This is a response to the letter to the editor “Prioritizing the Prevention of Early Deaths during Covid‐19,” by Govind Persad.

Jurgen Habermas is by far the most preeminent and influential philosopher in Germany today. The scope of his writings is remarkable. Their influence extends over a wide range of disciplines that include philosophy, social theory, hermeneutics, anthropology, linguistics, ethics, educational theory, and public policy. The impact of Habermas's writings on theology alone reaches from fundamental to political theology, from moral to practical theology. The significance of Habermas, Modernity, and Public Theology is twofold. First, it represents a genuine dialogue, an actual (...) conversation, between Habermas and theologians. While theologians have appealed to Habermas's work in innumerable articles and monographs, he himself until now has remained silent. This book, then, is unique insofar as it offers the true give and take of dialogue. Second, this book focuses on Habermas's most recent work, especially his interpretation of modernity, his theory of communicative action, and his development of a discourse ethics. In so doing, it corrects some of the prevalent misreadings of Habermas within the theological literature devoted to him. In examining the relation between critical theory and a public and practical theology, the contributors note both the promise and limitations of Habermas's basic arguments and insights. They challenge Habermas as much as they learn from him. Sharing the conviction that religious traditions contain sources for interpreting human nature and society, they argue that if Habermas would attend more to the role of religion within life and society, he would more fully realize his project for a communicative rationality under the conditions of modernity and would offer amore comprehensive understanding of rationality, society, and modernity. Taking his own turn at the end of the book, Habermas responds to each of the contributors, comments on the broader theological reception of his work, and offers his own fascinating views on the function and development of religion in modernity and on the status and claim to truth of theological discourse. The work concludes with an extremely useful annotated bibliography covering Habermas's own writings, general introductions to Habermas and to critical theory, and works devoted to specific aspects of Habermas's thought. When the Covid‐19 pandemic reached the United States in spring 2020, many states and hospitals announced crisis standards of care plans that used age as a categorical exclusion criterion. Such age choosing was quickly flagged as discriminatory, and so some states and hospitals shifted to embedding age as a tiebreaker deeper in their plans. Different rationales were given for using age as a tiebreaker: that younger patients were more likely to survive than older patients, that saving younger patients would save (...) more life years, and that younger patients deserved a chance to live through life's stages. We provide a critical analysis of these three rationales, noting the differences between them, and then questioning the ethical and legal justifications for such age choosing. (shrink)

Field-Programmable Gate Arrays (FPGAs) have emerged as an attractive means of implementing logic circuits, providing instant manufacturing turnaround and negligible prototype costs. They hold the promise of replacing much of the VLSI market now held by mask-programmed gate arrays. FPGAs offer an affordable solution for customized VLSI, over a wide variety of applications, and have also opened up new possibilities in designing reconfigurable digital systems. Field-Programmable Gate Arrays discusses the most important aspects of FPGAs in a textbook manner. This article looks at Francis Fukuyama’s analysis of Hegel in "The End of History and the Last Man." It argues that Fukuyama’s “Last Man” thesis has been unduly neglected due to the focus on his “End of History” thesis. The “Last Man” (a term borrowed from Nietzsche) is a person who lashes out for attention because they do not receive any special, individual recognition in a society where all seem to get some level of recognition (e.g. having their basic (...) biological needs met by the welfare state, having certain rights, etc.). I argue that Fukuyama’s analysis on this topic has proved prescient. The “Last Man problem” has manifested in various ways across our culture, particularly in the context of the “Alt-Right” movement. However, I argue that Fukuyama has misread and oversimplified Hegel, who can help us to explain this phenomenon. (shrink)

Brown I VIEWERS OF KEN BURNS'S third cultural epic "Jazz" probably fell into one of three categories. 2 Some found it gripping. Some found it grating. Some found it both at once.The series has unforgettable moments: spectacular jitterbug sequences; Jimmy Lunceford's horn men fanning their trumpet (...) bells with hat mutes in sync; the close-up of the whirring cross-hand drumming of Art Blakey; the bitter-sweet glance Billie Holiday and Lester Young exchange in their last filmed appearance together; the occasional marriage of visuals to music. One riveting three minutes comes when the talking heads tune out, a 78-rpm disk of Louis Armstrong's "West End Blues" is set spinning, and the thrilling notes pour out on a carousel of visual imagery—finally freeze-framing on the face of the young genius himself.On the downside, the series is massively repetitious. As a result of Burns's decision to track two major figures—Louis Armstrong and Duke Ellington—from cradle to grave, the same cuts of Armstrong appear again and again, no matter what the time frame. Some of the series' commentators are particularly annoying—the fiddler of Burns's Civil War series, Matt Glaser, for instance, with his fatuous theories [End Page 157] about Louis Armstrong and Albert Einstein. And the documentary's heavy load of social freight—by Wynton Marsalis, and his mentors Albert Murray and Stanley Crouch 3 —threatens to flatten the music.The series is designed as informative entertainment, not Jazz 101. But Burns pays a price here, as he did in his documentary about baseball, in which not even the basics of the game, let alone any of the subtleties, were explained. In "Jazz" we get no explanation of what Jelly Roll Morton did to transform ragtime into jazz. (The series could easily have pressed Morton himself into service. With no sacrifice of his considerable charm, Morton did explain it, beautifully, in his recorded Library of Congress interviews. 4) Although the swing era gets big billing, no attempt is made to explain how swing rhythm actually works, as contrasted with earlier practices. (I have watched swing drummer Panama Francis entertain a packed hall with a brief but riveting illustration of how it works.)As jazz history, the film also has problems. Some legendary figures are resurrected unconvincingly. When Marsalis tells us what the legendary trumpet player Buddy Bolden sounded like, the illustrative off-camera trumpet is Marsalis's, not Bolden's, who embedded not one note in a record groove. Further, we face the tiresomely obvious problem of omissions. We hear nothing of Albert Ayler, Keith Jarrett, Sun Ra, Mildred Bailey, Benny Carter, Lennie Tristano, Erroll Garner, Eric Dolphy, Art Pepper, or Woody Herman. All we learn about Bill Evans—whose influence on jazz piano was huge—is that Miles Davis hired him even though he was white. Omissions are inevitable, of course. But there is a muted pattern to the exclusions. It was impossible for the series to avoid Benny Goodman, given his central role in the swing era. But white figures are too often either ignored or treated as alienated outsiders. We hear New York Times columnist Margo Jefferson opine that Bix Beiderbecke drank himself to death because he wasn't allowed to play with black musicians. In fact, many of the greatest players—white and black—never played with musicians of their own caliber.Most figures covered in the film are treated either with respect or with reverence. But things get nasty when matters turn to avant-gardists. Thus, Branford Marsalis—Wynton's talented brother—singles out the volcanic pianist Cecil Taylor for a particularly hostile attack. 5 Instead of explaining what Ornette Coleman meant by "free jazz," Albert Murray tells us that jazz is, by definition, free music—and by implication, that Coleman's concept must be fatuous. TisoA retreat program designed by the participants in the ongoing Ch'an/Zen-Catholic Dialogue explored the dialogue of religious experience and the dialogue of life, set amid the redwoods of Guerneville, California. The 28–31 January 2009 meeting was cochaired by the Rev. Heng Sure of the Berkeley Buddhist Monastery and the Institute for World Religions, Berkeley, California, and by (...) Most Rev. John C. Wester, Bishop of Salt Lake City, Utah.Sr. Mary Ann Donovan of the Jesuit School of Theology, Berkeley, led an experience of lectio divina based on John 15:1–17, Jesus's simile of the vine and the branches. Rev. Victoria Austin of the San Francisco Zen Center gave an "encouragement talk," which would typically be delivered to Zen retreatants. She referred to the Gospel passage, noting: "We don't prune the vine because it is dead, but because it has the capacity to be fruitful. We don't purify the mind to get rid of dirt, but to return to the mind's original purity, which is the source of our conscience and is the true life within us." Rev. Jan Chosen Bays of Great Vow Zen Monastery in Oregon observed that "Vows make our life energy more focused, keeping us from losing purpose and meaning. Vows prune away unnecessary things. When we ask for help with the challenge of being faithful to our vows, we call up and encounter unexpected sources of support and 'grace.' "The Ch'an Buddhist presentation focused on meditation experience, which was described as "recovering the natural state of the mind." Prof. Martin Verhoeven of the Pacific School of Religion pointed out that in meditation "we are returning to the origin, not moving forward to 'gain something.'" Linking ethical engagement with contemplation, he said, "When the mind of a meditator is motivated to act out of genuine compassion, its action is accurate and correct. Action is neither driven nor obstructed by ego or sentiment." These comments resonated with Rev. Heng Sure's presentation on the statement on the environment from the recent Gethsemane III conference "Simple and Sufficient," in which Buddhist and Christian monastics embraced an ecologically valid way of life. Urging the group to notice the connections between contemplation and ethical action, Bishop John C. Wester commented: "This [End Page 145] work embodies mercy by lifting people up; it embodies justice as it arises out of our common humanity."Because of the financial challenges that all three sponsoring institutions are facing, it was decided to conclude formal sponsorship of the Ch'an/Zen-Catholic Dialogue with this meeting. However, participants agreed to work together to reconstitute the dialogue regionally. A steering committee was designated to undertake new logistical arrangements and to draft a narrative of the previous seven years of dialogue for posting on our respective websites. My poetized culture is one which has given up the attempt to unite one’s private ways of dealing with finitude and one’s sense of obligation to other human beings.Richard Rorty repudiated W. B. Yeats’s aspiration “to hold justice and reality in a single vision,” and he did so with relish.2 Thrilling though it is, Rorty would say, there is no need to weave into a single, coherent narrative our commitment to the end of cruelty (justice) and our idiosyncratic aesthetic (...) tastes (reality). We can affirm both principles individually—justice and reality—without concocting a “philosophy of life” (or finding a “philosophical slop-shop”3) that will draw straight lines from aesthetic obsession to justice work. Little is known about the origins of the Brown Book of Ludwig Wittgenstein. One of his better-known texts, it was first published in print in 1958 and is based on notes that Wittgenstein had dictated to two of his pupils, Francis Skinner and Alice Ambrose, at Cambridge University during the academic year of 1934 – 35. The present paper examines some of the few extant remarks by Wittgenstein and others about the circumstances from which the text emerged against (...) the backdrop of various source materials, including a set of handwritten and typed notes that belong to a collection of Ambrose’s papers at Cambridge University Library. This paper investigates the emergence, in the second part of the 17th century, of a new body of experimental knowledge dealing with the chemical transformations of water taking place in plants. We call this body of experimental knowledge a “chemical history of vegetation.” We show that this chemical natural history originated, in terms of recipes and methods of investigation, in the works of Francis Bacon and that it was constructed in accordance with Bacon's precepts for putting together natural and (...) experimental histories. Our paper covers a wide array of experimental investigations, carried out by people with different backgrounds, theoretical assumptions, and metaphysical allegiances (Thomas Browne, Robert Sharrock, Robert Boyle, Nehemiah Grew, John Beale, and John Evelyn). We claim that, despite their differences, these naturalists had a lot in common. First, they treated plants as laboratories of chemical investigation. Second, they used the experiments with plants to develop tools, hypotheses, and operational concepts, which travelled from one naturalist to the other, even when their respective explanatory vocabularies were widely different. Third, we show that some of them also manifested an interest in defining and clarifying the limits and structure of this new body of experimental knowledge, displaying, thus, a certain disciplinary unity. The following essay analyzes the arguments made by the principal academic proponent of income taxation, Columbia University economist E. R. A Seligman, after it was found to be unconstitutional in 1894. Seligman thought that the prevalent theory of just taxation, that it should be based on a natural right to one’s person and property, was wrong. The principal American philosophical proponent of this natural rights-based approach to taxation was the late Brown University philosopher and economist, Francis Wayland. The (...) essay analyzes the flaws in Seligman’s contention that there are no natural rights and, therefore, no natural property rights, so that taxation could not be justified by the benefits received for the protection of such rights. Instead, he claimed taxation should rest upon a person’s financial capacity. Since that capacity would be most accurately measured by net worth, we would have expected Seligman to endorse a proportionately assessed net worth tax (which was commonly used by the states in the nineteenth century). Alternatively, he argued for an income tax progressively assessed. This essay argues that since income is only a portion of financial capacity, his argument fails. (shrink)

In a new interpretation, Garrett Wallace Brown considers Kant's cosmopolitan thought as a form of international constitutional jurisprudence that requires minimal legal demands. He explores and defends topics such as cosmopolitan law, cosmopolitan right, the laws of hospitality, a Kantian federation of states, a cosmopolitan epistemology of culture and a possible normative basis for a Kantian form of global distributive justice.

"The Mind is not a Vessel to be Filled but a Fire to be Kindled", and "Education is Not the Filling of Pail But the Lighting of a Fire", and ... Something About a Horse ... You can lead a horse to water, but you can’t make it smile? Because of the long face and all? (No, that can’t be it). Anyway, borrowing a bit from Plutarch and Yeats (maybe, there is no agreement on whether he said that about (...) pails and fires), and some idiom from 12th Century Old English about horses walking on water, I assume, we can glean the following gem: learning requires active participation by learners. It is almost embarrassing to have to write that, but here we are with education today, mostly unloading facts into unlit receptacles. This doesn’t work, and not just because the metaphor is mixed. Genuine learning requires focus, which requires motivation, which is cultivated by interest, which needs curiosity, which is not something teachable through the typical educational curricula. I can, as Aristotle tells us, teach students the basics of some ethical theory, but I cannot make them virtuous. Ah-ha! I can lead a horse to water, but I can’t make it abide by the categorical imperative (No, that’s not quite right. Although it’s true--most horses are utilitarians). One way that seems to work in piquing student interest in learning philosophy is to use humor as you make the case that a philosophical attitude is very similar to a humorous attitude. Both rely heavily on questioning our collective presuppositions, both cultivate rational skepticism, and both are never content with accepting traditions and values that are mindlessly received. I’ve got it now: You can lead a horse to water, but you can’t make it an iconoclast! (still not it). Friedrich Nietzsche published a book in 1889 titled Twilight of the Idols: Or How to Philosophize with a Hammer. This was during his most frenetic and fecund period, just before the syphilis set in rendering him somewhat less than his lauded Ubermensch. The “Idols” for Nietzsche were “false gods” or the ubiquitous errors that philosophy should expose. He is likely borrowing (without citation!) from sir Francis Bacon, whose “idols” are fetishes which can divert us from the pursuit of truth. Learning is hard, but it doesn’t have to be gloomy, hence, I advocate for a different sort of hammer to act as a “tuning-fork” sounding out the hollow and dangerous idols handed down to us that have passed for sagacity. The debate on the European Union's democratic deficit usually operates within a national-democratic framework of analysis. This article argues for a change in methodology. It follows the thesis that the EU is a ‘demoicracy’– a polity of multiple demoi– and has to be evaluated as such. Core principles of demoicracy are developed and the EU is assessed accordingly. Such an evaluation is not only more adequate, but also provides original insights: it is found that, whereas the constitutional development of the (...) EU has approached demoicratic standards in general, major deficits remain at the national level. (shrink)
