Georges Bataille is one of the most influential thinkers to have seriously considered the work of Donatien Alphonse François, the Marquis de Sade. What is undeniable is that the two thinkers share a number of thematic and theoretical commonalities, in particular on the subject of human nature and sexuality. However, there are serious theoretical divergences between the two, a fact generally overlooked in the secondary literature. Rather than being a mere precursor to Bataille, as himself implies, I suggest that Sade (...) is a very different thinker, a fact that Bataille does not fully acknowledge. (shrink)

Theodor Adorno and Max Horkheimer, in Dialectic of Enlightenment [Dialektik der Aufklärung, first published in 1944], argue that Donatien-Alphonse-François, the Marquis de Sade (1740–1814), and Friedrich Nietzsche have brought the Enlightenment project of grounding morality in reason to an end. For Adorno and Horkheimer, Sade has revealed philosophy’s moral impotency, in particular “the impossibility of deriving from reason any fundamental argument against murder [...].”1 Marcel Hénaff, Susan Neiman, and Annie Le Brun have similarly suggested that Sade has demonstrated that morality (...) is no more philosophically justified than immorality.2 There is no doubt that there is much discussion of moral philosophy in Sade’s surviving works. But are these extraordinary claims of Sade’s sceptical powers justified? To answer this question, this paper sets out to identify the moral and meta- ethical claims made in Sade’s works, and to assess his arguments for those claims. (shrink)

When, in dealing with modern critics of Origen, he roundly castigates the scholarly ghettoism that goes on, one is in complete sympathy. Kerr for instance (...) gets scolded for not quoting De Lubac. Lutheran scholars and Catholic, Germans perhaps and French, will tend to approach Origen with preformed conclusions. They have too often written within an exceedingly limited scholarly tradition. Fair enough. People have not any excuse for ignoring one another's contributions. Evidences of this sort of thing, with conspicuous faults on both sides (Lutheran and Catholic, that is) are not far to seek, God knows. One is not so happy however when the faint suggestion is made, particularly in the appendix, that it is only to students with the proper dispositions that Origen will yield up his message. That one must believe with Origen, so to speak. It may be the enthusiasm of the moment, or the undue influence of Origen's own attitude to holy writ; but this could be a disastrous line of argument. It comes perilously near to the reasons Julian the Apostate gave for excluding Christians from the Hellenist schools. And it smacks too much of Hellenistic ideas about doctrine for the multitude and for the initiate. Incidentally Crouzel argues that Origen, contrary to the accepted beliefs about him, was singularly free of this sort of thing. Some of his supposedly esoteric doctrines are found in the most popular of his compositions, and vice versa. In all it is a book calculated to set students of Origen thinking, and searching. Minor, sometimes indirect, causes have kept the name of John Duns Scotus in the minds of many philosophers of the twentieth century. The dependence of Gerard Manly Hopkins' notion of inscape on Duns Scotus' doctrine on intuitive cognition and individuation is a case in point. Another and more direct instance is that of the concurrence of some modern theories on free will with the exposition of Scotus. Those whose interest in Duns Scotus has been piqued by some allusion invariably ask the question, where can one get something in English by the man? The answer still is, the man has had quite a few expositors but not many translators. The latest of such expositions is Duns Scotus: The Basic Principles of His Philosophy, B. Bonansea's translation of an Italian work by E. Bettoni. The only complete work of Duns Scotus in English translation is his small opus presenting a demonstration of the existence of God: The De Primo Principio of John Duns Scotus, (St. Bonaventure, N. Y.: 1949), translated by Evan Roche, O.F.M. Allan Wolter is presently engaged in producing a new translation with more extensive notes, since the original translation is out of print. A small selection from Scotus' Oxford Commentary is contained in Richard McKeon's Selections from Medieval Philosophers, Vol. II. The reason for the scarcity of translations has been the lack of a definitive edition of BOOK REVIEWS 93 Scotus's works. No one wanted to undertake an extensive translation from insufficiently edited texts, especially when a definitive text was thought to be imminent. A commission was appointed thirty-six years ago to do for John Duns Scotus what had been done so magnificently for his Franciscan predecessor, St. Bonaventure. The first definitive edition of the opera ornnia of a Scholastic in the period of Scholastic revival was published by Franciscan scholars at Quaracchi near Florence: the Opera Ornnia Sancti Bonaventurae (1882-1901) in nine volumes. The same scholars, under the leadership of E. Longpr~, O.F.M., turned their attention to the works of Scotus. The problems facing the commission were admittedly much greater. Artificial Intelligence in the form of different machine learning models is applied to Big Data as a way to turn data into valuable knowledge. The rhetoric is that ensuing predictions work well—with a high degree of autonomy and automation. We argue that we need to analyze the process of applying machine learning in depth and highlight at what point human knowledge production takes place in seemingly autonomous work. This article reintroduces classification theory as an important framework for understanding such seemingly (...) invisible knowledge production in the machine learning development and design processes. We suggest a framework for studying such classification closely tied to different steps in the work process and exemplify the framework on two experiments with machine learning applied to Facebook data from one of our labs. By doing so we demonstrate ways in which classification and potential discrimination take place in even seemingly unsupervised and autonomous models. Moving away from concepts of non-supervision and autonomy enable us to understand the underlying classificatory dispositifs in the work process and that this form of analysis constitutes a first step towards governance of artificial intelligence. The concept of vulnerability is widely used in research ethics to signal attention to participants who require special protections in research. However, this concept is vague and under‐theorized. There is also growing concern that the dominant categorical approach to vulnerability (as exemplified by research ethics regulations and guidelines delineating vulnerable groups) is ethically problematic because of its assumptions about groups of people and is, in fact, not very guiding. An agreed‐upon strategy is to move from categorical towards analytical approaches (focused (...) on analyzing types and sources of vulnerability) to vulnerability. Beyond this agreement, however, scholars have been advancing competing accounts of vulnerability without consensus about its appropriate operationalization in research ethics. Based on previous debates, we propose that a comprehensive account of vulnerability for research ethics must include four components: definition, normative justifications, application, and implications. Concluding that no existing accounts integrate these components in a functional (i.e., practically applicable) manner, we propose an integrative and functional account of vulnerability inspired by pragmatist theory and enriched by bioethics literature. Using an example of research on deep brain stimulation for treatment‐resistant depression, we illustrate how the integrative‐functional account can guide the analysis of vulnerability in research within a pragmatist, evidence‐based approach to research ethics. While ultimately there are concerns to be addressed in existing research ethics guidelines on vulnerability, the integrative‐functional account can serve as an analytic tool to help researchers, research ethics boards, and other relevant actors fill in the gaps in the current landscape of research ethics governance. This paper identifies several ways in which personality informs philosophical belief. In the present study, individuals holding doctorates in philosophy were given a personality inventory and asked to respond to nine philosophical questions, seven of which produced significant sample sizes. Personality predicted response to three of these seven questions, suggesting that philosophers' beliefs are determined in part by their personalities. This is taken as evidence that philosophy is intrinsically subjective, a claim which is herein developed more completely and defended against (...) several objections. (shrink)

BackgroundPromoting the social value of global health research undertaken in resource poor settings has become a key concern in global research ethics. The consideration for benefit sharing, which concerns the elucidation of what if anything, is owed to participants, their communities and host nations that take part in such research, and the obligations of researchers involved, is one of the main strategies used for promoting social value of research. In the last decade however, there has been intense debate within academic (...) bioethics literature seeking to define the benefits, the beneficiaries, and the scope of obligations for providing these benefits. Although this debate may be indicative of willingness at the international level to engage with the responsibilities of researchers involved in global health research, it remains unclear which forms of benefits or beneficiaries should be considered. International and local research ethics guidelines are reviewed here to delineate the guidance they provide.MethodsWe reviewed documents selected from the international compilation of research ethics guidelines by the Office for Human Research Protections under the US Department of Health and Human Services.ResultsAccess to interventions being researched, the provision of unavailable health care, capacity building for individuals and institutions, support to health care systems and access to medical and public health interventions proven effective, are the commonly recommended forms of benefits. The beneficiaries are volunteers, disease or illness affected communities and the population in general. Interestingly however, there is a divide between "global opinion" and the views of particular countries within resource poor settings as made explicit by differences in emphasis regarding the potential benefits and the beneficiaries.ConclusionAlthough in theory benefit sharing is widely accepted as one of the means for promoting the social value of international collaborative health research, there is less agreement amongst major guidelines on the specific responsibilities of researchers over what is ethical in promoting the social value of research. Lack of consensus might have practical implications for efforts aimed at enhancing the social value of global health research undertaken in resource poor settings. Further developments in global research ethics require more reflection, paying attention to the practical realities of implementing the ethical principles in real world context. (shrink)

This paper proposes a new interpretation of mutual information (MI). We examine three extant interpretations of MI by reduction in doubt, by reduction in uncertainty, and by divergence. We argue that the first two are inconsistent with the epistemic value of information (EVI) assumed in many applications of MI: the greater is the amount of information we acquire, the better is our epistemic position, other things being equal. The third interpretation is consistent with EVI, but it is faced with the (...) problem of measure sensitivity and fails to justify the use of MI in giving definitive answers to questions of information. We propose a fourth interpretation of MI by reduction in expected inaccuracy, where inaccuracy is measured by a strictly proper monotonic scoring rule. It is shown that the answers to questions of information given by MI are definitive whenever this interpretation is appropriate, and that it is appropriate in a wide range of applications with epistemic implications. Citizenship rights have become vital to our sense of personal identity and social membership in modern society. Roche argues that today we have to shift from the conventional postwar politics of social rights to a new politics of social obligations and personal responsibility.

Just how realistic about human nature and real possibilities must a theory of justice, or a moral theory, more generally, be? Lines have been drawn, with some holding that idealizing away from reality is indispensable and others maintaining that utopian thinking is not just useless but irrelevant. In Utopophobia David Estlund defends the value of utopian theory. At his most modest, Estlund claims that it is a legitimate approach, not ruled out of court by anti-idealists on entirely inadequate grounds—merely “by (...) assumption or definition” as he puts it. Yet he also argues against what we call real world theory, which takes account of human imperfection and feasible options. It invites complacency and undermines aspiration, he argues, and he accepts Rawls’ claim that it will of necessity be unsystematic, thanks to its realism. We accept that the utopian approach is neither useless nor irrelevant. Yet we press hard against the charges against real world theory, maintaining that, properly understood, it invites neither complacency nor aspiration and can perfectly well offer a systematic and principled account of normative concepts, including justice specifically. Moral theorists like Singer and Greene argue that we should discount intuitions about ‘up-close-and-personal’ moral dilemmas because they are more likely than intuitions about ‘impersonal’ dilemmas to be artifacts of evolution. But by that reasoning, it seems we should ignore the evolved, ‘up-close-and-personal’ intuition to save a drowning child in light of the too-new-to-be-evolved, ‘impersonal’ intuition that we need not donate to international famine relief. This conclusion seems mistaken and horrifying, yet it cannot be the case both that ‘up-close-and-personal’ intuitions (...) are more reliable than ‘impersonal’ intuitions, and vice versa. Thus, Singer’s evolutionary debunking argument proves too much, and should not be taken seriously. However, Singer’s debunking argument is typical of an entire class of arguments that seeks to debunk normative principles by reference to evolution. This entire class of argument, I argue, therefore also proves too much to be taken seriously. (shrink)

The British government recently announced its willingness to expand the number of state–funded faith schools. It was a decision that aroused considerable controversy, with much of the unease centring around the allegedly divisive nature of such schools. In this article I defend faith schools against the charge that they necessarily undermine social cohesion and show how they can, in fact, legitimately be seen as a force for unity. In addition, I challenge the critics’ key assumption that non–denominational schools are inherently (...) better positioned than their faith–based counterparts to promote a tolerant society. One of the consequences of the public outcry over the 1929 St Valentine’s Day massacre was the establishment of a Scientific Crime Detection Laboratory at Northwestern University. The photogenic ‘Lie Detector Man’, Leonarde Keeler, was the laboratory’s poster boy, and his instrument the jewel in the crown of forensic science. The press often depicted Keeler gazing at a female suspect attached to his ‘sweat box’, a galvanometer electrode in her hand, a sphygmomanometer cuff on her arm and a rubber pneumograph (...) tube strapped across her breasts. Keeler’s fascination with the deceptive charms of the female body was one he shared with his fellow lie detector pioneers, all of whom met their wives – and in William Marston’s case, his mistress too – through their engagement with the instrument. Marston employed his own ‘Love Meter’, as the press dubbed it, to prove that ‘brunettes react far more violently to amatory stimuli than blondes’. In this article, I draw on the psychoanalytic concepts of fantasy and pleasure to argue that the female body played a pivotal role in establishing the lie detector’s reputation as an infallible and benign mechanical technology of truth. In recent years the institutionalisation of ethics as a means of enhancing the ethical nature of business operations has received widespread empirical coverage. To date, however, few studies have been conducted in the Australian business context. This paper examines the institutionalisation of ethics by a sample of companies based in Perth, Western Australia. In particular, company representatives were asked if their company was institutionalising ethics, why this initiative was undertaken, how this was taking place and what specific issues were being (...) addressed in the institutionalisation process. The results suggest that perceptions of external parties were the primary motivation for ethics institutionalisation efforts although there was also considerable focus on trying to internalise ethical values. In terms of how ethics were being institutionalised the responding companies were more likely to have conducted ethics training programs than to have written Codes of Conduct and in general it appears that few companies were developing comprehensive formal ethics programs. The primary issue covered by these institutionalisation efforts was the observance of laws. (shrink)

An often overlooked tension in liberal theory turns on its commitment to procedural accounts of legitimacy on the one hand, and to the robust protection of the right of citizens to dissent on the other. To the extent that one evaluates legitimate decision-making on the basis of the procedures that bear on it, determining how extra-procedural expressions of dissent fit into the picture becomes a complex undertaking. This is especially true if one accepts that protecting extra-procedural expressions of dissent is (...) itself foundational to the overall legitimacy of the state. My aim in this paper is to explore some of the implications that follow from this tension. The paper proceeds in two parts. In the first part, I review the political grounds that support a protection on dissent. By drawing on its republican foundations, I argue that the functional role that the right to dissent serves in complex political communities is intimately connected to concerns over legitimacy. I claim that for the right to perform its function successfully, protections must be placed on both procedural and extra-procedural forms of dissent. The second part of the paper issues a direct challenge to procedural accounts of legitimacy. If a protection on citizen dissent is vital to legitimating government action, and if that protection necessarily extends to both procedural and extra-procedural forms of dissent, it follows that legitimacy cannot be captured by procedure alone—even procedures that secure the fair and equal participation by all affected parties. The Spanish philosopher Miguel de Unamuno and the American social scientist Ernest Becker see death as humanity’s fundamental anxiety. My essay explores the ethical ramifications attendant upon making that anxiety a well-spring of human activity. More specifically, I am interested in humanity’s effort to escape death via the secular milieu of social remembrance. Does such an effort produce a vista where the other exhibits an intrinsic value? Alternatively, does the other become a mere means in light of one’s project of (...) self-preservation? Pursuing such questions, this reflection will explore both positive and negative responses. It will take up the Columbine school shootings in reference to the latter and a notion of protest with regard to the former. The treatise will culminate with a discussion of Unamuno’s ethics of irreplaceability and its potential to engender a universal human respect while also endorsing one’s commitment to her concrete individuality. This article explores the patient consent process in modern community pharmacy practice and discusses the related ethical dilemmas in this environment. The myth of appropriately informed consent, and irrefutable evidence as to a pharmacist’s intentions when advising a patient, are core issues for discussion. The objective is to clarify where such dilemmas may exist in the consent process and to ultimately form a framework against which ethical guidelines might facilitate resolution of the dilemma faced by the pharmacist who is expected (...) to simultaneously maintain legal and duty of care responsibilities in the patient consent process. I argue that free will is a nominal construct developed and deployed post hoc in an effort to provide cohesive narratives in support of a priori moral-judgmental dispositions. In a reversal of traditional course, I defend the view that there are no circumstances under which attributions of moral responsibility for an act can, should, or do depend on prior ascriptions of free will. Conversely, I claim that free will belief depends entirely on the apperceived possibility of moral responsibility. Orthodoxy dictates (...) an agency-first thesis, according to which free will is necessarily antecedent to moral responsibility. However, I present a number of arguments against this view, and in favor of an agency-last stance, according to which the concept of free will is dependent upon that of moral responsibility. I provide further support for my case in the form of new empirical evidence regarding the stable mode of inference used to attribute free will across moral contexts. These experimental results can be interpreted to imply the deflation of one of the longest-standing veridical paradoxes in experimental philosophy. Furthermore, the sole conceptual scheme found to be capable of modeling the experimental results is also capable of illuminating several classic works in the analytic philosophy of moral agency. China, India, Brazil and other major Third World nations have long refused to sign the Nuclear Non‐proliferation Treaty. This position might at first sight appear to be without any question morally unjustified and even irrational. Yet their claim that the treaty is ‘discriminatory’ merits the serious attention which it has not received. Only if certain aspects of this claim are accepted by the nuclear weapons signatories does a moral and rational onus to sign become unquestionable.

How may we best understand the motivational structure that stands behind individuals' acts of voting? In “The Impartial Spectator Goes to Washington” we suggested that expressive concerns swamp narrowly consequential motivations, in contradistinction to normal market transactions in which the priority is reversed. A striking consequence of this fact is that individuals will be led to vote for outcomes that they would reject were they in a position to act decisively. In this regard we found the moral psychology Adam Smith (...) develops in The Theory of Moral Sentiments remarkably fecund in suggesting alternatives to what we call the standard theory of electoral behavior.
