In this paper we show how a realistic normative democratic theory can work within the constraints set by the most pessimistic empirical results about voting behaviour and elite capture of the policy process. After setting out the empirical evidence and discussing some extant responses by political theorists, we argue that the evidence produces a two-pronged challenge for democracy: an epistemic challenge concerning the quality and focus of decision-making and an oligarchic challenge concerning power concentration. To address the challenges we then (...) put forward three main normative claims, each of which is compatible with the evidence. We start with a critique of the epistocratic position commonly thought to be supported by the evidence. We then introduce a qualified critique of referenda and other forms of plebiscite, and an outline of a tribune-based system of popular control over oligarchic influence on the policy process. Our discussion points towards a renewal of democracy in a plebeian but not plebiscitarian direction: Attention to the relative power of social classes matters more than formal dispersal of power through voting. We close with some methodological reflections about the compatibility between our normative claims and the realist program in political philosophy. (shrink)

Lewis Gordon presents the first detailed existential phenomenological investigation of antiblack racism as a form of Sartrean bad faith. Bad faith, the attitude in which human beings attempt to evade freedom and responsibility, is treated as a constant possibility of human existence. Antiblack racism, the attitude and practice that involve the construction of black people as fundamentally inferior and subhuman, is examined as an effort to evade the responsibilities of a human and humane world. Gordon argues that the (...) concept of bad faith militates against any human science that is built upon a theory of human nature and as such offers an analysis of antiblack racism that stands as a challenge to our ordinary assumptions of what it means to be human. Arguments about the supersession of historic injustice often use the dispossession of Indigenous lands as an example of the sort of injustice in the past that can be superseded in certain circumstances. This article aims not to directly challenge the content of such arguments but to place them into a different context, wherein they are seen playing a role in ongoing efforts to remove Indigenous understandings of law, justice, and morals from discussions about state-Indigenous histories and interactions. The normative narrowness (...) of these arguments is explored alongside developments within Canadian law that purport to respond to the historic denial of substantive Indigenous interests in lands by colonial and Canadian authorities. While the analysis predominantly takes a bird’s-eye view of the interaction of varied normative systems, the conclusion advances a normatively charged argument, as I speculate about why courts – and academics writing about the passage of time – seem intent on developing arguments that displace Indigenous understandings. The aim of this paper is to apply the metaphysics of John Duns Scotus in constructing a new conception of matter which does not stand in opposition to the mental realm, but is rather composed of both physical and mental elements. The paper is divided into four parts. Section one addresses Scotus’ claim that matter is intelligible and actual in itself. Section two aims to show that matter can be seen as a deprived thinking being. Section three analyzes Scotus’ conception (...) of place. The paper will explore a key tension between eternity and temporality that comes to the fore in the seeming contradiction between freedom of the human will and divine foreknowledge of future contingents. It will be claimed that Duns Scotus’s adaptation of Thomas Aquinas’s view reduces the tension between a human being’s freedom and divine foreknowledge of future contingents to the question of how to conflate the now of eternity and our experience of the instantaneous now. Scotus’s account of the matter (...) is unfortunately not satisfying and it is the purpose of this paper to develop this insight further in a speculative manner. In order to make such co-nowness possible, it will be asked how the eternal and the temporal can co-cause together. This problem will be tackled through a development of Scotus’s doctrine of the will taken elsewhere, in order to examine how the divine and the human wills can occur together. It will be claimed that such co-willing produces a co-nowness of the eternal and the instantaneous ‘nows’ which generates a logical temporal movement. (shrink)

This book applies philosophical hermeneutics to biblical studies. Whereas traditional studies of the Bible limit their analysis to the exploration of the texts' original historical sense, this book discusses how to move beyond these issues to a consideration of biblical texts' existential significance for the present. In response to the rejection of biblical significance in the late nineteenth century and the accompanying crisis of nihilism, B. H. McLean argues that the philosophical thought of Heidegger, Bultmann, Gadamer, Habermas, Ricoeur, Levinas, (...) Deleuze and Guattari provides an alternative to historically oriented approaches to biblical interpretation. He uses basic principles drawn from these philosophers' writings to create a framework for a new 'post-historical' mode of hermeneutic inquiry that transcends the subject-based epistemological structure of historical positivism. In Ockham's Razors: A User's Guide, Elliott Sober argues that parsimony considerations are epistemically relevant on the grounds that certain methods of model selection, such as the Akaike Information Criterion, exhibit good asymptotic behaviour and take the number of adjustable parameters in a model into account. I raise some worries about this form of argument.

In general, Confucians have taken a dim view of the law. They have felt warranted in this view by a reading of Confucius’ Analects 2.3 in which the Master apparently disparages law-centered governance. Two great Confucian philosophers, however, Zhu Xi and Jeong Yakyong (widely known by his pen name, Dasan), view the role of law in society differently. Like all Confucians, they teach the cultivation of virtue, but alongside building social harmony through ritual and good character, these two philosophers perceive (...) that social order also requires the penal law. In this paper, I argue that Zhu Xi and Dasan, and Dasan in particular, follow the evidentiary lead of the classical Chinese philosopher Mozi to support their legal philosophy. Mozi offered three standards for establishing truth claims: empirical evidence from common life, authoritative evidence, and evidence of outcomes. Mozi’s empirical standard takes evidence of common life from what ordinary people have seen. Zhu Xi and Dasan take the evidence of common life, not from what the people have seen, but from common understandings contained in the written language. They use this approach to arrive at a different understanding of Analects 2.3 than other Confucians, one that relates the content of that passage to Analects 12.17. They interpret the passage on a philological basis that supports the presence of penal law from a perspective of ordinary life. For authoritative evidence, Zhu Xi and Dasan like Mozi appeal to the authority of the ancient sages, who register their support for penal law. Dasan also follows Mozi’s evidentiary lead in the evidence of outcomes by fully developing a consequential picture of how the absence of law detrimentally affects society. On this point, Dasan establishes a new and revolutionary legal outlook that differs from that of Zhu Xi. I show Dasan taking lessons from the classical Legalists to arrive at this position warranted by the evidence of outcomes. Having satisfied the three evidentiary standards, Dasan thus establishes the importance of the penal law from a Confucian perspective. (shrink)

Many are (...) those who smile and say that what they call "the architectural surrounds" that they have designed and built for what they call "organisms that person" are intriguing enough, but this idea of slipping death's grip… Really. They say. Hmmm. And they clear their throats. But is it really that unusual to think that what inspires philosophical thinking is death? And insofar as death has inspired philosophy, hasn't it inspired escape—and if not escape from death itself then at least escape from its terrors? Plato's Phaedo is an early instance of this, and Wittgenstein's Tractatus is a more recent one, no less explicit in its discussion of death. Gins and Arakawa are therefore part of a long and traditional line of philosophers who's thinking never quite loses sight of death. But why are philosophers concerned with death?The reason is simple. By and large, philosophers don't like it here. They would rather be somewhere else. And what don't they like about it here? Often, almost invariably, it is becoming that bothers them. Becoming. And they don't like becoming both for existential and metaphysical reasons. Existentially, "becoming" means change. Today's friends may betray you tomorrow, or the next day. And even if they don't, they will die. And be gone. You too. Soon enough. Dead. Existentially, change and becoming ruin everything we care about—people and projects. Metaphysically, "becoming" is a threat to the dream of understanding, the dream of forming a precise [End Page 40] picture of the world. I learned this from the opening pages of Deleuze's Logic of Sense. On top of the cake, beautifully marked in currants, are the words "EAT ME," and Alice did. She ate the cake and grew taller. And what, you may wonder, is the problem with that? It happens at children's parties every day, even after eating normal cake.Common sense assumes that at any moment Alice will be a certain height, and that as the moments pass her height will increase. But this is just as if we had taken an egg-slicer to her becoming taller, turning becoming into a succession of unchanging slices of being. This egg-sliced reality is good enough for ordinary work, and it is good enough, by means of the calculus, for science and for physics. But it is not good enough for metaphysics. If at a given moment Alice is really becoming taller, then at that moment, while she is becoming, she must paradoxically be both a definite height h, and also not h. If there is becoming, then the world cannot be completely conceptually represented. And if everything is becoming, then nothing can be conceptually represented. That is the metaphysical difficulty with becoming, and so philosophers run from becoming. They run both from death and from what is beyond representation.They tend to go in either of two directions. Up or down. Either up to eternity if you are drawn to the transcendent, or down to the rough ground, the earth, if you are drawn to the ordinary. Written by economists and philosophers, these essays attempt to place neoclassical economic theory, especially conventional textbook micro-economic theory, in the broader context of other social sciences and modern economics. In doing so, the book aims to find the boundaries of economics and to define more sharply its relationship to other (...) kinds of inquiry. Though the widespread use of textbook microtheory in business, economic, and political analysis is a clear testament to its power, the restrictions and artificialities of neoclassical assumptions give cause for worry even to many economists.
