BackgroundCountries are increasingly devoting significant resources to creating or strengthening research ethics committees, but there has been insufficient attention to assessing whether these committees are actually improving the protection of human research participants.DiscussionResearch ethics committees face numerous obstacles to achieving their goal of improving research participant protection. These include the inherently amorphous nature of ethics review, the tendency of regulatory systems to encourage a focus on form over substance, financial and resource constraints, and conflicts of interest. Auditing and accreditation programs (...) can improve the quality of ethics review by encouraging the development of standardized policies and procedures, promoting a common base of knowledge, and enhancing the status of research ethics committees within their own institutions. However, these mechanisms focus largely on questions of structure and process and are therefore incapable of answering many critical questions about ethics committees' actual impact on research practices.The first step in determining whether research ethics committees are achieving their intended function is to identify what prospective research participants and their communities hope to get out of the ethics review process. Answers to this question can help guide the development of effective outcomes assessment measures. It is also important to determine whether research ethics committees' guidance to investigators is actually being followed. Finally, the information developed through outcomes assessment must be disseminated to key decision-makers and incorporated into practice. This article offers concrete suggestions for achieving these goals.ConclusionOutcomes assessment of research ethics committees should address the following questions: First, does research ethics committee review improve participants' understanding of the risks and potential benefits of studies? Second, does the process affect prospective participants' decisions about whether to participate in research? Third, does it change participants' subjective experiences in studies or their attitudes about research? Fourth, does it reduce the riskiness of research? Fifth, does it result in more research responsive to the local community's self-identified needs? Sixth, is research ethics committees' guidance to researchers actually being followed? (shrink)

This paper examines the problems that may arise, particularly for military personnel, when the requirements of doing one's duty seem to come into conflict with the demands of loyalty. This conflict is especially problematic because loyalty is often seen, especially by serving military personnel, as the highest of military virtues. The paper introduces a categorisation of ethical issues into two main types, which are referred to as ‘ethical dilemmas’ and ‘tests of integrity’ which is then used to clarify the issues (...) involved when duty and loyalty come into conflict. It is argued that a true understanding of loyalty and disloyalty means that the demands of loyalty can never legitimately override a genuine duty to follow orders. (shrink)

Donald T. Campbell outlines an epistemological theory that attempts to be faithful to evolution through natural selection. He takes his position to be consistent with that of Karl R. Popper, whom he credits as the primary advocate of his day for natural selection epistemology. Campbell writes that neither he nor Popper want to give up the goal of objectivity or objective truth, in spite of their evolutionary epistemology. In discussing the conflict between an epistemology based on natural selection and objective (...) truth, Campbell cites an article by the German sociologist and philosopher Georg Simmel entitled 'On a Connection of Selection Theory to Epistemology', as presenting the issue in a notably forthright manner.The present essay summarizes Simmel's article, with the purpose of clarifying, in terms that Campbell apparently finds satisfactory, the conflict that Campbell acknowledges between an evolutionary epistemology and ultimate truth; the essay then examines the responses of Campbell and Popper to Simmel's position. Might fiction help us to develop and advance new theories about the nature of consciousness? And might such theories, in turn, inform our understanding of the process of reading fiction? Three recent volumes—one by English critic and novelist, David Lodge; another by literary theorist, Alan Palmer; and a third by philosopher and (now) novelist, Dan Lloyd—raise these important, genre-bending questions, and they offer challenging if not always convincing answers to them. More generally, these volumes make valuable contributions to the fruitful cross-pollination that has developed between philosophers, scientists, literary theorists, and novelists who are interested in the nature of consciousness.Lodge's new collection of essays is called Consciousness and the Novel: Connected Essays, and like all of the criticism he has written since the late eighties, this volume is intended for a general audience, not for [End Page 299] literary theorists. The title essay, "Consciousness and the Novel," is a revised version of the Richard Ellman Lectures in Modern Literature that Lodge gave at Emory University in 2001, and the other nine essays, all previously published, cover such topics as Howards End; the novels of Evelyn Waugh; The Letters of Kingsley Amis; Martin Amis's memoir, Experience; and the relationship between literature and criticism. I will focus on "Consciousness and the Novel."Lodge's thesis in this essay is that novels play an essential role in our exploration of the nature of human consciousness. This thesis is certainly true, but it is also entirely banal. Much more interesting is what Lodge says in support of it. He argues that because of the unique representative possibilities of the novel, conscious experiences can be represented more effectively in novels than they can be in scientific writing. Taken literally, as an assertion about the relative representational power of novels and scientific discourse, this is extremely implausible. However, taken more loosely—as an invitation to those of us interested in consciousness to take a closer look at the ways conscious experiences are represented in novels—Lodge's claim is sensible and appealing. I will consider the literal reading of Lodge's claim first and then turn to the looser one.It is undoubtedly true that, as a whole, novelists devote more energy to representing conscious experiences than writers of scientific discourse do. However, science writers can use whatever techniques best serve their aims, including the aim of describing conscious experiences, so there is no reason to think that conscious experiences can, in principle, be represented more effectively in novels than in broadly scientific discourse. Given that Lodge discusses such creative science writers as Antonio Damasio, Daniel Dennett, and Steven Pinker in the course of his essay, it is surprising and disappointing to find him caricature scientific writing in the following way: "science... is a third-person discourse. The first-person pronoun is not used in scientific papers. If there were any hint of qualia in a scientific paper... it would be edited out" (p. 11). Qualia are the supposedly subjective qualitative aspects of conscious experiences. How the plucked string of a cello sounds to you; how the rotting fish in the garbage smells to you; and how it feels for you to inch down into the smooth, almost-too-hot water of a perfect bubble bath—these are all (supposedly) examples of qualia. Lodge is simply mistaken when he says that there is no hint of qualia in scientific writing. There is no consensus about whether qualia can be explained scientifically. Much of the reigning research on non-religion and non-belief focuses on demographics and personality characteristics. While this is a necessary foundation on which future research may be built upon, such data does not necessarily produce theory. In many ways the dominant cultural milieu of religions along with the benign intent of some researchers force a person who holds no belief in a God to assume an oppositional identity in relation to religion. This oppositional identity tautologically sets researchers up to continually (...) define its object by the absence of something. This something cannot always function as a normative point of reference in which to tell researchers what to look for. Taking their motivation from the perceived failure of the reductive physicalist project concerning consciousness, panpsychists ascribe subjectivity to fundamental material entities in order to account for macro-consciousness. But there exists an unresolved tension within the mainstream panpsychist position, the seriousness of which has yet to be appreciated. I capture this tension as a dilemma, and offer advice to panpsychists on how to resolve it. The dilemma is as follows: Panpsychists take the micro-material realm to feature phenomenal properties, plus micro-subjects to (...) whom these properties belong. However, it is impossible to explain the generation of a macro-subject (like one of us) in terms of the assembly of micro-subjects, for, as I show, subjects cannot combine. Therefore the panpsychist explanatory project is derailed by the insistence that the world’s ultimate material constituents are subjects of experience. The panpsychist faces a choice of giving up her explanatory ambitions, or of giving up the claim that the ultimates are subjects. I argue that the latter option is preferable, leading to neutral monism, on which phenomenal qualities are irreducible but subjects are reducible. So panpsychists should be neutral monists. (shrink)

Suppose the prevailing distribution of property rights is unjust as determined by the relevant conception of distributive justice. You have far more than you should have under that theory and I have far less. Then I defraud you and in doing so reallocate resources so that our holdings ex post more closely approximate what distributive justice requires. Do I have a duty to return the property to you? There are many good reasons for requiring me to return to you what (...) I have taken. One is that while you may have no right in justice to all that you own, it does not follow that I do, or that I have a right to take it. Home care is one of the fastest‐growing industries in the United States, providing valuable opportunities for millions of older adults and people with disabilities to live at home rather than in institutional settings. Home care workers assist clients with essential activities of daily living, but their wages and working conditions generally fail to reflect the importance of their work. Drawing on the work of Eva Feder Kittay and other care ethicists, we argue that good care involves attending to the needs (...) of another out of a concern for their well‐being. Such care should be standard in the home care system. Yet, because of the pervasive racial, gender, and economic inequalities that the home care industry perpetuates, home care workers and their clients cannot reasonably be expected to care about each other. We endorse reforms aimed at enabling home care workers and their clients to form and maintain professional relationships that cultivate care.. (shrink)

Could there be a power world? That is to say, could there be a world consisting of nothing but dispositional properties? If there couldn't be, then, obviously, the actual world is not such a world. That is one reason why answering this question is important. However, even if one thinks it is already obvious that the actual world is not a power world, answering this question is still important, because whether there could be a power world depends, in part, on (...) whether all the properties in a world could be dispositional . It also depends on whether dispositional properties require nondispositional bases. Could water solubility, for example, be a brute feature of salt, or must this disposition be explicable in terms of some further, nondispositional property that salt also possesses? Answering these questions about the nature of properties is clearly essential to arriving at a plausible ontology of the actual world. (shrink)

Vantassel Eugene, OR: Resource, 2009. 232pp. $26.00In Dominion over Wildlife?, Stephen Vantassel, a scholar with professional experience in animal damage control, provides a substantive examination of the neglected subject of human–wildlife relations. For this, he is to be commended. Although ultimately disappointing, his argument (...) indicates that much work remains to be done in this area.Vantassel’s subtitle is somewhat misleading since he devotes the bulk of the book to a polemic against a small group he terms “Christian Animal Rights (CAR) activists”—especially Anglican theologian Andrew Linzey and his followers—who question the idea that God grants humans dominion over creation (“Dominionism”), including the moral right to manage, kill, and eat animals. “The critical question... is whether CAR activists are correct in their belief that Scripture exhorts us to adopt a vegetarian and non-violent stance toward animals” (14). Vantassel’s response is more exegetical than theological, and in the mode of conservative evangelical apologetics, he devotes chapters to refuting CAR activists’ appeals to the Old Testament (specifically the covenant of Creation, the narratives of the Fall and Noah, the sacrificial system, and passages that support humane treatment of animals); the New Testament (Christ’s concern for animals, a Christus Victor view of the atonement, and an Edenic eschatology); ethics (compassion, restraint, and stewardship); and science (a case study of whether trapping is unnecessarily cruel and environmentally irresponsible). Only in the final chapter does he propose his model of “Shepherdism,” which “avoids the negative stereotypes held against Dominionism, while upholding God’s decree that humans maintain their superintendence over animals” (160). Shepherdism centers on the principles that creation is “God’s property,” that humans are charged with being its caretakers, and that Christ is a model for behavior toward it. Vantassel insists that humans should treat wildlife humanely and not exterminate species.For Vantassel, theology is a matter of individuals—largely apart from church or tradition—reading an inerrant Bible to discern God’s commands. Likewise, ethics is a matter of individuals using reason to construct arguments that “stand on their own merits” and “may still be sufficient to persuade, if not compel, Christian behavior even if Scripture does not mandate the behavior” (99). This [End Page 193] is not the forum for criticizing these approaches, but they not only distance Vantassel’s argument from scholarship in the field—which he does not engage—but also make it unlikely that it will persuade those who do not read the Bible or view God in the same way. To note two examples, on the basis of Amos 4, he contends that “some environmental problems are caused not through our direct abuse of the land but through our disobedience, which God then punishes through sending environmental catastrophes” (165n13), and on the basis of Christ’s acceptance of fishing with nets (Luke 5:4), he contends that “Christians are permitted to not only eat animals, they may employ means to capture them that will cause pain and injury” (171). Indeed, as a lifelong hunter who shares Vantassel’s basic position, I found myself more sympathetic to the CAR activists’ arguments toward which he is frequently uncharitable; he associates them with Darwinism and feminist and liberation theologies, labels their hermeneutics “modernistic” for stressing narrative, and variously calls their ideas “absurd,” “incredulous,” and “strange.”Vantassel discusses a number of helpful statistics and studies, and he rightly points out the problems posed by factory farming, the disproportionate effects of environmental degradation on the poor, and the practical difficulties of vegetarianism. Background Biobanking and genomic research requires collection and storage of human tissue from study participants. From participants’ perspectives within the African context, this can be associated with fears and misgivings due to a myriad of factors including myths and mistrust of researchers. From the researchers angle ethical dilemmas may arise especially with consenting and sample reuse during storage. The aim of this paper was to explore these ethical considerations in the establishment and conduct of biobanking and genomic studies in Africa. (...) Methods We conducted a narrative synthesis following a comprehensive search of nine (9) databases and grey literature. All primary research study designs were eligible for inclusion as well as both quantitative and qualitative evidence from peer reviewed journals, spanning a maximum of 20 years (2000–2020). It focused on research work conducted in Africa, even if data was stored or analysed outside the region. Results Of 2,663 title and abstracts screened, 94 full texts were retrieved and reviewed for eligibility. We included 12 studies (7 qualitative; 4 quantitative and one mixed methods). Ethical issues described in these papers related to community knowledge and understanding of biobanking and genomic research, regulation, and governance of same by research ethics committees, enrolment of participants, types of informed consents, data collection, storage, usage and sharing as well as material transfer, returning results and benefit sharing. ca. Biospecimen collection and storage is given in trust and participants expect confidentially of data and results generated. Most participants are comfortable with broad consent due to trust in researchers, though a few would like to be contacted for reconsenting in future studies, and this would depend on whether the new research is for good cause. Sharing data with external partners is welcome in some contexts but some research participants did not trust foreign researchers. Conclusion Biobanking and genomic studies are a real need in Africa. Linked to this are ethical considerations related to setting up and participation in biobanks as well as data storage, export, use and sharing. There is emerging or pre-existing consensus around the acceptability of broad consent as a suitable model of consent, the need for Africans to take the lead in international collaborative studies, with deliberate efforts to build capacity in local storage and analysis of samples and employ processes of sample collection and use that build trust of communities and potential study participants. Research ethics committees, researchers and communities need to work together to work together to adapt and use clearly defined ethical frameworks, guidelines, and policy documents to harmonize the establishment and running of biobanking and genomic research in Africa. Some believe that it is immoral to harm animals, but it is not immoral to kill humanely raised domesticated animals. Implicit in this is the assumption that it is possible to raise and slaughter animals without harming them significantly. In recent years, a number of philosophers – DeGrazia, Harman, Bradley, and others – have claimed that slaughter harms an animal in proportion to the amount of valuable future life that an animal loses in dying, which seems to challenge this assumption. (...) But a question remains: how much are domesticated animals, particularly humanely raised ones, harmed by their slaughter? Here, I take up this question. My answer may be surprising: in ordinary circumstances, slaughter hardly deprives humanely raised animals of any good life, and so is not very harmful to them. This result may strengthen the case for humane slaughter – or it may give us reason to revise our understanding of the harmfulness of death. (shrink)

Objective: To study the preferences of patients for information related to elective procedures.Methods: A survey was carried out using a sample of 187 women. The majority of whom were on a low-income, who obtained obstetric or gynaecological services at St Joseph Regional Medical Center in Milwaukee, Wisconsin, while they were in a waiting room.Results: Many of the complications, including those that are uncommon and less serious, were considered to be relevant to the medical decisions of most patients. Average seriousness ratings (...) associated with complications of various elective procedures were in the range of moderate to high. A frequency of complications of 1:100 or higher would factor into most women’s elective treatment decisions. Women indicated a preference for receiving as much or more information pertaining to complications associated with particular elective obstetric or gynaecological procedures as other elective procedures.Conclusion: Most women wish to be informed of risks and treatment alternatives, rate many complications as serious, and are likely to use information provided to make elective treatment decisions. When is it justifiable to exclude a person who wishes to enter a country? What are the acceptable moral bases for immigration policy? These questions lie at the heart of this book, the first interdisciplinary study of the fundamental normative issues underpinning immigration policy. A distinguished group of economists, political scientists, and philosophers offer a provocative discussion of this complex topic. Among the issues addressed are the proper role of the state in supporting a particular culture, the possible destabilization of (...) the political and social life of a country through immigration, the size and distribution of economic losses and gains, and the legitimacy of discriminating against potential immigrants in favor of members of the resident population. In this extraordinary collection, many of the leading legal philosophers in the world evaluate the success of Hart's responses to Dworkin on several of these counts. Notable contributors include Joseph Raz of Oxford University and Jules L. Coleman of the Yale Law School.

According to Russellian monism, consciousness is constituted at least partly by quiddities: intrinsic properties that categorically ground dispositional properties described by fundamental physics. If the theory is true, then consciousness and such dispositional properties are closely connected. But how closely? The contingency thesis says that the connection is contingent. For example, on this thesis the dispositional property associated with negative charge might have been categorically grounded by a quiddity that is distinct from the one that actually grounds it. Some argue (...) that Russellian monism entails the contingency thesis and that this makes its consciousness‐constituting quiddities epiphenomenal—a disastrous outcome for a theory that is motivated partly by its prospects for integrating consciousness into physical causation. We consider two versions of that argument, a generic version and an intriguing version developed by Robert J. Howell, which he bases on Jaegwon Kim's well‐known “exclusion argument.” We argue that neither succeeds. (shrink)

One of the first volumes in the new series of prestigious Oxford Handbooks, The Oxford Handbook of Jurisprudence and Philosophy of Law brings together specially commissioned essays by twenty-six of the foremost legal theorists currently writing, to provide a state of the art overview of jurisprudential scholarship.

Notwithstanding its phenomenological appeal, physicalists have tended to shun the notion that we are ‘acquainted’ with our mental states in consciousness, due to the fact that the acquaintance relation seems mysterious, irreducible, and consequently unnatural. I propose a model of conscious experience based on the idea of ‘mental quotation’, and argue that this captures what we want from acquaintance but without any threat to naturalism. More generally the chapter embodies a complaint that reductionists seem unable to look past the representation (...) relation to do the implementing of consciousness, and a call for theorists to investigate other relations to model our connection to our conscious states, like the constitution/part-whole relationship. This mundane relation has what it takes to give us natural acquaintance with our conscious-mental states. (shrink)

In this paper I first examine two important assumptions underlying the argument that physicalism entails panpsychism. These need unearthing because opponents in the literature distinguish themselves from Strawson in the main by rejecting one or the other. Once they have been stated, and something has been said about the positions that reject them, the onus of argument becomes clear: the assumptions require careful defence. I believe they are true, in fact, but their defence is a large project that cannot begin (...) here. So, in the final section I comment on what follows if they are granted. I agree with Strawson that --broadly -- 'panpsychism' is the direction in which philosophy of mind should be heading; nevertheless, there are certain difficulties in the detail of his position. This article will examine the case of Ms B, a woman with tetraplegia for a year, who, prior to rehabilitation or return to community life, sought a ruling that doctors may turn off her ventilator. The authors are people with disabilities. Their analysis focuses on the manner in which the High Court framed the case in terms of mental capacity, addressed the issue of suicide and ambivalence, and resolved informed consent and treatment alternative issues. US does not oppose the general right to refuse treatment, there is significant concern about lack of informed consent and denial of desired treatment alternatives, and the cavalier manner in which these factors have been dismissed. With the development of the division of labor, the household has declined in importance as a unit of economic production. Yet even as the individual wage earner has assumed a central place in modern exchange economies, the household has still been seen as an important unit of distribution, in which wage earners provide for their non-income-producing family members. With the breakdown of the family in recent decades, however, the communal income-sharing function of the family has, in significant part, been taken (...) overby the state. In this essay, I examine this fundamental change in the structure of production and distribution in modern exchange economies. Going beyond this, I propose a new structure of markets–markets for rights to influence collective decision-making within a society. Examining Metaphors in Biopolitical Discourse This essay argues that common metaphors and metaphoric phrases used in biopolitical discourse limit how meanings are constructed by framing messages narrowly: so much so, that alternate readings are delimited, resulting in less opportunity for cognitive scrutiny of such messages. We moor our discussion of metaphors in cognitive linguistics, building on three decades of research by scholars including Sam Glucksberg, George Lakoff and Mark Johnson, and Ray Gibbs, Jr., demonstrating how research in framing effects bolsters (...) our claims of limited entailments resulting from message construction. By situating our discussion of framing in biopolitics we make a case that metaphors including Frankenfood, designer baby, vegetative state and death tax address how life and death are "managed" in discourse. In this essay we demonstrate ways in which the framing of some metaphors in social discourse slip under readers' and viewers' cognitive radars, and thus become "under-the-radar metaphors.". (shrink)
