The idea of free trade in Grotius's Mare liberum and his legal opinion De iure praedae has a strong theological basis. Grotius called the right to travel and trade freely a ius sanctissimum, a 'sacrosanct law'. He also perceived the Freedom of the Seas as being a direct result of the will of God. This theological background was strategically necessary because Grotius developed the Mare liberum and the De iure praedae to argue against Spanish-Portuguese claims to a trade monopoly that (...) also had theological underpinnings. But the theological aspect of Grotius's theory was also emphasized by the references he made to the Dominican friar Francisco de Vitoria's ius communicationis. This precursor to Grotius's Freedom of the Seas, which Vitoria had developed in his De indis, is connected to the legal justification of Christian mission and so has a clear theological connotation. In Grotius's work, Vitoria's concept of a universal right to Christian mission supervised by the pope was transformed into a theologically supported right to free trade. With this transformation of the ius communicationis into the principle of the Mare liberum, Grotius develops a theological basis not for politics but for economics. One can speak therefore, following Giorgio Agamben, of an 'economic theology' in regard to Grotius, a term that is, in turn, derived from Carl Schmitt's notion of 'political theology'. (shrink)

The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

Can Artificial Intelligence be more effective than human instruction for the moral enhancement of people? The author argues that it only would be if the use of this technology were aimed at increasing the individual's capacity to reflectively decide for themselves, rather than at directly influencing behaviour. To support this, it is shown how a disregard for personal autonomy, in particular, invalidates the main proposals for applying new technologies, both biomedical and AI-based, to moral enhancement. As an alternative to these (...) proposals, this article proposes a virtual assistant that, through dialogue, neutrality and virtual reality technologies, can teach users to make better moral decisions on their own. The author concludes that, as long as certain precautions are taken in its design, such an assistant could do this better than a human instructor adopting the same educational methodology. (shrink)

There are a bewildering variety of ways the terms "realism" and "anti-realism" have been used in philosophy and furthermore the different uses of these terms are only loosely connected with one another. Rather than give a piecemeal map of this very diverse landscape, the authors focus on what they see as the core concept: realism about a particular domain is the view that there are facts or entities distinctive of that domain, and their existence and nature is in some important (...) sense objective and mind-independent. The authors carefully set out and explain the different realist and anti-realist positions and arguments that occur in five key domains: science, ethics, mathematics, modality and fictional objects. For each area the authors examine the various styles of argument in support of and against realism and anti-realism, show how these different positions and arguments arise in very different domains, evaluate their success within these fields, and draw general conclusions about these assorted strategies. Error theory, fictionalism, non-cognitivism, relativism and response-dependence are taken as the most important positions in opposition to the realist and these are explored in depth. Suitable for advanced level undergraduates, the book offers readers a clear introduction to a subject central to much contemporary work in metaphysics, epistemology and philosophy of language. ABSTRACT There has been extensive debate among various disciplines about the nature and value of play. From these discussions it seems clear that play is a phenomenon with more than just one dimension: as a specific type of activity, as a form or structure, as an ontologically distinctive phenomenon, as a type of experience, or as a stance or an attitude towards a particular activity. This article focuses on the importance of the playful attitude in sport. It begins by attempting (...) to describe the underpinning features of a playful attitude, and its relation to Suits’ lusory attitude and the concept of gamification. Finally, it considers and critically evaluates the relationship between play and sport and the importance of the playful attitude in sporting activities. The purpose of this paper is a far deeper analysis of the playful attitude and its relationship to sport than has been previously provided, and a more precise definition as to what the playful attitude is. This will ultimately help to answer questions about the value of sport and how sport ought to be played. (shrink)

Retomo, en este artículo, la conocida distinción platónica entre doxa y epistêmê, hecha principalmente en el Menón y la República. Pero subrayo con énfasis particular la diferencia de criterios, de un diálogo a otro. Mientras que en el primero predomina el criterio lógico de la estabilidad de epistêmê y la inestabilidad dóxa, debida respectivamente a la concatenación (desmós) y la falta de concatenación de sus elementos, el segundo enfatiza el criterio ontológico de los objetos:la misma cosa no puede ser aprehendida (...) por la ciencia y la opinión, pues la primera concierne al ser absoluto, identificado con las Formas platónicas, y la segunda a algo que es intermedio entre el ser absoluto y el no-ser absoluto. Después de objetar que Platón no logra demostrar su división tripartita de la realidad, sostengo que la diferencia de criterios aquí analizada se debe a la ausencia de la Teoría Platónica de las Formas en el Menón. However, I stress now the difference in criteria from one dialogue to the other. While in the first prevails the logical criterion of stability of epistêmê and unstableness of dóxa, owing respectively to the concatenation (desmós) and the lack of concatenation of their elements, the second emphasizes the ontological criterion of objects: the same thing cannot be apprehended by science and opinion, for the former concerns to absolute being, identified with Platonic Ideas, while the latter to something which is halfway between absolute being and absolute not-being. After objecting that Plato fails to demonstrate his tripartite division of reality, I claim that the difference of criteria hereby analyzed is due to the absence of Plato’s Theory of Ideas in Meno. Although the concept of food sovereignty is rooted in International Peasant Movements across the global south, activists have recently called for the adoption of this framework among low-income communities of color in the urban United States. This paper investigates on-the-ground processes through which food sovereignty articulates with the work of food justice and community food security activists in Oakland, California, and Seattle, Washington. In Oakland, we analyze a farmers market that seeks to connect black farmers to low-income consumers. In Seattle, (...) we attend to the experiences of displaced immigrant farmers from Latin America and their efforts to address their food needs following migration. In both cases, we find that US based projects were constrained by broader forces of neoliberalism that remained unrecognized by local activists. In Oakland, despite a desire to create a local food system led by marginalized African Americans, emphasis on providing green jobs in agriculture led activists to take a market-based approach that kept local food out of the economic grasp of food-insecure neighborhood residents. In Seattle, the marginalization of the immense agroecological knowledge of Latino/an immigrant farmers rendered local food projects less inclusive and capable of transformative change. Taken together, these very different cases suggest that a shift towards food sovereignty necessitates a broad acknowledgement of and resistance to neoliberalism. (shrink)

A logic is called 'paraconsistent' if it rejects the rule called 'ex contradictione quodlibet', according to which any conclusion follows from inconsistent premises. While logicians have proposed many technically developed paraconsistent logical systems and contemporary philosophers like Graham Priest have advanced the view that some contradictions can be true, and advocated a paraconsistent logic to deal with them, until recent times these systems have been little understood by philosophers. This book presents a comprehensive overview on paraconsistent logical systems to change (...) this situation. The book includes almost every major author currently working in the field. The papers are on the cutting edge of the literature some of which discuss current debates and others present important new ideas. The editors have avoided papers about technical details of paraconsistent logic, but instead concentrated upon works that discuss more 'big picture' ideas. Different treatments of paradoxes takes centre stage in many of the papers, but also there are several papers on how to interpret paraconistent logic and some on how it can be applied to philosophy of mathematics, the philosophy of language, and metaphysics. This article critically examines the development and consensus outputs of the Concussion in Sport Group. We examine the six Consensus Statements between 2001 and 2023 to explore the challenges that the presence of contextual forces pose to the development of effective and ethically justifiable medical guidelines to manage situations involving brain-injured athletes. First, we discuss the implicit and explicit ethical framework and goals underlining the statements. Secondly, drawing on a relational account of athlete choice, we expound on the limitations of (...) the framework, concentrating on those resulting from a simplified understanding of athlete autonomy. Thirdly, we conclude by proposing a series of recommendations to improve concussion management protocols: (1) adopting a broader understanding of autonomy built upon relational accounts, beyond just the healthcare professional-athlete relationship; (2) further minimizing conflicts of interest that increase athletes’ vulnerability and hinder decision-making ability; (3) enhancing healthcare professional training to allow better adjustment of treatment plans to athletes’ contexts; and (4) promoting research on sociocultural elements affecting athletes’ vulnerability and autonomy. Se considera la centralidad técnica de la cuantificación en los modelos algorítmicos y numéricos de triaje y se incide en la prevalencia normativa de los criterios consecuencialistas, incluso cuando éstos hayan de ajustarse a sistemas de múltiples principios. Finalmente se sugiere que una concepción ética de los desastres precisa de una perspectiva compleja y integral de la gestión de los desastres (...) que no se limite a la fase de respuesta inmediata a los mismos y que supere a la par que integre los principios de la bioética y la indispensabilidad de los criterios consecuencialistas en las decisiones de triaje. Gareth Evans produced a powerfulline of argument against Quine's well-known Thesis of the Inscrutability of Reference. In one part of his attack, Evans argued that, under certain conditions, structural simplicity may become truth-conducive for semantic theories. Being structurally more complex than the standard semantic theory, perverse semantic theories a la Quine are an easy prey for Evans' considerations. The bulk of the paper will be devoted to addressing Evans' criticism. By reviewing the classical/connectionist debate in cognitive science between a hypothetical (...) sympathizer of “cognitive orthodoxy" and the friend ofconnectionism, I shall contend that the Quinean has nothing to fear from a classical reading of Evans' considerations. Stephen Jay Gould’s monumental The Structure of Evolutionary Theory ‘‘attempts to expand and alter the premises of Darwinism, in order to build an enlarged and distinctive evolutionary theory . . . while remaining within the tradition, and under the logic, of Darwinian argument.’’ The three branches or ‘‘fundamental principles of Darwinian logic’’ are, according to Gould: agency (natural selection acting on individual organisms), efficacy (producing new species adapted to their environments), and scope (accumulation of changes that through geological time yield (...) the living world’s panoply of diversity and morphological complexity). Gould’s efforts to contribute something important to each of these three fundamental components of Darwinian Theory are far from successful. (shrink)

A logic is said to be paraconsistent if it doesn’t license you to infer everything from a contradiction. To be precise, let |= be a relation of logical consequence. We call |= explosive if it validates the inference rule: {A,¬A} |= B for every A and B. Classical logic and most other standard logics, including intuitionist logic, are explosive. Instead of licensing you to infer everything from a contradiction, paraconsistent logic allows you to sensibly deal with the contradiction.

Pendant l’ete de 1928 Heidegger a offert un seminaire sur le troisieme livre de la Physique d’Aristote et donc sur l’explication aristotelicienne de la nature du mouvement. La derniere seance de ce cours, qui eut lieu le 25 juillet, est d’une grande importance parce que c’est a cette occasion que Heidegger va au livre neuf de la Metaphysique pour essayer de comprendre la notion ontologique qui est a la base de l’interpretation aristotelicienne du mouvement : l’energeia. Mais dans les protocoles (...) de ce seminaire qui se trouvent parmi les papiers de Heidegger et qui ont ete publies recemment dans le volume 83 de la Gesamtausgabe, la seance du 25 juillet se trouve absente. Ce fait a conduit l’editeur a conclure que le seminaire avait pris fin le 23 juillet, sans s’apercevoir donc que la conclusion du seminaire manquait. Il existe heureusement une transcription preservee parmi les papiers de l’etudiante de Heidegger, Helene Weiss, et accessible aujourd’hui dans les archives de l’universite de Stanford. Cette transcription montre que la derniere session eut bien lieu le 25 juillet et nous offre la lecture heideggerienne de Metaphysique IX qui ne se trouve pas dans la version de la Gesamtausgabe. C’est dans le contexte de cette lecture que Heidegger fait la declaration etonnante qui nous concerne ici : ≪Dans la derniere instance, la Metaphysique Θ revient a Platon ; la priorite de l’energeia est fondamentalement la meme chose que l’epekeina des Idees. ≫La première tâche que je me propose ici sera d’expliquer cette déclaration qui suggère une relation tres etroite, ou meme une identite, entre la notion aristotelicienne de l’energeia comme ayant une priorite vis‑a‑vis de la dunamis et la notion platonicienne de l’Idee du Bien comme etant epekeina de l’ousia. Pour cette explication je ferai appel non seulement au contexte du seminaire de 1928, mais aussi aux textes plus tardifs comme les Beitrage et les cours sur Nietzsche dans lesquels Heidegger semble presupposer et développer sa déclaration de 1928. Ma seconde tâche sera de comparer cette thèse heideggerienne a la tentative de Gadamer de surmonter l’opposition traditionnelle entre les ontologies de Platon et d’Aristote en faisant appel a l’idee du bien chez les deux. Cette tentative se trouve dans le texte Die Idee des Guten zwischen Plato und Aristoteles. La comparaison que j’entreprends ici va montrer certaines affinites entre les interpretations de l’Idee du Bien chez Heidegger et Gadamer, mais aussi de profondes differences qui vont determiner leurs differents projets philosophiques. His Jewish ancestry wasn’t proved until 1964, his painful illness was wrong interpretated by Dr. Marañón, he became disappointed in his friendship with Erasmus, his pacifist ideas were considered as imperial ones, finally, his texts have been wrongly translated. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. This article identifies a double allusion to the tragic characters of Phaedra and Eriphyle in Amm. Marc. 14.1.3 and considers its possible meanings. In combination, these allusions evoke the double nature of the story of Eriphyle, therefore functioning as a reference to the double nature of Caesar Gallus’ depiction in Ammianus. The double allusion consequently forms part of Ammianus’ tragic style throughout Book 14. Having identified the presence of this double allusion, the article illuminates its possible meaning by connecting Ammianus’ (...) passage to the Virgilian rewriting of the description of Eriphyle in Homer. This book is dedicated to the work of Alasdair Urquhart. The book starts out with an introduction to and an overview of Urquhart’s work, and an autobiographical essay by Urquhart. This introductory section is followed by papers on algebraic logic and lattice theory, papers on the complexity of proofs, and papers on philosophical logic and history of logic. The final section of the book contains a response to the papers by Urquhart. Alasdair Urquhart has made extremely important contributions to a (...) variety of fields in logic. He produced some of the earliest work on the semantics of relevant logic. He provided the undecidability of the logics R and E, as well as some of their close neighbors. He proved that interpolation fails in some of those systems. Urquhart has done very important work in complexity theory, both about the complexity of proofs in classical and some nonclassical logics. In pure algebra, he has produced a representation theorem for lattices and some rather beautiful duality theorems. In addition, he has done important work in the history of logic, especially on Bertrand Russell, including editing Volume four of Russell’s Collected Papers. (shrink)

En 1985, Brasil salía de un periodo de 21 años de dictadura y abría un proceso constituyente para lograr una redemocratización. La Constitución de 1988 fue nombrada como «ciudadana» porque reforzó los derechos civiles e introdujo derechos colectivos de pueblos indígenas y otros pueblos tradicionales, derechos colectivos sobre el medio ambiente y la cultura, además de derechos a la vivienda, a la salud, a la educación y de los consumidores. No fue fácil la implementación de esos derechos y el presente (...) trabajo analiza la aplicación de los derechos de los pueblos y de la naturaleza, dividiéndolos en tres periodos particulares. El primero, desde la promulgación de la Constitución, en 1988, hasta la elección de Lula da Silva y su posesión en 2003; periodo marcado por la aplicación de políticas neoliberales en contraposición con las normas constitucionales colectivas. El segundo periodo, representado por los gobiernos de Lula y de Dilma Rousseff, del 2003 hasta el 2016, cuando la presidenta es alejada para que asuma su vicepresidente; periodo marcado por un desarrollismo contradictorio con los derechos colectivos. El tercer periodo, a partir del 2016, caracterizado por la intención de destruir la Constitución. (shrink)
