Die Arbeit war von der Lykienforschung lange erwartet worden. Denn die wichtigen Entdeckungen lykischer Kirchen und Klöster durch M. R. Harrison in den 60er Jahren des vergangenen Jahrhundert boten nur eine kursorische Dokumentation dieser Denkmäler, die noch viele Fragen offen ließ. Daher versprachen die 1976 und 1977 durchgeführten Surveys der beiden Autoren entscheidende „Nachbesserungen“ und neue Erkenntnisse. Leider blieb das Manuskript ganze 20 Jahre liegen, ehe es zum Druck gegeben wurde, der dann noch einmal sechs Jahre auf sich (...) warten ließ. Es fußt auf einem Forschungsstand von 1997. Damit konnte der in den letzten Jahren erfolgte Schub jüngerer Forschung zu frühbyzantinischen Denkmälern Lykiens nicht mehr berücksichtigt werden. Few seem to have difficulty in distinguishing between religious and secular institutions, yet there is widespread disagreement regarding what "religion" actually means. Indeed, some go so far as to question whether there is anything at all distinctive about religions. Hence, formulating a definition of "religion" that can command wide assent has proven to be an extremely difficult task. In this article I consider the most prominent of the many rival definitions that have been proposed, the majority falling within three basic (...) types: intellectual, affective and functional definitions. I conclude that there are pragmatic reasons for favouring the formerly popular view that essentialist definitions of "religions" are inadequate, and that religions should be construed, instead, as possessing a number of "family resemblances". In so arguing, I provide a response to the view that there is nothing distinctive about religions, as well as to the recent claim that religions do not exist. (shrink)

In their important book, Causation in the Law, H. L. A. Hart and Tony Honore argue that causation in the law is based on causation outside the law, that the causal principles the courts rely on to determine legal responsibility are based on distinctions exercised in ordinary causal judgments. A distinction that particularly concerns them is one that divides factors that are necessary or sine qua non for an effect into those that count as causes for purposes of legal responsibility (...) and those that do not. Hart and Honore claim that this distinction is often one of fact rather than of legal policy, and that the factual basis is to be found in the ordinary distinction we draw between causes and 'mere conditions'. If this claim is correct, we may hope to illuminate the legal distinction by articulating the principles behind the ordinary one. This is a challenging task since, as in the case of most cognitive skills, we are far better at making particular judgments than we are at stating the general principles that underlie them. Hart and Honore devote the first part of their book to this difficult task. We have, then, two large projects. One is to articulate our ordinary notion of causation, especially the distinction between cause and mere condition. This is the project of constructing an 'ordinary model'. The other is to argue for what we may call the 'shared concept claim', the claim that the concept of legal cause is based on the ordinary notion of causation, that 'causal judgments, though the law may have to systematize them, are not specifically legal. They appeal to a notion which is part of everyday life' (1985, p. lv; all references to follow are from this edition). This essay will focus on Hart and Honore's ordinary model, rather than on their shared concept claim. Written by a non-Jewish analytic philosopher, this book addresses the issue of whether, and to what extent, current opposition to Israel on the liberal-left embodies anti-Semitic stances. It argues that the dominant climate of liberal opinion disseminates, however inadvertently, a range of anti-Semitic assertions and motifs of the most traditional kind. It advocates a return to an unrestricted anti-racism which would allow liberals to defend Palestinian interests without demonizing Jews.

A complex of transformations, carried into effect with varying tempos since the beginning of the era of industrial revolutions, has disrupted a certain number of human societies: societies which the ethnologists often call “modern” in opposing them to those labeled “traditional.”.

This article reviews three basic ways in which the relationship between Abrahamic religion and science has been construed: as fundamentally antagonistic; as non‐antagonistically incommensurable; and as complementary. Unfortunately, while each construal seems to offer benefits to the religious believer, none, as the article demonstrates, is without considerable cost.

Sterba argues that God would be ethically bound to implement a set of exceptionless evil prevention requirements. However, he argues that the world as we know it is not as it would be if God were applying them. Sterba concludes that God does not exist. In this paper, I offer a penal colony theodicy that will show how the world as we know it is entirely compatible with God’s implementation of such evil prevention requirements.

In a recent article JRS, 68 f. Nicholas Horsfall sought to demonstrate that Corythus, which Virgil makes the original home of Dardanus, should be identified with Tarquinii, some 50 miles north-west of Rome, on the coast of Etruria, rather than with Cortona, roughly twice as far away, to the north, and inland. In doing so he expressed surprise that the Virgilian evidence should have been completely ignored by previous writers on the subject : and, using the Aeneid as the main (...) source on which his own argument was based, he supported his conclusion with a careful examination of several other aspects of the problem. This paper examines the impact of neoreactionary (NRx) thinking – that of Curtis Yarvin, Nick Land, Peter Thiel and Patri Friedman in particular – on contemporary political debates manifest in ‘architectures of exit’. We specifically focus on Urbit, as an NRx digital architecture that captures how post-neoliberal politics imagines notions of freedom and sovereignty through a micro-fracturing of nation-states into ‘gov-corps’. We trace the development of NRx philosophy – and situate this within contemporary political and technological change to theorize the (...) significance of exit manifest within the notion of ‘dynamic geographies’. While technological programmes such as Urbit may never ultimately succeed, we argue that these, and other speculative investments such as ‘seasteading’, reflect broader post-neoliberal NRx imaginaries that were, perhaps, prefigured a quarter of a century ago in The Sovereign Individual. Nicolas Malebranche 1In his Éloge du Pere Malebranche, delivered to the Parisian Academy of Sciences on 22 April 1716, Bernard Fontenelle recounted the story of Nicolas Malebranche's somewhat controversial conversion to Cartesianism. When friends and colleagues had taken him to task over his new-found commitment to the doctrines of Descartes, Malebranche responded with this question: "Did Adam have the perfect science?" It was agreed that this was the common view. Malebranche responded that he, too, aspired to the perfect science, and that his quest for this knowledge could not be satisfied by following the historical or critical pursuits of his colleagues, but by adopting the procedures set out by Descartes. 2 For Malebranche, the Cartesian method offered a means of overcoming the limitations of the fallen intellectual faculties of Adam's seventeenth-century descendents, and thus of restoring the fabled encyclopedic knowledge of the first man. [End Page 239]Aspirations to recover the science of Adam provided a common motivation for a number of early-modern philosophical projects. Earlier in the seventeenth century Francis Bacon had famously observed in his Novum Organum (1620) that the human dominion over nature which Adam had lost at the Fall could be restored in some measure by the sciences: "For man by the fall fell at the same time from this state of innocency and from his dominion over creation." The moral losses of the human race were to be restored in some measure by "religion and faith"; Adam's lost knowledge, and the dominion which it made possible, by "arts and sciences." 3 Bacon's vision of a reconstructed knowledge of nature during the period which he regarded (somewhat prematurely) as "the last times" clearly played an important role in legitimizing the goals and methods of the new natural philosophy. Indeed the program of the Royal Society of London from its inception in 1660 explicitly relied upon a Baconian rhetoric of the restoration of that human knowledge and dominion over nature which Adam had once enjoyed.While historians such as Charles Webster have alluded to the ways in which the myth of an original perfect philosophy motivated projects for the advancement of learning in a rather general way, little attention has been paid to the manner in which early-modern views of the nature of the original fall from knowledge directly informed the methods of the new sciences, determined the scope of their enquiry, and provided ammunition for use against traditional learning. 4 Moreover, most commentators, following Webster's lead, have restricted their attention to Francis Bacon, and to the Baconian aspirations of subsequent reformers of knowledge in seventeenth-century England. In this paper I shall suggest that the biblical narrative of the Fall played a far more direct role in the development of early modern knowledge—both in England and on the Continent—than has often been assumed, and that competing strategies for the advancement of knowledge in the seventeenth century were closely related to different assessments of the Fall and of its impact upon the human mind. Untangling the relationship of law and liberty is among the core problems of political theory. One prominent position is that there is no freedom without law. This article challenges the argument that, because law is constitutive of freedom, there is no freedom without law. I suggest that, once properly understood, the argument that law is constitutive of freedom does not uniquely apply to law. It also applies to social norms. What law does for freedom, social norms can do too. Thus, (...) I claim the question facing us is not the easy one of either law or social norms. Respecting this draws attention to the unique risks to our freedom introduced by both sets of norms. (shrink)

ABSTRACTNoncompete clauses, or agreements by employees to not work for a competitor or start a competing business, have recently faced increased public scrutiny and criticism. This article provides a qualified defense of NCCs. I focus on the argument that NCCs should be banned because they unfairly restrict the options of employees. I argue that this argument fails because it neglects the economist Thomas Schelling’s insight that limiting exit options can be beneficial for a person. This employee-based defense of NCCs does (...) not absolve all their uses, but it does give us a rough test for evaluating the permissibility of NCCs. With this test in hand, I turn to some of the more controversial uses of NCCs. For those who weigh heavily the interests of employees, the question is not whether NCCs, but when. (shrink)
