Recent work has demonstrated how data-driven AI methods can leverage consumer protection by supporting the automated analysis of legal documents. However, a shortcoming of data-driven approaches is poor explainability. We posit that in this domain useful explanations of classifier outcomes can be provided by resorting to legal rationales. We thus consider several configurations of memory-augmented neural networks where rationales are given a special role in the modeling of context knowledge. Our results show that rationales not only contribute to improve the (...) classification accuracy, but are also able to offer meaningful, natural language explanations of otherwise opaque classifier outcomes. Autism provides a model for exploring the nature of self‐consciousness: self‐consciousness requires the ability to reflect on mental states, and autism is a disorder with a specific impairment in the neurocognitive mechanism underlying this ability. Experimental studies of normal and abnormal development suggest that the abilities to attribute mental states to self and to others are closely related. Thus inability to pass standard ‘theory of mind’ tests, which refer to others’ false beliefs, may imply lack of self‐consciousness. Individuals who persistently (...) fail these tests may, in the extreme, be unable to reflect on their intentions or to anticipate their own actions. In contrast, individuals with high‐functioning autism or Asperger syndrome often possess a late‐acquired, explicit theory of mind, which appears to be the result of effortful learning. An experimental study with three people with Asperger syndrome suggested that level of performance on standard theory of mind tasks was strongly related to the ability to engage in introspection. Qualitative differences in the introspections of high‐functioning people with autism are also reflected in autobiographical accounts which may give a glimpse of what it is like to be autistic. The paper investigates the epistemological and communicative competences the experts need to use and communicate evidence in the reasoning process leading to diagnosis. The diagnosis and diagnosis communication are presented as intertwined processes that should be jointly addressed in medical consultations, to empower patients’ compliance in illness management. The paper presents defeasible reasoning as specific to the diagnostic praxis, showing how this type of reasoning threatens effective diagnosis communication and entails that we should understand diagnostic evidence as defeasible as well. It argues that metaphors might be effective communicative devices to let the patients understand the relevant defeasors in the diagnostic reasoning process, helping to improve effective diagnosis communication, and also encouraging a change in patients’ beliefs and attitudes on their own experience of illness and illness’ management. What enables individuals to act together? Recent discoveries suggest that a variety of mechanisms are involved. But something fundamental is yet to be investigated. In joint action, agents represent a collective goal, or so it is often assumed. But how, if at all, are collective goals represented in joint action and how do such representations impact performance? To investigate this question we adapted a bimanual paradigm, the circle-line drawing paradigm, to contrast two agents acting in parallel with two agents performing (...) a joint action. Participants were required to draw lines or circles while observing circles or lines being drawn. The findings indicate that interpersonal motor coupling may occur in joint but not parallel action. This suggests that participants in joint actions can represent collective goals motorically. (shrink)

The development of vaccines against SARS-CoV-2 (COVID-19) presented a unique set of challenges. There was a global need for safe, effective vaccines against a new virus. In response to the development of vaccines for COVID-19 (some of which used novel technologies), there was a proliferation of no-fault compensation schemes (NFCS) for COVID-19 vaccine injuries. We identified 28 national vaccine injury NFCS operating in December 2019. Just 2 years later, over 130 countries had some NFCS coverage for COVID-19 vaccines. This rapid (...) expansion was primarily driven by the creation of three multinational schemes. The COVID-19 Vaccines Global Access (COVAX) scheme covers vaccines given under the COVAX framework in 92 low and middle-income countries across the globe. The African Vaccines Acquisition Trust (AVAT) scheme covers vaccines administered under the AVAT framework in 36 African and Caribbean countries. The UNICEF scheme covers vaccines administered by UNICEF in 18 Asian countries.Because of the sudden expansion of no-fault compensation for vaccine injury, especially in developing economies, more research on the foundations, procedures and outcomes of NFCS is needed. In this article, we examine how these NFCS meet the needs of individual claimants and society more widely. To do so, we first review the rationales offered to support the creation of vaccine injury NFCS. We then argue that, in order to achieve their function as compensation mechanisms, NFCS should be accessible and offer substantive and procedural justice to claimants. Finally, we focus on transparency and accountability as necessary requirements to allow scrutiny over existing NFCS and their wider impacts. (shrink)

Argues that affirming the irreducible differences between men and women can lead to more transformative politics than the struggle for abstract equality between the sexes. In The Symbolic Order of the Mother Luisa Muraro identifies the bond between mother and child as ontologically fundamental to the development of culture and politics, and therefore as key to achieving truly emancipatory political change. Both corporeal development and language acquisition, which are the sources of all thinking, begin in this relationship. However, Western civilization (...) has been defined by men, and Muraro recalls the admiration and envy she felt for the great philosophers as she strove to become one herself, as well as the desire for independence that opposed her to her mother. This conflict between philosophy and culture on the one hand and the relationship with the mother on the other constitutes the root of patriarchy’s symbolic disorder, which blocks women’s (and men’s) access to genuine freedom. Muraro appeals to the feminist practice of gratitude to the mother and the recognition of her authority as a model of unconditional nurture and support that must be restored. This, she argues, is the symbolic order of the mother that must overcome the disorder of patriarchy. The mediating power of the mother tongue constitutes a symbolic order that comes before all others, for both women and men. Most of the existing natural language processing systems for legal texts are developed for the English language. Nevertheless, there are several application domains where multiple versions of the same documents are provided in different languages, especially inside the European Union. One notable example is given by Terms of Service (ToS). In this paper, we compare different approaches to the task of detecting potential unfair clauses in ToS across multiple languages. In particular, after developing an annotated corpus and a machine learning (...) classifier for English, we consider and compare several strategies to extend the system to other languages: building a novel corpus and training a novel machine learning system for each language, from scratch; projecting annotations across documents in different languages, to avoid the creation of novel corpora; translating training documents while keeping the original annotations; translating queries at prediction time and relying on the English system only. An extended experimental evaluation conducted on a large, original dataset indicates that the time-consuming task of re-building a novel annotated corpus for each language can often be avoided with no significant degradation in terms of performance. The paper describes a highly specific Italian action research experience, connected with the trade unions, going through different phases from the 1970s to the present day. The journey is not only a journey through time but also through different approaches. It ranges from the initial experience focusing on health and safety problems at the workplace involving the workers as co-designers of new working environments to today’s search conference experience. For each phase there is a full description and comment on the (...) methods utilised by the research group. The main methodological shift described in the paper is the one from discussion groups, based on Bion’s thinking, to the search conferences, based on Emery’s line of thinking. Both are oriented to the subjectivity of the people involved, although in the discussion group experience the research groups considered the subjectivity of the people involved as the subject of the observation. The researchers’ aim of was to acquire a reliable knowledge of what was at stake and to pass it on to the union that organised the research in order to promote actions. Hence, the action-research circuit is based upon different actors and the process is integrated only from the point of view of the union. In the search conference experience the researchers are involved in a co-design process and so the action-research circuit is really integrated from the researchers’ perspective; there are, of course, multiple perspectives in this case and this opens up epistemological problems that are not discussed in the paper. There are currently serious concerns that published scientific findings often fail to be reproducible, and that some solutions may be gleaned by attending the several methodological and sociological recommendations that could be found in the literature. However, researchers would also arrive at some answers by considering the advice of the philosophy of science, particularly semantics, about theses on truth related to scientific realism. Sometimes scientists understand the correspondence thesis of truth as asserting that the next unique empirical confirmation of a (...) hypothesis suffices to attribute truth to it provisionally. Such empiricist bias is not necessarily at the core of CTT, but Mario Bunge proposed the synthetic thesis of truth, based on CTT, to explicitly avoid the bias. STT requires considering a hypothesis corroborated, both by purely empirical confirmation and external consistency or compatibility with the bulk of existing background knowledge. While a capricious understanding of CTT could be rigged to recommend the “one shot game” in hypothesis testing, STT clearly demands the use of multiple approaches, empirical as well as theoretical, and it asserts that a scientific test is effective to the extent to which it is neither purely empirical, nor viewed in isolation. Pattern consistency together with an understanding of causal relations make confirmed hypotheses robust and more reliable. The militancy of the double mechanism of hypothesis control of STT can help mitigate the reproducibility crisis. Earl Werner’s research program in community ecology is an example of the use of STT criteria, which leads to the development of reliable, cross-checked, ecological results, with high predictive capacity. At Columbia University in 1906, William James gave a highly confrontational speech to the American Philosophical Association (APA). He ignored the technical philosophical questions the audience had gathered to discuss and instead addressed the topic of human energy. Tramping on the rules of academic decorum, James invoked the work of amateurs, read testimonials on the benefits of yoga and alcohol, and concluded by urging his listeners to take up this psychological and physiological problem. What was the goal of this unusual (...) speech? Rather than an oddity, Francesca Bordogna asserts that the APA address was emblematic—it was just one of many gestures that James employed as he plowed through the barriers between academic, popular, and pseudoscience, as well as the newly emergent borders between the study of philosophy, psychology, and the “science of man.” Bordogna reveals that James’s trespassing of boundaries was an essential element of a broader intellectual and social project. By crisscrossing divides, she argues, James imagined a new social configuration of knowledge, a better society, and a new vision of the human self. Machine learning classifiers are increasingly used to inform, or even make, decisions significantly affecting human lives. Fairness concerns have spawned a number of contributions aimed at both identifying and addressing unfairness in algorithmic decision-making. This paper critically discusses the adoption of group-parity criteria (e.g., demographic parity, equality of opportunity, treatment equality) as fairness standards. To this end, we evaluate the use of machine learning methods relative to different steps of the decision-making process: assigning a predictive score, linking a classification to (...) the score, and adopting decisions based on the classification. Throughout our inquiry we use the COMPAS system, complemented by a radical simplification of it (our SAPMOC I and SAPMOC II models), as our running examples. Through these examples, we show how a system that is equally accurate for different groups may fail to comply with group-parity standards, owing to different base rates in the population. We discuss the general properties of the statistics determining the satisfaction of group-parity criteria and levels of accuracy. Using the distinction between scoring, classifying, and deciding, we argue that equalisation of classifications/decisions between groups can be achieved thorough group-dependent thresholding. We discuss contexts in which this approach may be meaningful and useful in pursuing policy objectives. We claim that the implementation of group-parity standards should be left to competent human decision-makers, under appropriate scrutiny, since it involves discretionary value-based political choices. Accordingly, predictive systems should be designed in such a way that relevant policy goals can be transparently implemented. Our paper presents three main contributions: (1) it addresses a complex predictive system through the lens of simplified toy models; (2) it argues for selective policy interventions on the different steps of automated decision-making; (3) it points to the limited significance of statistical notions of fairness to achieve social goals. Metaphor has been considered as a cognitive process, independent of the verbal versus visual mode, through which an unknown conceptual domain is understood in terms of another known conceptual domain. Metaphor might instead be viewed as a cognitive process, dependent on the mode, which leads to genuinely new knowledge via ignorance. First, I argue that there are two main senses of ignorance at stake when we understand a metaphor: we ignore some existing properties of the known domain in the sense (...) that we disregard or neglect them; we ignore some “non-existing” properties of the known domain in the sense that they are not a piece of information belonging to the known domain, but emerge in metaphor interpretation. Secondly, I consider a metaphor as a reasoning device, guiding the interpreters along a path of inferences to a conclusion, which attributes to the target some properties of the source. In this path, interpreters might discover the ignored existing properties of the known domain and/or recover the “non-existing” properties, inferring or imagining the missing piece of information. Finally, I argue that, especially in visual metaphors, this process is guided by a “sentiment of rationality”, tracking a disruption of existing familiar conceptualisations of objects and/or actions and a recovery of ignored properties. The global spread of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) or coronavirus disease 19 (COVID-19) has led to the imposition of severely restrictive measures by governments in the Western hemisphere. We feel a contrast between these measures and our freedom. This contrast, we argue, is a false perception. It only appears to us because we look at the issue through our contemporary moral philosophy of utilitarianism and an understanding of freedom as absence of constraints. Both these views can be (...) substituted with more sophisticated alternatives, namely an ethics of virtue and a notion of freedom of the will. These offer a fuller picture of morality and enable us to cooperate with the current restrictions by consciously choosing to adhere to them instead of perceiving them as draconian and immoral. We ask whether we should collaborate with the restrictions and argue that considerations of virtue will lead to an affirmative answer. More broadly, virtue ethics permits to deal with the practical concerns about how an individual should behave during this pandemic, given the current lockdown measures or lack thereof. -/- In section 1, we present how utilitarianism and a notion of freedom as negative liberty support the opposition to restrictive measures. In section 2, we outline an alternative based on an ethics of virtue and a more elaborated notion of free will. Cryonics—also known as cryopreservation or cryosuspension—is the preservation of legally dead individuals at ultra-low temperatures. Those who undergo this procedure hope that future technology will not only succeed in reviving them, but also cure them of the condition that led to their demise. In this sense, some hope that cryopreservation will allow people to continue living indefinitely. Typical theory of mind tasks assess children’s ability to attribute a false belief in order to predict or explain an action. According to these standard tasks, young children do not represent the independent (mistaken) beliefs of others until the fourth year—yet long before this, children are able to track speakers’ intentions in order to learn new words. Might communication be a privileged domain for theory of mind? In the present study we explored pre‐schoolers’ ability to track a false belief in (...) order to acquire a novel word. A puppet labeled a novel object in a false belief condition (contents of a box had been switched without her knowledge), and a true belief condition (contents switched in her presence). Children were significantly better at tracking the puppet’s false belief in the word‐learning task than in a standard false belief test. Possible reasons for this advantage are discussed, and the suggestion made that representation of mental states may emerge precociously in the service of communication. (shrink)
