This Introduction describes the approach and rules applied when translating a 25-page excerpt from Marx’s Manuscript of 1867–68, as published in the MEGA, Volume II/4.3. The draft status and terseness of the text required that the translation proceed along with a working-out of its mathematical content. The translation’s main guideline was to translate the draft such as it stood, while correcting figures and formulas wherever possible. Remaining major deficiencies and inconsistencies are discussed in depth, showing also what an outstanding level (...) of acuity Marx had already achieved in a manuscript at first-draft stage. This article analyzes the concept of the legal mobilization of laws and institutions for the redressal of “justiciable” problems—problems for which a remedy can potentially be obtained through legal processes. The dispute-processing approach initiates the naming, blaming, claiming framework, to understand the reasons that substantial “perceived injurious experiences” do not mature into lawsuits. This article proceeds further with the discussion of the idea of a “dispute pyramid.” This method presents a real problem of asserting injuries that are unperceived, subjective in (...) nature. Broad methodological approaches are applied in empirical research regarding claiming. The expansive methodological spectrum includes, structured surveys, institutional records ethnography etc. This article then examines the explanations that have been advanced for variations in claiming patterns, both at the individual and the aggregate levels. It analyses the points of general agreement and issues where agreement is lacking and proposes an agenda for future research related to claiming. (shrink)

인간은 생존을 위해 경제활동에 참여해야 하며, 동시에 경제공동체를 구성해 더불어 살아갈 수밖에 없는 존재이다. 경제활동의 개인적 목표는 우선 자기 자신에게 유익한가에 달려 있는 문제로 그것은 도덕적으로 중립적이다. 그렇지만 경제공동체가 효과적으로 기능하려면 일정한 질서구조에 근거해야 한다. 바로 이 지점에서 경제의 윤리적 측면이 성립된다. 윤리적 측면에서 경제는 개별욕구만족을 넘어서 만인의 복지를 향한 질서구조에 토대해야 한다. 경제는 특정개인의 사익뿐만 아니라 사회적 공동선에 기여해야 하기 때문이다. 우리는 그런 경제를 인간존엄성을 보장할 수 있는 질서구조라 할 수 있다. 이 글은 의식적, 개인적 차원에서의 경제윤리가 아닌 제도적, (...) 구조적 차원의 질서구조에 입각한 경제윤리의 중요성을 규명하는 데 그 중요한 목적이 있다. 이런 일정한 테두리 질서에 근거할 때 경제행위는 질서철학으로써 경제의 중심에 ‘인간’을 염두에 둘 수 있다. 먼저, ‘보이지 않는 손’에 따르는 자본주의체제에서 공동선은 어떻게 가능한가를 중심으로 경제윤리의 근거를 마련한다. 다음으로, 자본주의에서 질서구조 차원의 윤리정립이 왜 필요하며, 어떻게 담보할 수 있는지를 밝히고, 이에 입각할 때 만인의 인간존엄이 보장될 수 있는 경제행위가 가능함을 밝힌다. 마지막으로, 이런 논의를 바탕으로, 현대의 시장경제에서 도덕성은 질서구조의 정립에 의해 가능함을 살피고, 그에 따른 시장경제 수정의 필요성을 제안한다. 요컨대, 경제윤리는 일정한 질서구조에 입각할 때 더욱 잘 확보되고 보장될 수 있음을 해명한다. Der Autor entwickelt ein eigenständiges Konzept von Eifersucht und betrachtet sie unabhängig von anderen Emotionen, doch verwoben mit ihnen. Um die vielen Facetten der Eifersucht zu berücksichtigen, schlägt er ein psychoanalytisches Prozessmodell vor, das den je individuellen Verlauf einer Eifersuchtsentwicklung in den Blick nimmt. Anhand von Beispielen werden die lebensgeschichtlichen Eifersuchts-Dreiecke mit den Verlaufsordnungen normaler und pathologischer Eifersucht, den unterschiedlichen Reaktionen auf Eifersucht und der Psychogenese eifersüchtiger Pathologie verknüpft. Den Mechanismus der Eifersucht sieht er, bei aller Komplexität, in einer unbewussten (...) Strategie: Äußerlich inszenierte Konflikte der Erwachseneneifersucht sollen dazu dienen, Kränkung und Scham zu bewältigen und die wachgerufenen Emotionen kindlicher, teils traumatischer Beziehungserfahrungen niederzuhalten.
