This paper proposes an interpretation of German idealism which seeks to grant key importance to its connection with romanticism without thereby undermining its philosophical rationality. I suggest that the fundamental motivation of German idealism is axiological, and that its augment of Kant's idealism is intelligible in (...) terms of its combined aim of consolidating the transcendental turn and legitimating the kind of relation to value articulated in German romanticism. /// [Paul Franks] German idealists regard Spinozism as both the realism that outflanks Kant's idealism and the source of the conception of systematicity with which to fortify idealism. But they offer little argument for this view. To fill the gap, I reconstruct arguments that could underlie Jacobi's and Pistorius's tentative but influential suggestions that Kant is or should be a Spinozist. Kant is indeed a monist about phenomena, but, unlike Spinoza, a pluralist about noumena. Nevertheless, it is arguable that the Third Antinomy can be solved by a more thoroughgoing Spinozistic monism. The resulting Spinozism outflanks Kant by acknowledging Jacobi's charge that philosophy annihilates immediacy and individuality, whereas Kant's commitment to things in themselves can seem a half-hearted attempt to avoid the charge. In this paper I discuss the proposal that the law of torts exists to do justice, more specifically corrective justice, between the parties to a tort case. My aims include clarifying the proposal and defending it against some objections (as well as saving it from some defences that it could do without). Gradually the paper turns to a discussion of the rationale for doing corrective justice. I defend what I call the ‘continuity thesis’ according to which at least part of (...) the rationale for doing corrective justice is to mitigate one’s wrongs, including one’s torts. I try to show how much of the law of torts this thesis helps to explain, but also what it leaves unexplained. In the process I show (what I will discuss in a later companion paper) that ‘corrective justice’ cannot be a complete answer to the question of what tort law is for. (shrink)

This volume, edited by a philosopher and an anthropologist, is a collection of essays on the philosophical implications of laboratory and field research. While neither the best nor the worst of the genre, it is a collection that offers a representative sample of traditional themes. As practicing scientists who view the implications of behavioural research from a somewhat different perspective we offer this critical review.

I argue that Diogenes and early Cynicism can be understood in an explicitly social and political context, where Cynic praxis, performative public action, can be seen to make visible oppositions inherent to the polity. In doing so, Diogenes’ praxis should be understood as a form of immanent critique, one that demonstrates, for example, that nature and custom are interrelated oppositions in the polis. Cynicism here is understood as a form of immanent critique because Diogenes challenges the social norms of the (...) polis without endorsing external universal standards or predetermined models, but from illuminating dynamics from within the polis and polity. The Introduction to this volume identifies and briefly summarizes certain issues which have been of central concern to philosophers in the transcendental tradition, including: the question of its relation to metaphysics; the relation of transcendentalism to transcendental idealism; the Kantian concept of a condition of possibility; the concepts of transcendental logic and of transcendental proof or argumentation; the concept of the transcendental turn and the issue of its justification; and the standpoint of transcendental reflection.

My understanding is that proximate explanations concern adaptive mechanism and that ultimate explanations concern adaptive rationale. Viewed in this light, the two kinds of explanation are quite distinct, but they interact in a complementary way to give a full understanding of biological adaptations. In contrast, Laland et al. (2013)—following a literal reading of Mayr (Science 134:1501–1506, 1961)—have characterized ultimate explanations as concerning any and all mechanisms that have operated over the course of an organism’s evolutionary history. This has unfortunate consequences, (...) such as allowing random drift to form the basis for ultimate explanations, and allowing proximate and ultimate explanations to bleed into each other until their distinction is meaningless. Here, I suggest Laland et al’s explanatory framework of “reciprocal causation” is not conducive to successful biological science, and that they have misunderstood key elements of the theory of Darwinian adaptation. This paper is stimulated by and indebted to a study by Charles Altieri of the ways in which affect is present and articulated in art and literature, which, he argues, hold significance for the philosophy of emotion. I focus on Altieri's thesis that affective states may have aesthetic qualities and value. I pursue this notion first with reference to Nietzsche's attempt to recruit affect as a means of countering Schopenhauer's pessimism. I then attempt to show the coherence of the notion (...) that passion may exhibit an aesthetic dimension, drawing on Richard Wollheim's account of certain ideas in psychoanalytic theory, for which I suggest precedents in the history of philosophy. How do laws resemble rules of games, moral rules, personal rules, rules found in religious teachings, school rules, and so on? Are laws rules at all? Are they all made by human beings? And if so how should we go about interpreting them? How are they organized into systems, and what does it mean for these systems to have 'constitutions'? Should everyone want to live under a system of law? Is there a special kind of 'legal justice'? Does it consist (...) simply in applying the law of the system? And how does it relate to the ideal of 'the rule of law'?These and other classic questions in the philosophy of law form the subject-matter of Law as a Leap of Faith. In this book John Gardner collects, revisits, and supplements fifteen years of celebrated writings on general questions about law and legal systems - writings in which he attempts, without loss of philosophical finesse or insight, to cut through some of the technicalities with which the subject has become encrusted in the late twentieth century. Taking his agenda broadly from H.L.A. Hart's The Concept of Law, Gardner shows how the key ideas in that work live on, and how they have been and can still be improved in modest ways to meet important criticisms - in some cases by concession, in some cases by circumvention, and in some cases by restatement. In the process Gardner engages with key ideas of other modern giants of the subject including Kelsen, Holmes, Raz, and Dworkin. The _Analects_ is a compendium of the sayings of Confucius (551-479 b.c.e.), transcribed and passed down by his disciples. How it came to be transformed by Zhu Xi (1130-1200) into one of the most philosophically significant texts in the Confucian tradition is the subject of this book. Scholarly attention in China had long been devoted to the _Analects._ By the time of Zhu Xi, a rich history of commentary had grown up around it. But Zhu, claiming that the _Analects_ was (...) one of the authoritative texts in the canon and should be read before all others, gave it a still more privileged status in the tradition. He spent decades preparing an extended interlinear commentary on it. Sustained by a newer, more elaborate language of metaphysics, Zhu's commentary on the _Analects_ marked a significant shift in the philosophical orientation of Confucianism--a shift that redefined the Confucian tradition for the next eight centuries, not only in China, but in Japan and Korea well. Gardner's translations and analysis of Zhu Xi's commentary on the _Analects_ show one of China's great thinkers in an interesting and complex act of philosophical negotiation. Through an interlinear, line-by-line "dialogue" with Confucius, Zhu effected a reconciliation of the teachings of the Master, commentary by later exegetes, and contemporary philosophical concerns of Song-dynasty scholars. By comparing Zhu's reading of the _Analects_ with the earlier standard reading by He Yan (190-249), Gardner illuminates what is dramatically new in Zhu Xi's interpretation of the _Analects._ A pioneering study of Zhu Xi's reading of the _Analects,_ this book demonstrates how commentary is both informed by a text and informs future readings, and highlights the importance of interlinear commentary as a genre in Chinese philosophy. Deep brain stimulation (DBS) is an effective treatment for the debilitating motor symptoms of Parkinson’s disease and other neurological disorders. However, clinicians and commentators have noted that DBS recipients have not necessarily experienced the improvements in quality of life that would be expected, due in large part to what have been described as the ‘psychosocial’ impacts of DBS. The premise of this paper is that, in order to realise the full potential of DBS and similar interventions, clinical services need to (...) be arranged in such a way that these psychosocial dimensions are recognised and managed. Our starting point is that the psychosocial effects of DBS ‘in the field’ present us with analytically-useful disruptions: they disturb and foreground deeply held assumptions relating to the individual, health and its treatment, and which in a crude form manifest as the myth of technological solutionism within health care. Drawing on scholarship in medical sociology and science and technology studies (STS), we argue that DBS brings to the fore the relational dimensions of personhood, and demonstrates the emotional and social turmoil that can result if the relational dimensions of personhood are ignored by clinical services. In light of this, we argue that DBS should be implemented within a regime of care. Drawing on ethnographic research of a paediatric DBS clinical service, we provide an example of a regime of care, and conclude by reflecting on what other DBS services might learn from this paediatric service. Jeff McMahan rejects the relevance of desert to the morality of self-defense. In Killing in War he restates his rejection and adds to his reasons. We argue that the reasons are not decisive and that the rejection calls for further attention, which we provide. Although we end up agreeing with McMahan that the limits of morally acceptable self-defense are not determined by anyone’s deserts, we try to show that deserts may have some subsidiary roles in the morality of self-defense. Action-relative accounts can be contrasted with effect-relative accounts, which hold that an action may harm an individual in virtue of its effects on that individual, regardless of whether the individual would have been better off in the absence of the (...) action. In this paper, I argue that our judgments about the strength of the reason against harming lend support to effect-relative accounts over action-relative accounts. I first criticize Fiona Woollard’s argument for the claim that an effect-relative account of harming could ground only a weak reason against harming. I then argue for a set of three principles that can be conjoined with an effect-relative account to explain the strength of the reason against harming. (shrink)

Sometimes emotions excuse. Fear and anger, for example, sometimes excuse under the headings of (respectively) duress and provocation. Although most legal systems draw the line at this point, the list of potentially excusatory emotions outside the law seems to be longer. One can readily imagine cases in which, for example, grief or despair could be cited as part of a case for relaxing or even eliminating our negative verdicts on those who performed admittedly unjustified wrongs. To be sure, the availability (...) of such excuses depends on what wrong one is trying to excuse. No excuse is available in respect of all wrongs. Some wrongs, indeed, are inexcusable. This throws up the interesting question of what makes a particular emotion apt to excuse a particular wrong. Why is fear, for example, more apt to excuse more serious wrongs than, say, pride or shame? This question leads naturally to another. Why are some emotions, such as lust, greed, and envy, apparently not apt to furnish any excuses at all? Can one not be overcome by them? Can they not drive one to wrongdoing as readily as fear and grief? Or is that not the point? (shrink)

In this commentary on Stokoe’s article, ‘Moving forward with membership categorization analysis’, I take up the challenge to apply her keys for MCA to an extract of conversation recorded in a restaurant. The strengths of conversation analysis have not included – and indeed have not attempted to achieve – successful engagement with beyond-the-immediate-talk aspects of culture and the commonsense workings of society. The aim of the article is to explore what MCA might add to an analysis of a stretch of (...) talk using conversation analytic tools. It was found that a systematic application of the keys did indeed provide a richer account of what was going on. Whereas categories alone did not appear to provide more insights than commonsense can tell us, when the broader array of MCA tools and keys were applied, an enhanced analysis of the passage of talk emerged. An exploration of whether this can be extended as a method for a rigorous investigation of culture and society while still being grounded in participants’ mutual, moment-by-moment orientations to categories seems at the very least worth the serious attention of scholars interested in interaction. Critics have standardly regarded Sartre’s Critique of Dialectical Reason as an abortive attempt to overcome the subjectivist individualism of his early philosophy, motivated by a recognition that Being and Nothingness lacks ethical and political significance, but derailed by Sartre’s Marxism. In this paper I offer an interpretation of the Critique which, if correct, shows it to offer a coherent and highly original account of social and political reality, which merits attention both in its own right and as a reconstruction of (...) the philosophical foundation of Marxism. The key to Sartre’s theory of collective and historical existence in the Critique is a thesis carried over from Being and Nothingness: intersubjectivity on Sartre’s account is inherently aporetic, and social ontology reproduces in magnified form its limited intelligibility, lack of transparency, and necessary frustration of the demands of freedom. Sartre’s further conjecture – which can be formulated a priori but requires a posteriori verification – is that man’s collective historical existence may be understood as the means by which the antinomy within human freedom, insoluble at the level of the individual, is finally overcome. The Critique provides therefore the ethical theory promised in Being and Nothingness. (shrink)
