La médecine personnalisée devrait être renommée "médecine des données". Les finalités de cette médecine sont, à partir d'une quantité importante de données, de déduire ou d'induire différentes informations valorisables à la fois au niveau du soin, de la recherche et de l'industrie. Pour cela, un réseau d'échange ou de partage d'échantillons biologiques, de données génétiques et d'informations entre patients, cliniciens, chercheurs et industriels est développé, grâce à des voies de communication dématérialisées. Ce réseau permet de centraliser le stockage, et une (...) partie du traitement et de l'analyse, au niveau de centres de soin et de recherche académiques et/ou de "plateformes bifaces". Les enjeux éthiques majeurs de cette médecine résident alors dans les moyens et les modalités d'accès, de stockage et d'usage des données génétiques et requièrent des solutions. L'intérêt de cette thèse de doctorat est donc de proposer à la fois une nouvelle méthode de recherche en bioéthique permettant de mieux étudier de tels phénomènes sociaux complexes et une solution possible aux enjeux éthiques identifiés grâce à cette méthode. One of the requirements in the Dutch regulation for euthanasia and assisted suicide is that the doctor must be satisfied ‘that the patient's suffering is unbearable, and that there is no prospect of improvement.’ In the notorious Chabot case, a psychiatrist assisted a 50 year old woman in suicide, although she did not suffer from any somatic disease, nor strictly speaking from any psychiatric condition. In Seduced by Death, Herbert Hendin concluded that apparently the Dutch regulation now allows physicians to (...) assist anyone in suicide simply because he or she is unhappy.In this paper, I reject Hendin's conclusion and in particular his description of Mrs Boomsma as someone who was ‘simply unhappy.’ After a detailed narration of her lifestory, I turn to the American philosopher Harry Frankfurt's account of volitional incapacity and love for a more accurate characterization of her suffering. Having been through what she had, she could only go on living as another person than the one she had been when she was a happy mother. That would have violated her integrity, and that she could not bring herself to do. (shrink)

According to relativized transcendentalism, the meaning of expressions, consisting in their intension and extension, is provided by a set of (syntactical, semantical and pragmatical) rules which prescribe their correct use in a context. We interpret a linguistic system by fixing a domain (of the values of the variables) and by assigning exactly one object to each individual constant and n-tuples of objects to predicates. The theory says that proper names have a purely referential role and that their meaning is therefore (...) limited to the individual they designate. Since all singular terms must refer to exactly one referent there are no so-called empty names. A proper name is defined as a syntactically unstructured term in a language L used in a context C such that the truth condition for a sentence (Φα in L and C consists in the fact that, in accord with the rule which maps items from the set of individual constants into the set of objects, a refers to an object x and x satisfies Φ. It is shown how - by using this theory - puzzling problems concerning Frege's morning star and evening star, allegedly empty names, changes of name etc. can easily be solved. (shrink)

Networks for the exchange and/or sharing of genetic data are developing in many countries. We focus here on the situations in the US and France. We highlight some recent and remarkable differences between these two countries concerning the mode of access to, and the storage and use of genetic data, particularly as concerns two-sided markets and dynamic consent or dynamic electronic informed consent. This brief overview suggests that, even though the organization and function of these two-sided markets remain open to (...) criticism, dynamic e-IC should be more widely used, especially in France, if only to determine its real effectiveness. A key question in contemporary metaphilosophy of thought experiments is the “wheat from chaff” problem: How can we separate the good and trustworthy thought experiments from the untrustworthy ones? This article examines this problem by viewing thought experimentation as a form of mental simulation. It argues that we should approach the limitations of thought experiments in light of the general shortcomings of our capacity to run mental simulations. Furthermore, the article proposes an answer to the wheat from chaff problem by (...) presenting three danger signals for untrustworthy thought experiments. These are (1) high counterfactuality of the imagined scenario, (2) complexity of the imagined scenario, and (3) a large psychological distance to the imagined scenario. (shrink)

This review of Turner’s “Computational Artifacts” focuses on one of the key novelties of the book, namely the proposal to understand the nature of computer programs as a “trinity” of specification, symbolic program, and physical process, replacing the traditional dualist views of programs as functional/structural or as symbolic/physical. This trinitarian view is found to be robust and helpful to solve typical issues of dualist views. Drawing comparisons with Simon’s view of the artifact as an interface, the author suggests that this (...) trinitarian view may characterize not only computational artifacts but also artifacts in general. One ambiguity is however noticed on the denotation of what Turner actually calls the “physical process.”. (shrink)

BackgroundSince 2006, the genetic testing company 23andMe has collected biological samples, self-reported information, and consent documents for biobanking and research from more than 1,000,000 individuals, through a direct-to-consumer online genetic-testing service providing a genetic ancestry report and a genetic health report. However, on November 22, 2013, the Food and Drug Administration halted the sale of genetic health testing, on the grounds that 23andMe was not acting in accordance with federal law, by selling tests of undemonstrated reliability as predictive tests for (...) medical risk factors. Consumers could still obtain the genetic ancestry report, but they no longer had access to the genetic health report in the United States. However, this did not prevent the company from continuing its health research, with previously obtained and future samples, provided that consent had been obtained from the consumers concerned, or with health reports for individuals from other countries. Furthermore, 23andMe was granted FDA authorization on February 19, 2015, first to provide reports about Bloom syndrome carrier status, and, more recently, to provide consumers with “carrier status” information for 35 genes known to cause disease.DiscussionIn this Debate, we highlight the likelihood that the primary objective of the company was probably two-fold: promoting itself within the market for predictive testing for human genetic diseases and ancestry at a low cost to consumers, and establishing a high-value database/biobank for research and personal information).SummaryBy dint of this marketing approach, a two-sided market has been established between the consumer and the research laboratories, involving the establishment of a database/DNA biobank for scientific and financial gain.
