We report on the case of a 2-year-old female, the youngest person ever to undergo ovarian tissue cryopreservation (OTC). This patient was diagnosed with a rare form of sickle cell disease, which required a bone-marrow transplant, and late effects included high risk of future infertility or complete sterility. Ethical concerns are raised, as the patient's mother made the decision for OTC on the patient's behalf with the intention that this would secure the option of biological childbearing in the future. He argues that it can be fully understood in terms of the agency of individuals, and concepts derived from our understanding of individual action. He thus argues for a strong form of methodological individualism.

Recent work on the semantics and pragmatics of slurs has explored a variety of ways of explaining their potential to derogate, with the most popular family of approaches appealing to either: (i), the doxastic or evaluative attitudes or commitments expressed by — or (ii), the propositions concerning such attitudes or commitments semantically or pragmatically communicated by — the speakers who use them. I begin by arguing that no such speaker-oriented approach can be correct. I then propose an alternative treatment of (...) slurs, according to which they are semantically associated with both descriptive and directive content. On the view I defend, when speakers use slurs, they simultaneously propose to add an at-issue proposition to the conversational common ground and issue a not-at-issue directive to their interlocutors to adopt a derogatory perspective toward members of the targeted group. This proposal both avoids the problems faced by other accounts and opens up a novel way of thinking about the phenomenon of appropriation. (shrink)

Surveillance is essential for communicable disease prevention and control. Traditional notification of demographic and clinical information, about individuals with selected infectious diseases, allows appropriate public health action and is protected by public health and privacy legislation, but is slow and insensitive. Big data–based electronic surveillance, by commercial bodies and government agencies, which draws on a plethora of internet- and mobile device–based sources, has been widely accepted, if not universally welcomed. Similar anonymous digital sources also contain syndromic information, which can be (...) analysed, using customised algorithms, to rapidly predict infectious disease outbreaks, but the data are nonspecific and predictions sometimes misleading. However, public health authorities could use these online sources, in combination with de-identified personal health data, to provide more accurate and earlier warning of infectious disease events—including exotic or emerging infections—even before the cause is confirmed, and allow more timely public health intervention. Achieving optimal benefits would require access to selected data from personal electronic health and laboratory records and the potential to re-identify individuals found to be involved in outbreaks, to ensure appropriate care and infection control. Despite existing widespread digital surveillance and major potential community benefits of extending its use to communicable disease control, there is considerable public disquiet about allowing public health authorities access to personal health data. Informed public discussion, greater transparency and an ethical framework will be essential to build public trust in the use of new technology for communicable disease control. (shrink)

Existing work on gaslighting ties it constitutively to facts about the intentions or prejudices of the gaslighter and/or his victim’s prior experience of epistemic injustice. I argue that the concept of gaslighting is more broadly applicable than has been appreciated: what is distinctive about gaslighting, on my account, is simply that a gaslighter confronts his victim with a certain kind of choice between rejecting his testimony and doubting her own basic epistemic competence in some domain. I thus hold that gaslighting (...) is a purely epistemic phenomenon—not requiring any particular set of intentions or prejudices on the part of the gaslighter—and also that it can occur even in the absence of any prior experience of epistemic injustice. Appreciating the dilemmatic character of gaslighting allows us to understand its connection with a characteristic sort of epistemic harm, makes it easier to apply the concept of gaslighting in practice, and raises the possibility that we might discover its structure and the associated harm in surprising places. Quotation marks in natural language that do not function straightforwardly as devices for securing reference to linguistic objects have generally been categorized as instances of either mixed quotation or scare quotation. I argue that certain uses of quotation marks in natural language resist assimilation to either of these two theoretical categories, as well as to the more familiar categories of pure and direct quotation. It follows that we must recognize a novel type of quotation in natural language, which I call (...) dummy quotation because it involves the contribution of semantically minimal `dummy meanings' to composition. I develop a semantic theory of dummy quotation and show that it is better able than rival proposals to account for the troublesome examples in question. (shrink)

Greatly aided by an information age in which protesting laborers in a remote offshore outpost can capture front page headlines around the globe, theSarbanes-Oxley Act of 2002 (SARBOX) has made corporate transparency the linchpin for good corporate governance. Under a SARBOX-enhancedregulatory framework, publicly traded corporations are required to rapidly disclose material changes in their financial conditions or operations—changes such as impairments to goodwill, a trademark, or some other intangible corporate asset. Especially challenging for multinational corporations (MNCs) with far-flung corporate empires (...) is the need to stay abreast of the ebb and flow of goodwill, at a time when transnational human rights groups are aggressively mobilizing world opinion against the sweatshop labor conditions that abound at the offshore production sites favored by MNCs. The author explains why the convergence of a digital age of free-flowing information and the advent of SARBOX, a legislative enactment of paraenetic design, is causing the boards of MNCs to more critically evaluate the long-term costs of their offshore operations. Este artículo presenta un contrapunto entre Edith Stein y Ernst Tugendhat, centrado en la relación entre fe y mística como dos caminos hacia la experiencia trascendente, abordados desde sus respectivas posturas fenomenológicas. El análisis se enfoca en la interpretación de obras clave de ambos autores, ofreciendo una perspectiva contrastiva de sus puntos de partida: la experiencia de la fe cristiana en Stein, orientada a una relación mística con Dios, y la búsqueda de una mística secular en Tugendhat, basada en el (...) autoconocimiento. Este contrapunto metodológico no busca equilibrar sus visiones, sino resaltar sus convergencias y divergencias, visibilizando la complejidad de la experiencia mística. Finalmente, se exploran las limitaciones del análisis y se proyectan posibles aportaciones de ambos autores a una revisión contemporánea de la mística en el contexto religioso. (shrink)

In my comments, I address two issues that are important but not central to the paper under review here. First, I present a reading of the postphenomenological concept of multistability by going back to Merleau-Ponty’s notion of the primacy of perception. I conclude that assertions affirming the multistability of technologies should not be seen as merely empirical. Second, I address the adequacy of using the language of ‘empirical’ and ‘transcendental’ as a means to categorize exclusionary approaches in philosophy of technology.

In industrial societies where civil law and state institutions have become well established secular vehicles for governing the populace, it is widely assumed that the state no longer has an interest in fortifying the religious sector as a complementary source of social control. Thus, a distinction is drawn between the Islamic state that is ruled by religious law and the secular state of Western industrial societies in which religion is deemed to have lost its influence in the public sphere. This (...) dissertation argues that civil law is not religiously neutral and thus challenges a central premise of secularization theory. Introducing a new theoretical model that classifies civil law on the basis of its purpose-to protect religious liberty, engage or fortify the religious sector, or to advance universal norms-the author examines the impact of the three different types of legislation upon religious freedom and the individual autonomy of religious minorities in Sweden, an aggressively secularized industrial society. The author concludes that, viewed from the standpoint of a religious nonconformist, there is no discernible difference between living in a society that is overtly ruled by religious law (e.g., an Islamic state) and living in a "secular” society that is ruled by civil law either embedded with religious norms or designed to facilitate state appropriation of the religious sector as a complementary means of social control. In either environment, the author argues, the religious nonconformist will be forced to conform to the religious norms of the predominant religious group. (shrink)

In Europe ≈15,000 patients receive larval therapy for wound treatment annually. Over the past few years, clinical studies have demonstrated the success of larvae of Lucilia sericata as debridement agents. This is based on a combination of physical and biochemical actions. Laboratory investigations have advanced our understanding of the biochemical mechanisms underlying the beneficial effects of larval secretions, including removal of dead tissue, reduction of the bacterial burden, and promotion of tissue regeneration. The present article summarizes our current understanding of (...) the microbiological, immunological, and wound healing actions of larval therapy, and the molecules involved in these beneficial effects. Future studies will focus on the isolation, identification, and (pre)clinical testing of the effective molecules of L. sericata larvae. These molecules may be candidates for the development of new agents for the treatment of several infectious and inflammatory diseases, including chronic wounds. (shrink)

Two cross-modal experiments provide partial support for O'Regan & Noë's (O&N's) claim that sensorimotor contingencies mediate perception. Differences in locating a target sound accompanied by a spatially disparate neutral light correlate with whether the two stimuli were perceived as spatially unified. This correlation suggests that internal representations are necessary for conscious perception, which may also mediate sensorimotor contingencies.

In this interpretive commentary on Theaetetus, Gregory Kirk makes a major contribution to scholarship on Plato by emphasizing the relevance of the interpersonal dynamics between the interlocutors for the interpretation of the dialogue’s central arguments about knowledge. Kirk attends closely to the personalities of the participants in the dialogue, focusing especially on the unique demands faced by a student—in this case, Theaetetus—and the ways in which one can embrace or deflect the responsibilities of learning. Kirk’s approach gives (...) equal consideration to the dual demands of dramatic interpretation and philosophical argument that constitute the unique character of the Platonic text, and he develops an original interpretation of the Theaetetus, concluding that the uncertainty that characterizes wisdom supersedes the certainty of knowledge. Among the entities that can be mentally or linguistically represented are mental and linguistic representations themselves. That is, we can think and talk about speech and thought. This phenomenon is known as metarepresentation. An example is "Authors believe that people read books." -/- In this book François Recanati discusses the structure of metarepresentation from a variety of perspectives. According to him, metarepresentations have a dual structure: their content includes the content of the object-representation (people reading books) as well as the (...) "meta" part (the authors' belief). Rejecting the view that the object representation is mentioned rather than used, Recanati claims that since metarepresentations carry the content of the object representation, they must be about whatever the object representation is about. Metarepresentations are fundamentally transparent because they work by simulating the representation they are about. -/- Topics covered in this wide-ranging work include the analysis of belief reports and talk about fiction, world shifting, opacity and substitutivity, quotation, the relation between direct and indirect discourse, context shifting, semantic pretense, and deference in language and thought. This book presents an original discussion and analysis of epistemic peer disagreement. It reviews a wide range of cases from the literature, and extends the definition of epistemic peerhood with respect to the current one, to account for the actual variability found in real-world examples. The book offers a number of arguments supporting the variability in the nature and in the range of disagreements, and outlines the main benefits of disagreement among peers i.e. what the author calls the benefits to (...) inquiry argument. Could robots be genuinely intelligent? Could they be conscious? Could there be zombies? Prompted by these questions Robert Kirk introduces the main problems of consciousness and sets out a new approach to solving them. He starts by discussing behaviourism, Turing's test of intelligence and Searle's famous Chinese Room argument, and goes on to examine dualism – the idea that consciousness requires something beyond the physical – together with its opposite, physicalism. Probing the idea of zombies, he concludes they are (...) logically impossible. Having presented the central problems, he sketches his solution: a version of functionalism, according to which consciousness consists in the performance of functions. While there is wide agreement among philosophers about what the main problems of consciousness are, there is little agreement on how to go about solving them. With this powerful case for his version of functionalism, Kirk offers an engaging introduction to both the problems and a possible solution. (shrink)

This paper attacks an old dogma in the philosophy of action: the idea that in order to intend to do something one must believe that there is at least some chance that one will succeed at what one intends. I think that this is a mistake, and that recognizing this will force us to rethink standard accounts of what it is to intend to do something and to do it intentionally.

Harms and risks to groups and third-parties can be significant in the context of research, particularly in data-centric studies involving genomic, artificial intelligence, and/or machine learning technologies. This article explores whether and how United States federal regulations should be adapted to better align with current ethical thinking and protect group interests. Three aspects of the Common Rule deserve attention and reconsideration with respect to group interests: institutional review board (IRB) assessment of the risks/benefits of research; disclosure requirements in the informed (...) consent process; and criteria for waivers of informed consent. In accordance with respect for persons and communities, investigators and IRBs should systematically consider potential group harm when designing and reviewing protocols, respectively. Research participants should be informed about any potential group harm in the consent process. We call for additional public discussion, empirical research, and normative analysis on these issues to determine the right regulatory and policy path forward. (shrink)

Moral distress, if left unaddressed, leads to a number of harmful emotions and behaviors that take a toll on the personal and professional well-being of healthcare workers. In this article, a clinical case is used to illustrate a moral distress debriefing framework that can be utilized by clinical ethicists and healthcare professionals with the appropriate skill set. The first part of the framework is preparatory; it includes guidance on how to identify the needs of healthcare providers, set goals for a (...) debriefing session, gather relevant information, and plan the logistics of the meeting. The second part of the framework is implemental; it outlines an eight-step method to conduct the session from beginning to end. It describes how to constructively reflect on the experience, explore emotional responses, share coping strategies, and identify takeaways for future positive outcomes. This framework can be used to empower healthcare team members to deal with moral distress and be better equipped to handle challenging situations. (shrink)

The principles of the 3Rs—replacement, refinement, and reduction—strongly shape discussion of methods for performing more humane animal research and the regulation of this contested area of technoscience. This special issue looks back to the origins of the 3Rs principles through five papers that explore how it is enacted and challenged in practice and that develop critical considerations about its future. Three themes connect the papers in this special issue. These are the multiplicity of roles enacted by those who use and (...) care for animals in research, the distribution of “feelings that matter” across species and spaces of laboratory animal practice, and the growing importance of “cultures of care” in animal research. This paper gives an account of proxy agency in the context of collective action. It takes the case of a group announcing something by way of a spokesperson as an illustration. In proxy agency, it seems that one person or subgroup's doing something counts as or constitutes or is recognized as (tantamount to) another person or group's doing something. Proxy agency is pervasive in institutional action. It has been taken to be a straightforward counterexample to an appealing deflationary view of (...) collective action as a matter of all members of a group making a contribution to bringing about some event. I show that this is a mistake. I give a deflationary account of constitutive rules in terms of essentially collective action types. I then give an account of one form of constitutive agency in terms of constitutive rules. I next give an account of status functions—of which being a spokesperson is one—that also draws on the concept of a constitutive rule. I then show how these materials help us to see how proxy agency is an expression of the agency of all members of the group credited with doing something when the proxy acts. (shrink)

This book offers a unique comparative study of ubuntu, a dominant ethical theory in African philosophy, and western monotheism. It is the first book to bring ubuntu to bear on the axiology of theism debate in contemporary analytic philosophy of religion. A large motivating force behind this book is to explore the extent to which there is intersubjective ethical agreement and disagreement between ubuntu and Western worldviews like monotheism and naturalism. First, the author assesses the various arguments for anti-theism and (...) pro-theism on the assumption that ubuntu is true. Ubuntu's communitarian focus might be so different from the Western tradition that it completely changes how we evaluate theism and atheism. Second, the author assesses the advantages and disadvantages of the truth of ubuntu for the world. Third and finally, he assesses the axiological status of faith for both monotheism and ubuntu. Ubuntu and Western Monotheism will be of interest to scholars and advanced students specializing in philosophy of religion, African religion and philosophy, and religious ethics. (shrink)

Philosophers have recently wondered whether the value impact of the existence of God on the world would be positive, negative, or neutral. Thus far discussions have distinguished between the value God's impact would have overall, in certain respects, and/or for particular individuals. A commonality amongst the various positions that have been taken up is to focus on the goods and drawbacks associated with both theism and atheism. Goods associated with atheism include things like privacy, independence, and autonomy. I argue that (...) it is better overall and for everyone to prefer a hidden God to no God. This is because it is possible to experience many of the goods attributed to atheism if God is hidden even if they do not really obtain, while also gaining many of the additional goods connected to theism. This amounts to a new solution to the problem of divine hiddenness: God might hide in order to increase or maximize the axiological value of the world. (shrink)

On March 23, 2010, President Obama signed the Patient Protection and Affordable Care Act, a major piece of health care reform legislation. This comprehensive legislation includes provisions that focus on prevention, wellness, and public health. Some, including authors in this symposium, question whether Congress considered public health, prevention, and wellness issues as mere afterthoughts in the creation of PPACA. As this article amply demonstrates, they did not.This article documents the extent of congressional consideration on public health issues based on personal (...) experience working on the framework for health care reform — specifically, my experience as a Fellow for a member of the Health Subcommittee of the Senate Finance Committee from 2008-2009. I also include a review of congressional activity in the United States House of Representatives. Analysis of the congressional meetings and hearings reveals that Congress had a deep understanding about the critical need to reform the U.S. public health and prevention system. (shrink)
