Duns Scotus's famous proposition was first attacked in a short polemical treatise attributed to Thomas of Sutton. By the time of Ockham, the proposition was known as the propositio famosa, so called by Walter Chatton, Ockham's colleague at Oxford and London, who defended it against Ockham's lengthy critique. At Paris, during the same period, it was called the propositio vulgata and was used approvingly by Francis of Meyronnes, Peter of Navarre and Durandus St. Pourçain. This “famous proposition” was so (...) controverted because on it depended the acceptance, with Duns Scotus, or the rejection, with Ockham, of theology as a strict, propter quid science. As its detractors and defenders must have realized, it also struck at the heart of the divergent philosophical outlooks of Duns Scotus and Ockham. For all of this, Duns Scotus's famous proposition and its history have all but escaped notice. (shrink)

The present article critically examines three aspects of Graham Priest's dialetheic analysis of very important kinds of limitations (the limit of what can be expressed, described, conceived, known, or the limit of some operation or other). First, it is shown that Priest's considerations focusing on Hegel's account of the infinite cannot be sustained, mainly because Priest seems to rely on a too restrictive notion of object. Second, we discuss Priest's treatment of the paradoxes in Cantorian set-theory. It is shown that (...) Priest does not address the issue in full generality; rather, he relies on a reading of Cantor which implicitly attributes a very strong principle concerning quantification over arbitrary domains to Cantor. Third, the main piece of Priest's work, the so-called “inclosure schema”, is investigated. This schema is supposed to formalize the core of many well-known paradoxes. In a thought-provoking paper, Schuklenk and Smalling argue that no right to conscientious objection should be granted to medical professionals. First, they hold that it is impossible to assess either the truth of conscience-based claims or the sincerity of the objectors. Second, even a fettered right to conscientious refusal inevitably has adverse effects on the rights of patients. We argue that the main problem with their position is that it is not derived from a broader reflection on the meaning and (...) implications of freedom of conscience and reasonable accommodation. We point out that they collapse two related but distinct questions, that is, the subjective conception of freedom of conscience and the sincerity test. We note that they do not successfully show that the standard norm according to which exemption claims should not impose undue hardship on others is unworkable. We suggest that the main reason why arguments such as no one is forced to be a medical professional are flawed is that public norms should not constrain citizens to choose between two of their basic rights unless it is necessary. In fine, Schuklenk and Smalling, who see conscience claims as arbitrary dislikes, sell freedom of conscience short and forego any attempts at balancing the competing rights involved. We maintain the authors neglect that most of legal reasoning is contextual and that the blanket restriction of healthcare professionals' freedom of conscience is disproportionate. (shrink)

Intimate and medicalized, natural and technological, reproduction poses some of the most challenging ethical dilemmas of our time. This volume brings together scholars from multiple perspectives to address both traditional and novel questions about the rights and responsibilities of human reproducers, their caregivers, and the societies in which they live.

The degree of realism that Duns Scotus understood his formal distinction to have implied is a matter of dispute going back to the fourteenth century. Both modern and medieval commentators alike have seen Scotus's later, Parisian treament of the formal distinction as less realist in the sense that it would deny any extra-mentally separate formalities or realities. This less realist reading depends in large part on a question known to scholars only in the highly corrupt edition of Luke Wadding, where (...) it is printed as the first of the otherwise spurious Quaestiones miscellaneae de formalitatibus. The present study examines this question in detail. Cited by Scotus's contemporaries as the Quaestio logica Scoti, we establish that it was a special disputation held by Scotus at Paris in response to criticisms of his use of the formal distinction in God, identify its known manuscripts, and provide an analysis based upon a corrected text, showing in particular the total unreliability of the Wadding edition. Our analysis shows that the Logica Scoti does not absolutely prohibit an assertion of formalities as correlates of the formal distinction, even in the divine Person, so long as their non-identity is properly qualified. That is, the positing of formalities does not of itself entail an unqualified or absolute distinction. (shrink)

This chapter compares the institutional setting and integrations processes in Switzerland and the EU. The major findings are that EU integration is trying to achieve more political integration and accommodation of a much higher degree of diversity in much less time than has ever been the case in Switzerland. Integration and expansion processes that were slower and non-linear in Switzerland and that happened in separate phases (e.g. religious diversification, linguistic diversification, territorial expansion, etc.) are all going on at the same (...) time in the EU. Especially integration and accession with enormous shocks of diversification are engineered at the same time in the EU. From this point of view, the EU has already tried to go beyond many stages that took centuries to be completed in Switzerland. The institutional design of the European Union seems to echo quite well the federal state formation process in Switzerland. The following precisions are however necessary in the comparative perspective. First, the momentary stage of European Integration, characterized by intergovernmental crisis management, resembles the (dysfunctional) intergovernmental centralism of the Swiss cantons during the decades before the formation of the federal-state in 1848. Second, due to the greater diversity of the European Union, this quasi-federal system has derived in extreme asymmetries between the member states. Since EU identity is not well entrenched among European citizens (and politicians), it has been hard to design institutions and policies of common territorial protection and redistribution and there is mistrust towards centralistic EU institutions (specially in the countries more affected by the economic crisis). Most European citizens do not feel that their interests are taken into account by the European Union. Third, it is important to note that in Swiss federalism the municipalities play an important role, they are much more than just administrative districts. This city-centred and bottom up construct of citizenship is guaranteed by the Swiss federal constitution. Citizens feel that their most immediate and local identity is not jeopardized but rooted in and guaranteed by the Swiss federal constitution. Compared to sub-national Swiss federalism, EU federalism is entirely focused on the nation-state and the EU institutions. Serious consideration ought to be given to the idea that European citizenship is not only about bringing citizenship to a higher European level but also about bringing it more to the root-level of citizenship: the city. Direct democracy has acted as a federator in the Swiss context. Switzerland made direct democracy and direct democracy made Switzerland. There has been a slow and iterative process of adaptation of structurally similar institutions of direct democracy at all levels (communal, cantonal, federal) of all units (all communes, all cantons, confederation roughly between 1830-1891. To the contrary, the EU is only incipiently in a process of introducing direct democracy (in some member-states and ECI), and so far direct democracy is mainly practiced as national plebiscitary democracy. Under this guise it is seen as a threat to EU integration and probably not without good reason. While in Switzerland the coherent introduction of direct democracy at all levels of the polity in the long run served as an important unifier, direct democracy has even not been considered as integrative part of all levels of political integration in the EU. It is of great interest that the one element in which the European Union has based the construction of EU citizenship and identity – mobility of residence – has been implicitly discouraged in Switzerland. The institutional design as incorporated in Swiss multicultural identity (which aims fundamentally at the protection of cantonal autonomy, culture and language) has facilitated that Switzerland is called today a successful multicultural society. Most citizens identify with Switzerland as a country and they like it as it is, but they do not want to take advantage of their formal right to move to other parts of the country, especially not across language borders. The same institutional design that has made of Switzerland a successful case of multiculturalism and democracy poses important barriers that make it difficult for the Swiss to move their residence across their country. Considering that one of the main features of European citizenship is the freedom of movement and residence, this poses a main concern. The Swiss compromise between the formal right and economic necessity of mobility on the one hand and the protection of political and cultural sub-identities on the other hand, is commuting. Due to the vast size, this is of limited applicability in the EU. However, in a Europe of cities and trans-border regions, commuting is an important option provided that every European citizen lives reasonably close to an important economic centre. In short, the Europe of commuters deserves attention in the context of EU citizenship. (shrink)

Of singular importance to the medieval theory of transcendentals was the position of John Duns Scotus that there could be a concept of being univocally common, not only to substance and accidents, but even to God and creatures. Scotus''s doctrine of univocal transcendental concepts violated the accepted view that, owing to its generality, no transcendental notion could be univocal. The major difficulty facing Scotus''s doctrine of univocity was to explain how a real, as opposed to a purely logical, concept could (...) be abstracted from what agreed in nothing real, in this case, God and creatures. The present article examines Scotus''s solution to this difficulty and its interpretation in four of his noted fourteenth-century followers. It is shown that the balance Scotus''s solution achieved between the competing demands of the real diversity between God and creatures, on the one side, and the conceptual unity of transcendental being, on the other, is taken in opposed directions by his interpreters. Either the real diversity of God and creatures is given priority, so that the concept of being becomes a purely logical notion, or the real unity of the concept of being is stressed, so that some sort of real community is posited between God and creatures. By all accounts one of the most influential philosophical contributions of Duns Scotus is his distinction between intuitive cognition, in which a thing is known as present and existing, and abstractive cognition, which abstracts from actual presence and existence. Recent scholarship has focused almost exclusively on the role given intuitive cognition in the justification of contingent propositions and on the debates over certitude which arose from the critiques of Scotus's distinction by Peter Aureoli and William of Ockham.

Thus, a good citizen realizes that he is part of a social and political society. Thus, his personal goodness, and the goodness of his actions contributes to the good of all.
