Adequate treatment of pain is essential to alleviate suffering, yet studies show that patients with terminal or serious illness receive inadequate pain relief. In the case of terminally ill patients, adequate palliation of pain may be likely to reduce requests for physician-assisted suicide. This issue of the journal addresses barriers to effective pain relief and suggests how treatment of pain can be improved. The symposium features the Pain Relief Act, which is designed to provide practitioners who prescribe controlled substances for (...) pain with protection from inappropriate legal sanctions. The Act is the product of the Project on Legal Constraints on Access to Effective Pain Relief, whose principal investigators were Nancy Neveloff Dubler, LL.B., Sandra H. This paper is intended as a contribution to a recent vigorous debate inThe Times, between the distinguished journalist Bernard Levin, the eminent Oxford economist Wilfred Beckerman and the Archbishop of York, John Habgood, among others. The debate concerns morality, ‘free will’ and determinism. As a former German Jew, who lost close relatives at Auschwitz and who suffered personally severely in my youth under daily virulent Nazi persecution, I obviously cannot remain strictly detached and neutral. Yet, I shall attempt to (...) retain as much neutrality as possible, since I think that the main rivals in this debate have all some very relevant, interesting and valid things to say. Let me also state other, probably very relevant, biases. I am an ardent Zionist. In addition, I am a diehard mechanistic materialist as regards basic philosophy, although I am tolerant of other people's religious feelings, because I realize that my materialism is as metaphysical as their religious views. With this as background let me return to the technical issues. Obviously, in a philosophical journal one can write at a level above that ofThe Times, where there is, perhaps, insufficient room to debate philosophical, biological, physical and other niceties in some depth. In the era of Romanticism, certain authors sought to redefine man’s place in nature as a response to industrialism. The German Naturphilosoph Friedrich Schelling published his treatise Of Human Freedom in 1809 that reveals traces of romantic notions of nature with an existential undercurrent that predated and influenced the philosophical movement known as Existentialism. The existentialist philosopher Martin Heidegger delivered a series of lectures on the treatise at the University of Freiburg in 1936. In his works, Heidegger stresses the importance (...) of being actively involved in the world. His interpretation of the treatise, with its emphasis on the way humans and other creatures are engaged with their environment, calls to mind contemporary thinking in ecology. Through Heidegger’s interpretation, I will show that Schelling’s treatise could be construed as a proto-ecological study, which is to say a study in ecology before the development of the concept or field of study. For some decades, the concept of human dignity has been widely discussed in bioethical literature. Some authors think that this concept is central to questions of respect for human beings, whereas others are very critical of it. It should be noted that, in these debates, dignity is one component of a long-lasting and widespread conceptual construct used to support a stance on the ethical question of the moral status of an action or being. This construct has been used from Modernity (...) onward to condemn slavery and torture as violations of human dignity. In spelling it out, we can come to a better understanding of what “dignity” means and become aware that there exists a quite useful place for this notion in our ethical thought, albeit a modest one. I offer a new interpretation of Heidegger’s analysis of anxiety in Being and Time as an account of the relationship between individual agents and the public normative practices of their communities. According to a prominent recent interpretation, Heidegger’s discussions of anxiety, death and the “call of conscience” together explain how we can respond to the norms of our practices as reasons and subject them to critical reflection. I argue that this is only part of the story. Anxiety is an occasion (...) for Dasein to take responsibility for its ongoing activity of interpreting the possibilities for living and acting made available by the normative practices of its community, which is presupposed and overlooked from the perspective of everyday Dasein. Public normativity underdetermines Dasein’s conception of what it would mean to take up any of the possibilities available in its world as a way of living its own life. (shrink)

This paper uses E. M. Forster’s novel Howards End to help articulate what I describe as a moral pluralist approach to moral conflict. Moral pluralism, I argue here, represents a way of responding to the moral conflicts we encounter in our lives, rather than the mere acknowledgment of their inevitability, as suggested by value pluralists like Isaiah Berlin. The tragic view of moral conflict epitomized by Sophocles’ Antigone and endorsed by most theories of value pluralism, tells us that we must (...) choose between moral commitments and reconcile ourselves to the moral regrets that inevitably follow from moral choice. The moral pluralist view, in contrast, suggests that we should seek means, however imperfect, of satisfying conflicting moral commitments and minimizing causes for moral regret. That view, I argue, drives the words and actions of Forster’s heroine in Howards End, Margaret Schlegel. Confronted with a battle between a willful patriarch and a self-righteous sister, a conflict that maps neatly onto the central conflict in Sophocles’ tragedy, Margaret refuses to take sides without refusing to make moral choices. And in doing so, she comes to exemplify an unexpected kind of moral heroism. (shrink)

The language theory of Mikhail Bakhtin does not fall neatly under any single rubric - 'dialogism,' 'marxism,' 'prosaics,' 'authorship' - because the philosophic foundation of his writing rests ambivalently between phenomenology and Marxism. The theoretical tension of these positions creates philosophical impasses in Bakhtin's work, which have been neglected or ignored partly because these impasses are themselves mirrored by the problems of antifoundationalist and materialist tendencies in literary scholarship. The essays in Part I of _Beyond Poststructuralism seek_ to demonstrate fallacies of structuralist and poststructuralist thought that remain potent even though the theoretical structures that led to their enunciation have lost much of their original influence. These fallacies include the idea that one must avoid the consideration of authorial intention; that meanings are undecidable; that there is no justification for seeking unity in a text; that all hierarchies of value are reversible; that history is no more than an open (...) contest among competing narrative constructions; and that the very nature of language makes the falsifiability of statements about human experience impossible. Sustainability is typically viewed as consisting of three forces, economic, social, and ecological, in tension with one another. In this paper, we address the dangers posed to societal sustainability. The concern being addressed is the very survival of societies where the rights of individuals, personal and collective freedoms, an independent judiciary and media, and democracy, despite its messiness, are highly valued. We argue that, as a result of various technological innovations, a range of dysfunctional impacts are threatening social and political (...) stability. For instance, robotics and automation are replacing human labor and decision-making in a range of industries; search engines, monetized through advertising, have access to, and track, our interests and preferences; social media, in connecting us to one another often know more about us than we ourselves do, enabling them to profit in ways which may not coincide with our well-being; online retailers have not only acquired the ability to track and predict our buying choices, but also they can squeeze vendors based on their outsize bargaining power; and, in general, virtual technologies have changed both the way we think and our sense of self. With the rising deployment of the Internet of Things, and developments in machine learning and artificial intelligence, the threats to individual freedoms and rights, societal cohesion and harmony, employment and economic well-being, and trust in democracy are being ratcheted up. This paper lauds the benefits and addresses the harm wrought by the high tech giants in Information and Communication Technologies. The search for rapidly growing revenues drives firms to accelerate product innovation without fully investigating the entire gamut of their impacts. As greater wealth accrues to the leaders of tech firms, inequalities within firms and societies are widening, creating social tensions and political ferment. We explore the ethical nature of the challenge employing a simple utilitarian calculus, complemented by approaches rooted in rights, justice, and the common good. Various options to address the challenges posed by ICTs are considered and evaluated. We argue that regulation may do little more than slow down the damage to society, particularly since societal values and political preferences vary internationally. Firms need to establish ethical standards, imbuing the upholders of these standards with sufficient authority, while creating a culture of morality. User involvement and activism, and shareholders’ concerns for the sustainability of societies on whose continued prosperity they depend, are imperative to humanity’s ability to decide the future direction of technology. Pantheism is a metaphysical and religious position. Broadly defined it is the view that (1) "God is everything and everything is God ... the world is either identical with God or in some way a self-expression of his nature" (H.P. Owen). Similarly, it is the view that (2) everything that exists constitutes a 'unity' and this all-inclusive unity is in some sense divine (A. MacIntyre). I begin with an account of what the pantheist's ethical position is formally likely to be (...) (e.g. objectivist etc.). I then discuss the relationship between pantheism and ecology in the context of the search for the metaphysical and ethical foundations for an ecological ethic. It is claimed that it is no accident that pantheism is often looked to for such foundations. (shrink)

In his article 'Specifying, balancing and interpreting bioethical principles' (Richardson, 2000), Henry Richardson claims that the two dominant theories in bioethics - principlism, put forward by Beauchamp and Childress in Principles of Bioethics , and common morality, put forward by Gert, Culver and Clouser in Bioethics: A Return to Fundamentals - are deficient because they employ balancing rather than specification to resolve disputes between principles or rules. We show that, contrary to Richardson's claim, the major problem with principlism, either the (...) original version, or the specified principlism of Richardson, is that it conceives of morality as being composed of free-standing principles, rather than as common morality conceives it, as being a complete public system, composed of rules, ideals, morally relevant features, and a procedure for determining when a rule can be justifiably violated. We obtain an array of consistency results concerning trees and stationary reflection at double successors of regular cardinals $\kappa $, updating some classical constructions in the process. This includes models of $\mathsf {CSR}(\kappa ^{++})\wedge {\sf TP}(\kappa ^{++})$ (both with and without ${\sf AP}(\kappa ^{++})$ ) and models of the conjunctions ${\sf SR}(\kappa ^{++}) \wedge \mathsf {wTP}(\kappa ^{++}) \wedge {\sf AP}(\kappa ^{++})$ and $\neg {\sf AP}(\kappa ^{++}) \wedge {\sf SR}(\kappa ^{++})$ (the latter was originally obtained in joint work by Krueger and (...) the first author [9], and is here given using different methods). Analogs of these results with the failure of $\sf {SH}(\kappa ^{++})$ are given as well. Finally, we obtain all of our results with an arbitrarily large $2^\kappa $, applying recent joint work by Honzik and the third author. (shrink)

The scholastic philosopher is interested in definition for a different reason than the lexicographer and linguist. The philosopher is trying to learn things. Fe defines, after investigating reality, in an attempt to describe reality clearly and to sum up some aspect of his understanding of reality. Hence, we find our scholastic philosophers adopting as a main feature of their method this insistence on defining, on precise and detailed explanation of their definitions, and on proving that their definitions da correctly express (...) what a nature or activity is. A dictionary of the language of scholastic philosophy fitted to the needs of beginners and of undergraduate students of the subject is not available in English. (shrink)

Philosophical writing on the welfare state has taken a defensive turn in recent years, largely in response to two related phenomena: the re-emergence of pro-market ideologies in the larger political culture and the imperiled condition of real world welfare states in a global economy in which national governments have diminishing capacities for shaping the social and economic lives of their citizens. But thanks in part to the tireless advocacy of Philippe Van Parijs, an even more radically redistributive form of public (...) provision than the welfare state has come onto the intellectual agenda—and the political agenda too, at least in Belgium and the Netherlands. Van Parijs proposes that all citizens be accorded an unconditional “basic income grant” as large as is compatible with the need to generate as much wealth as possible for redistribution. By now, this idea has many defenders. It also boasts a genealogy extending back to such writers as Tom Paine, François Huet, Edward Bellamy and G. D. H. Cole. But Van Parijs has become its best-known and most adept philosophical proponent, and this book represents his most sustained effort to date to investigate its normative foundations. (shrink)
