In 1985, a member of the Canadian judiciary handed down a written judgment in which he distinguished between erotica and obscene matter. The judgment attracted the scorn of some normative sociologists, who complained of the insufficiency of the social psychological research on which it was based. Their reaction prompts a review of the judgment in the light of social constructionism and of ethnomethodology; this, in turn, prompts a comparison of social constructionist and ethnomethodological methodologies, in which the legal judgment serves (...) merely as a test case. It is argued that normative sociology and social constructionism, both being of an essentially ironic cast, occlude the judge's sense-making procedures, the very phenomena they purport to describe. There is a major division in the interpretation of Kant, between traditionalists and revolutionaries. Traditionalists tend to assimilate Kant to predecessors such as Leibniz, Hume, or Berkeley. Revolutionaries take more seriously Kant's vehement repudiation of all the earlier empiricist, rationalist, realist, idealist, skeptical, and dogmatic doctrines.

Graham Priest presents an exploration of the development of Buddhist metaphysics, which is viewed through the lens of the catuskoti. In its earliest and simplest form this is a logical/metaphysical principle which says that every claim is true, false, both, or neither; but Priest shows how the principle itself evolves as the metaphysics develops.

This volume puts leading pragmatists in the philosophy of language, including Robert Brandom, in contact with scholars concerned with what pragmatism has come to mean for the law. In many chapters, the version of pragmatism deployed proves a fruitful approach to its subject matter; in others, shortcomings of the specific brand of pragmatism are revealed. A comprehensive treatment of the concept of causation in evolutionary biology that makes clear its central role in both historical and contemporary debates. Most scientific explanations are causal. This is certainly the case in evolutionary biology, which seeks to explain the diversity of life and the adaptive fit between organisms and their surroundings. The nature of causation in evolutionary biology, however, is contentious. How causation is understood shapes the structure of evolutionary theory, and historical and contemporary debates in evolutionary biology (...) have revolved around the nature of causation. Despite its centrality, and differing views on the subject, the major conceptual issues regarding the nature of causation in evolutionary biology are rarely addressed. In a sample of 522 police officers and staff in an English police force, we investigated the role of authoritarian leadership in reducing the levels of employee ethical voice. Drawing upon uncertainty management theory, we found that authoritarian leadership was negatively related to employee ethical voice through increased levels of felt uncertainty, when the effects of a motivational-based mechanism suggested by previous studies were controlled. In addition, we found that the negative relationship between authoritarian leadership and employee ethical voice via (...) felt uncertainty is mitigated by higher levels of benevolent leadership. That is, when authoritarian leaders simultaneously exhibit benevolence, they are less likely to cause feelings of uncertainty in their followers who are then more likely to speak up about unethical issues. The only constant in theological education is change, despite brave attempts to hold the tide back in some quarters. Yet, Western-based theological education remains the norm globally. The Faculty of Theology at the University of Pretoria exemplifies this norm despite its commitment to Africanisation. This article will consider transformation through the lens of the leadership of Prof. Johan Buitendag, who has led the transformation initiative from his own shared leadership perspective as dean since 2010. Change in the faculty will be (...) analysed through analysis of the faculty plans, with particular reference to teaching, learning and research. Bartha (2012) conjectures that, if we meet all of the other objections to Pascal’s wager, then the many-Gods objection is already met. Moreover, he shows that, if all other objections to Pascal’s wager are already met, then, in a choice between a Jealous God, an Indifferent God, a Very Nice God, a Very Perverse God, the full range of Nice Gods, the full range of Perverse Gods, and no God, you should wager on the Jealous God. I argue that his (...) requirement of [strongly] stable equilibrium is not well-motivated. There are other types of Gods, no less worthy of consideration than those that figure in Bartha’s deliberations, which are intuitively no worse wagers than the Jealous God. In particular, I have suggested that one does no worse to wager on a jealous cartel than one does to wager on a Jealous God. Moreover, I argue that there are other types of Gods, no less worthy of consideration than those that figure in Bartha’s deliberations, that make trouble for Pascal’s wager, but not because one would do better to wager on them rather than on a Jealous God. Finally, I argue that, if we suppose that infinitesimal credences are in no worse standing the infinite utilities, then we cannot accept the assumption—built into the relative utilities framework—that there cannot be infinitesimal credences. In this paper, I aim to bring out the implausibility of the claim that there is a class of philosophers of religion—holders of a particular constellation of beliefs about religion—whose religious beliefs are either uniquely rational or uniquely supported by a stock of cogent arguments. My initial focus will be on models of parties to religious disagreements. These models may be simple, but I believe that there is much to be learned from them.

Although the presence or absence of a pitch accent clearly can play an important role in signaling the discourse and information structure of an utterance, whether the form of an accent determines the type of information it conveys is more controversial. We used an eye‐tracking paradigm to investigate whether H*, which has been argued to signal new information, evokes different eye fixations than L+H*, which has been argued to signal the presence of contrast. Our results demonstrate that although listeners interpret (...) these accents differently, their interpretive domains overlap. L+H* creates a strong bias toward contrast referents whereas H* is compatible with both new and contrast referents. (shrink)

As inter‐organisational relations represent an increasingly important element in business the ability to build sustainable relationships becomes a key skill. To achieve sustainable relationships parties need to move from a low trust/low ethics base to a high trust/high ethics base in their relating. This paper uses data from a study into trust‐based partnering in the construction industry to demonstrate that ethics is integral to trust building. The data supports the proposition that ethical partnering, which is characterised by reliability, delivery of (...) promises, open and honest communications, respect and reciprocity, and a willingness to act reasonably towards each other, is the most effective model for parties seeking to build sustainable relationships. It is a very curious thing that proponents of Idealism have considered it to be a satisfactory counter to ‘scepticism’, ‘nihilism’, and the like. On the contrary, it seems to me that Idealism is a very close cousin to ‘brain-in-a-vat’ scepticism and other anti-naturalistic fantasies. Moreover, it seems to me that Idealism is inferior to Naturalism for much the same kinds of reasons that ‘brain-in-a-vat’ scepticism and other anti-naturalistic fantasies are inferior to Naturalism: a proper weighing of theoretical virtues discloses (...) that Naturalism is the most virtuous worldview. Assisted dying is a divisive and controversial topic and it is therefore desirable that a broad range of interests inform any proposed policy changes. The purpose of this study is to collect and synthesize the views of an important stakeholder group—namely people with disabilities —as expressed by disability rights organisations in Great Britain. Parliamentary consultations were reviewed, together with an examination of the contemporary positions of a wide range of DROs. Our analysis revealed that the vast majority do not have (...) a clear public stance; those that do exhibit a significant diversity of opinion. DROs opposing legislation on assisted dying have argued that it would be premature, misguided, inequitable and culturally undesirable. Some specify conditions that would have to be satisfied before they could support legalisation, such as radical improvements in health and social care services and the elimination of discrimination against PwD. DROs supporting assisted dying maintain that a change in the law would promote autonomy, end intense suffering, can be delivered safely and is supported by the DRO’s membership. The discussion considers the reasons why several DROs adopt a neutral stance and the argument is made that, whatever their overarching stance on the issue, DROs need to be involved in the policy debate so that the crucial perspectives of PwD are heard and addressed. This is an important message for countries around the world that permit, or are considering legalising, assisted dying. (shrink)

The cognitive science of religion draws on insights from evolutionary psychology, and offers explanations of religious belief based on natural cognitive processes. This article examines a number of competing explanations of religious belief by considering it as a solution to the challenge of cooperation. The challenge of stopping individuals cheating within a cooperative group has been a problem throughout humanity’s evolutionary history. Empirical evidence drawn from fields such as anthropology and psychology suggests that religious beliefs are part of an evolved (...) cognitive system that motivates individuals to cooperate with other members of their group. Three possible evolutionary accounts, the memetic, by‐product, and adaptation accounts, are considered as evolved solutions to the challenge of cooperation. (shrink)

There is a thinking animal in your chair and you are the only thinking thing in your chair; therefore, you are an animal. So goes the main argument for animalism, the Thinking Animal Argument. But notice that there are many other things that might do our thinking: heads, brains, upper halves, left-hand complements, right-hand complements, and any other object that has our brain as a part. The abundance of candidates for the things that do our thinking is known as the (...) Thinking Parts Problem. Animalists who endorse the Thinking Animal Argument must solve this problem by giving reasons for privileging the animal over its rivals. In order to meet this challenge, some animalists have argued that the best solution is a biological minimalist one. In what follows, I argue that every extant biological minimalist solution to the Thinking Parts Problem fails. (shrink)

This is the concluding chapter of a debate book about the existence of God: *Theism and Atheism: Opposing Arguments in Philosophy* (Gale, 2019). The book has a large number of contributors on both sides. My chapter suggests one way of unifying the contributions that are made on the atheistic side.

A reciprocity framework is presented as an analysis of morality, and to explain and justify the attribution of moral rights and duties. To say an entity has rights makes sense only if that entity can fulfill reciprocal duties, i.e., can act as a moral agent. To be a moral agent an entity must (1) be self-conscious, (2) understand general principles, (3) have free will, (4) understand the given principles, (5) be physicallycapable of acting, and (6) intend to act according to (...) or against the given principles. This framework is foundational both to empirical and supernatural positions which distinguish a human milieu, which is moral, from a nonhuman milieu, which is not. It also provides a basis for evaluating four standard arguments for the rights ofnonhuman animals and nature-the ecological, the prudential, the sentimental, and the contractual. If reciprocity is taken as being central to the general concepts of rights and duties, then few animals, and no natural objects or natural systems, have rights and duties in an intrinsic or primary sense, although they may be assigned them in an extrinsic or secondary sense as a convenience in connection with human interests. Nevertheless, there are some animals besides humans - e.g., especially chimpanzees, gorillas, dolphins, and dogs - which, in accordance with good behavioral evidence, are moral entities, and sometimes moral agents. On the grounds of reciprocity, they merit, at aminimum, intrinsic or primary rights to life and to relief from unnecessary suffering. (shrink)

A recent political critique of Speculative Realism by Catherine Malabou finds fault with this loosely arranged movement for its focus on reality in its own right, apart from the subject. Malabou responds with a radical ontological claim, holding effectively – if not always explicitly – that subject and object mutually generate one another amidst a primal void. After criticizing this idea, I point to some of the difficult political consequences of such a position, though Malabou defines it positively as an (...) anarchic awakening that generates new collectivities unconstrained by any thing-in-itself. By contrast, I contend that nonhuman constraints and collaborators are an intimate part of the human political sphere. More generally, it is shown that there are consequences for which sorts of relations are taken to be the primary political relations. (shrink)

This pioneering anthology of Middle English prologues and other excerpts from texts written between 1280 and 1520 is one of the largest collections of vernacular literary theory from the Middle Ages yet published and the first to focus attention on English literary theory before the sixteenth century. It edits, introduces, and glosses some sixty excerpts, all of which reflect on the problems and opportunities associated with writing in the "mother tongue" during a period of revolutionary change for the English language. (...) The excerpts fall into three groups, illustrating the strategies used by medieval writers to establish their cultural authority, the ways they constructed audiences and readerships, and the models they offered for the process of reading. Taken together, the excerpts show how vernacular texts reflected and contributed to the formation of class, gender, professional, and national identity. They open windows onto late medieval debates on women's and popular literacy, on the use of the vernacular for religious instruction or Bible translation, on the complex metaphorical associations contained within the idea of the vernacular, and on the cultural and political role of the "courtly" writing associated with Chaucer and his successors. Besides the excerpts, the book contains five essays that propose new definitions of medieval literary theory, discuss the politics of Middle English writing, the relation of medieval book production to notions of authorship, and the status of the prologue as a genre, and compare the role of the medieval vernacular to that of postcolonial literatures. The book includes a substantial glossary that constitutes the first mapping of the language and terms of Middle English literary theory. _The Idea of the Vernacular_ will be an invaluable asset not only to Middle English survey courses but to courses in English literary and cultural history and courses on the history of literary theory. Zhuangzi: The Essential Writings, with Selections from Traditional Commentaries is an excellent new translation of the Zhuangzi. Brook Ziporyn has produced an abridged and annotated edition of the classic for Hackett's growing series of translations on early Chinese intellectual history. The closest competitors to this new edition are the translations by Watson (1968), Graham (1981), and Mair (1994). Ziporyn's work succeeds in part because he manages to do both less and more than the others. With judicious abridgement (sixteen (...) full chapters, including all seven "Inner" chapters, plus selections from six more—about two-thirds of the entire work) and valuable added commentary, this book is a great choice for the .. This paper outlines an argument for atheism from naturalism that I have developed in more detail elsewhere (in particular, in *The Best Argument against God*). The overall shape of the argument is as follows: first, naturalism is simpler than theism; second, there is no data that naturalism does not explain at least as well as theism; and, third, naturalism entails atheism; so we have good reason to prefer atheism to theism. We cannot apply the principles of morla law and obligation without intimate knowledge of the subject - the human being, who has to act morally. This text argues that an anthropology is required to provide accurate information of human nature in its relationship to moral science if the universal principals are to be located in their total human context.

We project the future accumulation of profiles belonging to deceased Facebook users. Our analysis suggests that a minimum of 1.4 billion users will pass away before 2100 if Facebook ceases to attract new users as of 2018. If the network continues expanding at current rates, however, this number will exceed 4.9 billion. In both cases, a majority of the profiles will belong to non-Western users. In discussing our findings, we draw on the emerging scholarship on digital preservation and stress the (...) challenges arising from curating the profiles of the deceased. We argue that an exclusively commercial approach to data preservation poses important ethical and political risks that demand urgent consideration. We call for a scalable, sustainable, and dignified curation model that incorporates the interests of multiple stakeholders. (shrink)

Analogies are offered to guide our explanatory responses to the fine-tuning of the universe. Situations that prompt us to reject an explanation involving a single chance event are presented as analogous to the fine-tuning. Thus, by analogy, we are prompted to reject an explanation of the fine-tuning involving a single universe fine-tuned by chance. But if the alleged analogues are not analogous they misguide us. I argue that the alleged analogues are not analogous and hence they do misguide our explanatory (...) responses to the fine-tuning. I use William Dembski’s work on eliminating chance explanations for “specified” events of small probability to illustrate the misguiding nature of the analogies. (shrink)

My English paper was translated into German by Gabriele Schlegel. -/- The aim of this paper is to examine the prospects for proofs or successful arguments for the existence or non-existence of God.

This paper is a study of the role of happiness in Kant’s theory. I begin by noting two recurrent characterizations of happiness by Kant, and discuss their relationship. Then I take up the general issue of the relation of happiness to moral virtue. I show that, for Kant, the antagonists are not morality and happiness, but the moral point of view and “self-conceit”, the inveterate tendency to elevate the concern for contentment or satisfaction of inclination to the status of a (...) supreme principle. Indeed, I try to show that there are deep positive connections between happiness and moral virtue because of the distinctive content of the moral life and of the indeterminacy of happiness. The capacity to unite one’s ends into a “system” in accordance with reason requires the moral point of view. Not only is morality not imprudent, but by itself prudence alone gives no definite principle of organization.The second issue I investigate is Kant’s theory of the non-moral or cond itional good. Since the Highest (complete) Good for Kant consists of perfect virtue and happiness, it follows that all non-moral goods have value only because they are components or conditions of happiness. This is a strong and dubious position. Given Kant’s account(s) of happiness, it entails that nothing that fails to affect contentment or the satisfaction of inclination has non-moral value. This denies the possibility of non-moral ideas of excel ence that could compete with both morality and happiness for human allegiance. Consequently, although Kant is often thought to give too little importance to happiness in human life, arguably he accords it too much value. (shrink)

There is presently a debate between Subjectivists and Objectivists about moral wrongness. Subjectivism is the view that the moral status of our actions, whether they are morally wrong or not, is grounded in our subjective circumstances – either our beliefs about, or our evidence concerning, the world around us. Objectivism, on the other hand, is the view that the moral status of our actions is grounded in our objective circumstances – all those facts other than those which comprise our subjective (...) circumstances. A third view, Ecumenism, has it that the moral status of our actions is grounded both in our subjective and our objective circumstances. After outlining and evaluating the various arguments both against Subjectivism and against Objectivism, this Element offers a tentative defense of Objectivism about moral wrongness. (shrink)
