éste concibe la interpretación como una forma de diálogo, en la medida que, desde su perspectiva en todo texto alguien le dice algo a alguien, independientemente de que el intérprete sea o no (...) el destinatario original del texto. Para Finlayson, el descubrimiento de América constituyó el fin de un ciclo, la circunvalación del globo, el encuentro de las dos corrientes migratorias que, habiendo partido de Asia, se dirigieron una hacia el este y la otra hacia el oeste. Frente a la Europa de ese entonces, acosada por cruentas guerras religiosas, desunida, amenazada por el oriente, integrada por muchas naciones que aún no eran propiamente Estados, con la legitimidad de los gobiernos en una crisis que ya se preveía, América (...) aparecía como territorio de esperanzas. Tal situación es, en algún sentido, análoga a la que se vivió en los años cuarenta del siglo XX, y así sostiene Finlayson: “[…] la superpoblación, los conflictos internacionales, la pobreza, las guerras que hoy asuelan casi todo el mundo tienen su esperanza concreta en los inmensos territorios de América”. No obstante, parece que se trata de una esperanza siempre incumplida y siempre postergada. (shrink)

The present paper seeks, from the political realism of Hinkelammert and the politics of the liberation of Dussel, to identify the initial limits that delineate the framework of political action. The political action framework delimits the space of empirical possibility. For it, the definition of politics is adopted as “art of the possible”, explicitly accepted by Hinkelammert and developed implicitly by Dussel. Three limits are identified that outline the framework of political action: 1) the natural environment as a condition of (...) existence of living corporality, 2) the satisfaction of physical needs as a condition to preserve living corporality, 3) intersubjective experiences as a condition to maintain the human life. Propose these limits allows to establish the bases of the utopia of the political realism of Hinkelammert and of the politics of the liberation of Dussel. (shrink)

Relationships between degree/area of academic formation and religious and Darwinian views are controversial. This study aimed to compare the religious beliefs and acceptance of Darwinian evolution between two contrasting South American scientific communities (Chile and Colombia), accounting for different degrees and areas of academic formation. In 2018, 115 last year bachelor students (surveyed as freshmen in 2014 for a previous study) from Chile, and 283 first/last year bachelor students, graduate students, and professors from Colombia, all belonging to biology, chemistry, or (...) physics, were surveyed. Chilean students/faculty were significantly more agnostic/atheist, more accepting of Darwinian evolution, and less creationist than their Colombian counterparts. Academic degree and area differently affected these views in both countries, as only in Chile there was a clear tendency among biologists and physicists with higher degrees to hold less religious and creationist views. Marked differences between the history, socioeconomic contexts, and especially in high school and university curricula of both countries might explain these results. (shrink)

According to the argumentative theory of reasoning, humans have evolved reasoning abilities for argumentative purposes. This implies that some reasoning skills should be universals. Such a claim seems to be at odd with findings from cross-cultural research. First, a wealth of research, following the work of Luria, has shown apparent difficulties for illiterate populations to solve simple but abstract syllogisms. It can be shown, however, that once they are willing to accept the pragmatics of the task, these participants can perform (...) at or near ceiling. Second, historical, sociological and anthropological research has been used to claim that some Eastern cultures have not developed argumentation. These claims are the result of oversimplifications and of a selective view of the data. A closer looks reveals instead very elaborate forms of argumentation, in Chinese culture particularly. Third, cross-cultural psychologists have carried out an extensive research program aimed at showing that Easterners do not rely on the principle of non-contradiction and that they use holistic rather than analytic thinking. A review of these experiments shows that no qualitative difference emerges in the way Easterners and Westerners deal with argumentation and that in the proper context both populations can easily have recourse to holistic or analytic thinking. It is possible to conclude from this critical review that the reasoning skills involved in argumentation seem to be universal even though they can be used in different ways in various cultural contexts. The persistence of multiple educational pathways into the nursing profession continues to occupy scholars internationally. In the Netherlands, various groups within the Dutch healthcare sector have tried to differentiate nursing practice on the basis of educational backgrounds for over 50 years. Proponents argue that such reforms are needed to retain bachelor‐trained nurses, improve quality of care and strengthen nurses' position in the sector. Opponents have actively resisted reforms because they would mainly benefit bachelor‐trained nurses and neglect practical experience and technical (...) skills. This historical case study aims to provide insight in this apparent stalemate. Our analysis of this debate is informed by literature on institutional work and current debates within the historiography of nursing. This study contributes to a better understanding of this contemporary debate by examining a broader timeframe than is usually studied, and by highlighting nurses' roles in complex processes of change. We argue that, rather than being stuck in their professional development, different groups of nurses have forged their own path forward in their professional development, albeit via different strategies. Die Fragestellungen der Metaphysik, so scheint es, sind nicht mehr zeitgemäß. Der Begriff erinnert an abgehobene Systeme ohne jeden Realitätssinn. Dabei gibt es kein Denken ohne Metaphysik. Unter Bezugnahme auf die Traditionen der Phänomenologie und der französischen Philosophie versteht Robert Hugo Ziegler Endlichkeit als eine positive Auszeichnung, während der Begriff der Zeitlichkeit die erste Dimension von Sein beschreibt. Sein grundlegender Beitrag zur Reflexion über Mensch und Welt zeigt, wie sich die Philosophie selbstbewusst einer Erneuerung der Metaphysik stellen kann.

Peng and Nisbett put forward an influential theory of the influence of culture on the resolution of contradiction. They suggested that Easterners deal with contradiction in a dialectical manner, trying to reconcile opposite points of view and seeking a middle-way. Westerners, by contrast, would follow the law of excluded middle, judging one side of the contradiction to be right and the other to be wrong. However, their work has already been questioned, both in terms of replicability and external validity. Here (...) we test alternative interpretations of two of Peng and Nisbett’s experiments and conduct a new test of their theory in a third experiment. Overall, the Eastern and Western participants behaved similarly, failing to exhibit the cross-cultural differences observed by Peng and Nisbett. Several interpretations of these failed replications and this failed new test are suggested. Together with previous failed replications, the present results raise questions about the breadth of Peng and Nisbett’s interpretation of cross-cultural differences in dealing with contradiction. Und welche philosophischen Instrumente können gegen dessen erneutes Erstarken wirken? Robert Hugo Ziegler analysiert beispielhaft Autoren wie Jünger, Heidegger, Schmitt und Rand und schlägt einen systematischen Begriff des reaktionären Denkens vor. Damit entmystifiziert er eine Diskursform, die letztlich nur in der eigenen Mystifizierung besteht, und bezieht auch politisch Stellung gegen das Wiederaufleben der Reaktion.

Este artículo evalúa los alcances del Cuaderno Azul como crítica sistemática en contra de la que se ha denominado una concepción o explicación causal del significado, específicamente la que formula Russell en The Analysis of Mind. Tal evaluación procederá, primero, aclarando la manera como la concepción causal defiende una noción de significado entendida como la conducta adecuada según el acontecer de leyes causales de orden psicológico. En segundo lugar, desarrollando la crítica que Wittgenstein elabora en el Cuaderno Azul contra la (...) concepción russelliana en tres momentos: 1) la crítica a la hipótesis de las imágenes; 2) el rechazo a la existencia de un proceso interno y oculto; 3) el abandono de una noción psicológica de comprensión para explicar el concepto de significado. Finalmente se aclarará de qué manera toda la crítica del Cuaderno Azul está orientada a debilitar la pretensión que subyace a la explicación causal de explicar científicamente el concepto de significado. El presente Dossier de Euphyía sobre Ética Ambiental y Animal reflexiona sobre la urgente necesidad de revisar nuestras teorías éticas tradicionales ante la crisis ambiental actual. Los editores destacan cómo la ética ha evolucionado desde su enfoque antropocéntrico hacia una consideración más inclusiva que abarca animales, ecosistemas y el entorno inorgánico. Este cambio surge frente a los impactos negativos de la industrialización y la explotación irracional de la naturaleza. Los artículos abordan diversas perspectivas críticas. Entre ellos, se examinan las tensiones (...) entre ecologismo y animalismo, las prácticas antropocéntricas históricas en relación con los animales, y las propuestas de ética ambiental basadas en la responsabilidad hacia futuras generaciones. También se analizan los desafíos éticos y políticos que plantea el cambio climático, como el desplazamiento climático y los derechos de las comunidades afectadas. El dossier promueve una ética ampliada que reconozca la interconexión entre humanos y naturaleza, y que confronte los paradigmas especistas y antropocéntricos. Al hacerlo, busca fomentar una reflexión interdisciplinaria que inspire tanto el pensamiento filosófico como el activismo en pro de un planeta más sostenible y equitativo para todos sus habitantes. This study examines the interplay between text summarization techniques and embeddings from Language Models (LMs) in constructing expert systems dedicated to the retrieval of legal precedents, with an emphasis on achieving cost-efficiency. Grounded in the growing domain of Artificial Intelligence (AI) in law, our research confronts the perennial challenges of computational resource optimization and the reliability of precedent identification. Through Named Entity Recognition (NER) and part-of-speech (POS) tagging, we juxtapose various summarization methods to distill legal documents into a convenient form (...) that retains their essence. We investigate the effectiveness of these methods in conjunction with state-of-the-art embeddings based on Large Language Models (LLMs), particularly ADA from OpenAI, which is trained on a wide range of general-purpose texts. Utilizing a dataset from one of Brazil’s administrative courts, we explore the efficacy of embeddings derived from a Transformer model tailored to legal corpora against those from ADA, gauging the impact of parameter size, training corpora, and context window on retrieving legal precedents. Our findings suggest that while the full text embedded with ADA’s extensive context window leads in retrieval performance, a balanced combination of POS-derived summaries and ADA embeddings presents a compelling trade-off between performance and resource expenditure, advocating for an efficient, scalable, intelligent system suitable for broad legal applications. This study contributes to the literature by delineating an optimal approach that harmonizes the dual imperatives of computational frugality and retrieval accuracy, propelling the legal field toward more strategic AI utilization. O objectivo deste artigo é demonstrar como, através da participação de John Courtney Murray no decorrer dos trabalhos conciliares, certas noções e intelecções da reflexão teológica e epistemológica de Bernard Lonergan influíram decisivamente na estrutura básica da Declaração Conciliar Dignitatis Humanae. Neste sentido, o artigo passa em revista a estrutura fundamental do argumento em favor da liberdade religiosa de John Courtney Murray, focalizando a atenção sobre o momento em que este autor contribui directamente, como primeiro escriba, para a construção do (...) primeiro esquema autónomo sobre a Liberdade Religiosa no Concílio Vaticano II. O artigo destaca ainda, numa análise sucinta sobre este texto conciliar, os contributos lonerga-nianos que explicitamente transitam, através de Murray, para o corpo do documento, que foram decisivos para um novo enquadramento metodológico da problemática e, assim, para a aprovação final do Documento. /// The main purpose of this article is to show how certain notions and insights of Bernard Lonergan's theological and epistemological reflection exert their influence upon the basic structure of Dignitatis Humanae, through the active conciliar participation of John Courtney Murray on the subject. Thus, the focus of the article is on the main structure of Murray's apologetic argument for religious freedom, precisely when the author works, as first scribe, upon the first conciliar autonomous draft on Religious Liberty. Through a brief scrutiny of this conciliar text, the article also points out Lonergan's decisive assessments, although indirectly through the hands of Murray, for a new methodological stance that allowed the final Declaration's approval. In the following sections we hold that physical continuity suffices personal persistence through time. First, we determine the theoretic and conceptual grounds of the metaphysical problem of personal identity, the relevant notion of «personal identity», the temporal persistence question simpliciter, what identity criteria and individuation principles are, and the formal properties of the identity concept. We differentiate between the simple and complex views, stating the reductionist thesis transversal to the latter. In the central sections, we discuss the main arguments and (...) objections endorsed to the dominant identity criteria, namely, the lockean memory criterion, causal dependence criteria of psychological connectivity and continuity, the corporeal or physical criterion, the somatic view and the cerebral criterion. Psychological criteria are not considered promising. We hold the hypothesis that personal identity consists in a causal relation of brute physical continuity. For such, we refine the original corporeal criterion, showing that the defense of, at least, minimal physicalism about mind-brain identity ensure its reinforcement. (shrink)

Trata-se de uma exploração de três perspectivas acerca da relação entre nosso modo de habitar ou estar no mundo e entre práticas discursivas distintas daquela da filosofia tradicional. Em um primeiro momento, será explorada a perspectiva heideggeriana acerca da ideia de um habitar poético enquanto distinta atitude e sensibilidade diante do ente em geral. Em seguida, em resposta ao suposto afastamento heideggeriano do âmbito ordinário dos entes da ocupação cotidiana, se explorará a hermenêutica narrativista de Paul Ricoeur, em especial no (...) que esta oferece para a reflexão sobre o tema da identidade pessoal. Finalmente, a palavra será passada ao romancista, frequentemente considerado “filosófico”, Milan Kundera, cuja concepção de romance permite, na esteira da reflexão dos hermeneutas, que seja esboçado um programa de cultivo de uma sensibilidade e de uma atitude muito especiais e frequentemente esquecidas em nossa errância dispersa no cotidiano. In Promoting Justice Across Borders, Lucia Rafanelli develops an ethical theory of ‘reform intervention’: a deliberate attempt to promote justice in a foreign society. The theory specifies which types of interventions are justified under what circumstances and who is justified in intervening where. Rafanelli’s theory eschews nation-states and instead makes its main actors societies with capacity for self-determination. This, I argue, can make the theory hard to apply, because different societies can overlap or intersect, and the theory’s implications change depending (...) on how one draws boundaries around groups. So the theory can give contradictory directives for the same event, depending on how one envisions the subject of intervention. The move away from states, however, may be inevitable, because contemporary problems in international relations (such as those related to climate change) cannot be easily contained within the framework of independent sovereign states in the international system. Trata-se de um estudo comparativo entre as ideias do filósofo Paul Ricoeur (1913 – 2005) e do romancista Milan Kundera (1929-) sobre as experiências do tempo e da memória. Parte-se de uma comparação inicial das ideias de ambos os pensadores acerca dos temas da ipseidade, da História e da experiência do tempo. Em um segundo momento, o pensamento de ambos os autores é colocado em confrontação crítica, em especial no que concerne aos seus respectivos entendimentos sobre a natureza da experiência (...) humana do tempo e os limites da memória. Em seguida, passa-se ao exame das ideias e hipóteses de Kundera sob a luz da hermenêutica filosófica de Ricoeur, com o intento de mostrar que essa é onde essa hermenêutica é mais intensamente desafiada que melhor mostra suas valências filosóficas. Em um último momento, pretende-se mostrar que dessa confrontação crítica resultam interessantes convergências por meio das quais ambos os pensadores oferecem perspectivas similares e complementares para fins do cultivo de uma memória feliz e de uma experiência viva do tempo. Should a debate of the choice between metaphorical investigation and epistemological realism in organizational research be prioritized as Willy McCourt called for in Organization Studies? We argue here against doing any such thing — a ‘realism’ debate in organizational theory would merely be a ‘red herring’. Theoretical investigation from Ricoeur to Derrida has liberated us from the need to re-visit the theme, but examination of Gareth Morgan's intellectual development, as begun by McCourt, is of interest because it reveals two very (...) different ‘realisms’. What is of interest about ‘realism’ is not an eitherlor of either ‘realism’ or ‘constructivism’, but a polyphony of the many voices of research. (shrink)
