The Supreme Court of Idaho held, in Idaho Association of Chiropractic Physicians, Inc. v. Alcorn, No. 23787,1999 WL 134677, at *1, that insurance regulations of health care services must apply equally to all providers. The Idaho legislature enacted the Small Employer Health Insurance Availability Act, Idaho Code § 41-4701, and the Individual Health Insurance Availability Act, id. § 41-5201, which is to be implemented by the Idaho Small Employer and Individual Health Reinsurance Program. The goal of the legislation is to (...) make health insurance available and affordable to small employers and their employees, and to individuals who would not otherwise have health insurance. Accordingly, the Program promulgated the following rule: “Chiropractic services will be subject to one thousand dollars per year limit.” Idaho Ass’n of Chiropractic Physicians, 1999 WL 134677, at *1.The plaintiff, the Idaho Association of Chiropractic Physicians, sought declaratory judgment and injunctive relief against defendant, James M. That the pattern into which Lentricchia seeks to assimilate Stevens is politically charged becomes clearest when we turn to the following oddly incomprehensible statement: “In the literary culture that Stevens would create, the ‘phallic’ would not have been the curse word of some recent feminist criticism but the name of a limited, because male, respect for literature” . At the point where he makes this assertion, Lentricchia has been persuasively demonstrating that Stevens was “encouraged … to fantasize the potential social (...) authority of the literary as phallic authority” . But suddenly the critic’s measured discourse is disrupted by obviously personal feelings about the “curse word of some recent feminist criticism” and by a dazzlingly illogical definition of “respect for literature.” Such a disruption suggests that, in making his apparently objective argument about Stevens, Lentricchia has some other not so hidden agenda—and, of course, his peculiar decision to link his discussion of Stevens with an attack on The Madwoman in the Attic further supports this conclusion. What most strikingly reinforces the point, however, is the hysterical—or perhaps, with some recent feminist linguists, we should say “testerical”—rhetoric in which he couches his assault on our work.14 14. In The Vitality of Contradiction, Bruce Gilbert provides an exposition of Hegel's political philosophy to establish not only that societies fail because of their contradictions, but also how the unsurpassable oppositions of social life cultivate freedom. He moves beyond Hegel's works to consider the limits of liberal-capitalism and the contemporary social movements around the world that stretch us beyond the global economic system. Drawing on key Hegel texts such as Phenomenology of Spirit and the Philosophy of Right, Gilbert (...) shows how societies outgrow themselves as they come to recognize key aspects of freedom and justice. He argues that the dialectic requires that we recognize how liberal-capitalism has both cultivated freedom and yet fails to lead us to more sophisticated forms of freedom. Gilbert also highlights organizations including Brazil's Movement of Landless Workers and the Mondragon cooperative in Spain and the sophisticated ways in which they are teaching the world new and better ways to be free. Engaging and perceptive, The Vitality of Contradiction illuminates the basic principles behind Hegel's political thought and indicates the ways in which his work encourages people to strive for a form of socialist democracy. It may therefore on this special occasion be of some interest if I cast some retrospective glances at philosophy's daily life in and after the middle 1920s. I shall not steal from the proper hands the task of sketching the history of the Royal Institute itself; but I have some now fairly rare qualifications for describing the philosophical world into which it was (...) born. Some believe that all arguments make an implicit “inference claim” that the conclusion is inferable from the premises (e.g., Bermejo-Luque, Grennan, the Groarkes, Hitchcock, Scriven). I try to show that this is confused. An act of arguing arises because an inference can be attributed to us, not a meta-level “inference claim” that would make the argument self-referential and regressive. I develop six (other) possible explanations of the popularity of the doctrine that similarly identify confusions.

There is evidence that people with schizophrenia have difficulties in some (recently evolved) competencies for processing social information. However, a case can be made that vulnerabilities can also lie in (previously evolved) threat and safeness processing systems. Evolutionary models may need to consider interactions between genetic sensitivities, early experiences of threat/safeness, and later cognitive vulnerabilities. Psychological treatments must address issues of experienced threat and safeness before working on more cognitive competencies.

It is a pleasure to all of us to hold forth upon subjects about which we know very little. It is particularly a temptation to university professors to get away from the subjects of their own chairs and lecture as dogmatically as their nature demands on subjects of other people's chairs. That is why I am speaking to-night about Psychology. As to Vice, the case is a little different. Even if my own experience is regrettably limited, I have for some (...) years studied the Chairman, and I bring my observations before a society full of persons whose range and profundity of knowledge will be sufficient to correct any hasty generalizations on my part. Analogies are often theoretically useful. Important principles of electricity are suggested by an analogy between water current flowing through a pipe and electrical current “flowing” through a wire. A basic theory of sound is suggested by an analogy between waves caused by a stone being dropped into a still lake and “sound waves” caused by a disturbance in air.

Sartre’s scattered commentaries and remarks on theater, published in a variety of media outlets, as well as in the most unlikely of essays, were finally assembled late in Sartre’s career and published in one volume, Un Théâtre de situations, put together by Michel Contat and Michel Rybalka in 1973. Inevitably, a number of later or missing theatrical documents then came to light, and an updated edition of Un Théâtre de situations appeared in 1992. There still remained, however, other documents on (...) theater which for one reason or another were not included in the later volume. Two of these documents are published interviews that Sartre gave to the Russian theater journal, Teatr, in 1956 and 1962. It is those virtually unknown interviews by Sartre on theater that we are pleased to publish here for the first time in English translation. (shrink)

This ambitious and sweeping book presents a powerful argument against moral relativism and in favor of the objectivity of a theory of democratic individuality. Unlike much recent work in this field, the book does not simply adumbrate such a view. Rather, it develops the parallels between various versions of scientific and moral realism, and then reinterprets the history and internal logic of democratic theory, maintaining, for example, that the abolition of slavery represents genuine moral progress. The book also recasts the (...) clashes between Marxist and Weberian, radical and liberal sociologies in the light of these moral claims, and sketches the institutions of a radical democracy. Developing students’ skills to pose and respond to questions and actively engage in inquiry behaviours enables students to problem solve and critically engage with learning and society. The aim of this study was to analyse the impact of providing teachers with an intervention in inquiry pedagogy alongside inquiry science curriculum in comparison to an intervention in non-inquiry pedagogy alongside inquiry science curriculum on student questioning and other inquiry behaviours. Teacher participants in the comparison condition received training in four inquiry-based science (...) units and in collaborative strategic reading. The experimental group, the community of inquiry (COI) condition, received training in facilitating a COI in addition to training in the same four inquiry-based science units. This study involved 227 students and 18 teachers in 9 primary schools across Brisbane, Australia. The teachers were randomly allocated by school to one of the two conditions. The study followed the students across years 6 and 7 and students’ discourse during small group activities was recorded, transcribed and coded for verbal inquiry behaviours. In the second year of the study, students in the COI condition demonstrated a significantly higher frequency of procedural and substantive higher-order thinking questions and other inquiry behaviours than those in the comparison condition. Implementing a COI within an inquiry science curriculum develops students’ questioning and science inquiry behaviours and allows teachers to foster inquiry skills predicated by the Australian Science Curriculum. Provision of inquiry science curriculum resources alone is not sufficient to promote the questioning and other verbal inquiry behaviours predicated by the Australian Science Curriculum. (shrink)

Im Laufe der letzten Jahre lässt sich allerdings beobachten, dass der einstmals verpönte Werkbegriff schrittweise wieder zu einer zentralen und produktiven Analysekategorie avanciert ist. Der vorliegende Band untersucht, welche Formen und Funktionen der Werkbegriff in den Geisteswissenschaften des 21. Jahrhunderts annehmen kann.

This essay explores the hypothesis that Plato plays a more significant role in the late philosophy of Nishida Kitarō than is typically acknowledged. As Nishida himself said, both he and Plato attempt to articulate a metaphysics of self-determination. This requires a first principle that cannot be an arbitrary positing of some determination, and thus must be indeterminate. In the case of Nishida this is the “place of nothingness”. Nishida claims that at least some of the inspiration for his notion of (...) nothingness comes from the chōra of Plato’s Timaeus. This paper argues, however, that the “One” of the Parmenides, the Good of the Republic and mind (nous) in the Phaedo and Philebus actually offer closer affinities to Nishida’s notion of self-determining nothingness than does the chōra. The paper also argues that interesting affinities can also be found between Plato’s turning around of the soul (periagoge) and Nishida’s “event” of religious experience, as well as between Platonic eros and Nishida’s notion of love.
