Abstract:When people reason on the basis of moral rules, do they suppose that in the absence of a prohibitory rule they are free to act, or do they suppose that morality always requires a justification establishing a permission to act? In this essay we present a series of learning experiments that indicate when learners tend to close their system on the basis of natural liberty and when on the principle of residual prohibition. Those who are taught prohibitory rules tend to (...) infer natural liberty while those taught permission rules tend to infer residual prohibition. In mixed cases, where learners are taught both types of rules, there is some tendency to suppose that natural liberty is the default. Both natural liberty and its denial can be learned; is there a reason to adopt one system of moral rules or the other? We argue that systems of social morality based on a principle of natural liberty have a striking advantage over their competitors: they are well adapted to effectively exploring the constant novel circumstances that arise in open, dynamic, societies. This article updates “The State of the Question in the Study of Plato” (Southern Journal of Philosophy, 1996) based on research covering the years from 1995–2015. Its three major parts examine: (1) how the mid‐twentieth‐century consensus has fared, (2) whether the new trends identified in that article have continued, and (3) identify trends either new or missed in the original article. On the whole, it shows the continuing decline of dogmatic and nondramatic Plato interpretation and the expansion and ramification of (...) the more literary, dramatic, and nondogmatic “new Platonism.” What was a growing insurgency twenty years ago can now be described as a, if not the, dominant approach. This thesis examines the relationship between nihilism and postmodernism in relation to the sublime, and is divided into two parts: theory and literature. Beginning with histories of nihilism and the sublime, the Enlightenment is constructed as a conflict between the two. Rather than promote a simple binarism, however, nihilism is constructed as a temporally-displaced form of sublimity that is merely labelled as nihilism because of the dominant ideologies at the time. Postmodernism, as a product of the Enlightenment, is therefore implicitly (...) related to both nihilism and the sublime, despite the fact that it is often characterised as either nihilistic or sublime. Whereas prior forms of nihilism are ‗modernist‘ because they seek to codify reality, postmodernism creates a new formulation of nihilism – ‗postmodern nihilism‘ – that is itself sublime. This is explored in relation to a broad survey of postmodern literature through a series of interconnected themes. These themes – apocalypse, the absurd, absence, and space – arise from the debates presented in the theoretical chapters of this thesis, and demonstrate the ways in which nihilism and the sublime interact within postmodern literature. Because of the theoretical and literary debates presented within it, this thesis concludes that it cannot be a thesis at all. (shrink)

The question “Why should I be moral?” has long haunted normative ethics. How one answers it depends critically upon one’s understanding of morality, self-interest, and the relation between them. Stephen Finlay, in “Too Much Morality”, challenges the conventional interpretation of morality in terms of mutual fellowship, offering instead the “radical” view that it demands complete altruistic self-abnegation: the abandonment of one’s own interests in favor of those of any “anonymous” other. He ameliorates this with the proviso that there is no (...) rational basis for morality’s presumption of precedence, leaving it up to each person to decide when and whether they prefer self-interested concerns to more stringent moral requirements. I counter Finlay’s radical altruism with fair egalitarianism, a more congenial interpretation of moral normativity that repudiates self-abnegation and holds instead that ceteris paribus everybody’s interests are equal. As a result, supererogation and moral sainthood become more intelligible, and the choice between self-interest and morality becomes one between different decision procedures, the particular advantage of morality being others compatible results. This book offers a philosophical interpretation of the historical debate between Bentham and classical Common Law Theory, a debate that is fundamental to philosophical thought and has shaped contemporary conceptions of nature, tasks, and limits of law and adjudication. The author explores the philosophical foundations of Common Law theory, focusing particularly on the writings of Sir Mathew Hale and David Hume.

Against the well-known objection that in the history of science there are many theories that are successful but false, Psillos offers a three-pronged defense of scientific realism as the best explanation for the success of science. Focusing on these, I criticize Psillos’ defense, arguing that each prong is weakened when we recognize that according to realist rebuttals of the underdetermination argument and versions of empiricism, realists are committed to accounting for the explanatory success of theories, not their mere empirical adequacy (...) or instrumental reliability. I conclude by indicating how ‘explanationist’ realism might be recast to accommodate my arguments. (shrink)

In both theoretical and applied contexts the concept of autonomy has assumed increasing importance in recent normative philosophical discussion. Given various problems to be clarified or resolved the author characterizes the concept by first setting out conditions of adequacy. The author then links the notion of autonomy to the identification and critical reflection of an agent upon his first-order motivations. It is only when a person identifies with the influences that motivate him, assimilates them to himself, that he is autonomous. (...) In this article, we examine how affect influences judgment and thought, but also how thought transforms affect. The general thesis is that the nature and impact of affective reactions depends largely on their objects. We view affect as a representation of value, and its consequences as dependent on its object or what it is about. Within a review of relevant literature and a discussion of the nature of emotion, we focus on the role of the object of affect in governing (...) both the nature of emotional reactions and the impact of affect and emotion on cognition and action. Although emotion is always about the here and now, the capacity for abstract thought means that the human here and now includes imagination as well as perception. Indeed, the hopes and fears that dominate human lives often involve things only imagined. (shrink)

In this essay, I criticize Laudan's view that methodological rules in science are best understood as hypothetical imperatives, for example, to realize cognitive aim A, follow method B. I criticize his idea that such rules are best evaluated by a naturalized philosophy of science which collects the empirical evidence bearing on the soundness of these rules. My claim is that this view yields a poor explanation of (1) the role of methodological rules in establishing the rationality of scientific practices, (2) (...) the debates scientists have over rival methodological rules, and (3) the reasons on the basis of which scientists actually embrace, challenge, or transform methodological rules. A better explanation is provided by treating at least some methodological rules as foundational standards of theory-appraisal which define the criteria of scientific truth, knowledge, evidence, proof, explanations, etc., for a certain tradition or community of scientific practice. Such standards are in turn grounded or challenged on the basis of their coherence or incoherence with a wider body of scientific judgments. This view leads away from a naturalized philosophy of science back to its more classical epistemological conception. (shrink)

For some years now, the significance of truth for politics has been intensely debated under the buzzword “post-truth.” However, this cannot hide the fact that political theory and philosophy have systematically neglected the relationship between truth and politics throughout their history. This article intends to remedy this desideratum by differentiating the various modes in which truth is referred to and invoked in the political field. To this end, the main strands of the post-truth debate are reconstructed and their shortcomings are (...) pointed out. Second, based on a contrasting reading of Habermas and Foucault, possible starting points for systematizing the relationship between truth and politics are discussed. Third, and as a prolegomenon to such a systematization, the article proposes a cartography of political truth forms and relations along five fault lines: truth as foundation and de-foundation, truth as coercion and freedom, truth as virtue and scandal, truth as secret and transparency, and truth as knowledge and practice. Während Philosophie auf sicheres Wissen und Erkenntnis ziele, gehe es der Rhetorik nicht um Wahrheit, sondern um die bloße Wahrscheinlichkeit und Meinung. Das kann allerdings nicht darüber hinwegtäuschen, dass Philosophie und Rhetorik auf grundsätzliche Weise aufeinander verwiesen bleiben. In this essay, I critically evaluate the approaches to explaining the success of science in Kuhn and the works of inference-to-the-best-explanation scientific realists. Kuhn ’s challenge to realists, who invoke the truth of theories to explain their success, is two-fold. His paradigm-account of success confronts realists with the problem of theory change, and the historical fact of successful theories later rejected as false. Secondly, Kuhn ’s account of the success of science has no need to bring truth into the explanation. (...) In turn, I argue that weakness in Kuhn and the prevailing forms of scientific realism motivate a better account of realism which I characterize as ‘best current theory realism’ and defend against the pessimistic meta-induction and the problem of theory-change. This realism argues that the best explanation of the success of current and past scientific theories only requires the simple claim that our best current theories are true. Kuhn ’s account can explain how normal science succeeds but cannot account for why its problem solutions work where they do and why they fail for other puzzles. (shrink)

In general, offers a good discussion of Dworkin's theory of interpretation. Postema is critically concerned with whether Dworkin commits himself to individualistic and privatistic sense of interpretation and how Dworkin articulates the logical independency of pre-interpretive paradigm instances or social facts which form the object of interpretation and the end which is interpretively posited in the act of interpretation. Criticisms, for the most part, appear to be compatible with Dworkin's overall theory and may simply be additional explication of the character (...) of interpretation. "There is nothing in Dworkin's meta-theory of interpretation of social practices that requires attention to the interpretive activities of fellow participants. Herein lies the strong "protestantism" of Dworkin's theory. Not only is each participant encouraged to take up the interpretive enterprise...but each individual participant also has access to the truth, as it were, about what the practice is and requires, though private interpretation of the practice-text. While Dworkin seems to recognize that the practice is common, he counsels participants to live as if each had a private understanding of his own." "It is problematic because it makes interpretation of social practices insufficiently practical, insufficiently intersubjective, and thus insufficiently political." Notes that the interpretive attitude when acting in a practice is relatively rare, usually becoming part of a practice is more like learning a discipline or technique. "[I]t may not be possible intelligibly to separate that point from the activies and rules in which it is expressed. The same meaning may, conceivably, be expressed in some other way, but this does not imply that the meaning is logically independent of the medium of expression." "That is, the behavior is logically separable from its interpretation only on pain of denying that the practice is common activity yielding common principles." "Often an agent may only come to understand his actions long after he has performed them, or may later come to see his actions in a very different light...First, on this view meaningful action is a primitive. Action is expressive of its meaning or purpose, but not resolvable into distinct behavior and purpose. But, since this purpose or meaning may not be fully or clearly articulated, interpretation can be seen as the activity of re-formulating and articulating it. In his classic work The Mind and its Place in Nature published in 1925 at the height of the development of quantum mechanics but several years after the chemists Lewis and Langmuir had already laid the foundations of the modern theory of valence with the introduction of the covalent bond, the analytic philosopher C. D. Broad argued for the emancipation of chemistry from the crass physicalism that led physicists then and later—with support from a rabblement of philosophers who knew as (...) much about chemistry as etymologists—to believe that chemistry reduced to physics. Here Broad’s thesis is recast in terms more familiar to chemists. In the hard sell of particle physics, several prominent figures in chemistry—Hoffmann, Primas, and Pauling—have had their views interpreted to imply that they were sympathetic to greedy reductionism when in fact they were not. Indeed, being chemists without physicists as alter egos, they could not but side with Broad’s contention that chemistry, as a science that deals primarily in emergent phenomena which are beyond the purview of physicalism, owes no acquiescence to particle physics and its ethereal wares. Historically, among the most widely used expediencies in chemistry and materials science are additivity or mixture rules and their cohort transferability, all of which are devised and used under the mantle of naive reductionism. Here it is argued that while the transfer of functional groups between molecules works empirically to an extent, it is strictly outlawed by the no-cloning theorem of quantum mechanics. Several illustrative examples related to chemistry’s irreducibility to physics are presented and discussed. The failure of naive reductionism exhibited by the deep-inelastic scattering of leptons by A > 2 nuclei is traced to the same flawed reasoning that was the original basis of Moffitt’s ‘atoms in molecules’ hypothesis, the neglect of context, nuclei in the case of high-energy physics and molecules in the case of chemistry. A non-exhaustive list of other contexts from physics, chemistry, and molecular biology evidencing similar departures from the ideal of additivity or reductionism is provided for the perusal of philosophers. Had the call by the mathematician J. T. Schwartz for developments in mathematical linguistics possessed of a less single, less literal, and less simple-minded nature been met, perhaps it might have persuaded scientists to abandon their regressive fixation with unphysical reductionism and to adapt to new methodologies that engender a more nuanced handling of ubiquitous emergent phenomena as they arise in Nature than is the case today. The increased interest in exorcisms and demonology should be moderated by a proper understanding of the relationship between psychology and spirituality. There is an important link between psychological aberrations and possession, but too often and too quickly, a person’s mental health is dismissed or overlooked in favor of a diagnosis of demonic possession. The Church’s ritual of exorcism can be properly used only after psychological discernment, episcopal approval, and personal assent. Most priests are not prepared for the role of exorcist (...) and should spend their time more effectively addressing pastoral needs. The belief in demons is part of biblical witness and Catholic history. At the same time, we must avoid any tendency toward redemption by exorcism. (shrink)

I argue that post-Kuhnian approaches to rational scientific change fail to appreciate several distinct philosophical requirements and relativist challenges that have been assumed to be, and may in fact be essential to any adequate conception of scientific rationality. These separate requirements and relativist challenges are clearly distinguished and motivated. My argument then focuses on Shapere's view that there are typically good reasons for scientific change. I argue: that contrary to his central aim, his account of good reasons ultimately presupposes the (...) requirement of universal standards of scientific reasoning; that the good reasons established by his account underdetermine the rationality of scientific change and allow that other changes would have been equally or even more rational; that as a result, Shapere's approach fails to meet what I characterize as the challenges of moderate, sociological, and cognitive relativism. The basic concept of Bentham's moral and political philosophy was public utility. He linked it directly with the concept of the universal interest, which comprises a distinctive partnership of the interests of all members of the community. The ultimate end of government and aim of all of morality is ‘the advancement of the universal interest’. This essay articulates the structure of Bentham's notion of universal interest and locates it in his theory of value.

The chapter discusses the various ways in which ethical theory and moral practice relate to one another. Various proposals are discussed and evaluated, such as that the relation is a deductive one, that the relation is one of norm-specification, or that the theory provides multiple moral principles that must be balanced against one another. The author makes some suggestions on how the relation between theory and practice should be understood.
