In Australia, since 2004, there has been a move to expand the range of models for legal practice. Lawyers may now incorporate a legal practice, which may have non-legal directors and shareholders. They may also enter into a partnership with a range of non-legal professional partners. This change is happening at the same time that legal practice culture is moving from a professional service model to a business-oriented model. Increased pressures have been thrown into the mix by the global financial (...) crisis and the downturn in the legal market. Inevitably, these changes have created new conflict problems. When a lawyer is responsible to both clients and shareholders, how can that conflict be resolved? What are the roles of non-legal directors or partners? What if they have ethical or legal duties which conflict with a lawyer?s duty to a client? When a corporate legal business is listed on the stock exchange, what pressure may that bring to bear on the business model of the legal practice? How can all of these issues be resolved in grim financial times? The author will examine all of these issues in light of Australian and international experiences with new lawyering patterns and the global financial crisis. (shrink)

This article illustrates ways in which the concepts of the norm and normativity are implicated in relations of power. Specifically, I argue that these concepts have come to function in a normalizing manner. I outline Michel Foucault’s thinking on the norm and normalization and then provide an overview of Jürgen Habermas’s thinking on the norm and normativity in order to show that Habermas’s conceptualizations of the norm and normativity are not, as he posits, necessary foundations for ethics and politics, but (...) in fact simply one philosophical approach among many. Uncritically accepting a Habermasian framework therefore produces normalizing effects and inhibits alternative and potentially emancipatory thinking about ethics and politics. Having problematized the requirement of normative foundations as it is currently articulated, I conclude by examining the emancipatory potential of a particular aspect of Foucault’s work for the practice of philosophy. In a 1983 interview, Michel Foucault contrasts our contemporary interest in sexual identity with the ancient Greek preoccupation with diet, arguing that sex has replaced food as the privileged medium of self-constitution in the modern West. In the same interview, Foucault argues that modern liberation movements should return to the ancient model of ethics, of which diet was a prime example, as aesthetics or self-transformative practice. In this paper I take up Foucault's argument with respect to the Animal Liberation Movement (...) and the dietetics of ethical vegetarianism. Contra Foucault, I suggest that diet has not been replaced by sexuality in the modern West, and that food choices, along with and intertwined with sexuality, continue to function as practices of self-constitution in both disciplinary and aesthetic fashions. I then consider the implications of this argument for the Animal Liberation Movement, exploring ways in which it might (and to some degree already does) take on aesthetic rather than moral strategies in order to pursue what Foucault once described as “an ethics of acts and their pleasures which would be able to take into account the pleasure of the other.”. Knowledge Representation and Reasoning (KR&R) is based on the idea that propositional content can be rigorously represented in formal languages long the province of logic, in such a way that these representations can be productively reasoned over by humans and machines; and that this reasoning can be used to produce knowledge-based systems (KBSs). As such, KR&R is a discipline conventionally regarded to range across parts of artificial intelligence (AI), computer science, and especially logic. This standard view of KR&R’s participating fields (...) is correct — but dangerously incomplete. The view is incomplete because, as we explain herein, sophisticated KR&R must rely heavily upon philosophy. Encapsulated, the reason is actually quite straightforward: Sophisticated KR&R must include the representation of not only simple properties, but also concepts that are routine in the formal sciences (theoretical computer science, mathematics, logic, game theory, etc.), and everyday socio-cognitive concepts like mendacity, deception, betrayal, and evil. Because in KR&R the representation of such concepts must be rigorous in order to enable machine reasoning (e.g., machine-generated and machine-checked proofs that a is lying to b) over them, philosophy, devoted as it is in no small part to supplying analyses of such concepts, is a crucial partner in the overall enterprise. To put the point another way: When the knowledge to be represented is such as to require lengthy formulas in expressive formal languages for that representation, philosophy must be involved in the game. In addition, insofar as the advance of KR&R must allow formalisms and processes for representing and reasoning over visual propositional content, philosophy will be a key contributor into the future. Our research seeks to answer the question of how a conventional commodity supply chain can be transformed into a disintermediated commodity supply chain in the context of the fair trade (FT) movement. We present a normative framework for conceptualizing the disintermediation process, exploring the variables bearing on this process using the case of FT coffee to illustrate our insights. We highlight the motivational sources driving FT, suggesting that it is increasingly to the advantage of multinational enterprises to leverage their market (...) power to circumvent intermediaries in the supply chain and, in so doing, shift a greater share of income and wealth to producing communities. A research agenda centered on building an FT supply‐chain disintermediation index is proposed. (shrink)

A familiar theme in Greek philosophy, largely due to the influence of Plato's Cratylus, linguistic naturalism constitutes a major but under-studied area of Roman linguistic thought. Indeed, it holds significance not only for the history of linguistics but also for philosophy, stylistics, rhetoric and more. Analyses of height variation using the 1970 UK national cohort study (12,508 children at age 10 and 5470 at age 16) found clear evidence that children of higher socioeconomic status (as measured by social class, crowding, tenure, type of accommodation, income and receipt of government financial assistance) were on average taller than children of lower socioeconomic status but there was little or no difference in average stature between children living in urban or rural areas. Significant differences in height remained for (...) most of the variables after removing the effects of father’s social class suggesting that reliance on social class perse to explain height variation is inadvisable. Based on three years' ethnographic research with animal sanctuary workers, this paper argues that a level of moral certainty drives and justifies many of the workers' actions and beliefs. Similar to the "missionary zeal" of nonhuman animal rights activists, this moral certainty divides the world into two neat categories: good for the animals and bad for the animals. This overriding certainty takes precedence over other concerns and pervades all aspects of sanctuary life, resulting in the breakdown of different facets of (...) that life into good and bad homes, good and bad animals, and good and bad workers. The paper, therefore, argues that animal welfare workers may be as "radical" as animal rights activists in one respect—their adherence to the overriding principle of being "in it for the animals.". International Indigenous rights coalitions increasingly involve Indigenous and non-Indigenous civil society organizations with diverse backgrounds and interests. As these organizations more frequently interact and partner with one another, what issues are being emphasized in their advocacy efforts? This study utilizes content analysis of 60 Indigenous rights organizations’ websites, as well as interviews of several leaders and staff, to explore whether African Indigenous organizations emphasize different aspects of Indigenous rights in their messaging and advocacy than their other Indigenous and non-Indigenous coalition (...) partners, We find that African Indigenous CSOs discuss issues of unequal treatment more frequently, and issues of self-determination and assimilation less frequently, than their coalition partners. The messaging of Indigenous organizations outside of Africa contained similar themes as that of non-Indigenous CSOs. This raises questions regarding why these messages differ: do African Indigenous groups have distinct concerns and/or are there other reasons for the variance in messaging across international Indigenous rights coalitions. Written by international authors from a variety of backgrounds, this set looks at psychoanalysis in a number of different areas including, culture, religion, sociology, postmodernism, literary criticism and others.

In the midst of his account of the events, Thucydides says that it was difficult to switch Athens from democracy to the oligarchic rule of the Four Hundred (8.68.4). Most modem scholars have agreed, viewing the rise of the Four Hundred primarily as a coup effected by violence, terror and deceit. This interpretation does not conform to Thucydides' narrative (8.47-70), however, which shows that it was not very hard to end the Athenian democracy. Although terror, violence and propaganda have their (...) place in Thucydides' account, modem treatments overemphasize them and so ignore or gloss over Thucydides' charge that the Athenian people did not resist oligarchy very strenuously and so bear a large share of responsibility for it. In Thucydides' narrative Peisander et al. are open about plans for oligarchy (if not for the extremely limited oligarchy that they eventually put in place at Kolonos) both on Samos and in Athens, and meet little resistance from democratic supporters. In addition, Thucydides' rhetoric repeatedly mutes what resistance there is, as if to underscore its weakness. Thucydides' Athenians for the most part quickly and easily abandon their democracy. There was a 'terror' campaign, but its scope, effect and need has been exaggerated. In particular, there is no reason to think that the location of the Kolonos meeting - where the Athenians voted the limited oligarchy of the Four Hundred into power-terrified them into doing so. Thucydides' comment on the difficulty of the task of the Four Hundred is ironic. There is a jarring contrast between Thucydides' judgement and his narrative which, when recognized, compels readers to re-examine their own assumptions and expectations. The attention modem commentators have given to Thucydides' words about intimidation and propaganda have left them deaf to the other interesting story Thucydides has to tell about the role the Athenian demos played in the move to oligarchy.
