Historically, the standard of care in medical negligence provided considerable scope for external evaluation of clinical judgment. Under the Bolam test, however, determining the standard was seen by the courts as essentially a matter for the medical profession, to be resolved by expert testimony with minimal court scrutiny. In recent years, courts have become more willing to probe such testimony and challenge the credibility of medical experts, although they would very rarely override clinical judgment. The House of Lords' decision in (...) Bolitho may be construed as inviting courts to reach their own conclusions on the reasonableness of clinical conduct, along standard risk–benefit lines, after having made their own assessment of the expert opinion. Closer scrutiny of such opinion is the more welcome in the light of current concerns about partisanship in expert testimony. (shrink)

We provide a general argument against value incomparability, based on a new style of impossibility result. In particular, we show that, against plausible background assumptions, value incomparability creates an incompatibility between two very plausible principles for ranking lotteries: a weak "negative dominance" principle (to the effect that Lottery 1 can be better than Lottery 2 only if some possible outcome of Lottery 1 is better than some possible outcome of Lottery 2) and a weak form of ex ante Pareto (to (...) the effect that, if Lottery 1 gives an unambiguously better prospect to some individuals than Lottery 2, and equally good prospects to everyone else, then Lottery 1 is better than Lottery 2). Individual differences in effortful control, a component of temperament, reflecting the ability to use attention and other cognitive processes to self-regulate emotion and behavior, contribute to child academic adjustment, social competence, and wellbeing. Research has linked excessive screen time in early childhood to reduced self-regulation ability. Furthermore, research suggests that parents are more likely to use screens with children who have more challenging temperaments, such as low levels of effortful control. Since screen time by children between the ages of 0 (...) and 18 has increased during the COVID-19 pandemic, it remains timely to investigate the developmental pattern of association between child screen media use and effortful control. We hypothesize that higher levels of screen media intake at age 3.5 will be associated with lower effortful control at age 4.5 and that lower effortful control at 3.5 will contribute to more screen media intake at age 4.5. This study draws on participants followed longitudinally over the span of 2-years for an investigation of Canadian preschoolers’ screen media use during the pandemic. A follow-up with this sample was completed in 2021. Analyses using a cross-lagged panel model revealed stability in child screen time and effortful control between the ages of 3.5 and 4.5. Child screen time at age 3.5 significantly contributed to decreased effortful control scores at the age of 4.5, whereas effortful control at age 3.5 did not contribute to screen time at age 4.5. Our results partially confirmed our hypothesis and indicated that higher levels of screen time intake were detrimental to the development of effortful control. These results suggest that screen media use, an exceedingly frequent activity, may play an enduring role in development by shaping young children’s temperaments. (shrink)

This paper presents a general education course offered at The Pennsylvania State University that integrates AI ethics within a creative arts context. The course emphasizes AI literacy and the ethical use of AI tools through the creation and critique of AI-generated art, literature, and music. Since its inception, the course has evolved to accommodate increasing enrollments and diverse student demographics while maintaining a focus on hands-on activities and ethical discussions. Student feedback indicates high engagement with the course’s ethical content, prompting (...) considerations for future course revisions. The authors argue that AI literacy, particularly ethical considerations, is essential for all students and advocate for the creation of similar courses across educational institutions to better prepare students for the ethical challenges of emerging AI technologies. MARX’s debt to Aristotle is acknowledged in part 1 of Capital, admittedly the most difficult and, as will be argued, the most fundamental part of his principal work. His principal work is the one which establishes that the labor theory of value holds not only in the state of nature, as for Locke, nor only in primitive society, as for Adam Smith, but also in the highest civilized society and, as against Ricardo, in such a way as to prove that (...) the proletariat is and must be exploited but will and can never exploit. With the analysis and reduction of capital into labor, the possibility of freedom in this new meaning, which is merely asserted in the "humanism" of his earlier writings, is proven and secured with the necessity of science. Considerable work within the modern 'space-time theory' approach to relativity physics has been devoted to clarifying the role and meaning of the principle of relativity. Two recent discussions of the principle within this approach, due to Arntzenius (1990) and Friedman (1983), are found to contain difficulties.

Since the 1909 work of Carathéodory, formulations of thermodynamics have gained ground which highlight the role of the the binary relation of adiabatic accessibility between equilibrium states. A feature of Carathéodory's system is that the version therein of the second law contains an ambiguity about the nature of irreversible adiabatic processes, making it weaker than the traditional Kelvin-Planck statement of the law. This paper attempts first to clarify the nature of this ambiguity, by defining the arrow of time in thermodynamics (...) by way of the Equilibrium Principle. It then argues that the ambiguity reappears in the important 1999 axiomatisation due to Lieb and Yngvason. (shrink)

While intended more for intellectual historians than for philosophers or Harvardians, this book will be found valuable by all three of these groups, hitherto considered distinct. The author announces three themes: the Harvard curriculum of moral philosophy in the seventeenth century; the transition in that century from scholasticism to Cartesianism, as visible in the great change in Harvard texts from 1650 to 1710; and a more specific argument that the influence of eighteenth-century sentimentalism was prepared by seventeenth-century Puritan religious thought. (...) These themes are articulated in chapters that are roughly chronological and show the stages of the critical transition, or change, from Aristotle to modern moral philosophy. This volume is a tribute by his peers, and by younger scholars of the next generation, to Harvey M. Friedman, perhaps the most profound foundationalist since Kurt Godel. Friedman's researches, beginning precociously in his mid-teens, have fundamentally shaped our contemporary understanding of set theory, recursion theory, model theory, proof theory and metamathematics. His achievements in concept formation and theory formulation have also renewed the standard set by Godel and Alfred Tarski for the general intellectual interest and importance of technical (...) work in foundations. Friedman pioneered the now well-established and flourishing field of Reverse Mathematics, whose aim is to calibrate the intrinsic logico-mathematical consistency-strength of all the important theorems of mathematics. He has relentlessly pursued the full extent of the incompleteness phenomena into which Godel provided the first revealing glimpse. The Godel--Friedman program, as it is now deservingly called, seeks to find simple, natural and elegant mathematical statements of a combinatorial nature, that can be proved to be independent of set theory even when extended by powerful large-cardinal existence axioms. I present a new puzzle about choice under uncertainty for agents whose preferences are sensitive to multiple dimensions of outcomes in such a way as to be incomplete. In response, I develop a new theory of choice under uncertainty for incomplete preferences. I connect the puzzle to central questions in epistemology about the nature of rational requirements, and ask whether it shows that preferences are rationally required to be complete.

Are LLMs cultural technologies like photocopiers or printing presses, which transmit information but cannot create new content? A challenge for this idea, which we call bibliotechnism, is that LLMs generate novel text. We begin with a defense of bibliotechnism, showing how even novel text may inherit its meaning from original human-generated text. We then argue that bibliotechnism faces an independent challenge from examples in which LLMs generate novel reference, using new names to refer to new entities. Such examples could be (...) explained if LLMs were not cultural technologies but had beliefs, desires, and intentions. According to interpretationism in the philosophy of mind, a system has such attitudes if and only if its behavior is well explained by the hypothesis that it does. Interpretationists may hold that LLMs have attitudes, and thus have a simple solution to the novel reference problem. We emphasize, however, that interpretationism is compatible with very simple creatures having attitudes and differs sharply from views that presuppose these attitudes require onsciousness, sentience, or intelligence (topics about which we make no claims). Robert Aumann presents his Agreement Theorem as the key conditional: “if two people have the same priors and their posteriors for an event A are common knowledge, then these posteriors are equal” (Aumann, 1976, p. 1236). This paper focuses on four assumptions which are used in Aumann’s proof but are not explicit in the key conditional: (1) that agents commonly know, of some prior μ, that it is the common prior; (2) that agents commonly know that each of them updates (...) on the prior by conditionalization; (3) that agents commonly know that if an agent knows a proposition, she knows that she knows that proposition (the “K K” principle); (4) that agents commonly know that they each update only on true propositions. It is shown that natural weakenings of any one of these strong assumptions can lead to countermodels to Aumann’s key conditional. Examples are given in which agents who have a common prior and commonly know what probability they each assign to a proposition nevertheless assign that proposition unequal probabilities. To alter Aumann’s famous slogan: people can “agree to disagree”, even if they share a common prior. The epistemological significance of these examples is presented in terms of their role in a defense of the Uniqueness Thesis: If an agent whose total evidence is E is fully rational in taking doxastic attitude D to P, then necessarily, any subject with total evidence E who takes a different attitude to P is less than fully rational. According to relationism, for Alice to believe that some rabbits can speak is for Alice to stand in a relation to a further entity, some rabbits can speak. But what could this further entity possibly be? Higher-order metaphysics seems to offer a simple, natural answer. On this view (roughly put), expressions in different syntactic categories (for instance: names, predicates, sentences) in general denote entities in correspondingly different ontological categories. Alice's belief can thus be understood to relate her to a sui (...) generis entity denoted by "some rabbits can speak", belonging to a different ontological category than Alice herself. This straightforward account of the attitudes has historically been deemed so attractive that it was seen as providing an important motivation for higher-order metaphysics itself (Prior [1971]). But I argue that it is not as straightforward as it might seem, and in fact that propositional attitudes present a foundational challenge for higher-order metaphysics. (shrink)

This article presents a new interpretation of the great Ming dynasty philosopher Wang Yangming’s celebrated doctrine of the “unity of knowledge and action”. Wang held that action was not unified with all knowledge, but only with an elevated form of knowledge, which he sometimes called “genuine knowledge”. I argue for a new interpretation of this notion, according to which genuine knowledge requires freedom from a form of doxastic conflict. I propose that, in Wang’s view, a person is free from this (...) form of doxastic conflict if and only if they are acting virtuously. (shrink)

In Educating Reason, Harvey Siegel presented the case regarding rationality and critical thinking as fundamental education ideals. In Rationality Redeemed? , a collection of essays written since that time, he develops this view, responds to major criticisms raised against it, and engages those critics in dialogue. In developing his ideas and responding to critics, Siegel addresses main currents in contemporary thought, including feminism, postmodernism and multiculturalism.

‘Argument’ has multiple meanings and referents in contemporary argumentation theory. Theorists are well aware of this but often fail to acknowledge it in their theories. In what follows, I distinguish several senses of ‘argument’ and argue that some highly visible theories are largely correct about some senses of the term but not others. In doing so, I hope to show that apparent theoretical rivals are better seen as collaborators or partners, rather than rivals, in the multi-disciplinary effort to understand ‘argument,’ (...) arguments, and argumentation in all their varieties. I argue as well for a pluralistic approach to argument evaluation and argumentative norms, since arguments and argumentation can be legitimately evaluated along several dimensions, but urge that epistemic norms enjoy conceptual priority. We review the dynamical approach to spacetime theories---in particular, its origins in the development of special relativity, its opposition to the contemporary `geometrical' approach, and the manner in which it plays out in general relativity. In addition, we demonstrate that the approach is compatible with the `angle bracket school'.

AbstractThis essay argues for a new interpretation of the notion of “unity” in Yangming’s 王陽明 famous doctrine of the “unity of knowledge and action” (zhi xing he yi 知行合一). I distinguish two parts of Wang’s doctrine: one concerning training (gong fu 工夫), and one concerning the “original natural condition” of knowledge and action (ben ti 本體). I focus on the latter aspect of the doctrine, and argue that Wang holds, roughly, that a person exhibits knowledge in its original natural condition (...) if and only if the person exhibits action in its original natural condition. Moreover, I argue that Wang denies that knowledge in its original natural condition is identical to action in its original natural condition. (shrink)

Beller, Bender, and Medin question the necessity of including social anthropology within the cognitive sciences. We argue that there is great scope for fruitful rapprochement while agreeing that there are obstacles (even if we might wish to debate some of those specifically identified by Beller and colleagues). We frame the general problem differently, however: not in terms of the problem of reconciling disciplines and research cultures, but rather in terms of the prospects for collaborative deployment of expertise (methodological and theoretical) (...) in problem-driven research.
