Ordinary moral thought often commits what social psychologists call 'the fundamental attribution error '. This is the error of ignoring situational factors and overconfidently assuming that distinctive behaviour or patterns of behaviour are due to an agent's distinctive character traits. In fact, there is no evidence that people have character traits in the relevant sense. Since attribution of character traits leads to much evil, we should try to educate ourselves and others to stop doing it.

Life in Groups: How We Think, Feel, and Act Together comprises thirteen essays by the author relating to human life in groups, together with a substantial introduction and concluding discussion. The essays continue the development and application of the author’s perspective on collective beliefs, emotions, and actions, arguing that these and other central social phenomena are grounded in a joint commitment of the parties. This commitment unifies them, guides their actions going forward, and determines their relations to one another in (...) important ways. In particular, it grounds in each of the parties a set of rights and obligations of a particular kind. The introduction serves both to introduce joint commitment to those unfamiliar with it and to advance discussion in light of questions that have been raised. Several of the essays respond to comments on particular aspects of the author’s work. I respond to some questions raised by Frances Kamm with respect to my book Rights and Demands (2018). The book focuses on demand-rights and asks how we accrue them. In other words, how does one accrue the standing to demand an action of someone or rebuke them for non-performance? My response to Kamm emphasizes how I understand “directed duties” in this context. Contrary to the standard practice of rights theorists, I do not start from the assumption that directed duties are (...) constituted by “plain” duties in the context of other factors (about which rights theorists disagree). Rather, I understand my duty to you as the correlative and equivalent of your standing to demand the action in question. I offer a number of further clarifications and conclude by distinguishing the targets of my discussion from other phenomena of interest to moral philosophers, such as complaining and blaming. The intersection of AI and neurotechnology has resulted in an increasing number of medical and non-medical applications and has sparked debate over the need for new human rights, or “neurorights,”...

The common view is that no novel IS an argument, though it might be reconstructed as one. This is curious, for we almost always feel the need to reconstruct arguments even when they are uncontroversially given as arguments, as in a philosophical text. We make the points as explicit, orderly, and (often) brief as possible, which is what we do in reconstructing a novel’s argument. The reverse is also true. Given a text that is uncontroversially an explicit, orderly, and brief (...) argument, in order to enhance plausibility, our first instinct is to flesh it out with illustrations and relationships to everyday life. If this process is fictive (e.g., with “thought experiments”) and orderly, it is story-telling. This paper investigates whether there is a principled way of determining a novel’s argument, which should contribute as much to understanding arguments as to understanding novels. (shrink)

Haeusermann et al. (Citation2023) draw three overall conclusions from their study on closed loop neuromodulation and self-perception in clinical treatment of refractory epilepsy. The first is that closed-loop neuromodulation devices did not substantially change epileptic patient’s personalities or self-perception postoperatively. The second is that some patients and caregivers attributed observed changes in personality and self-perception to the epilepsy itself and not to the DBS treatments. The third is that the devices provided participants with novel ways to make sense of their (...) illness. These findings further demonstrate a misalignment between some neuroethicists’ concerns about putative postoperative changes to personality, and the empirical evidence for such changes. Haeusermann et al. nonetheless concede that “neurotechnology directed at persisting rather than episodic clinical phenomena could have greater implications for personality or self-perception, either because they operate more continuously or are directed at clinical phenomena that are more stably integrated into patients’ self-concepts” (41). We acknowledge that the hypothesis that participants did not report changes because they were only episodically and not continually stimulated offers an interesting line for future investigation. Nonetheless, we would like to propose that potential postoperative personality changes might be correlated with the pathophysiology itself, rather than the stimulation effects of the technology. Generally, we advance the view that unintended effects solely induced by the technology cannot be excluded per se. Regardless, this comment aims to highlight that ethicists’ starting premise should be that patients suffering from diverse pathophysiology, or patients who are treated with stimulation in different brain regions and with differing parameters, would likely not react in the same way to treatment. Using a close reading of a single clause and its context in a section in A Pluralist Universe, we see the moral dangers James saw in traditional ontology, in particular its relation to war and peace. This analysis opens up James’s combining the personalist philosophy of his friend Borden Bowne (and others) with the pluralism he developed late in his career. This leads, further, to reflection of James’s performative philosophizing. Finding in James a theory of “pluralistic personalism” gives us a (...) fresh look at the far-reaching power of his basic concepts of moral philosophy. (shrink)

Challenges, possibilities, and opportunitie for re-founding the tradition of philosophical personalism today.

Surveying nearly seven decades of habitual and obsessive reading, I consider how my character and psychology used reading to shape philosophical questions that move me into forms in which I could pursue them by reading. This became both the method and the substance of my philosophical work. It preserved some core emotional issues but also gave me the way to integrate them into scholarship and into my life.

In their book EVALUATING CRITICAL THINKING Stephen Norris and Robert Ennis say: “Although it is tempting to think that certain [unstated] assumptions are logically necessary for an argument or position, they are not. So do not ask for them.” Numerous writers of introductory logic texts as well as various highly visible standardized tests (e.g., the LSAT and GRE) presume that the Norris/Ennis view is wrong; the presumption is that many arguments have (unstated) necessary assumptions and that readers and test takers (...) can reasonably be expected to identify such assumptions. This paper proposes and defends criteria for determining necessary assumptions of arguments. Both theoretical and empirical considerations are brought to bear. (shrink)

My essay, “Multi-modal argumentation” was published in the journal, _Philosophy of the Social Sciences,_ in 1994. This information appeared again in my book, _Coalescent argumentation_ in 1997. In the ensuing twenty years, there have been many changes in argumentation theory, and I would like to take this opportunity to examine my now middle-aged theory in light of the developments in our discipline. “Ethical criticism” is an approach to literary studies that holds that reading certain carefully selected novels can make us ethically better people, e.g., by stimulating our sympathetic imagination (Nussbaum). I try to show that this nonargumentative approach cheapens the persuasive force of novels and that its inherent bias and censorship undercuts what is perhaps the principal value and defense of the novel—that reading novels can be critical to one’s learning how to think.

Examining the author’s own experiences of narcotics addiction reveals certain aspects of the addicted mentality that have strong ethical valence. In general, this shows that addiction is not a state fundamentally characterized by lack. The rudiments of this position are found in some contemporary philosophy of addiction; also, it is contrasted with a common widely held mistaken view. Addiction should instead be understood in continuity with and as illuminating the nature of human personhood and subjectivity. Under a phenomenology specific to (...) the author’s experience, addiction appears as a mode of experience that has an unmanageable overflow of narratives created as discourses concerning people, events, thoughts, and feelings. Postmortem evidence of chronic traumatic encephalopathy (CTE) in the brains of American National Football League players who suffered concussions while playing have intensified concerns about the risks of concussion in sport.1 Concussions are frequently sustained by amateur and professional players of Australia’s three most popular football codes (Australian football, rugby league, and rugby union) and, to a lesser extent, other contact sports such as soccer. This raises major concerns about possible long-term neurological damage, cognitive impairment and mental health problems in (...) players of these sports. (shrink)

We report the results of an optical analogue of the fullerene molecule diffraction experiment. Our results, and an analysis of the fullerene experiment, suggest that the patterns observed in the latter can be explained using a localized particle model. There is no evidence that the grating period contributed to the published fullerene diffraction pattern. De Broglie waves, if they exist, are unlikely to have played a significant part in the fullerene diffraction experiment. The observed patterns are not consistent with those (...) expected according to wave theory for the experimental geometry corresponding to the slit-detector system and the de Broglie wavelength. The measurements were performed in the near field, making the demonstration of wave properties difficult. We outline a new classical approach to the electron and neutron interference experiments. The magnetic moment is crucial to this model, which emphasizes a mechanism for generating narrow-band continuum X-radiation. Some experiments are proposed which can decide between the suggested model and quantum mechanics, and which can also rule out an alternative stochastic model. (shrink)

Over a period of 19 months in 2006 and 2007, Mattel recalled approximately 14 million toys. The company was subjected to numerous lawsuits and regulatory actions and suffered severe damage to its reputation. Two issues were involved: excessive levels of lead in numerous toy surface paints and small detachable magnets in some toys, which could be swallowed. An examination of the facts shows that two different ethical situations were involved—one concerning product design and the other concerning manufacturing practices of Mattel's (...) Chinese contractors and subcontractors. The ethical obligations of the company and individuals within the company in the two situations were quite different, and illustrate problems faced by companies in managing their global supply chains. Background: Assisted dying remains an emotive topic globally with a number of countries initiating legislation to allow individuals access to assisted dying measures. Victoria will become the first Australian state in over 13 years to pass Assisted Dying Legislation, set to come into effect in 2019. Objectives: This article sought to evaluate the impact of Victorian Assisted Dying Legislation via narrative view and case study presentation. Research design: Narrative review and case study. Participants and research context: case study. Ethical considerations: (...) This legislation will provide eligible Victorian residents with the option to request access to assisted dying measures as a viable alternative to a potentially painful, protracted death. Findings: This legislation, while conservative and inclusive of many safeguards at present, will form the basis for further discussion and debate on assisted dying across Australia in time to come. Discussion: The passing of this legislation by the Victorian parliament was prolonged, emotive and divided not only the parliament but Australian society. Conclusion: Many advocates for this legislation proclaimed it was well overdue and will finally meet the needs of contemporary society. Protagonists claim that medical treatment should not provide a means of ending life, despite palliative care reportedly often failing to relieve the pain and suffering of individuals living with a terminal illness.
