Online Public Shaming is a form of norm enforcement that involves collectively imposing reputational costs on a person for having a certain kind of moral character. OPS actions aim to disqualify her from public discussion and certain normal human relations. We argue that this constitutes an informal collective punishment that it is presumptively wrong to impose on others. OPS functions as a form of ostracism that fails to show equal basic respect to its targets. Additionally, in seeking to mobilise unconstrained (...) collective power with potentially serious punitive consequences, OPS is incompatible with due process values. (shrink)

Moral and self-conscious emotions like guilt and shame can function as internal negative experiences that punish or deter bad behaviour. Individual differences exist in people’s tendency to experience guilt and shame. Being disposed to experience guilt and/or shame may predict students’ expectations of their emotional reactions to engaging in immoral behaviour in the form of academic misconduct, and thus dissuade students from intending to engage in this behaviour. In this study, students’ (n = 459) guilt and shame proneness, their expectations (...) of feeling guilt and shame if they engaged in academic misconduct, and their intentions to engage in academic misconduct were measured. Three of the four facets of the guilt and shame proneness scale [GASP: Guilt–Negative-Behavior-Evaluation (NBE), Guilt-Repair, Shame–Negative-Self-Evaluation (NSE)] had significant negative correlations with academic misconduct intentions, and these relationships were mediated by anticipating shame and guilt related to engaging in academic misconduct. These results suggest that for some students expecting to experience negative moral emotions when engaging in academic misconduct may protect them from breaching ethical assessment rules. (shrink)

Prosthetic devices that replace an absent body part are generally considered to be either cosmetic or functional. Functional prostheses aim to restore (some degree of) lost physical functioning. Cosmetic prostheses attempt to restore a “normal” appearance to bodies that lack (one or more) limbs by emulating the absent body part’s looks. In this article, we investigate how cosmetic prostheses establish a normal appearance by drawing on the stories of the users of a specific type of artificial limb: the facial prosthesis. (...) Given that prostheses are first and foremost devices worn upon the body, such an analysis requires an understanding of the ways in which bodies and technologies interact. We thus interpret users’ stories by critically engaging with the work of disability researcher and Actor-Network theorist Myriam Winance, as well as with the postphenomenological scholarship of Don Ihde and Peter-Paul Verbeek. Using this framework, we explore users’ attempts to achieve a proper fit between their faces and their prostheses, the technological transparency such a fit enables, and the ways in which transparency mediates users’ everyday exchanges with others. We conclude that a normal appearance, when it is achieved by means of prosthetics, enables the device’s user to navigate a precarious social environment as they encounter and interact with others in public. Philosophers have traditionally treated physicalism as an empirically informed metaphysical thesis. This approach faces a well-known problem often referred to as Hempel’s dilemma: formulations of physicalism tend to be either false or indeterminate. The generally preferred strategy to address this problem involves an appeal to a hypothetical complete and ideal physical theory. After demonstrating that this strategy is not viable, I argue that we should redefine physicalism as an interdisciplinary research program seeking to explain the mental in terms of the (...) physical that encompasses the physical sciences, the psychological and brain sciences, and philosophy. Redefining physicalism in this way improves upon previous reconstructive accounts while avoiding the indeterminacy associated with orthodox forms of futurist physicalism. (shrink)

Judgments concerning animals have arisen across a variety of established practice areas. There is, however, no publicly available repository of judgments concerning the emerging practice area of animal protection law. This has hindered the identification of individual animal protection law judgments and comprehension of the scale of animal protection law made by courts. Thus, we detail the creation of an initial animal protection law repository using natural language processing and machine learning techniques. This involved domain expert classification of 500 judgments (...) according to whether or not they were concerned with animal protection law. 400 of these judgments were used to train various models, each of which was used to predict the classification of the remaining 100 judgments. The predictions of each model were superior to a baseline measure intended to mimic current searching practice, with the best performing model being a support vector machine (SVM) approach that classified judgments according to term frequency—inverse document frequency (TF-IDF) values. Investigation of this model consisted of considering its most influential features and conducting an error analysis of all incorrectly predicted judgments. This showed the features indicative of animal protection law judgments to include terms such as ‘welfare’, ‘hunt’ and ‘cull’, and that incorrectly predicted judgments were often deemed marginal decisions by the domain expert. The TF-IDF SVM was then used to classify non-labelled judgments, resulting in an initial animal protection law repository. Inspection of this repository suggested that there were 175 animal protection judgments between January 2000 and December 2020 from the Privy Council, House of Lords, Supreme Court and upper England and Wales courts. Moral Case Deliberation is intended to assist healthcare professionals faced with difficult dilemmas in their work. These are situations that involve emotions. During Moral Case Deliberation, participants are invited to reflect on moral views and deliberate on them. Emotions are not explicitly addressed. This article aims to elucidate the role of emotions in Moral Case Deliberation, by analysing experiences of Moral Case Deliberation facilitators. Our research shows the role of emotions varies according to the phase of the Moral Case Deliberation (...) process. One negative aspect of emotions is that they can obstruct the Moral Case Deliberation discussion or distract from the moral question. A positive aspect is that they bring the dilemma into sharper focus. Devoting attention to emotions can help to ensure that responsible decisions are made, while also increasing the moral resilience of participants. (shrink)

This paper outlines a method to assess the effectiveness of diagrams, from semiotic foundations. In doing so, we explore the Peircian notion of signification, as applied to diagrammatic representations. We review a history of diagrams, with particular emphasis on schematics used for representing systems, and uncover the neglect of semiotic analysis of diagrammatic representations. Through application of category theory to the Peircian triadic model, we propose a set of quantitative quality measures for diagrams, and a framework for their assessment, based (...) on the properties of their encoding, pragmatic and perceptual morphisms. These measures include diagram complexity, utility, aesthetics and expert assessment of semiotic content, together with qualitative feedback. We consider the diagrams as an aid to cognitive processes, rather than a purely communication media. This utility-focused perspective on diagram quality dimensions allows for fresh insights into the creation of effective diagrams. (shrink)

Résumé Le but de cet article est d’interroger les trois notions de texte, discours et cognition, et les modèles théoriques, complémentaires ou opposés, qui les illustrent et les défendent. Pour cela, les notions ne seront pas analysées à la suite, une par une, mais en parallèle, deux par deux. Reprenant les orientations de mes travaux actuels en linguistique textuelle et en linguistique cognitive, je les confronterai en deux temps : texte vs. discours et texte vs. cognition. Cette double confrontation, avec (...) le texte pour dénominateur commun, laisse ainsi entendre, d’une part, que si je prends en compte le discours comme le cadre contextuel, situationnel, générique, où apparaît le texte, je m’attache au texte comme objet d’analyse, suivant en cela une tradition « pragoise », à la fois structurale ou macro-syntaxique et fonctionnelle ; cela laisse entendre, d’autre part, que cette conception du texte permet de concilier les théories néo-pragoises à celles que développent les linguistiques cognitives d’aujourd’hui, centrées sur diverses compétences, activités ou opérations, mentales, sémantiques, pragmatiques et sémiotiques, souvent regroupées sous le terme englobant ou résultant de représentation : espaces mentaux, projections, mélange (blending), émergence de sens. Pour finir je montre que la procédure de double intégration, conceptuelle et prédicative, permet d’illustrer la complémentarité des deux modèles, mental-cognitif et macrosyntaxique-textuel. (shrink)

Thus an object that is perfectly useless from a biological point of view (such as a medal, or the enemy's flag) can be desired because it is the object of other desires. Such a human desire, and human reality as it differs from animal reality, is only created by the action that satisfies such desires. Human history is the history of desires that are desired [Désirs désirés]. Undoubtedly, these could be words written by Girard. However, they are not. These words are quoted from the famous lectures given by Alexandre Kojève on Hegel's Phänomenologie des Geistes at the Ecole pratique des hautes études between 1933 and 1939. Recent advancements in algorithms for abstract argumentation make it possible now to solve reasoning problems even with argumentation frameworks of large size, as demonstrated by the results of the various editions of the International Competition on Computational Models of Argumentation (ICCMA). However, the solvers participating to the competition may be hard to use for non-expert programmers, especially if they need to incorporate these algorithms in their own code instead of simply using the command-line interface. Moreover, some ICCMA solvers focus on (...) the ICCMA tracks, and do not implement algorithms for other problems. In this paper we describe pygarg, a Python implementation of the SAT-based approach used in the argumentation solver CoQuiAAS. Contrary to CoQuiAAS and most of the participants to the various editions of ICCMA, pygarg incorporates all problems that have been considered in the main track of any edition of ICCMA. We show how to easily use pygarg via a command-line interface inspired by ICCMA competitions, and then how it can be used in other Python scripts as a third-party library. (shrink)

Saint Meinrad Seminary St. Meinrad, Indiana HE International Theological Commission's 1985 statement on " The Consciousness of Christ Concerning Himel £ and His Mission " undertakes to state what by faith Christians hold about the knowledge of Jesus. Jesus of Nazareth knew : first, that he was the Son of God, and that he possessed divine and (...) not merely prophetical authority; second, that his mission was to preach the Kingdom and die for the salvation of all; third, that he was founding a Church. Fourth and last, since he was dying for all, he knew the " all" he was dying for in such a way as to enable each Christian to say truly " he died for me " (see Gal. 2 :20). Beyond this the bare statement that Jesus was conscious of his identity and mission, the Commission declines to go, and expressly avoids " theological elaborations calculated to give an account of this datum of faith." 1 The traditional account of this datum is, of course, the theory of Christ's immediate (or " beatific") knowledge of God, and usually as elaborated by St. Thomas. Second, a key distinction upon which St. Thomas's account depends, that between faith and knowledge, tends to be obliterated in contemporary analytic epistemology, where knowledge is described as "justified true belief." This makes it hard to see the difference St. Thomas supposes there is between the cognitive state of Christians, on the one hand, and that of Jesus, on the other. Third, some modern biblical theology discovers Jesus himself as the ·exemplar of Christian faith. Thus, even supposing we have kept the distinction between faith and knowledge, the required application of the distinction becomes impossible.2 I will be unable to deal at any length with these last two difficulties, but will advert to them briefly within the outline of an approach to St. Thomas's account that I mean to give here.3 I. St. Thomas's Position as an Account of the Datum of Faith The first difficulty, however, is to be addressed at the outset and at some length. This book shows the surprising dynamism of the field of civil procedure through its examination of a cross section of recent developments within civil procedure from around the world. It explores the field through specific approaches to its study, within specific legal systems, and within discrete sub-fields of civil procedure. The book reflects the latest research and conveys the dynamism and innovations of modern civil procedure - by field, method and system. The book's introductory chapters lay the groundwork for researchers (...) to appreciate the flux and change within the field. The concluding chapters bring the many different identified innovations and developments together to show the field's ability to adapt to modern circumstances, while retaining its coherence even across different legal systems, traditions, fields and analytic approaches. Specifically, in this book the presence of dynamism is explored in the legal systems of the EU, France, the US, Brazil, Australia, the UK and China. So too that dynamism is explored in the contributions' analyses and discussions of the changes or need for change of specific aspects of civil procedure including litigation costs, class actions, derivative actions, pleadings, and res judicata. Furthermore, most of the individual contributions may be considered to be comparative analyses of their respective subjects and, when considered as a whole, the book presents the dynamism of civil procedure in comparative perspective. Those discrete and aggregated comparative analyses permit us to better understand the dynamism in civil procedure - for change in the abstract can be less visible and its significance and impact less evident. While similar conclusions may have been drawn through examinations in isolation, employing comparative analytic methods provided a richer analysis and any identified need for change is correspondingly advanced through comparative analysis. Furthermore, if that analysis leads to a conclusion that change is necessary then comparative law may provide pertinent examples for such change - as well as methodologies for successfully transplanting any such changes. In other words, as this book so well reflects, comparative law may itself usefully contribute to dynamism in civil procedure. This has long been a raison d'être of comparative law and, as clear from this book's contributions, in this particular time and field of study we find that it is very likely to achieve its lofty promise.
