Was kann die ‚dritte‘ Geschlechtsoption jenseits von ‚weiblich‘ und ‚männlich‘ bedeuten? Auf der Grundlage der Entscheidung des deutschen Bundesverfassungsgerichts von 2017, welche die explizite Anerkennung einer dritten Geschlechtskategorie ‚divers‘ forderte, diskutiert dieser Beitrag die soziale Funktion von nichtbinären Geschlechtskategorien. Es argumentiert, dass die dritte Option nicht nur ein negativer Begriff ist, der beide traditionellen Geschlechter verneint. Sie muss auch als positive Kategorie (oder als Familie von Kategorien) gedacht werden, welche über eine Identifikation mit der Freiheit von traditionellen Geschlechtsidentitäten und Geschlechternormen (...) gebildet ist. Die Kategorie ‚divers‘ kann deshalb keine einheitliche Identifikationskategorie sein. ‚Divers‘ soll vielmehr selbst als eine in sich diverse Kategorie gedacht werden – als ein offener Möglichkeitsraum. Wie weit kann aber die Diversifizierung der Geschlechtsidentität gehen? Der Beitrag argumentiert für eine kategorielle Pluralität der Geschlechtsanerkennung. Diese Position beinhaltet zwei Aussagen: (a) Die soziale, intersubjektive Geschlechteranerkennung braucht in der Tat Kategorien; eine vollständige Individualisierung von Geschlecht auch in dem Bereich ‚inter‘ ist nicht möglich und wäre auch nicht wünschbar. (b) Gesellschaften sollten es zulassen, dass die Geschlechtermatrix dynamisch erweitert wird, über nur zwei (oder nur drei) Kategorien hinaus. Die Gründe für diese Position werden in drei Schritten erklärt: (i) Die Pluralität von Geschlechtsidentitäten innerhalb des dritten Raumes ist eine soziale Tatsache, die zuerst einmal anerkannt werden muss. (ii) Pluralität innerhalb der dritten Geschlechtskategorie ist ethisch erforderlich, weil andere in sozialen Beziehungen ein Recht darauf haben, darüber anerkannt zu werden, als was sie gesehen werden wollen. Dieses Argument ergibt sich aus einer Rekonstruktion von Emmanuel Lévinas’ phänomenologische Ethik der Intersubjektivität. This article explores Mary Shelley’s Frankenstein as an “object of care” for use in examining the relationship between creativity and responsibility in the sciences and beyond. Through three short sketches from different disciplinary lenses—literature, science and technology studies, and feminist studies—readers get a sense of the different ways scholars might consider Shelley’s text as an object of care. Through an analysis and synthesis of these three sketches, the authors illustrate the value of such an object in thinking about broad cultural (...) issues. The article acts as a kind of boundary object by creating distinct, yet overlapping narratives from an object that is owned by many social worlds. The three sketches reveal Frankenstein as a thoughtful consideration about what it means to care for, or fail to care for, one’s creation, rather than as a cautionary tale about the evils of scientific hubris. Although infrastructures at universities often prevent interdisciplinary dialogue, the article concludes that purposeful boundary objects created around objects of care like Frankenstein can help build bridges and create shared meanings for new interdisciplinary spaces. It is estimated that more than half of all online transactions are abandoned before completion. This paper investigates the psychological factors that influence online shopping behavior, with a view to improving transactional success rates. Through a critical review of the literature, we identify a range of factors which predict abandonment of online shopping, highlighting affective and motivational dimensions in addition to processing style and characteristics of the consumer, device, and product. We conclude that online purchasing and payment systems that boost (...) consumers’ motivation to buy and prevent or attenuate negative affective states will demonstrate the greatest rates of transactional success. However, with rapid advancement in technology, continued research is needed to fully understand the potential impact on future online purchasing behavior. (shrink)

Julia Kristeva attempts to expose the limits of Lacan's theory of language by revealing the semiotic dimension of language that it excludes. She argues that the semiotic potential of language is subversive, and describes the semiotic as a poetic-maternal linguistic practice that disrupts the symbolic, understood as culturally intelligible rule-governed speech. In the course of arguing that the semiotic contests the universality of the Symbolic, Kristeva makes several theoretical moves which end up consolidating the power of the Symbolic and paternal (...) authority generally. She defends a maternal instinct as a pre-discursive biological necessity, thereby naturalizing a specific cultural configuration of maternity. In her use of psychoanalytic theory, she ends up claiming the cultural unintelligibility of lesbianism. Her distinction between the semiotic and the Symbolic operates to foreclose a cultural investigation into the genesis of precisely those feminine principles for which she claims a pre-discursive, naturalistic ontology. Although she claims that the maternal aspects of language are repressed in Symbolic speech and provide a critical possibility of displacing the hegemony of the paternal/symbolic, her very descriptions of the maternal appear to accept rather than contest the inevitable hegemony of the Symbolic. In conclusion, this essay offers a genealogical critique of the maternal discourse in Kristeva and suggests that recourse to the maternal does not constitute a subversive strategy as Kristeva appears to assume. Plotinus’ famous treatise against the Gnostics (33), together with contemporary and thematically related treatises on Intelligible Beauty (31), on Number (34), and on Free Will and the Will of the One (39), can be seen as providing the essential components of a Plotinian defense of polytheism against conceptual moves that, while associated for him primarily with Gnostic sectarians overlapping with Platonic philosophical circles, will become typical of monotheism in its era of hegemony. When Plotinus’ Gnostics ‘contract’ divinity into a single (...) God, they not only devalue the cosmos for its multiplicity and diversity, but also multiply intelligible principles unreasonably. This is because they have foreclosed the distinction, which is to become increasingly explicit in the later antique Platonists, between the intelligible and that which is given existentially, the domain belonging to Plotinus’ indeterminate multiplicity of ‘intelligible Gods’, as opposed to the dialectically determinate number of intelligible principles. Plotinus is prescient in recognizing that incipient monotheism threatens to erase the distinction between philosophy and theology, and between both of these and psychology, the final outcome of which can only be solipsism or nihilism. The defense of polytheism is seen in this fashion to be essential to the preservation of the space for philosophical discourse. (shrink)

We seem to have private privileged access to our own minds through introspection, but what exactly does this involve? Do we somehow literally perceive our own minds, as the common idea of a 'mind's eye' suggests, or are there other processes at work in our ability to know our own minds? Rethinking Introspection offers a new pluralist framework for understanding the nature, scope, and limits of introspection. The book argues that, contrary to common misconceptions, introspection does not consist of a (...) single mechanism but rather a diverse range of mental states and cognitive processes with a broad spectrum of epistemic properties. Building upon this revised conception of introspection, the book illustrates and analyzes the variety of ways in which we introspectively grasp the contents of our own minds, from the immediate phenomenal knowledge generated by conscious experience to the self-deceptive possibilities enabled by certain kinds of inner speech. The essay explores the systematic relationship in the work of Giordano Bruno (1548-1600) between his monadology, his metaphysics as presented in works such as De la causa, principio et uno, the mythopoeic cosmology of Lo spaccio de la bestia trionfante, and practical works like De vinculis in genere. Bruno subverts the conceptual regime of the Aristotelian substantial forms and its accompanying cosmology with a metaphysics of individuality that privileges individual unity (singularity) over formal unity and particulars over substantial forms without (...) sacrificing a metaphysical perspective on the cosmos. The particular is individuated as a unique site of desire, continually transforming but able to entrain itself and others through phantasmatic ‘bonding’, the new source of regularity in Bruno’s polycentric universe. Bruno thus tries to do justice to the demands of intelligibility as well as transformative eros. The essay concludes with a note on Bruno’s geometry as it relates to his general conception of form. Bordo argues that the “theoretics of heterogeneity” taken too far prevents us from being able make generalizations or broadly conceptual statements about women. 1 argue that the political efficacy of feminism does not depend on the capacity to speak from the perspective of “women” and that the insistence on the heterogeneity of the category of women does not imply an opposition to abstraction but rather moves abstract thinking in a self-critical and democratizing direction.

Severe staffing shortages have emerged as a prominent threat to maintaining usual standards of care during the COVID-2019 pandemic. In dire settings of crisis capacity, healthcare systems assume the ethical duty to maximise aggregate population-level benefit of existing resources. To this end, existing plans for rationing mechanical ventilators and intensive care unit beds in crisis capacity focus on selecting individual patients who are most likely to survive and prioritising these patients to receive scarce resources. However, staffing capacity is conceptually different (...) from availability of these types of discrete resources, and the existing strategy of identifying and prioritising patients with the best prognosis cannot be readily adapted to fit this real-world scenario. We propose that two alternative approaches to staffing resource allocation offer a better conceptual fit: (1)prioritise the worst off: restrict access to acute care services and hospital admission for patients at relatively low clinical risk and (2)prioritise staff interventions with high near-term value: universally restrict selected interventions and treatments that require substantial staff time and/or energy but offer minimal near-term patient benefit. These strategies—while potentially resulting in care that deviates from usual standards–support the goal of maximising the aggregate benefit of scarce resources in crisis capacity settings triggered by staffing shortages. This ethical framework offers a foundation to support institutional leaders in developing operationalisable crisis capacity policies that promote fairness and support healthcare workers. (shrink)

In this article I investigate the implications of antirealism, as characterized by Richard Rorty, for First Amendment jurisprudence under the United States Constitution. It is hoped that the implications, while played out in the context of a specific tradition, will have more universal application. In Section 1, Rorty’s ‘pragmatic antirealism’ is briefly outlined. In Section 2, some effects of the elimination of the concept of truth for First Amendment jurisprudence are investigated. Section 3 argues for the conclusion that given the (...) antirealist stance, the Supreme Court’s usage of the true/ false fact distinction is actually an uncritical allowance of viewpoint-based discrimination into speech protection that has potentially far-reaching and restrictive results for important speech. Finally, in Section 4 Rorty’s antirealism is combined with various traditional models of First Amendment analysis to see how it would function. The conclusions aimed at are twofold. First, that Rortian antirealism is compatible with the traditional models underlying First Amendment theory. Second, that a realization that truth is the result of, in Rorty’s words, ‘intra-mundane’ discourse leads to an argument for different and potentially stronger and more farreaching protections to speech. This chapter explores the expressive meaning of stops and frisks, paying special attention to frisks—police touching of people who, in the eyes of the “law,” are innocent. It argues that stops and frisks can be constructed as a form of torture, the effect of which is the assertion of police dominance of the streets. Stops and frisks cause injuries similar to those of illegal forms of tortures, and have the same kinds of “benefits.” Stops and frisks blur the line between (...) regulation and punishment. They are not supposed to be punishment, but they feel that way to their victims. The chapter is organized as follows. It begins by describing the Terry doctrine and its practice in the real world. It then offers a definition of torture, relying on Foucault's influential construct in Discipline and Punish. Next, it attempts to prove that stops and frisks are a form of torture. The final part of the chapter considers the purpose that this torture serves. (shrink)

This article explores how nuclear disaster narratives have both been informed by and articulated collective images of risk and uncertainty since the 1980s. Drawing on ideas from classical and affective narratology that are framed by a perspective informed by the sociology of knowledge, we examine three variations of narrating nuclear disasters in different media: (1) sociologist Charles Perrow’s detailed analysis of the Three Mile Island accident in his popular science book _Normal Accidents_ (1984), (2) Svetlana Alexievich’s _Chernobyl Prayer_ (1997), a (...) literary/journalistic account of the Chernobyl disaster that chronicles individuals’ experiences through eyewitness accounts, and (3) the television series _Chernobyl_ (2019), which, in a docufictional style, combines what is staged as an objective reconstruction of the unfolding of the disaster with subjective memories of those affected while reflecting on the incident’s larger political, scientific, and environmental contexts. We suggest that these three stories of nuclear incidents not only produce specific knowledges about the disaster in question but also address the fragility of knowledge systems and social structures as well as assessments of agency. As such, these narratives function as sites of mitigation that offer their readers/viewers certainty in times of crisis. (shrink)

In this paper, I aim to show that the arguments offered and conclusions at which Rawls aims in his book, The Law of Peoples, are telling as to the intellectual legitimacy of his larger theoretical project. To show this I first investigate how (1) non-liberal peoples fit within the limitations Rawls describes in The Law of Peoples and (2) how liberal peoples would react to such rules. I argue from the answers to these questions to the further conclusion that by (...) spreading the principles and tools of A Theory of Justice and Political Liberalism to the international realm some assumptions implicit in the earlier works come out more clearly. The final section of the paper analyzes some of the implications of the newly exposed assumptions for Rawls's project of liberal justice. (shrink)

Chaim Perelman's article in this volume first set me on the path of human rights ethics. A professor of Rhetoric, he understood the construction of human rights to be the construction of a universal audience, or potential universal audience, for the exercise of freedom of expression.

This volume argues that the Hegel system is not closed, but open to the future. The conclusion is convincing, although it may not have required as arduous an exposition as Hoffmeyer gives it. His prose as well as the usually solid substance of what he says is reminiscent of Hegel’s Logic, whose sections bearing on his conclusion he analyzes closely. One of the interesting aspects of his book is that Hoffmeyer argues against Hegel’s own explicit exposition to establish his conclusion. (...) Hegel, we know, asserts the Logic to be God’s eternal essence before the creation of nature and history as deployed in time. The essence of the absolute is what has been, but precisely for that reason it is a temporal process withdrawn into itself. But this essence is also the power or potential for such process unfurling itself anew and in unforeseen ways. I take this to be the apparent meaning of Hegel, not a revision of him as Hoffmeyer suggests. Newly appearing self-determined attainments manifest ever more fully an essence that has always been. Yet if we reject determinism, there are countless possible past essences of countless possibly different presents. If the absolute essence which has been expresses itself in World War II, it acquires posthumously the property of always having been capable of doing so. The indetermination of the present results in a change of the essential past into the potential for this rather than that. (shrink)

Among the results of recent investigation of epistemic intuitions by experimental philosophers is the finding that epistemic intuitions show cultural variability between subjects of Western, East Asian and Indian Sub-continent origins. In this paper I ask whether the finding of this variation is evidence of cross-cultural variation in the folk-epistemological competences that give rise to these intuitions—in particular whether there is evidence of variation in subjects’ explicit or implicit theories of knowledge. I argue that positing cross-cultural variation in subjects’ implicit (...) theories of knowledge is not the only possible explanation of the intuitions, and I suggest other explanations, including the hypothesis that each subject’s implicit theory of knowledge might contain a heterogeneous set of heuristics for ascribing knowledge. Variation in intuitions, then, might be the result of within-subject heterogeneity rather than across-subject heterogeneity. (shrink)

One of the most talked-about scholarly works of the past fifty years, Judith Butler’s _Gender Trouble_ is as celebrated as it is controversial. Arguing that traditional feminism is wrong to look to a natural, 'essential' notion of the female, or indeed of sex or gender, Butler starts by questioning the category 'woman' and continues in this vein with examinations of 'the masculine' and 'the feminine'. Best known however, but also most often misinterpreted, is Butler's concept of gender (...) as a reiterated social _performance _rather than the expression of a prior reality. Out of all the feminist theorists you both interrogate, she seems to emerge as a kind of touchstone of the feminist ethical, political, and intellectual concerns to which you (...) seem to aspire. Could each of you briefly outline how she figures in your work, whether your relations to her have changed, and if so, how?JB:I think that probably early on, when I started working on French feminism as a graduate student in the early ‘80s, I was not interested in her at all because she seemed to me to be an essentialist and that was a term we used quite easily then, when we thought we knew what it meant. In the late ‘80s, I started to rethink my objections to her on that basis and found that she was, among the feminist theorists I had read, perhaps the most versed in philosophy and that her engagement with philosophy was a curious mixture of both loyalty and aggression. And it became very interesting to me when I started thinking about her whole practice of critical mimesis—what she was doing when she was reading Freud, what was she doing when she was reading Plato—and I read Speculum again and again, frightened by its anger, compelled by the closeness of the reading, confused by the mimetism of the text. Was she enslaved to these texts, was she displacing them radically, was she perhaps in the bind of being in both positions at the same time? And I realized that whatever the feminine was for her, it was not a substance, not a spiritual reality that might be isolated, but it had something to do with this strange practice of reading, one in which she was reading texts that she was not authorized to read, texts from which she was as a woman explicitly excluded or explicitly demeaned, and that she would read them anyway. And then the question is: what would it mean to read from a position of radical deauthorization in order to expose the contingent authority of the text? That struck me as a feminist critical practice, a critical reading practice that I could learn from, and from that point on, highly influenced by both Drucilla’s work and Naomi Schor’s work [see Schor], I started to read her quite thoroughly.PC:Is this kind of relationship that she has with the philosophers she reads a sexual relationship? I am thinking of some of the sexualized terms you just used: loyalty and aggression.JB:Yes, there is no doubt that there is an eros of a certain kind, usually the kind that frightens me, quite frankly. I think Carolyn Burke has made this argument that Irigaray [End Page 19] has a romance with the philosophers [see Burke]. I think she has a certain masochistic-sadistic erotic engagement with the philosophers.EG:Do you think it is sado-masochistic?JB:Well, I think it was much more aggressive in Speculum of the Other Woman than it became in An Ethics of Sexual Difference. There, I think there is an engagement that is still very difficult, but at least there is evidence of a more loving engagement.PC:I hope that we can return to the question of love at the end.
