As women advance into leadership roles, the gender discrimination they face is a pressing issue that demands attention from a business ethics perspective. This paper considers the downstream consequences of such gender discrimination on their subordinates. Previous research indicates that women leaders in male-dominated organizations often face gender bias, which may prompt them to distance themselves from their gender identity as a coping mechanism (self-group distancing behavior). By integrating concepts from management, psychology, and business ethics, we investigate the following research (...) question: What are the downstream consequences of gender discrimination experienced by women leaders on their subordinates? We hypothesize that women leaders’ self-group distancing responses create uncertainty belonging among women subordinates, which leads to adverse outcomes such as decreased leadership aspirations and increased turnover intentions. Our results suggest that when a woman leader engages in self-group distancing because of gender discrimination, women subordinates experience reduced feelings of belonging, increased differentiation, diminished leadership aspirations, and heightened turnover intentions. In contrast, male subordinates’ sense of belonging, differentiation, leadership aspirations, and turnover intentions do not significantly differ when a woman leader engages in self-group distancing behavior. This article examines three divergent constructions about the salience of legal gender in lay people’s everyday lives and readiness to decertify gender. In our interviews (and survey data), generally participants minimised the importance of legal gender. The central argument in this article is that feminist socio-legal scholars applying legal consciousness studies to legal reform topics should find scrutinizing the construction of interview talk useful. We illustrate this argument by adapting and applying Ewick and Silbey’s (1998) ‘The Common Place of Law: (...) Stories from Everyday Life', ‘before’, ‘with’ and ‘against’ typology to interview talk about legal gender, and critique their cognitivist approach by offering a constructionist alternative. In our analysis, we offer a detailed discursive explication of three key legal consciousness themes. These themes offer a balanced representation of a dataset problematically ‘skewed’ towards sex-based rights feminist perspectives, namely that ‘before’ legal gender is an anti-decertification account, decertification would be risky for natal females; a ‘with’ legal gender construction is neither for nor against decertification per se, though the impact of decertification is produced in accounts as limited and unimportant; and ‘against’ legal gender is a pro-decertification classification, as not abolished legal gender is constructed as harmful to already marginalised groups. In concluding, we explore the reasoning for the lack of readiness for decertification currently, and return to the value of examining the construction of lay discourse about legal matters as talk is a form of social action. We suggest that applying discursive analysis to themes in legal consciousness studies enables a refocusing on the how rather than purely the what of divergent legal consciousnesses, and that this approach is a fruitful addition to feminist socio-legal studies. Background: The law and literature about children’s consent generally assume that patients aged under-18 cannot consent until around 12 years, and cannot refuse recommended surgery. Children deemed pre-competent do not have automatic rights to information or to protection from unwanted interventions. However, the observed practitioners tend to inform young children s, respect their consent or refusal, and help them to “want” to have the surgery. Refusal of heart transplantation by 6-year-olds is accepted. Research question: What are possible reasons to explain (...) the differences between theories and practices about the ages when children begin to be informed about elective heart surgery, and when their consent or refusal begins to be respected? Research design, participants and context: Research methods included reviews of related healthcare, law and ethics literature; observations and conversations with staff and families in two London hospitals; audio-recorded semi-structured interviews with a purposive sample of 45 healthcare professionals and related experts; interviews and a survey with parents and children aged 6- to 15-years having elective surgery (not reported in this paper); meetings with an interdisciplinary advisory group; thematic analysis of qualitative data and co-authorship of papers with participants. Ethical considerations: Approval was granted by four research ethics committees/authorities. All interviewees gave their informed written consent. Findings: Interviewees explained their views and experiences about children’s ages of competence to understand and consent or refuse, analysed by their differing emphases on informed, signified or voluntary consent. Discussion: Differing views about children’s competence to understand and consent are associated with emphases on consent as an intellectual, practical and/or emotional process. Conclusion: Greater respect for children’s practical signified, emotional voluntary and intellectual informed consent can increase respectful understanding of children’s consent. Nurses play a vital part in children's practitioner-patient relationships and physical care and therefore in all three elements of consent. (shrink)

Inclusive fitness has been under intense scrutiny in recent years, with many critics claiming the framework leads to incorrect predictions. We consider one particularly influential heuristic for estimating inclusive fitness in the context of the very case that motivated reliance on it to begin with: the Sir Philip Sidney signalling game played with relatives. Using a neighbour-modulated fitness model, we show when and why this heuristic is problematic. Technologies controlled directly by the brain are being developed, evolving based on insights gained from neuroscience, and rehabilitative medicine. Besides neuro-controlled prosthetics aimed at restoring function lost somehow, technologies controlled via brain-computer interfaces (BCIs) may also extend a user’s horizon of action, freed from the need for bodily movement. Whilst BCI-mediated action ought to be, on the whole, treated as conventional action, law and policy ought to be amended to accommodate BCI action by broadening the definition of action as “willed (...) bodily movement”. Moreover, there are some dimensions of BCI mediated action that are significantly different to conventional cases. These relate to control. Specifically, to limits in both controllability of BCIs via neural states, and in foreseeability of outcomes from such actions. In some specific type of case, BCI-mediated action may be due to different ethical evaluation from conventional action. (shrink)

Farm to school programs have been positioned as interventions that can support goals of the global food sovereignty movement, including strengthening local food production systems, improving food access and food justice for urban populations, and reducing distancing between producers and consumers. However, there has been little assessment of how and to what extent farm to school programs can actually function as a mechanism leading to the achievement of food sovereignty. As implemented in North America, farm to school programs encompass activities (...) not only related to school food procurement, but also to the development of student knowledge and skills under the framework of food literacy. Research on farm to school initiatives has largely been conducted in countries with government-supported national school feeding programs; this study examines farm to school organizing in Canada, where there is no national student nutrition program. Using qualitative fieldwork and document analysis, we investigate the farm to school movement in British Columbia, in a context where civil society concerns related to education and health have been the main vectors of farm to school mobilization. Our analysis suggests that, despite limited institutional infrastructure for school meals, the British Columbia farm to school movement has contributed toward realizing goals of food sovereignty through two main mechanisms: advocacy for institutional procurement of local and sustainable foods and mobilizing food literacy for increased public engagement with issues of social justice and equity in food systems. Stem cell tourism is a small but growing part of the thriving global medical tourism marketplace. Much stem cell research remains at the experimental stage, with clinical trials still uncommon. However, there are over 700 clinics estimated to be operating in mostly developing countries – from Costa Rica and Argentina to China, India and Russia – that have lured many patients, mostly from industrialized countries, driven by desperation and hope, which in turn continue to fuel the growth of such tourism.While (...) much research has focused on such dimensions as the promotions that allow such businesses to make their services known, media coverage, some patient research, and regulatory conditions for developing country clinics, little attention has been paid to the non-affected members of the general population, the future potential users of such services. This empirical study based on five focus group discussions with a diverse group of healthy adults in a Canadian city, explored participant views of patients who use stem cell tourism services, the likelihood they would avail themselves of such services if they were to suffer similar illnesses, and the conditions under which they might do so, and the impact that admonitions and advice from international expert bodies might have on their decisions. Our findings suggest that these healthy adults are sympathetic to the drivers of hope and desperation, and, despite cautions about research limitations, may seek such treatments themselves under similar conditions. These findings are discussed in the context of the policy and ethical issues raised by this form of medical tourism. (shrink)

Is selling sex a service like any other? Philosophers have given a range of answers to this question: (a) sex has a specific value that is debased by commercial markets in sex; (b) sex work is a service like any other; (c) markets in sex perpetuate structural systems of inequality. This article takes seriously the suggestion that there is something special about sex itself which raises a specific set of concerns when traded for money. The challenge is to explain this (...) without drawing on contentious essentialist claims about the value of sex. It proceeds by analysing a parallel between sexual promises and selling sexual consent. On an expectational theory of promising, commercial agreements to sex generate obligations in a way that is normatively analogous to sexual promises. Understanding the normative release conditions for such assurance‐providing agreements provides a way of analysing the justifiability of various ways of enforcing such agreements. I argue that the release conditions for agreements involving sex are not conducive to being codified under typical forms of service contract. As such, regulation aimed at legitimising sex work must provide adequate protections to workers without codifying it under typical forms of service contract. (shrink)

ExcerptCarl Schmitt (1888–1985) is known as the most consequential German legal and political mind of the twentieth century.1 Many crimes of the Nazi regime found support in his conceptual justifications, and Schmitt is called the “Crown Jurist” of the Third Reich with good reason. Historians, political scientists, and sociologists must grapple with the author in order to understand the course of totalitarianism in modernity. Whether literary historians should do so is far less settled, though he was fascinated by their object (...) of study. His writings on literary topics are said to reveal much about Schmitt’s person, politics, and period, but little about literature itself.2 This explains why his “Don Quijote und das Publikum” (“Don Quixote and the Public”), published in the arts and cultural journal Die Rheinlande in 1912, was almost unknown in literary studies for a century.3 Schmitt’s text on the novel by Miguel de Cervantes has not been reprinted, and until recently it had not been translated from the original German. Size has a role too. At under two thousand words, the text has probably escaped notice due to its small scale.4 Recent English and Italian translations in major humanistic journals may signal the end of its obscurity though.5 “Don Quixote and the Public” is at the door of literary studies. This study investigated whether brain neural activity that accompanied the processing of previously learned map information was influenced by the modality in which the spatial parameters of the maps were originally learned. Participants learned a map by either viewing it directly or by reading an equivalent verbal description. Following learning, the participants' ability to use their spatial knowledge was tested in a spatial orientation task. Electrophysiological recordings identified significant effects of prior learning modality on event‐related brain activity within 300 ms (...) following the presentation of map orientation instructions. The results indicate that modality‐specificity in spatial memory is present at a very early stage of processing. (shrink)

This discussion centers on two desiderata: the role of measurement in information-gathering and physical interaction in scientific practice. By taking inspiration from van Fraassen’s view, we present a methodological account of perspectival measurement that addresses empirical practice where there is complex intervention, disagreeing results, and limited theory. The specific aim of our account is to provide a methodological prescription for developing measurement processes in the context of limited theory. The account should be useful to philosophers of science, who are interested (...) in the intersection between representation and intervention; scientists, who are interested in methodological suggestions for theory-development and reliability; and interdisciplinary researchers, who are interested in the intersections between the pandemic, built environments, and social processes. We apply the process-view of measurement to COVID-19, specifically, measuring replication in the SARS-CoV-2 virus. The aim is to show that our account tracks key elements—manipulation/intervention, independence, invariance, and theory-development—by organizing unfolding measurement processes. Additionally, we use our account to make prescriptive suggestions for measurement practice in the COVID-19 context by discussing the need to broaden measurement perspective on interaction, manipulation, and production. Both unipolar and bipolar depression have been linked with impairments in executive functioning. In particular, mood symptom severity is associated with differences in common EF, a latent measure of general EF abilities. The relationship between mood disorders and EF is particularly salient in adolescence and young adulthood when the ongoing development of EF intersects with a higher risk of mood disorder onset. However, it remains unclear if common EF impairments have associations with specific symptom dimensions of mood pathology such as (...) blunted positive affect, mood instability, or physiological arousal, or if differences in common EF more broadly relate to what is shared across various symptom domains, such as general negative affect or distress. To address this question, bifactor models can be applied to simultaneously examine the shared and unique contributions of particular mood symptom dimensions. However, no studies to our knowledge have examined bifactor models of mood symptoms in relation to measures of common EF. This study examined associations between common EF and general vs. specific symptom dimensions using structural equation modeling in adolescents and young adults with varying severity of mood symptoms. A General Depression factor capturing shared variance across symptoms statistically predicted lower Common EF. Additionally, a factor specific to physiological arousal was associated with lower Common EF. Anhedonia-specific and Mania-specific factors were not significantly related to Common EF. Altogether, these results indicate that deficits in common EF are driven by, or reflect, general features of mood pathology that are shared across symptom dimensions but are also specifically associated with physiological arousal. This article explores the role of the Deaf child as peer educator. In schools where sign languages were banned, Deaf children became the educators of their Deaf peers in a number of contexts worldwide. This paper analyses how this peer education of sign language worked in context by drawing on two examples from boarding schools for the deaf in Nicaragua and Thailand. The argument is advanced that these practices constituted a child-led oppositional pedagogy. A connection is drawn to Freire’s (1972) (...) theory of critical pedagogy. Deaf children’s actions as peer educators are framed as an act of resistance towards the oppression of their language and culture. A contrast is drawn between oralist pedagogy that is historically associated with punitive practices and didactic methods and the experiential and dialogic interaction that characterised peer learning of sign languages. The argument is made that the peer teaching and learning processes enabled the self-actualisation of the Deaf children whereas the oralist methods were based on a deficit model that focused on modifying deaf children according to the norms of hearing society. The implications of this for current policy and practice are inferred to be about access to sign languages and the importance of Deaf communities in deaf children’s education. The argument is made that space needs to be created for deaf children to engage in peer learning. (shrink)

I defend the normativity of meaning against recent objections by arguing for a new interpretation of the ‘ought’ relevant to meaning. Both critics and defenders of the normativity thesis have understood statements about how an expression ought to be used as either prescriptive or semantic. I propose an alternative view of the ‘ought’ as conveying the primitively normative attitudes speakers must adopt towards their uses if they are to use the expression with understanding.

Gilbert Ryle's distinction between knowledge-how and knowledge-that faces a significant challenge: accounting for the unity of knowledge. Jason Stanley, an ‘intellectualist’ opponent of Ryle's, brings out this problem by arguing that Ryleans must treat ‘know’ as an ambiguous word and must distinguish knowledge proper from knowledge-how, which is ‘knowledge’ only so-called. I develop the challenge and show that underlying Ryle's distinction is a unified vision of knowledge as ‘a capacity to get things right’, covering both knowledge-how and knowledge-that. I show (...) how Ryle specifies the general notion into knowledge-how and knowledge-that and discuss the mutual interdependence exhibited by the two forms of knowledge. Ryle's positive view of knowledge, properly understood, emerges as an important, neglected, alternative which should be brought back into the ongoing conversation about practical and theoretical knowledge. Frege’s distinction between sense (Sinn) and meaning (Bedeutung) is his most influential contribution to philosophy, however central it was to his own projects, and however he may have conceived its importance. Philosophers of language influenced by, or reacting against the distinction, and historians of philosophy commenting on it, have all contributed to the voluminous literature surrounding it.1 Nonetheless in this essay I hope to shed new light on the distinction by considering it in the context of the development of Frege’s (...) thought, and connecting it more intimately than is usually done with Frege’s interests in logic, especially his views on judgment, truth and inference, which were central to his own projects as he conceived them. Fine and Kripke extended S5, S4, S4.2 and such to produce propositionally quantified systems , , : given a Kripke frame, the quantifiers range over all the sets of possible worlds. is decidable and, as Fine and Kripke showed, many of the other systems are recursively isomorphic to second-order logic. In the present paper I consider the propositionally quantified system that arises from the topological semantics for S4, rather than from the Kripke semantics. The topological system, which I dub , (...) is strictly weaker than its Kripkean counterpart. I prove here that second-order arithmetic can be recursively embedded in . This note is a friendly amendment to Marti's analysis of the failure of Føllesdal's argument that modal distinctions collapse in Carnap's logic S2. Føllesdal's argument turns on the treatment of descriptions. Marti considers how modal descriptions, which Carnap banned, might be handled; she adopts an approach which blocks Føllesdal's argument, but requires a separate treatment of non-modal descriptions. I point out that a more general treatment of descriptions in S2 is possible, and indeed is implicit in Marti's informal discussion, and (...) that this treatment also blocks Føllesdal's argument. Further, I show by a semantic argument that no revised version of Føllesdal's argument could establish a collapse of modal distinctions. (shrink)

We begin to fill a lacuna in the relevance logic enterprise by providing a foundational analysis of identity in relevance logic. We consider rival interpretations of identity in this context, settling on the relevant indiscernibility interpretation, an interpretation related to Dunn's relevant predication project. We propose a general test for the stability of an axiomatisation of identity, relative to this interpretation, and we put various axiomatisations to this test.
