Warming temperatures in the circumpolar north have led to new discussions around climate-driven frontiers for agriculture. In this paper, we situate northern food systems in Canada within the corporate food regime and settler colonialism, and contend that an expansion of the conventional, industrial agriculture paradigm into the Canadian North would have significant socio-cultural and ecological consequences. We propose agroecology as an alternative framework uniquely accordant with northern contexts. In particular, we suggest that there are elements of agroecology that are already (...) being practiced in northern Indigenous communities as part of traditional hunter-gatherer food systems. We present a framework for agroecology in the North and discuss its components of environmental stewardship, economies, knowledge, social dimensions and governance using examples from the Dehcho region, Northwest Territories, Canada. Finally, we discuss several challenges and cautions in creating policy around agroecology in the North and encourage community-based research in developing and testing this framework moving forward. Is it possible to design a forest policy that satisfies ethical and environmental concerns and is acceptable to business, labour and First Nations representatives? What is the best path through the tangle of ethical issues surrounding the collapse of the east coast fishery? What sort of obligations does a rich nation such as Canada have to satisfy the claims of global environmental justice? These are the sorts of issues in applied ethics that are tackled in this collection of essays, the (...) vast majority of which have been written especially for this volume. It is the first Canadian collection of its kind. The book is divided in to sections detailing with such topics as the environment and the economy; ethical issues relating to non-human animals; issues of gender; and issues relating to native peoples. Most of the authors are philosophers, though specialists in geography, geology, and the social sciences are also among the contributors. Frequent reference is made to theoretical ethical concerns, but the focus throughout is on applied ethics, and a variety of case studies are included. (Examples include essays on animal rights and the case of native hunters; surface mining in Northern Ontario, the Quebec arctic; and fishing communities in the Maritimes.) Cultural evolution studies are characterized by the notion that culture evolves accordingly to broadly Darwinian principles. Yet how far the analogy between cultural and genetic evolution should be pushed is open to debate. Here, we examine a recent disagreement that concerns the extent to which cultural transmission should be considered a preservative mechanism allowing selection among different variants, or a transformative process in which individuals recreate variants each time they are transmitted. The latter is associated with the notion of “cultural (...) attraction”. This issue has generated much misunderstanding and confusion. We first clarify the respective positions, noting that there is in fact no substantive incompatibility between cultural attraction and standard cultural evolution approaches, beyond a difference in focus. Whether cultural transmission should be considered a preservative or reconstructive process is ultimately an empirical question, and we examine how both preservative and reconstructive cultural transmission has been studied in recent experimental research in cultural evolution. Finally, we discuss how the relative importance of preservative and reconstructive processes may depend on the granularity of analysis and the domain being studied. (shrink)

To judge from the rash of recent law review articles, it is a miracle that research with human subjects in the U.S. continues to draw breath under the asphyxiating heel of the rent-seeking, creativity-stifling, jack-booted bureaucrethics that is the current system of research ethics oversight and review. Institutional Review Boards, sometimes called Research Ethics Committees, have been accused of perpetrating “probably the most widespread violation of the First Amendment in our nation's history,” resulting in a “disaster, not only for academics, (...) but for the whole nation.” One member of the President's Council on Bioethics went so far as to assert, “There has been no greater damage to academic freedom in the United States in my lifetime. And my lifetime encompasses McCarthy and it encompasses political correctness, both.” Locked in the bureaucratic “iron cage” of IRB oversight, critics charge that researchers have been transformed into a vulnerable, exposed population, subject to domination, that has been likened in one case to a kind of “Tuskegee in reverse.”. Contemporary process metaphysics has achieved a number of important results, most significantly in accounting for emergence, a problem on which substance metaphysics has foundered since Plato. It also faces trenchant problems of its own, among them the related problems of boundaries and individuation. Historically, the quest for ontology may thus have been largely responsible for the persistence of substance metaphysics. But as Plato was well aware, an ontology of substantial things raises serious, perhaps insurmountable problems for any account of our (...) epistemic access to such things. Physical things are subject to change, and as such, they are poor objects of knowledge—if knowledge is to be more reliable than mere opinion. There is a reading of Plato’s Theaetetus on which knowledge may be understood as a relation between an epistemic subject and a logos, where logoi are intrinsically dialectical, and where dialectic is a kind of intersubjective activity. Insofar as this epistemology may be attributed to Plato, the project of this paper is Platonic in spirit. It is also, in a sense, Kantian, in that it divorces ontology from the search for things-in-themselves, redirecting our attention from things to objects: epistemic objects. Such objects can be understood, as Maurice Merleau-Ponty proposed, as shared by multiple subjects by virtue of their participation in an intersubjective world, constituted by what Shaun Gallagher calls participatory sense-making. On an epistemology constructed in this way, the fact that both epistemic objects and their subject are mutable is no obstacle to knowledge. Far-from-equilibrium systems are forever mutable; at thermodynamic equilibrium, there would be neither subject, nor object. Epistemic objects, on this picture, are metastable loci of interactive potential. (shrink)

This paper examines the role of equipoise in evaluating international research. It distinguishes two possible formulations of the equipoise requirement that license very different evaluations of international research proposals. The interpretation that adopts a narrow criterion of similarity between clinical contexts has played an important role in one recent controversy, but it suffers from a number of problems. An alternative interpretation that adopts a broader criterion of similarity does a better job of avoiding both exploitation of the brute fact of (...) social deprivation and the exploitation of needy populations for the benefit of more well-off populations. It also holds out the promise of reconciling the need to find interventions that can be employed in developing world contexts with the cluster of moral values that must constrain the way such research is carried out. This is the first book to systematically examine the underlying theory of evidence in Anglo-American legal systems. Stein develops a detailed and innovative theory which sets aside the traditional vision of evidence law as facilitating the discovery of the truth. Combining probability theory, epistemology, economic analysis, and moral philosophy, he argues instead that the fundamental purpose of evidence law is to apportion the risk of error in conditions of uncertainty.

Any view of equipoise faces perhaps the most radical and far-reaching objections from moral foundations. These objections hold that the equipoise requirement conflates the ethics of medical research and the ethics of clinical medicine. Once this conflation is recognized, this position holds, research can be given a new foundation on the imperative to avoid exploiting research participants. This article argues that what is novel in this critique is not as successful as its proponents claim and that the ultimate success of (...) this approach actually hinges on a version of the objection from utility. Nevertheless, this criticism highlights the limited scope of applicability of the equipoise requirement. The article concludes, therefore, by describing the outlines of what the article calls an ‘integrative approach’ to clinical trials. This article argues that lingering uncertainty about the normative foundations of research ethics is perpetuated by two unfounded dogmas of research ethics. The first dogma is that clinical research, as a social activity, is an inherently utilitarian endeavor. The second dogma is that an acceptable framework for research ethics must impose constraints on this endeavor whose moral force is grounded in role-related obligations of either physicians or researchers. This article argues that these dogmas are common to traditional articulations of the (...) equipoise requirement and to recently articulated alternatives, such as the non-exploitation approach. Moreover, important shortcomings of these approaches can be traced to their acceptance of these dogmas. After highlighting these shortcomings, this article illustrates the benefits of rejecting these dogmas by sketching the broad outlines of an alternative called the "integrative approach" to clinical research. Before participants can be enrolled in a clinical trial, an institutional review board must determine that the risks that the research poses to participants are ‘reasonable.’ This paper examines the two dominant frameworks for assessing research risks and argues that each approach suffers from significant shortcomings. It then considers what issues must be addressed in order to construct a framework for risk assessment that is grounded in a compelling normative foundation and might provide more operationally precise guidance to the deliberations (...) of various stakeholders. The paper concludes by sketching the outlines of what is referred to as the ‘Integrative Approach’ to risk assessment and by highlighting some of the ways in which this approach may be more promising than current alternatives. This paper argues that a standard analysis of modals from formal semantics suggests a solution to the detaching problem — the problem of whether un-embedded 'ought'-claims can "detach" (be derived) from hypothetical imperatives and their antecedent conditions. On a broadly Kratzerian analysis, modals have a skeletal conventional meaning and receive a particular reading (e.g., deontic, epistemic, teleological) only relative to certain forms of contextual supplementation. I argue that 'ought'-claims can detach — subject to an important qualification — but only as (...) long as the 'ought's in the conditional premise and conclusion are interpreted relative to the same ordering sources. Although modus ponens can be shown to fail with hypothetical imperatives, the cases in question do not constitute a failure of detachment in the sense that ethicists have cared about. Rival wide-scoping accounts are proven to be linguistically problematic. They make incorrect predictions about the meanings of hypothetical imperatives, and founder in response to quantificational variants of the detaching problem. (shrink)

Sex is often thought of as a straightforwardly binary categorical variable. Yet there is considerable variation in would-be sex traits; from genitals and hormones to morphology, neurology and behaviour, there is rarely if ever a categorical binary. We introduce a strategy that researchers use to deal with this variation: Individualising Variation (IV). IV involves treating non-binary and gradual variation as idiosyncratic, as individual differences rather than sex-based differences. Using the contrasting cases of sex identification in field ornithology and the debate (...) about sex differences in neuroscience, we illustrate IV and investigate its epistemic and conceptual consequences. We argue that IV stabilises the ontological picture of sex as categorical and binary. While IV can be an epistemically benign research strategy in some cases, we argue that it can also be epistemically detrimental. This is because of its ability to mask evidence that would otherwise challenge related assumptions about the phenomenon of interest, such as what sexes are and what they look like. We also identify an alternative strategy, De- individualising Variation, which works against IV and helps life scientists recognise variation beyond categorical binaries. (shrink)

One of the fundamental challenges in any field of practical ethics is to articulate a framework for deliberation and decision making that is capable of providing warranted guidance about contentious ethical questions.1 Such a framework has to function effectively in the face of empirical uncertainty and what Rawls refers to as the fact of reasonable pluralism—the fact that individuals often differ in their ideals, ambitions, preferences and conceptions of the good life. One of the perennial questions in normative and metaethics (...) concerns the source of the warrant for such judgments, and a major preoccupation of practical ethics has been to find a way to generate such warrant without having to first settle all contentious philosophical questions about the nature and source of normativity. To the extent that scholars use the term ‘common morality’ to refer to a set of moral norms or concerns that are sufficiently common and widespread that they can be used as starting points for moral deliberation and inquiry, I am sympathetic to the term.2 To the extent that appeals to common morality are supposed to do more significant epistemic or justificatory work, they have always struck me as dangerously ad hoc and insufficiently responsive to the legitimate need to explain the ground for common normative claims. Although I am relatively sceptical of appeals to common morality, I am concerned that the version of this view that is critiqued in ‘Why not common morality’ is simply a straw person. Throughout the paper, Rhodes treats common morality as synonymous with everyday ethics and the ethics of everyday life. One of the central puzzles in ontology concerns the relation between apparently innocent sentences and their ontologically loaded counterparts. In recent work, Agustín Rayo has developed the insight that such cases can be usefully described with the help of the ‘just is’ operator: plausibly, for there to be a table just is for there to be some things arranged tablewise; and for the number of dinosaurs to be Zero just is for there to be no dinosaurs. How does the operator (...) relate to another prominent notion that is frequently put to similar use: metaphysical grounding? In this paper I show that despite what has been argued in the literature the ‘just is’ operator can be spelled out in terms of grounding: roughly, as having the same ultimate grounds. This is good news for Rayo, for it broadens his target audience. It is even better news for the friends of ground. For it exemplifies the immense fruitfulness of the notion of grounding in its ability to incorporate philosophically highly significant subtheories. (shrink)

Of all contemporary social theorists, Luhmann has best understood the centrality of the concept of meaning to social theory and has most extensively worked out the notion's implications. However, despite the power of his theory, the theory suffers from difficulties impeding its reception. This article attempts to remedy this situation with some critical arguments and proposals for revision. First, the theory Luhmann adopted from biology as the basis of his own theory was a poor choice since that theory has no (...) explanatory power, being purely descriptive; furthermore, that theory is fundamentally flawed since it implies that viruses are impossible. Second, Luhmann's theory of meaning cannot coherently make the social domain autonomous as he desires since Luhmann does not take into account the distinction between syntax and semantics. By introducing this distinction, making clear that social systems consist of rules, not just communications, and raising the rule concept to the same prominence in social theory as those of actor and system, autonomy can be maintained while avoiding the counterintuitive aspects of Luhmann's theory. Research misconduct is an alarming concern worldwide, and especially in Italy, where there is no formal training of young researchers in responsible research practices. The main aim of this study was to map the perceptions and attitudes about RM in a sample of young researchers attending a one-week intensive course on methodology, ethics and integrity in biomedical research, held at the University of Insubria. To this end, we administered the Scientific Misconduct Questionnaire to all attendees at the beginning of the (...) course. Thereafter, SMQ-R was re-administered at the end, to assess the impact of the course on the responsiveness of study participants, which is intended as the frequency of responses other than “don’t know”. Results show that respondents rate as high their own understanding about rules and procedures related to scientific misconduct, as well as the effectiveness of their institution’s measures for reducing it. Most of them perceive as low the chances of getting caught for RM. Some respondents believe that cases of misconduct occur in their workplace and that the integrity of a research is not solely the responsibility of the principal investigator. Among the main factors contributing to research misconduct, the need for publications, unclear definition of what constitutes misconduct and pressure for external funding do stand out. Respondents are concerned about the amount of misconduct and express a pressing need for training on research ethics. Remarkably, the responsiveness of participants tends to increase with course attendance. This finding may be useful to support education programmes devoted to research methodology, ethics and integrity among young researchers. (shrink)

Nineteenth and twentieth century philosophies of science have consistently failed to identify any rational basis for the compelling character of scientific analogies. This failure is particularly worrisome in light of the fact that the development and diffusion of certain scientific analogies, e.g. Darwin’s analogy between domestic breeds and naturally occurring species, constitute paradigm cases of good science. It is argued that the interactivist model, through the notion of a partition epistemology, provides a way to understand the persuasive character of compelling (...) scientific analogies without consigning them to an irrational or arational context of discovery. The rising cost of the opioid antagonist and overdose reversal agent naloxone is an urgent public health problem. The recent and dramatic price increase of Evzio, a naloxone auto-injector produced by Kaléo, shows how pharmaceutical manufacturers entering the naloxone marketplace rely on market exclusivity guaranteed by the patent system to charge prices at what the market can bear, which can restrict access to life-saving medication. We argue that 28 U.S.C. § 1498, a section of the federal code that allows the (...) government to use patent-protected products for its own purposes in exchange for reasonable compensation, could be used to procure generic naloxone auto-injectors, or at least bring Kaléo to the negotiating table. Precedent exists for the use of § 1498 to procure pharmaceuticals, and it could give meaning to the federal government's recent declaration of a public health emergency around the opioid epidemic, discourage new market entrants from charging exorbitant prices, and yield important public health benefits.
