ABSTRACT For Victoria Kahn, Hobbes' argument that fear of violent death is “the passion to be reckoned upon” in explaining what inclines men to peace must be interpreted as a mimetic argument. However, Kahn then notes a paradox that makes Hobbes' thinking problematic: whereas love and the desires are appetites that produce an imitative effect, fear is different. Though also a passion, fear lacks that capacity to produce a mimetic effect or, therefore, to generate a contract. My hypothesis is that (...) resolving the dilemma presented in Kahn's interpretation of Hobbes requires a shift in attention from mimesis to rhetoric and, more specifically, to biological rhetoric as defined by Nancy Struever. This approach to Hobbes makes it possible to understand the rhetorical role of fear in generating and maintaining the social contract, and how the problem that Kahn signals—the impotence of fear in relation to mimesis—can be resolved. This contribution to a symposium on Samantha Frost’s Lessons from a Materialist Thinker considers her innovative reinterpretation of Thomas Hobbes’s philosophy, situating him as a precursor of New Materialism. Frost’s reading emphasizes Hobbes’s conception of human beings as ‘thinking bodies’ inextricably intertwined with their environment. This materialist conception leads to a relational, peace-oriented ethic rooted in our interdependence. Frost’s interpretation is contrasted with those of Arash Abizadeh and Stephen Darwall. Abizadeh identifies two normative dimensions in Hobbes’s ethics: the prudential and (...) the juridical. This perspective highlights the role of contractual obligations, which is less prominent in Frost’s interpretation. Darwall’s projectivist interpretation suggests that Hobbes saw ethical judgments as projections of our desires onto the world, which potentially challenges Frost’s materialist reading. While acknowledging the tensions between these interpretations, it is argued that Frost’s reinterpretation offers valuable insights for addressing contemporary ethical and political challenges. In this article, we rebuild the reading of Benjamin’s Critique proposed by Menke and consider the appropriateness of violence in the law not as a tragic tension, but as a condition for its reproduction. Nors abu šie filosofai buvo retorikos kritikai, tarp jų požiūrių išryškėja esminių skirtumų. Hobbes’as, būdamas monarchijos šalininkas, paveiktas Lukrecijaus, kritikavo retoriką iš materialistinės, antropologijos perspektyvos. Paradoksalu, tačiau jis pasitelkė retorines strategijas savo naujajame scientia civilis. Kantas, nors ir kritikuodamas tiek Lukrecijaus materializmą, tiek ir retoriką, į savo filosofijos perspektyvą integravo kai kuriuos suderinamus retorinius elementus, visų pirma susijusius su epikūrizmo tradicija. Philosophy & Social Criticism, Volume 48, Issue 6, Page 882-903, July 2022. Indigenous conservation through patrimonialization is the product of political and legal decisions made by a non-indigenous agent: the liberal state, using the law to retain a form of bios. We propose that patrimonialization is the device by which liberal states have processed and integrated indigenous claims into a form of bios ultimately designed to safeguard state legal structures. We argue that, to uphold the rule of law in contexts (...) of struggle and resistance that challenge the very understanding of the law, states respond by wielding the law in the form of the rule by law, that is, pushing the law to the limit to give normative content to the criteria by which the state conducts its affairs, without straying from the individual rights framework. We hold that the rule by law is an operation that defines the patrimonialization of indigenous peoples. It increases their visibility while imposing limits on political action to keep them from becoming sui juris subjects capable of breaching the distinction between zoe and bios. In this article, we try to understand the political–ideological intent of these decisions, the intentions beyond the letter of the law of patrimonialized peoples. (shrink)

Este artículo discute los aportes de Quentin Skinner al análisis de las imágenes en la retórica política del Renacimiento y explora una elucidación teórica sobre su funcionamiento argumentativo aplicando la teoría de los actos de las imágenes de Horst Bredekamp. Después de revisar las dimensiones de la retórica de Skinner, el trabajo se enfoca en el examen del lugar que ocupan las imágenes en los argumentos retóricos. Para esto discute algunas imágenes icónicas del Renacimiento italiano e inglés como el Fresco (...) de Siena de Lorenzetti y el frontispicio del “Leviatán” de Hobbes. El trabajo establece que, a lo menos, tres figuras retóricas renacentistas que elaboraban imágenes con fines persuasivos servían de manera eficaz para construir abstracciones políticas, ficciones y para modificar significados de conceptos políticos. En términos visuales, el funcionamiento de estas tres figuras discursivas encuentra una explicación en la teoría de los de las imágenes que Bredekamp. El artículo concluye que, si bien la vinculación de los conceptos retóricos y visuales de ambos autores puede ser ejemplificada con el análisis de una sección del frontispicio del “Leviatán”, la viabilidad de utilizar este ensamblaje como modelo teórico para el examen de otras imágenes renacentistas depende, entre otras consideraciones, de la posibilidad de asociarlas a textos, contextos y a la comprensión de la recepción de los argumentos en una discusión específica. En este artículo doy cuenta de una práctica epistémica injusta —la apropiación epistémica—, que daña a agentes de conocimiento marginalizados en el transcurso de la diseminación conceptual y la asimilación intercomunal. El daño de la apropiación epistémica es doble. En primer lugar, mientras que los recursos epistémicos desarrollados en los márgenes son asimilados por audiencias dominantes, son explícitamente desprendidos de los agentes de conocimiento marginalizados responsables de su producción. En segundo lugar, los recursos epistémicos desarrollados en los márgenes, desprendidos de (...) ellos, se utilizan en discursos dominantes, en formas que benefician desproporcionadamente a los poderosos. This article rereads Benedict de Spinoza and recent interpretations of him as an epistemic democrat through the prism of contemporary debate on the conditions for deliberation in a democracy. Through a reconstruction of Spinoza's arguments and theories of deliberation and its preconditions, we argue that, for deliberation to produce the benefits Spinoza recognizes, the process must be inclusive, and those deliberating must be both intellectually humble and autonomous. This interpretation is new and diverges from those recently advanced by Justin Steinberg (...) and Sandra Leonie Field. In particular, on our reading, Spinoza's critique of humility does not extend to intellectual humility as it is understood today in political theory. Both autonomy and humility, as epistemologically conceived by political theorists today, can therefore be considered Spinozian civic virtues. (shrink)

El objetivo de la formación doctoral es la generación y difusión de nuevo conocimiento, sin embargo, no es claro cómo los programas de doctorado en Colombia se relacionan con este tipo de producción académica. A partir de ello, en el presente estudio se presenta el panorama general de la producción académica a través de las instituciones de educación superior colombianas que ofertan programas de formación doctoral en psicología. La producción académica se obtuvo de la base de datos Scopus en una (...) muestra de 13 universidades. Tras una búsqueda inicial, se encontraron 1345 documentos, con los cuales se realizó un análisis de los indicadores de productividad y de las redes de colaboración al interior de la disciplina en el país. Posteriormente, esta información se contrastó con la información nacional registrada en el sistema de Currículum Vitae Latinoamericano y del Caribe de 193 profesores asociados a las universidades que ofertan los programas de doctorado. Al comparar la producción académica nacional e internacional, se encontró una mayor correlación entre la dirección de tesis de posgrado y la publicación en revistas nacionales. Por lo tanto, se puede afirmar que el impacto de la formación doctoral en la generación de nuevo conocimiento es relativo y tiene un alcance limitado, siendo principalmente las revistas nacionales el medio de difusión de este conocimiento. Se recomienda evaluar el impacto de los productos asociados a la formación posgradual y la visibilidad internacional, con énfasis en las revistas indexadas en bases de datos internacionales. Among the various contemporary schools of moral thinking, consequence-based ethics, as opposed to rule-based, seems to have a good acceptance among professionals such as software engineers. But naïve consequentialism is intellectually too weak to serve as a practical guide in the profession. Besides, the complexity of software systems makes it very hard to know in advance the consequences that will derive from professional activities in the production of software. Therefore, following the spirit of well-known codes of ethics such as the (...) ACM/IEEE’s, we advocate for a more solid position in the ethical education of software engineers, which we call ‘moderate deontologism’, that takes into account both rules and consequences to assess the goodness of actions, and at the same time pays an adequate consideration to the absolute values of human dignity. In order to educate responsible professionals, however, this position should be complemented with a pedagogical approach to virtue ethics. (shrink)

En el contexto del sistema presidencial chileno, el artículo analiza el rol del Congreso en la elaboración de la política exterior, desde la perspectiva del enfoque transaccional desarrollado por Pablo Spiller y Mariano Tommasi (2000). De este modo, se plantea que el trabajo del Congreso en general, y de las comisiones de Relaciones Exteriores del Senado y de la Cámara de Diputados en particular, se caracteriza por la permanencia y continuidad de los miembros y, en consecuencia, por un trabajo especializado (...) y de alta calidad profesional, lo que favorece la cooperación entre los actores y los intercambios intertemporales entre éstos. Hrushovski proved that the theory of difference-differential fields of characteristic zero has a model-companion, which we shall denote DCFA. Previously, the author proved that this theory is supersimple. In supersimple theories there is a notion of rank defined in analogy with Lascar U-rank for superstable theories. It is also possible to define a notion of dimension for types in DCFA based on transcendence degree of realization of the types. In this paper we compute the rank of a model of DCFA, (...) give some properties regarding rank and dimension, and give an example of a definable set with finite rank but infinite dimension. Finally we prove that for the case of definable subgroup of the additive group being finite-dimensional and having finite rank are equivalent. (shrink)

El presente trabajo trata sobre responsabilidad extracontractual y toma como objeto de análisis un caso real que no quiere ser revisado por el Gobierno boliviano, desde la perspectiva de la responsabilidad, puesto que él mismo adquirió carga por culpa sobre un accidente aéreo de una nave y que, con el evento fatídico provocado, involucró a tres países: Bolivia, Colombia y Brasil; este último como principal afectado puesto que los pasajeros que fallecieron en el accidente eran de dicha nacionalidad. A partir de uma variedade de histórias sobre a vida íntima de mulheres famosas, o jornalismo de entretenimento e de fofocas compõe avaliações e julgamentos sobre emoções e comportamentos que alimentam atribuições culturais sobre a maternidade. Este artigo identifica duas matrizes culturais implicadas na narrativa jornalística do showbiz e dos chimentos - melodrama e escândalo - e analisa sua articulação na produção biográfica sobre mães celebridades que prolifera em revistas, programas de televisão e plataformas dedicadas a notícias sobre celebridades. Enquadrado (...) na tradição crítica do discurso, o artigo investiga a encenação de melodramas e escândalos na construção jornalística de seis histórias ligadas à maternidade de celebridades argentinas famosas. A partir da análise de diferentes fontes que encadearam essas histórias, observamos uma retórica moral expressa pela alternância complementar entre histórias de infortúnio e transgressões maternas. This book considers the seminal debate in jurisprudence between Ronald Dworkin and Stanley Fish. It looks at the exchange between Dworkin and Fish, initiated in the 1980s, and analyses the role the exchange has played in the development of contemporary theories of interpretation, legal reasoning, and the nature of law. The book encompasses 4 key themes of the debate between these authors: legal theory and its critical role, interpretation and critical constraints, pragmatism and interpretive communities, and some general implications of (...) the debate for issues like the nature of legal theory and the possibility of objectivity. The collection brings together prominent legal theorists and one of the protagonists of the debate: Professor Stanley Fish, who concludes the collection with an interview in which he discusses the main topics discussed in the collection. Traditionally, “the operator calculus of Born and Wiener” has been considered one of the four formulations of quantum mechanics that existed in 1926. The present paper reviews the operator calculus as applied by Max Born and Norbert Wiener during the last months of 1925 and the early months of 1926 and its connections with the rise of the new quantum theory. Despite the relevance of this operator calculus, Born–Wiener’s joint contribution to the topic is generally bypassed in historical accounts of (...) quantum mechanics. In this study, we analyse the paper that epitomises the contribution, and we explain the main reasons for the apparent lack of interest in Born and Wiener’s work. We argue that they did not solve the main problem for which the tool was intended, that of linear motion, because of their reluctance to use Dirac delta functions. (shrink)

This paper presents an interpretation of the ontology developed by Deleuze in Différence et répétition under a topological perspective. It maintains that the Deleuzian thesis concerning Being as univocal and differential is supported by a theory of expression which holds a conception of space that goes beyond the Euclidian viewpoint. I will approach this spatial dynamism from a series of mathematical notions that assist the production of Deleuze’s main ontological concepts, defining the expression and its moments by the interaction between (...) different types of multiplicities, made of heterogeneous folds. En los procesos de identificación social muchas veces la valoración del pasado resulta fundamental. La existencia objetiva de esa valoración ha propiciado que distintos actores sociales, en diferentes momentos históricos, hayan hecho uso del pasado en la estructuración de las ideologías que sustentan los procesos de identificación y, en consecuencia, sus propios proyectos políticos. Es decir, los mitos políticos están compuestos manifiestamente de dos componentes básicos. Por un lado, consisten en la así llamada política simbólica y por el otro lado, (...) son parte de la memoria colectiva. Es por esto que los mitos se enfrentan con las bases mismas del proyecto de modernidad, quizás la razón por la cual sea la politología la disciplina de las ciencias sociales que menos los ha estudiado. La utopía andina, el mahdi o el doceavo imán, el emperador alemán oculto y dormido y el bolivarianismo, constituyen algunos estos mitos políticos. (shrink)

Ronald Dworkin’s philosophy of law, in its mature version, is grounded in at least two central claims: first, a thesis about law and morality, which we might call the One-System Thesis; second, a thesis about how moral and legal propositions can be said to be true or false, which we might call the Interpretive Thesis. While the One-System Thesis holds that law and morality form a single system, the Interpretive Thesis makes two distinct claims: first, truth of interpretive propositions—such as (...) moral and legal propositions—must be established from within the practice in which they figure; second, the soundness of an interpretive proposition is related to the purpose of the practice under consideration. Mark Greenberg’s Moral Impact Theory of Law accepts the One-System Thesis while rejecting the Interpretive Thesis. The Moral Impact Theory is a metaphysical theory of how moral facts rationally determine the content of the law. Its main contention is that the actions of legal institutions have an impact on the moral obligations people have in a polity, and the content of the law is made up of the moral obligations that result from the actions of such institutions. Greenberg assumes that moral facts pre-exist and have some metaphysical priority in relation to legal facts. Moral facts must be prior and independent from legal practice in order to play a part in the rational determination of the content of the law. The point of this paper is to offer a response to Greenberg. I argue that the One-System Thesis only should be supported if the Interpretive Thesis is correct, and that without the latter the former becomes an implausible version of natural law jurisprudence. ¿Puede la tesis del reemplazo de Raz sobrevivir en el contexto de una teoría dworkiniana del derecho y de la adjudicación? Judging Positivism, de Margaret Martin, fornece una de las mejores reconstrucciones y una de las más interesantes críticas ya planteadas contra la influyente filosofía del derecho de Joseph Raz. En uno de los pasos centrales de su argumento, Martin desafía una sumisión central de Raz, que es el intento de combinar la tesis del reemplazo con la tesis de la (...) justificación normal. Mientras la primera exige que ciudadanos y oficiales excluyan de la deliberación cualesquiera razones de primer orden para la acción, la ultima invita consideraciones sobre legitimidad que no se puede examinar con independencia de las razones de primer orden que la tesis del remplazo pretende excluir. En este comentario crítico, yo acepto la crítica de Martin según la cual esas dos tesis no pueden ser aceptadas como argumentos conceptuales. Sin embargo, sugiero que aún existe un espacio para armonizarlas si se las acepta por razones normativas. Si hay un buen argumento para tratar razones jurídicas como un nivel intermedio de razones para la acción, entonces puede haber buenos argumentos circunstanciales para tratar razones institucionales como remplazantes en el sentido que Raz defiende en su teoría del derecho. En un intento por explicar la influencia y repercusiones impuestas por el culto a la prudencia en la historia, se mostrará la manera en que fueron introducidos lineamientos y puntos de vista metodológicos, por parte de dos historiadores y cortesanos del rey Felipe III; a saber, Antonio de Herrera y Tordesillas y Luis Cabrera de Córdova. Así, se describirá (...) finalmente la base retórica, pragmática y epistemológica de esta concepción de la historia, y desde luego, su supuesta utilidad como herramienta intelectual en la toma de decisiones, tanto del militar como del hombre de Estado. This article aims to put face to face the positions of Deleuze and Lacan in relation to the theories regarding the idea of the Oedipus complex inherited from Freudian psychoanalysis. This confrontation will become manifest by reviewing the concepts of desire, repression and castration, from the point of view of the subject’s relationship with language. In order to achieve this purpose, we will go through the topological proposals whereby both Deleuze and Lacan render account of that which is housed outside (...) the signifying logic, the paradigmatic axis of which is precisely the Oedipal Logic, thus forging a cutting-edge work in which the materiality of language, its sonority and texture will acquire relevance to rethink the status of the unconscious itself. Se examina la noción de espectro, propuesta en Espectros de Marx, para evidenciar la problematización que Jacques Derrida hace a la oposición, que se supone tajante, entre las nociones de vida y muerte. Se evidencia que Derrida no traza tal problematización exclusivamente a partir de Espectros de Marx, sino también desde diversos textos que dan cuenta de un constante asedio que ronda su pensamiento: la sobrevida. A su vez, se analiza la discusión que Derrida sostuvo con el espectro de Marx (...) para evidenciar: (1) de qué modo la herencia fiel-infiel de Marx contribuye al pensamiento de la sobrevida; (2) cómo en tal pensamiento de la sobrevida se inscribe necesariamente el problema de la justicia y la alteridad. In this article, we aim at presenting a thorough and comprehensive explanation of the mathematical and theoretical relation between all the aspects of Ptolemaic planetary models and their counterparts which are built according to Kepler’s first two laws. Our article also analyzes the predictive differences which arise from comparing Ptolemaic and these ideal Keplerian models, making clear distinctions between those differences which must be attributed to the structural variations between the models, and those which are due to the specific parameters (...) Ptolemy determined in the Almagest. We expect that our work will be a contribution for a better understanding not only of the Ptolemaic theories for planetary longitudes through a clearer perception of the way in which Keplerian features are present—or absent—in Ptolemy’s models, but also for a more balanced judgement of different aspects of the contribution of the first two laws of Kepler to the modern astronomical revolution. IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. The publication of scientific papers has become increasingly problematic in the last decades. Even if we agree that a renewed model is needed for peer-reviewed scientific publication, we think the problem does not essentially lie in professional publishing—with economic incentives—but in the publish-or-perish culture that dominates the lives of researchers and academics.
