If we have a natural right to liberty, it is hard to see how a state could be legitimate without first obtaining the (genuine) consent of the governed. I consider the threat natural rights pose to state legitimacy. I distinguish minimal from full legitimacy and explore different understandings of the nature of our natural rights. Even though I conclude that natural rights do threaten the full legitimacy of states, I suggest that understanding our natural right to liberty to be grounded (...) in our interests in a certain way might not commit us to requiring consent for minimal legitimacy. Thus, even if natural rights effectively block the full legitimacy of states - on the assumption that rarely, if ever, the requisite consent will be forthcoming - they may allow minimal state legitimacy. This study examines the notion of antinomy, or unavoidable contradiction, in the work of Pavel Florensky. Many Russian philosophers of the Silver Age shared a common conviction which is yet to receive sufficient attention in critical literature, either in Russia or abroad. This is namely a philosophical and theological dependence on unavoidable contradiction, paradox, or antinomy. The history of antinomy and its Russian reception is introduced here before a new framework for understanding Russian antinomism is defended. This is namely the (...) anticipation of ‘vertical’ antinomies in ‘horizontal’ antinomies. Here, by ‘horizontal’ we suppose an unavoidable contradiction of reason or philosophical reflection, and by ‘vertical’ an unavoidable contradiction of revelation, faith, or a self-contradictory dogma. The study aims to demonstrate that Florensky fails to provide a satisfactory anticipation of vertical antinomies. (shrink)

Comte argued against the Cartesian conception of the mind that the thinker cannot simultaneously think or perceive and observe itself so doing. Based on insights from cognitive neuroscience, Dehaene has recently given a contemporary answer to Comte’s challenge. He has extended some ideas of Helmholtz on unconscious inferences and argued that we can resolve Comte’s problem by reformulating it in terms of the brain. Since the brain consists of different parts having different functions, it is possible that some parts are (...) involved in observing (they unconsciously process information) while other parts integrate the received information resulting in conscious experiences to which we have access. Dehaene’s answer is criticized and the alternative neo-Aristotelian resolution of Comte’s challenge is discussed. Explanations of blindsight are used to illustrate the differences between the two responses to Comte’s challenge. (shrink)

First published in 1987. The theory that political obligation and authority are derived from the consent of citizens is commonly accepted in the history of Western political thought. It is expressed in the famous assertion of the American Declaration of Independence that governments derive 'their just powers from the consent of the governed' and in the constitutions of some Western powers. This book provides the first systematic and comprehensive restatement and defence of consent theory since the 19th Century. It distinguishes (...) consent from contract theory, examines what the actual consent of citizens can consist in and what place it must have in liberal democratic theory. The consent theory's relationship with ethics is explored and the major objections to the theory are countered. The author points to some political reforms which would increase the proportion of citizens in liberal democracies whose consent places them under political obligation. The book provides an overview of the current state of the consent theory of political obligation and authority. (shrink)

The aim of Massimiliano Tomba’s Insurgent Universality is to return to Marxism’s original historical vocation by freeing it from the hegemony of the exchange system and the encompassing agency of value. At the heart of this project appears the recognition that time, space and thus history have been captured by capitalism and transformed into categories of its own to organise people and social relationships for capital’s programme of accumulation. In this way, capital has been able to hijack history and invert (...) it into a representation of the real, into a historical trompe-l’œil instead of ‘presentify(ing) the past’. In this regard contemporising the past is an act of intervening in history and actualising it rather than representing it. Through this operation Tomba is able to retrieve an inventory of repressed and forgotten histories, which will unveil the sources of an ‘alternate legacy of modernity’ and radical political possibilities for the present. National and international guidelines outlining ethical conduct in research involving humans and animals have evolved into large and complex documents making the process of gaining ethics approval a complicated task for researchers in the area. Researchers, in particular those who are relatively new to the ethics approval process, can struggle to understand the parts of an ethics guideline that apply to their research and the nature of their ethical obligations to trial participants. With the scope of medical research likely to (...) continue to expand in the future, it is clear that ethics guidelines will only increase in complexity and number. This paper describes one possible solution to the problem: the use of an internet-based expert system to intelligently and interactively distribute the information stored in ethics guidelines to individual researchers. This paper also details how one such system was designed and tested with respect to Australian medical research ethics guidelines. (shrink)

Against the view of certain philosophers, such as Thomas Nagel, I defend the common sense belief that people are not morally responsible for what they do or bring about inadvertently. I consider what response we might reasonably expect from a person who inadvertently does or brings about some event or condition that is manifestly undesirable or bad; and I suggest that we might reasonably expect such a person not to feel guilty but, rather, to feel embarrassed by his or her (...) inability to prevent or avoid that condition or event. We argue that for theorists with a post-institutional conception of property, e.g., Rawlsians, there is no principled reason to limit the domain of distributive justice to tax and transfer-both tax policy and the rules of the private law are constructed in service to distributive aims. Such theorists cannot maintain a commitment to a normative conception of private law independent of their overarching distributive principles. In contrast, theorists with a pre-institutional conception of property can derive the private law from sectors of (...) morality independent of distributive justice. Nevertheless, we argue, this does not entail that the private law, for pre-institutional theorists, must be sanitized of equity-oriented values. Non-libertarian pre-institutional theorists holding principled commitments to equity-oriented values are free to invoke either tax and transfer or the rules of the private law to attain them. Business and love appear to have little to do with each other. We hold the opposite to be true if the concept of love in business draws from two corresponding grammars. This paper contributes to the ‘agenda for growth and affirmation of people and the environment’ in business. By focusing on the grammars of love and business we operationalize the concept of love in ways that business executives, managers and employees can understand, adopt, and implement. With references to the theory (...) and practice of management and organizations, we aim to contribute to expanding the theory and practice of responsible organizations and their leaders caring for others. Although fear and anxiety have gradually become a shared experience in the time of COVID-19, few studies have examined its content from historical, cultural, and phenomenological perspectives concerning the self-awareness and alterity. We discuss the development of the ubiquitous nature of Taijin-kyōfushō (TKS), a subtype of social anxiety disorder (SAD) originated and considered culturally-bound in the 1930s Japan involving fear of offending or displeasing other people. Considering the historical processes of disease classification, advances in cognitive neurosciences, and the need to (...) better understand the content of suffering, psychiatric nosology for SAD still appears controversial and requires further investigations. In this contribution we will briefly discuss the shareholders' need for social, ethical and environmental information and the efforts of corporations to address this need. Looking at three cases, we will raise some doubt with regard to the adequacy of corporate SEE reporting to meet the needs of shareholders. We will discuss the following three cases: BP's investments in Azerbaijan, Nike's management of its labour conditions, of child labour and security issues, and Monsanto's production of genetically modified seeds.

In utopian/science fiction literature, comprehensive knowledge is a familiar motif that also inspires recent policies to screen society through surveillance. In the late 20th century, a digital archive promised to facilitate quick access to abundant information and effective strategies to confront myriad challenges. Yet, today, the scale and scope of information accumulation in national and corporate repositories is reaching proportions whose intelligent processing excedes human capabilities, and triggering a shift in focus from dumb repository to artificial intelligence. Processing such accumulation (...) of knowledge necessiates skills commonly attributed to divinity. Without a theory that recognizes this condition and informs the operations of artificial intelligence, the latter is likely to fail in human ways, e.g., by perceiving false patterns resulting from flawed theories assigning meaning to knowledge. For successful pattern recognition to occur, theories must rest on science fiction and a digital ontotheology of the machine as the form this archive assumes. (shrink)

We spend a lot of time arguing about how schools might be improved. But we rarely take a step back to ask what we as a society should be looking for from education—what exactly should those who make decisions be trying to achieve? In Educational Goods, two philosophers and two social scientists address this very question. They begin by broadening the language for talking about educational policy: “educational goods” are the knowledge, skills, and attitudes that children develop for their own (...) benefit and that of others; “childhood goods” are the valuable experiences and freedoms that make childhood a distinct phase of life. Balancing those, and understanding that not all of them can be measured through traditional methods, is a key first step. From there, they show how to think clearly about how those goods are distributed and propose a method for combining values and evidence to reach decisions. They conclude by showing the method in action, offering detailed accounts of how it might be applied in school finance, accountability, and choice. The result is a reimagining of our decision making about schools, one that will sharpen our thinking on familiar debates and push us toward better outcomes. (shrink)

On the face of it, the directors of new large scientific projects have an impossible task. They have to make technical decisions about sciences in which they have never made a research contribution—sciences in which they have no contributory expertise. Furthermore, these decisions must be accepted and respected by the scientists who are making research contributions. The problem is discussed in two interviews conducted with two directors of large scientific projects. The paradox is resolved for the managers by their use (...) of interactional and referred expertise. The same analysis might be applicable to management in general. There are widespread calls for increased demographic diversity in science, often linked to the epistemic claim that including more perspectives will improve the quality of the knowledge produced. By distinguishing between demographic and epistemic diversity, we show that this is only true some of the time. There are cases where increasing demographic diversity will not bring about the necessary epistemic diversity and cases where failing to exclude some voices reduces the quality of the scientific debate. We seek to resolve these (...) tensions with an analysis that turns on the way the experience-based expertise of non-scientists can be absorbed into mainstream science. Mostly it has to be done via what we call ‘virtual diversity’, in which scientists take responsibility for acquiring interactional expertise in the non-scientific expertise-based domains which they consider provide knowledge valuable to the science. We argue that virtual diversity represents the only feasible option in most scenarios, with cases where demographic diversity or full cultural mergers provide the solution being the exception rather than the rule. This analysis is an exercise in the sociology of knowledge, which is considered as being continuous with philosophy. The paper is prescriptive as well as descriptive, and the moral, cultural, political, and educational implications of the argument are drawn out. A main conclusion is that the acquisition of virtual diversity should be a new norm for science, allowing the voices of experienced non-scientist citizens to be heard but without eroding the institution of science, which continues to be a vital foundation of truth in democracy. The subsystem S of Parry's AI [10] (obtained by omitting modus ponens for the material conditional) is axiomatized and shown to be strongly complete for a class of three valued Kripke style models. It is proved that S is weakly complete for the class of consistent models, and therefore that Ackermann's rule is admissible in S. It also happens that S is decidable and contains the Lewis system S4 on translation — though these results are not presented here.
