The two books on which this study is based represent the two branches of linguistic philosophy. One an anthology, the other an original work, they differ also in kind. In Logic and Language A.G.N. Flew has collected and ably prefaced nine essays by British analysts, the earliest of which, Ryle's "Systematically Misleading Expressions," appeared exactly twenty years ago. Nelson Goodman's The Structure of Appearance is a new reconstruction; not to recognize its vigor and impressiveness would be most ungracious even if (...) one rejects as radically as I do this particular Aufbau. Naturally, I shall say more about Goodman's book than about the essays. Yet I shall begin with the latter and say about Ryle's as much as about all the rest together. To justify this strategy I must put my own cards on the table, indicating where I stand on this controversy or near controversy between formalists and antiformalists. To my mind, then, it is gray against gray, not white against black. Both sides agree, and I agree with them, that there is no experience or, if you please, no experiment that decides what is presumably at issue between phenomenalists and realists. In this important sense, both sides agree, and I agree with them, that all philosophical problems are verbal. But in another equally important sense they are not verbal. This sense both formalists and antiformalists have lost or stand in danger of losing if what they do is no better than what they say they do. Now for my reasons for singling out and starting off with the essay that marks Ryle's sober-eyed and reluctant conversion to the linguistic philosophy. It so happens that he there states very aptly a body of doctrine on which both sides could still agree and from which they in fact branched off at about the time the paper was first published. Also, the doubts and dissatisfactions to which he there confessed contain the starting points of the peculiar dialectics by which both formalists and antiformalists may be driven to extremes. Even better than that, I believe I can make use of these hesitancies to lend color to my own argument for a middle position which, as one is tempted to say on such occasions, does justice to both sides. That Ryle himself has in the meantime become a hero of the antiformalists is merely a piquant detail and does not deter me. (shrink)

In the 21st century, Carl Gustav Jung (1875-1961) remains one of the key figures in the field of analytical psychology - and Psychological Types, or The Psychology of Individuation, published in 1921, is one of his most influential works. It was written during the decade after the publication of Psychology of the Unconscious (1912), which effectively ended his friendship and collaboration with Sigmund Freud. Whereas the earlier work had clearly marked Jung's psychoanalytical divergence from Freud it is the Psychology (...) of Types that fully clarifies and presents the nature, quality and characteristics of his analytical psychology. The work, which was in part a consequence of his need to reconcile the competing theories of Freud, whom he regarded as extraverted, and Alfred Adler, whom he saw as introverted, develops his concept of descriptive categories for understanding the human mind in terms of the two essential attitude types: introversion and extraversion. These basic attitudes operate in tandem with four principal interacting functions of consciousness which Jung identifies as sensation and intuition, which are functions of perception, and thinking and feeling, which are functions of judgment. The eight resulting psychological types are then explored, described, identified, characterised and explained in considerable detail, with a soaring range of examples drawn from the whole of human history, culture and experience. In his efforts to explore and illuminate the nature of the unconscious mind and indeed the collective unconscious, he investigates the problems posed by the differing psychological types and how these have manifested from classical and medieval times to the 20th century. His observations range from Aristotle, Socrates and Plato to Tertullian and Origen, and from Abélard and Master Eckhart to Martin Luther and the problem of transubstantiation. Jung takes the listener on an odyssey of human thinking. He considers the problem of types in the works of Schiller and Goethe, and Spitteler and his treatment of the Prometheus myth. He contrasts idealism and realism, the Apollonian and the Dionysian in Nietzsche, and explores a host of philosophical and religious sources from the Bible to Taoism to Brahminism. He considers the nature of the reconciling symbol in Spitteler before analysing the nature of types in modern philosophy, aesthetics and biography, giving detailed consideration to William James' characteristic pairs of opposites and Furneaux Jordan's 'character sketch of the emotional types'. Jung goes on to fully identify and describe the characteristic differences between the extraverted and introverted types and provides an extensive chapter on definitions to fully clarify the meaning of the language he employs and make his meaning more accessible. This paper examines the effects of a decrease in auditor litigation risk in a setting that isolates a change in auditor litigation risk from changes in auditor reputation. _StoneRidge Investment Partners v. Scientific Atlanta_ is a 2008 U.S. Supreme Court ruling that restricted secondary actor liability in class action suits, resulting in a decrease in class actions that listed auditors as defendants. We document that the _StoneRidge_ decision is associated with a negative CAR for clients of Big 4 auditors and (...) industry specialist auditors, in particular those associated with high-litigation risk, low cash, and past incidences of modified going concern opinions. These findings are consistent with investor perception of lower potential payoffs from secondary defendants in class action suits, in particular auditors, following the _StoneRidge_ decision. We also document that auditors are more (less) likely to accept (reject) risky clients and charge lower audit fees to risky clients after _StoneRidge_, consistent with a decrease in auditor litigation risk that increases auditor risk tolerance. Finally, we provide evidence that audit firms issue fewer going concern opinions following _StoneRidge_, consistent with a decrease in litigation risk leading to lower audit quality_._ Our results are relevant to policy makers as they consider the disciplinary role of litigation on audit markets. _Psychological Types_ is one of Jung's most important and most famous works. First published by Routledge in the early 1920s it appeared after Jung's so-called fallow period, during which he published little, and it is perhaps the first significant book to appear after his own confrontation with the unconscious. It is the book that introduced the world to the terms 'extravert' and 'introvert'. Though very much associated with the unconscious, in _Psychological Types_ Jung shows himself to be a supreme theorist (...) of the conscious. In putting forward his system of psychological types Jung provides a means for understanding ourselves and the world around us: our different patterns of behaviour, our relationships, marriage, national and international conflict, organizational functioning. The eminent philosopher of science Carl G. Hempel, Stuart Professor of Philosophy at Princeton University and a Past President of the American Philosophical Association, has had a long and distinguished academic career in the course of which he has been professorial mentor to some of America's most distinguished philosophers. This volume gathers together twelve original papers by Hempel's students and associates into a volume intended to do homage to Hempel on the occasion of his 65th year in 1970. The papers (...) are grouped around the unifying topic of Hempel's own interests in logic and philosophy of science, the great majority dealing with issues on inductive logic and the theory of scientific explanatio- problems to which Hempel has devoted the bulk of his outstandingly fruitful efforts. Although the production and recognition of social actions have been central concerns for conversation analysis from the outset, it has recently been argued that CA is yet to develop a systematic analysis of ‘action formation’. As a partial remedy to this situation, John Heritage introduces ‘epistemic status’, which he claims is an unavoidable component of the production and recognition of social action. His proposal addresses the question how is social action produced and recognized? by reference to another question how is (...) relative knowledge recognized? Despite the importance placed on the latter question, it is not clear how it is to be answered in particular cases. We argue that the introduction of epistemic status builds on a reformulation of the action formation problem that unnecessarily de-emphasizes the importance of the sequential environment. Our re-analyses of key sequences cast doubts on the empirical grounding of the epistemic program, and question whether the fundamental role of epistemic status has been convincingly demonstrated. Carl Gustav Hempel (1905-1997) was one of the preeminent figures in the philosophical movement of logical empiricism. He was a member of both the Berlin and Vienna circles, fled Germany in 1934 and finally settled in the US where he taught for many years in New York, Princeton, and Pittsburgh. The essays in this collection come from the early and late periods of Hempel's career and chart his intellectual odyssey from a rigorous commitment to logical positivism in the 1930s (...) (when Hempel allied himself closely with Carnap) to a more sociological approach close in spirit to the work of Neurath and Kuhn. The collection brings together essays which have up till now been difficult to find, four of which are appearing in English for the first time. Cumulatively they offer a fresh perspective on Hempel's intellectual development and on the rise and demise of logical empiricism. (shrink)

Introducing a sociological perspective on judicial emotions, we argue that previous studies underemphasize structural and interactional dimensions. Through key concepts in the sociology of emotions we relate professional court actors’ emotion management to the emotional regime of the judiciary. Examples from the Swedish judiciary illustrate three main arguments: (a) The idea of rational justice as nonemotional must be investigated as a joint accomplishment including collective emotion management; (b) Judicial objectivity requires situated emotion management and empathy, orientated by emotions of pride/shame; (...) (c) The structural dimensions of power/status mitigate feeling and display rules. The situated power of the judge is upheld by ritual deference from other court professionals. Concluding, we suggest topics to develop structural and interactional perspectives on judicial emotion. (shrink)

Only a few studies explore the lifeworld of the spouses of persons affected by early-onset Alzheimer disease. The aim of this study is to explore the lifeworld of spouses when their partners are diagnosed with AD, focusing on spouses’ lived experience. The study employs an interpretative phenomenological framework. Ten in-depth interviews are performed. The results show that spouses’ lifeworld changes with the diagnosis. They experience an imprisoned existence in which added obligations, fear, and worry keep them trapped at home, both (...) physically and mentally. In their longing for freedom, new strategies and attitudes helps the spouses to create an extended “lived space” with their partner. The findings stress the importance of paying attention to the lifeworld of spouses and making clinical recommendations on this basis. Most importantly, the lifeworld perspective has implications for how we understand what care is. We hope to challenge all different healthcare professionals and invite them to discuss the deep meaning of care and the definition of being professional in encounters with vulnerable others from a lifeworld perspective. Scholars have argued that we have compelling reasons to combat climate change because it threatens human rights, referred to here as ‘climate rights’. The prospects of climate rights are analysed assuming two basic desiderata: its accuracy in capturing the normative dimension of climate change ; and its ability to generate political measures. In order for climate rights to meet these desiderata certain conditions must be satisfied: important human interests are put at risk by global climate change; there is an identified (...) rights-holder and obligation-bearer; this relationship is codified in a legitimate formal structure; it is feasible to claim the rights; an ‘enforcement mechanism’ could strengthen compliance. When asserting climate rights it is insufficient to consider the moral ground or actual enforcement possibilities by themselves. Normative and practical aspects are closely interlinked and must be studied in tandem. (shrink)

Alle Weltauffassungen seien in vorwissenschaftlicher Form in ihnen enthalten und müssten von der Philosophie «in Begriffen gewonnen werden». Dies unternimmt die 1886 erschienene Religionsphilosophie. Sie schliesst an Die wirkliche und die scheinbare Welt an und ist Teil von Teichmüllers Projekt der Entwicklung einer neuen, personalistischen Philosophie. Aus dieser Perspektive analysiert er auch die Religionen. Dafür zieht er nicht nur Texte, sondern auch zahlreiche religiöse Verhaltensweisen, Kulte und Artefakte heran. Die Zurücknahme der (...) Projektion des Gottesbewusstseins und das zunehmende Bewusstsein um das eigene Ich bestimmen nach Teichmüller die religiöse Entwicklung. Dabei unterscheidet er eine projektivische, eine pantheistische und eine personalistische Stufe der Religion. Der zweite geplante Band der Religionsphilosophie sollte das Christentum als Vertreterin der personalistischen Religion behandeln. Wegen des unerwarteten Todes Teichmüllers blieb er ungeschrieben. Als Ersatz wird der Religionsphilosophie ein aus dem Nachlass ediertes Manuskript seiner Vorlesungen über Philosophie des Christenthums beigefügt, die zeitlich und inhaltlich unmittelbar an die Religionsphilosophie anschlossen. Teichmüllers entmythologisiertes Christentum ist nicht nur die Religion der selbständigen, ewigen menschlichen Person. Es befreit auch von der Angst vor Gottes Strafe, von der Qual des Sündenbewusstseins und dem Bangen um Erlösung und emanzipiert das Individuum von totalitären religiösen Institutionen. (shrink)

Patients with advanced cancer often experience a reduced ability to eat, which may result in tensions between patients and family members. Often with advanced cancer diagnoses, patients’ appetites decline markedly, while family members focus on nutritional intake with the hope that this will postpone death. This hope might cause tensions between the patient and family; the family may expect healthcare professionals to encourage the patient to eat more, whereas the patient needs to be supported in their reduced ability to eat. (...) When these tensions arise, healthcare professionals can experience challenges in providing good palliative care. To address these challenges in the provision of palliative care, healthcare professionals may adopt a care ethics approach. Similar to palliative care’s focus on patient and family members’ relationships, a care ethics approach emphasizes interdependency and social relationships. Using Joan Tronto’s care ethics approach, we conducted a normative analysis of what caring for patients with reduced ability to eat and their family members should look like. Tronto’s approach includes five phases of care: caring about, taking care of, care giving, care-receiving, and caring with. Based on our analysis and empirical studies on patients with advanced cancer and family members, concerns with their lack of appetite, we assert that healthcare professionals must be mindful of the potential of tensions related to appetite and be adept in dealing with these tensions. We urge that education is needed for healthcare professionals regarding the psychosocial impact of reduced ability to eat on both patients and family members and interprofessional collaboration is of the essence. T. L. Short's Peirce's Theory of Signs offers a strong interpretation of semeiotic, advocating a developmental and naturalistic position. This commentary examines some of the main features of Short's approach, raising a number of critical questions concerning the growth of Peirce's thought and the problem of anthropomorphism. First, two possible weaknesses in Short's account of the development of semeiotic, connected to the treatment of the "New List of Categories" and the role of the index, are noted. Next, the menace of (...) anthropomorphism is placed in the context of Peirce's startling affirmation of this point of view. Finally, the article draws attention to Short's bold claim that Peirce's theory of signs needs to be modified in order to accommodate a plurality of final interpretants in view of varying purposes. The concept of inreducible complexity is central to the origins controversy. Ineducible complexity (IC) may be defined as any machine or system that requires two or more parts in order to function. Examples range from molecules to mousetraps, organelles, and organisms such as humans. This essay explores the relationship between IC and complexity, clarifying the levels of IC such as the irreducible core and its mode of function. IC has been used in a wide variety of disciplines for over a (...) century. Objections to irreducibte complexity include co-option, the "junk DNA" theory, and the scaffolding argument. Co-option, a major argument against IC, attempts to explain how IC can be achieved through natural means by utilizing existing parts to construct a new biological machine or structure. Yet examples of IC in both the biological and non-biological wortds show that such common objections do not invalidate the concept. IC is firmly established. (shrink)
