The narrative of the digital phenotype as a transformative vector in healthcare is nearly identical to the concept of “data drivenness” in other fields such as law enforcement. We examine the role of a prescription drug monitoring program in California—a computerized law enforcement surveillance program enabled by a landmark Supreme Court case that upheld “broad police powers”—in the interprofessional conflict between physicians and law enforcement over the jurisdiction of drug use. We bring together interview passages, clinical artifacts, and academic and (...) gray literature to investigate the power relations between police, physicians, and patients to show that prescribing data appear to the physician as evidence of problematic patient behavior by the patients, and to law enforcement as evidence of physician misconduct. In turn, physicians have adopted a disciplinary approach to patients, using quasi-legalistic documents to litigate patient behavior. We conclude that police powers have been used to pave data infrastructure through a contested jurisdiction, and law enforcement have used that infrastructure to enroll physicians into the work of disciplining patients. Sometime in 1355 the Northumbrian knight Sir Thomas Gray, meditating an ambition to write a history of England during his imprisonment by the Scots in Edinburgh, dreamed a dream. In it a Sibyl appears, to tutor him in his historical project. She takes him to a ladder leaning against a high wall in an orchard. As he climbs each of four rungs, he sees, through an opening in the wall, Walter, archdeacon of Exeter; Bede; the author of the Polychronicon (...) ; and the vicar of Tynemouth, author of the Historia aurea. The Sibyl explains that these writers cover the respective stages of insular history. The fifth and last rung concerns the future and is not for Sir Thomas to climb—the Sibyl quotes two prophecies, one by Merlin, and observes that deciphering them should be left to the divines. When the Sibyl instructs Gray to call his work Scalacronica— referring thus not only to the scaling ladder he is standing on but to his family arms—she makes his task clear: his history is to traverse the periods represented by the four figures and others, in a compilatory work. Russellians, Relationists, and Fregeans disagree about the nature of propositional-attitude content. We articulate a framework to characterize and evaluate this disagreement. The framework involves two claims: i) that we should individuate attitude content in whatever way fits best with the explanations that characteristically appeal to it, and ii) that we can understand those explanations by analogy with other ‘higher-level’ explanations. Using the framework, we argue for an under-appreciated form of Russellianism. Along the way we demonstrate that being more explicit about (...) the framework in which debates about attitude content take place allows us to more precisely characterize the space of possible positions and the dialectic between them. A study of the political philosophy of the Russian born thinker explains how Isaiah Berlin came to reject ideological frameworks in favor of a pluralism that acknowledges the inevitable diversity of human values.

The concept of brain death as equivalent to cardiopulmonary death was initially conceived following developments in neuroscience, critical care, and transplant technology. It is now a routine part of medicine in Western countries, including the United States. In contrast, Eastern countries have been reluctant to incorporate brain death into legislation and medical practice. Several countries, most notably China, still lack laws recognizing brain death and national medical standards for making the diagnosis. The perception is that Asians are less likely to (...) approve of brain death or organ transplant from brain dead donors. Cultural and religious traditions have been referenced to explain this apparent difference. In the West, the status of the brain as home to the soul in Enlightenment philosophy, combined with pragmatism and utilitarianism, supports the concept of brain death. In the East, the integration of body with spirit and nature in Buddhist and folk beliefs, along with the Confucian social structure that builds upon interpersonal relationships, argues against brain death. However, it is unclear whether these reasoning strategies are explicitly used when families and medical providers are faced with acknowledging brain death. Their decisions are more likely to involve a prioritization of values and a rationalization of intuitive responses. Why and whether there might be differences between East and West in the acceptance of the brain death concept requires further empirical testing, which would help inform policy-making and facilitate communication between providers and patients from different cultural and ethnic backgrounds. Geoffrey Lloyd engages in a wide-ranging exploration of what we can learn from the study of ancient civilizations that is relevant to fundamental problems, both intellectual and moral, that we still face today. These include, in philosophy of science, the question of the incommensurability of paradigms, the debate between realism and relativism or constructivism, and between correspondence and coherence conceptions of truth. How far is it possible to arrive at an understanding of alien systems of belief? Is it possible (...) to talk meaningfully of 'science' and of its various constituent disciplines, 'astronomy' 'geography' 'anatomy' and so on, in the ancient world? Are logic and its laws universal? Is there one ontology - a single world - to which all attempts at understanding must be considered to be directed? When we encounter apparently very different views of reality, how far can that be put down to a difference in conceptions of what needs explaining, or of what counts as an explanation, or to different preferred modes of reasoning or styles of inquiry? Do the notions of truth and belief represent reliable cross-cultural universals? In another area, what can ancient history teach us about today's social and political problems? Are the discourses of human nature and of human rights universally applicable? What political institutions do we need to help secure equity and justice within nation states and between them? Lloyd sets out to answer all these questions, and to argue that the study of the science and culture of ancient Greece and China provided a precious resource in order to advance a wealth of modern debates. It is possible to learn multiple layers of non-linear features by backpropagating error derivatives through a feedforward neural network. This is a very effective learning procedure when there is a huge amount of labeled training data, but for many learning tasks very few labeled examples are available. In an effort to overcome the need for labeled data, several different generative models were developed that learned interesting features by modeling the higher order statistical structure of a set of input vectors. One (...) of these generative models, the restricted Boltzmann machine (RBM), has no connections between its hidden units and this makes perceptual inference and learning much simpler. More significantly, after a layer of hidden features has been learned, the activities of these features can be used as training data for another RBM. By applying this idea recursively, it is possible to learn a deep hierarchy of progressively more complicated features without requiring any labeled data. This deep hierarchy can then be treated as a feedforward neural network which can be discriminatively fine-tuned using backpropagation. Using a stack of RBMs to initialize the weights of a feedforward neural network allows backpropagation to work effectively in much deeper networks and it leads to much better generalization. A stack of RBMs can also be used to initialize a deep Boltzmann machine that has many hidden layers. Combining this initialization method with a new method for fine-tuning the weights finally leads to the first efficient way of training Boltzmann machines with many hidden layers and millions of weights. It is these possible worlds which give us our understanding; and in human affairs we decide them by practical rather than theoretical judgement. In his widely acclaimed account of the role of counterfactuals in explanation, Geoffrey Hawthorn deploys extended examples from history and modern times to defend his argument. Spinoza's doctrine of the eternity of the mind is often understood as the claim that the mind has a part that is eternal. I appeal to two principles that Spinoza takes to govern parthood and causation to raise a new problem for this reading. Spinoza takes the composition of one thing from many to require causal interaction among the many. Yet he also holds that eternal things cannot causally interact, without mediation, with things in duration. So the human mind, since (...) it is the idea of a body existing in duration, cannot have an eternal part. In order to solve this problem, I propose an aspectual reading of Spinoza's doctrine of the eternity of the mind: the mind itself is eternal, under one of its aspects. (shrink)

This article takes issue with procedural reductionism, which is the inclination to reduce all matters of judgement and responsibility to the following of some procedure or rule. Two scenarios provide content for a discussion of professional discretion in the context of accountability. The author shows that in professional life there will always be situations that stand beyond the rules of procedures and require the unique judgement of the professional at the time. While this judgement may be determined by the facts (...) available in a situation of uncertainty, it cannot be reduced to the facts (including facts about rules and procedures). This collection of Geoffrey Hill's criticism spans the length of his career as a pre-eminent poet-critic. Three previously published books of criticism are reprinted, sometimes with substantial revisions, and two new works added.

In his seminars on the death penalty, Derrida consistently describes Kant's arguments in favor of capital punishment as “rigorous” and explicitly relates that rigor to the mechanisms of execution and the subsequent rigor mortis of the corpse. ‘Rigor’ has also often been a contested term in descriptions of deconstruction: different commentators have either deplored or celebrated the presence or the absence of rigor in Derrida's work. Derrida himself uses the term a good deal throughout his career, usually in a positive (...) sense, although he also at least once, in passing, suggests the need to question the rigor of the concept of rigor itself. In this paper, I will outline the place of Kant in the Death Penalty Seminars and suggest that it is the very rigor attributed to Kant that makes him (rather than some other writers—whether supporters or opponents of the death penalty—whose arguments seem less rigorous to Derrida) an exemplary object for deconstructive attention, not for the first time in Derrida's work. Broadening the focus beyond the texts Derrida explicitly analyzes, I suggest that this kind of attention can also be fruitfully brought to bear on some more general arguments in Kant about right and justice. In conclusion, I suggest some implications of this situation for the still difficult issue of the more general relation between deconstruction and critique in the Kantian sense. (shrink)

At an important moment in his reading of Heidegger in Geschlecht III, Derrida wields a pair of semi-technical terms from his own earlier work, and uses them to identify a classical, indeed Aristotelian, vein in Heidegger’s reading of Trakl. This gesture is complex, both in that, in spite of appearances, the Mehrdeutigkeit Heidegger identifies in Trakl is not essentially to do with the term Geschlecht, and in that Derrida’s presentation of Aristotle’s views about polysemia is perhaps over-simplified, or at least (...) leaves open the possibility of a more generous reading. Derrida’s notion of dissemination is shown not to entail a mere exacerbation of polysemia, but a quasi-semantic re-marking of the “syntax” that allows for any semantic effects at all. It is suggested that the fact that this marking can be described by Derrida as “monotonous” might open onto a slightly different reading both of Aristotle’s understanding of pollachos legomenon and pros hen, and Heidegger’s understanding of the Einklang of Trakl’s poetry. This study focused on the influence of American and Chinese cultures on consequentialism orientation in decision-making within the broader context of psychologists’ academic roles and responsibilities. In addition, this study hypothesized that educational level would affect culturally influenced ethical decision making in both cultures. Based on the American Psychological Association Ethics Code, 20 ethical scenarios in 5 domains in psychology were created and used to examine the influence of culturally ethical beliefs on psychologists’ decision making among 181 participants. The results (...) indicated that significant cultural differences in consequentialism orientation differentiated Chinese and American participants and influenced their resolution of ethical issues. The Port-Royal Logic includes a brief discussion of modal propositions, containing several mnemonic devices for rules of equivalence governing the possibility, necessity, impossibility, and contingency of propositions. When the mnemonics are decoded, it can be seen that these rules treat possibility and contingency as formally equivalent modes. The aim of this paper is twofold: to show that this identification of possibility and contingency follows from the Logic’s formal treatment of those modes; and to show that such a treatment of these (...) modes conflicts with claims the authors make in other contexts. In particular, the equivalence of possibility and contingency conflicts with the Cartesian principle that whatever is clearly and distinctly conceivable is possible—a principle that Arnauld and Nicole explicitly endorse elsewhere in the Logic. Why, then, would the authors adopt such equivalence rules? The paper concludes with a discussion of the historical precedents for these rules: they were a standard feature of Scholastic logic textbooks in seventeenth century France. It is likely that Arnauld and Nicole simply reproduced the rules for this reason, without recognizing that they were a poor fit for a Cartesian logic textbook like the Port-Royal Logic. (shrink)

During the Standing Rock protests in North Dakota, USA/Turtle Island, a group of military veterans knelt in front of Oceti Sakowin Elders asking forgiveness for centuries of settler colonial military ventures in Oceti Sakowin Territory. Leonard Crow Dog forgave them and immediately demanded respect for Native Nations throughout the U.S. Lacking such respect, he said, Native people will cease paying taxes. Crow Dog’s post-forgiveness remarks speak to the political context of the military veterans’ request: They seek collective forgiveness amidst ongoing (...) occupation and harms committed by the collective they represent. In this chapter, I examine this case study and argue that ongoing harm undermines requests for forgiveness on behalf of collectives. I look to the work of Glen Coultard, Waziyatawin, and Leanne Simpson to consider what a responsible request for collective forgiveness would entail. (shrink)

This essay draws on the work of Jacques Derrida and Angela Y. Davis towards a philosophical resistance to the death penalty in the U.S. I find promise in Derrida’s claim that resistance to the death penalty ought to contest a political structure that founds itself on having the power to decide life and death, but I move beyond Derrida’s desire to consider the abolition of the death penalty without engaging with the particular histories and geographies of European colonialism. I offer (...) a critique of Derrida’s recently published work on the death penalty by engaging with the work of Davis and argue that discussions of state violence in nations that inherit European forms of sovereignty must take seriously the racist violence on which those sovereign powers rely. The paper attempts to account for the confusion over the validity of the concept of schizophrenia in terms of two closely related aspects of conceptual indeterminacy. Firstly, it is identified on the basis of a breakdown in intelligibility, but what constitutes such a breakdown is indeterminate. Secondly, the concept sits between the categories of natural disease or illness on the one hand, and character trait or moral failing or gift on the other. This entails an indeterminacy in attempting to define (...) the role that physiological explanation could have. Light may be thrown on the concept by exploring a distinction between a life story in which the schizophrenic condition emerges as the conclusion of the story and a causal process in which the condition is the end result or final consequence. The issue of the conventionality of geometry is considered in the light of the special theory of relativity. The consequences of Minkowski's insights into the ontology of special relativity are elaborated. Several logically distinct senses of "conventionalism" and "realism" are distinguished, and it is argued that the special theory vindicates some of these possible positions but not others. The significance of the usual distinction between relativity and conventionality is discussed. Finally, it is argued that even though the spatial metric within (...) an inertial reference frame is euclidean, it is impossible to define unique objects which can serve as the relativistic surrogates of the spatial points of classical geometry. Certified nursing assistants (CNAs) provide up to 80% of the direct care to older adults in long‐term care facilities.CNAs are perceived as being at the bottom of the hierarchy among healthcare professionals often negatively affecting their job satisfaction. However, manyCNAs persevere in providing quality care and even reporting high levels of job satisfaction. The aim of the present investigation was to identify primary themes that may helpCNAs make meaning of their chosen career; thus potentially partially explaining increases in job satisfaction (...) among this group. Focus groups were conducted withCNAs at three long‐term care facilities. Four themes emerged from the data:CNAwork is good or special;CNAas relationship builder;CNAas expert;CNAas team member. These themes reflect the perceptions that theseCNAs held in regard to themselves and their relationships to others in the work environment and, when present, can contribute to intrinsic job satisfaction. Our meaning‐making themes support the premise thatCNAs do not passively accept the evaluations of others but instead actively frame identities that validate their importance to residents and the institution. This paper argues that neither a general right to exclude migrants nor a general right to migrate freely exists. The extent of the right to exclude or the right to migrate freely must instead, in the majority of cases, be determined indirectly by examining whether a given immigration law or policy would result in the violation of migrants right to exclude migrants is constrained by what the author calls the indirect principle of freedom of migration. Under this principle, if an (...) immigration law or policy cannot be imposed without violating a migrant's basic rights, then the law or policy cannot be legitimately implemented. The argument for this principle is undertaken both conceptually and substantively. It is then defended against the objections that on the one hand, it may not have enough critical force, and on the other, it may be overly restrictive of states’ power to exclude migrants. (shrink)
