The Supreme Court of Idaho held, in Idaho Association of Chiropractic Physicians, Inc. v. Alcorn, No. 23787,1999 WL 134677, at *1, that insurance regulations of health care services must apply equally to all providers. The Idaho legislature enacted the Small Employer Health Insurance Availability Act, Idaho Code § 41-4701, and the Individual Health Insurance Availability Act, id. § 41-5201, which is to be implemented by the Idaho Small Employer and Individual Health Reinsurance Program. The goal of the legislation is to (...) make health insurance available and affordable to small employers and their employees, and to individuals who would not otherwise have health insurance. Accordingly, the Program promulgated the following rule: “Chiropractic services will be subject to one thousand dollars per year limit.” Idaho Ass’n of Chiropractic Physicians, 1999 WL 134677, at *1.The plaintiff, the Idaho Association of Chiropractic Physicians, sought declaratory judgment and injunctive relief against defendant, James M. That the pattern into which Lentricchia seeks to assimilate Stevens is politically charged becomes clearest when we turn to the following oddly incomprehensible statement: “In the literary culture that Stevens would create, the ‘phallic’ would not have been the curse word of some recent feminist criticism but the name of a limited, because male, respect for literature” . At the point where he makes this assertion, Lentricchia has been persuasively demonstrating that Stevens was “encouraged … to fantasize the potential social (...) authority of the literary as phallic authority” . But suddenly the critic’s measured discourse is disrupted by obviously personal feelings about the “curse word of some recent feminist criticism” and by a dazzlingly illogical definition of “respect for literature.” Such a disruption suggests that, in making his apparently objective argument about Stevens, Lentricchia has some other not so hidden agenda—and, of course, his peculiar decision to link his discussion of Stevens with an attack on The Madwoman in the Attic further supports this conclusion. What most strikingly reinforces the point, however, is the hysterical—or perhaps, with some recent feminist linguists, we should say “testerical”—rhetoric in which he couches his assault on our work.14 14. In _Reliable Reasoning_, Gilbert Harman and Sanjeev Kulkarni -- a philosopher and an engineer -- argue that philosophy and cognitive science can benefit from statistical learning theory, the theory that lies behind recent advances in machine learning. The philosophical problem of induction, for example, is in part about the reliability of inductive reasoning, where the reliability of a method is measured by its statistically expected percentage of errors -- a central topic in SLT. After discussing philosophical attempts to evade (...) the problem of induction, Harman and Kulkarni provide an admirably clear account of the basic framework of SLT and its implications for inductive reasoning. They explain the Vapnik-Chervonenkis dimension of a set of hypotheses and distinguish two kinds of inductive reasoning. The authors discuss various topics in machine learning, including nearest-neighbor methods, neural networks, and support vector machines. Finally, they describe transductive reasoning and suggest possible new models of human reasoning suggested by developments in SLT. (shrink)

According to Val Plumwood (1995), liberal-democracy is an authoritarian political system that protects privilege but fails to protect nature. A major obstacle, she says, is radical inequality, which has become increasingly far-reaching under liberal-democracy; an indicator of ‘the capacity of its privileged groups to distribute social goods upwards and to create rigidities which hinder the democratic correctiveness of social institutions’ (p. 134). This cautionary tale has repercussions for education, especially civics and citizenship education. To address this, we explore the potential (...) of what Gerard Delanty calls ‘cultural citizenship’ as an alternative to the disciplinary citizenship that permeates Western liberal discourse. Cultural citizenship emphasises citizenship as communication and continual learning processes, rejecting the idea of citizenship as a fixed set of cultural ideals, norms or values defined and enforced by liberal society’s legal, political and cultural institutions, including education and ‘citizenship training’. However, we contend that a critical first step, essential to democratic correctiveness, is to clear away obstacles created by the privileging of a dominant epistemic position. We conclude that Plumwood’s philosophy alongside John Dewey’s work on democracy and education provide a theoretical framework for effective democratic inquiry aimed towards interconnective, deliberative practice and corrective methodology for epistemic accountability. In The Vitality of Contradiction, Bruce Gilbert provides an exposition of Hegel's political philosophy to establish not only that societies fail because of their contradictions, but also how the unsurpassable oppositions of social life cultivate freedom. He moves beyond Hegel's works to consider the limits of liberal-capitalism and the contemporary social movements around the world that stretch us beyond the global economic system. Drawing on key Hegel texts such as Phenomenology of Spirit and the Philosophy of Right, Gilbert (...) shows how societies outgrow themselves as they come to recognize key aspects of freedom and justice. He argues that the dialectic requires that we recognize how liberal-capitalism has both cultivated freedom and yet fails to lead us to more sophisticated forms of freedom. Gilbert also highlights organizations including Brazil's Movement of Landless Workers and the Mondragon cooperative in Spain and the sophisticated ways in which they are teaching the world new and better ways to be free. Engaging and perceptive, The Vitality of Contradiction illuminates the basic principles behind Hegel's political thought and indicates the ways in which his work encourages people to strive for a form of socialist democracy. We report the results of an optical analogue of the fullerene molecule diffraction experiment. Our results, and an analysis of the fullerene experiment, suggest that the patterns observed in the latter can be explained using a localized particle model. There is no evidence that the grating period contributed to the published fullerene diffraction pattern. De Broglie waves, if they exist, are unlikely to have played a significant part in the fullerene diffraction experiment. The observed patterns are not consistent with those (...) expected according to wave theory for the experimental geometry corresponding to the slit-detector system and the de Broglie wavelength. The measurements were performed in the near field, making the demonstration of wave properties difficult. We outline a new classical approach to the electron and neutron interference experiments. The magnetic moment is crucial to this model, which emphasizes a mechanism for generating narrow-band continuum X-radiation. Some experiments are proposed which can decide between the suggested model and quantum mechanics, and which can also rule out an alternative stochastic model. (shrink)

The legitimacy of multi-stakeholder initiatives (MSIs) as institutions for social and environmental governance in the global economy has received much scholarly attention over the past years. To date, however, research has yet to focus on assessing the legitimacy of MSIs in their interactions with other actors within larger systems of deliberation. Drawing on the deliberative systems perspective developed within deliberative democracy theory, we theorise a normative framework to evaluate the roles of MSIs within the broader systems of governance they co-construct (...) through their interactions with other initiatives, governments, non-governmental organisations, and other external actors. As we demonstrate in our evaluation of the illustrative case of the Bangladesh Accord on Fire and Building Safety as a MSI in the context of the Bangladeshi garment industry, this framework can help researchers assess whether a MSI ultimately serves to enhance or undermine the deliberative legitimacy of the overall system of which it forms a part. This chapter directs attention to calls to integrate compassion training in curricula throughout the education system. Following a review of current Higher Education aims and objectives, and the potential psychological impacts that these can have on staff and students, we outline a case for compassion based initiatives in education. We discuss the nature and functions of compassion, as well as how compassion can heighten prosocial competencies. We then consider how compassion based approaches can be - and have been - implemented (...) in education settings, including HE, to promote the health and well-being of staff and students, as well as academic performance. We argue that elements of compassion should underpin the training of lecturers, as well as students, if UK institutes of learning truly embrace the various core values they advertise. (shrink)

Crowdsourcing platforms are powerful tools for academic researchers. Proponents claim that crowdsourcing helps researchers quickly and affordably recruit enough human subjects with diverse backgrounds to generate significant statistical power, while critics raise concerns about unreliable data quality, labor exploitation, and unequal power dynamics between researchers and workers. We examine these concerns along three dimensions: methods, fairness, and politics. We find that researchers offer vastly different compensation rates for crowdsourced tasks, and address potential concerns about data validity by using platform-specific tools (...) and user verification methods. Additionally, workers depend upon crowdsourcing platforms for a significant portion of their income, are motivated more by fear of losing access to work than by specific compensation rates, and are frustrated by a lack of transparency and occasional unfair treatment from job requesters. Finally, we discuss critical computing scholars’ proposals to address crowdsourcing’s problems, challenges with implementing these resolutions, and potential avenues for future research. (shrink)

Investigating experimental and avant-garde works of art as literature, Gilbert probes what art can't see about the literary and what literature has overlooked in the arts.

Over a period of 19 months in 2006 and 2007, Mattel recalled approximately 14 million toys. The company was subjected to numerous lawsuits and regulatory actions and suffered severe damage to its reputation. Two issues were involved: excessive levels of lead in numerous toy surface paints and small detachable magnets in some toys, which could be swallowed. An examination of the facts shows that two different ethical situations were involved—one concerning product design and the other concerning manufacturing practices of Mattel's (...) Chinese contractors and subcontractors. The ethical obligations of the company and individuals within the company in the two situations were quite different, and illustrate problems faced by companies in managing their global supply chains. This study explores the reflective processes of Scottish artist, Norman Gilbert, as he created twenty-five drawings depicting his wife, Pat Gilbert, as she lay dying following an Alzheimer’s-related stroke. Norman, ninety-one, had drawn Pat regularly over their sixty-five-year marriage. One week after Pat died, Norman was interviewed by a family friend to chronicle his reflections on the drawings. The drawings along with the interview transcript are analyzed qualitatively as a case study. Norman’s Hospital Drawings of Pat transform what (...) was initially a private experience into a shared comprehension of end of life and bereavement. (shrink)
