The “impossibility results” in algorithmic fairness suggest that a predictive model cannot fully meet two common fairness criteria – sufficiency and separation – except under extraordinary circumstances. These findings have sparked a discussion on fairness in algorithms, prompting debates over whether predictive models can avoid unfair discrimination based on protected attributes, such as ethnicity or gender. As shown by Otto Sahlgren, however, the discussion of the impossibility results would gain from importing some of the tools developed in the philosophical literature (...) on feasibility. Utilizing these tools, Sahlgren sketches a cautiously optimistic view of how algorithmic fairness can be made feasible in restricted local decision-making. While we think it is a welcome move to inject the literature on feasibility into the debate on algorithmic fairness, Sahlgren says very little about what are the general gains of bringing in feasibility considerations in theorizing algorithmic fairness. How, more precisely, does it help us make assessments about fairness in algorithmic decision-making? This is what is addressed in this Reply. More specifically, our two-fold argument is that feasibility plays an important but limited role for algorithmic fairness. We end by offering a sketch of a framework, which may be useful for theorizing feasibility in algorithmic fairness. (shrink)

Arlie Hochschild glosses the practice of women migrants in poor nations who leave their families behind for extended periods of time to do carework in other wealthier countries as a “global heart transplant” from poor to wealthy nations. Thus she signals the idea of an injustice between nations and a moral harm for the individuals in the practice. Yet the nature of the harm needs a clear articulation. When we posit a sufficiently nuanced “right to care,” we locate the harm (...) to central relationships of the migrant women. The “right to (give and receive) care” we develop uses a concept of a relational self drawn from an ethics of care. The harm is situated in the broken relationships, which in turn have a serious impact on a person’s sense of equal dignity and self-respect, particularly since the sacrifice of central relationships of the migrant woman allows others (mostly women) to maintain these same relationships. The paper ends with a brief discussion of some of the solutions we need to consider. (shrink)

Ethical problems regularly arise during daily care in nursing homes. These include violation of patients' right to autonomy and to be treated with respect. The aim of this study was to investigate how caregivers emphasize daily dialogue and mutual reflection to reach moral alternatives in daily care. The data were collected by participant observation and interviews with seven caregivers in a Norwegian nursing home. A number of ethical problems linked to 10 patients were disclosed. Moral problems were revealed as the (...) caregivers acted in ways that they knew were against patients' interest. We used a theoretical interpretation according to Habermas' discourse ethics on the importance of dialogue when deciding moral courses of action for patients. This theory has four basic requirements: communicative competence, equality, self-determination, and openness about motives. (shrink)

Student nurses are confronted by many ethical challenges in clinical practice. The aim of the study was to explore Malawian students’ experiences of ethical problems during their clinical placement. A phenomenological hermeneutic design comprising interviews and qualitative content analysis was used. Ten students were interviewed. Three main themes emerged: 1) Conflict between patient rights and the guardians’ presence in the hospital; 2) Conflict between violation of professional values and patient rights caused by unethical behaviour; and 3) Conflict between moral awareness (...) and the ideal course of action. The students had difficulties ensuring patient rights and acting in accordance with western norms and values which are not always appropriate in the Malawian context. The students require role models who demonstrate professional attitudes towards patients’ rights and values. There is a need to create pedagogical strategies in which a caring attitude and ethical reflection can be learned and cultivated in clinical practice. (shrink)

Plato and Aristotle were very much alive between the fifteenth and the seventeenth centuries. The essays in this volume investigate the interaction, both in terms of harmony and contrast, between the two philosophers in early modernity, that is in a time when long-forgotten texts became available and a new philological awareness was on the rise. Dealing with famous and less famous early modern interpreters and philosophers, in a transnational and translinguistic perspective, this volume reveals the agendas behind the discussions on (...) Plato's and Aristotle's philosophies. In studying these texts, it is hard to imagine a more significant collision of big names with big ideas. This project takes us to the centre of the intellectual life of the period and its most exciting debates. (shrink)

The comment starts with a brief exposition of the Eroteric View put forth by Artūrs Logins. I then provide one friendly comment on the exact form of the normative question which is central to the view, and suggest that in addition to the question, ‘Why ought S to φ?’, Logins should take the question, ‘Why is S permitted to φ?’ as definitive of normative reasons. In a more critical comment, I reflect on how normative explanatory reasons and normative reasoning reasons (...) relate, calling into question Logins’s claim that the two kinds of reasons are fundamentally distinct. First, I argue that being a normative explanatory reason near enough guarantees being a normative reasoning reason; second, I argue that normative explanatory reasons as well as normative reasoning reasons can be weighed, and that they can be weighed against each other. In this paper I argue for a theory of punishment I call Multilateral Retributivism. Typically retributive notions of justice are unilateral: focused on one person’s desert. I argue that our notions of desert are multilateral: multiple people are owed when a moral crime is committed. I argue that the purpose of punishment is communication with the end-goal of reconciling the offender to society. This leads me to conclude that the death penalty and life without parole are unjustified because they necessarily (...) cut communication short. (shrink)

In Moral Failure, Lisa Tessman argues against two principles of moral theory, that ought implies can and that normative theory must be action-guiding. Although Tessman provides a trenchant account of how we are thrust into the misfortune of moral failure, often by our very efforts to act morally, and although she shows, through a discussion well-informed by the latest theorizing in ethics, neuroethics, and psychology, how much more moral theory can do than provide action-guiding principles, I argue that the two (...) theses of moral theory that she disputes remain indispensable for ethical theory. Current debates about reasons and reasoning often draw comparisons between epistemic and practical reasons and reasoning and presuppose substantial unity between the practical and epistemic domains. This stance seems to conflict with a stark Humean contrast between the two domains: With respect to practical reasons and reasoning, Hume highlights the role of impressions, especially the passions, in motivating and rationalizing action, while apparently downplaying the potential relevance of beliefs, reason, or reasons. With respect to epistemic reasons and theoretical reasoning, he (...) urges us to proportion our belief to the evidence (EHU 10.4), which suggests a significant epistemic role for evidential reasons. My contribution ar-gues that there is nonetheless a convincing and interesting unified Humean account of reasons and reasoning across both domains. To present my case, I first narrow down the unity claim that I am interested in. I then closely engage with Hume’s claims in epistemology, the philos-ophy of action, and metaethics to develop the unified Humean account. (shrink)

Artificial intelligent (AI) systems used in medicine are often very reliable and accurate, but at the price of their being increasingly opaque. This raises the question whether a system’s opacity undermines the ability of medical doctors to acquire knowledge on the basis of its outputs. We investigate this question by focusing on a case in which a patient’s risk of recurring breast cancer is predicted by an opaque AI system. We argue that, given the system’s opacity, as well as the (...) possibility of malfunctioning AI systems, practitioners’ inability to check the correctness of their outputs, and the high stakes of such cases, the knowledge of medical practitioners is indeed undermined. They are lucky to form true beliefs based on the AI systems’ outputs, and knowledge is incompatible with luck. We supplement this claim with a specific version of the safety condition on knowledge, Safety*. We argue that, relative to the perspective of the medical doctor in our example case, his relevant beliefs could easily be false, and this despite his evidence that the AI system functions reliably. Assuming that Safety* is necessary for knowledge, the practitioner therefore doesn’t know. We address three objections to our proposal before turning to practical suggestions for improving the epistemic situation of medical doctors. (shrink)

I present two of Jacob Klein’s chief discoveries from a perspective of peculiar fascination to me: the enchanting (to me) contemporaneous significance, the astounding prescience, and hence longevity, of his insights. The first insight takes off from an understanding of the lowest segment of the so-called DividedLine in Plato’s Republic. In this lowest segment are located the deficient beings called reflections, shadows, and images, and a type of apprehension associatedwith them called by Klein “image-recognition” (εἰκασία). The second discovery involves a (...) great complex of notions from which I will extract one main element:the analysis of what it means to be a number and what makes possible this kind of being, and, it turns out, all Being. Richard Popkin’s seminal study on the revival of skepticism from the late Renaissance onwards gave a prominent role to Pyrrhonism, rediscovered through the translation of Sextus Empiricus’s writings into Latin and their usage in Michel de Montaigne’s Essais, among other works. Maia Neto’s new book aims to reassess this interpretation, claiming that Montaigne’s disciple, Pierre Charron, in his La sagesse, displayed a distinctively Academic skeptical wisdom that became central in the philosophical debate of the period. Code Choice and Face This paper starts by presenting the factors that govern language choices among multilinguals, to show then that they can be seen as the result of face considerations:1) "Natural" or "efficient" language choice: choosing the language for which the product of the competences of both partners is highest. This maximizes the negative face, i.e. the freedom of action, of both partners.2) Language practice: choosing a language not because it is the easiest one but because one wishes to (...) practice it. This means reducing one's positive and negative face for the moment in order to increase them in the long run.3) Prestige or its opposite, fear of losing face by making mistakes. This is clearly the positive face aspect of language choices.4) And finally, compliance: adapting to the language preferences of one's partner by speaking either his mother tongue, or a language s/he has a preference for. This means reducing one's own negative face in order to increase the one of the partner. Which in turn will contribute to the positive face of both partners, one feeling important because s/he is being complied with, and the other getting the image of a kind and polite person. (shrink)

The editors present the essays that are collected in the volume and which are the outcome of talks given at the international conference “Kurt Gödel Philosopher: From Logic to Cosmology” that was held in Aix en Provence (France) in summer 2013. Many of the authors belong to a group of scientists who have contributed to an ANR project with the same title under the direction of Gabriella Crocco.

This article brings recent insights from political animal philosophy and critical animal studies concerning animal subjectivity and multispecies communities into conversation with Daoist philosophy. Daoism is currently underexplored in animal philosophy and multispecies justice theory. This is unfortunate since Daoist ontology and Daoist concepts such as wanwu (萬物) and wuwei (無為) include recognition of nonhuman agency and multispecies entanglements. They offer a fruitful starting point for rethinking the position of the human in the whole of things as well as relations (...) between human and nonhuman animals. (shrink)

Does the critical discourse about resilience reiterate the problematic dichotomy between suffering and agency that the concept of resilience inscribes? In this discussion piece, I engage with Brad Evans’ and Julian Reid’s reflections on resilience. Although I share with Evans and Reid a normative critique of resilience, I am critical of their discussion of vulnerability. Rather than arguing that vulnerability precludes political transformation, as Evans and Reid do, or that vulnerability enables political coalition, as in Judith Butler’s account of precarity, (...) one should ask: how is vulnerability framed? I argue for framing vulnerability through a critical theory of the victim which explores the interconnections between injurability and agency rather than treating them as oppositional terms. Eva Simantoni-Bournia Un masque humain à Hyria de Naxos, nouveau témoignage de contacts chypriotes p. 119-132 Neuf tessons d'un masque en terre cuite représentant une figure masculine barbue presque grandeur nature, datés de la fin du VIIIe - début du VIIe siècle av. J.-C., ont été découverts en 1994 dans le sanctuaire d'Hyria à Naxos. Ce masque naxien doit son importance à la rareté de ce type d'objets, surtout à haute époque. Les masques en terre cuite du sanctuaire d'Orthia à (...) Sparte, les plus connus et les plus étonnants du monde grec, sont presque tous plus récents et la plupart relève d'une tradition stylistique différente. Les masques en terre cuite du Chypro-Géométrique I mis au jour dans les sanctuaires de Kition et de Salamine à Chypre constituent les parallèles les plus proches de l'exemplaire d'Hyria. Cet article propose que le masque barbu idéalisé d'Hyria était porté, lors d'une sorte de représentation (δρώμενον), par celui qui jouait le rôle de l'époux de la déesse de la fécondité vénérée avec Dionysos dans le grand sanctuaire naxien et identifiée à Ariane. La représentation — fréquente dans le culte de Dionysos — d'une sorte d'union rituelle dans les pratiques cultuelles d'Hyria est vraisemblable. Les contacts chypriotes, confirmés par notre masque, étayent le rapprochement de l'Ariane naxienne avec la grande déesse chypro-orientale, que nous avons proposé jadis sur la base des trouvailles du sanctuaire et à partir des témoignages littéraires. The Yugoslav wars of secession in the 1990s left traces of the past among the societies living in the successor states. Those traces can be found within the collective memory of these societies, and are transmitted through various communication channels to the next generation. Today, this post-war and post-Yugoslav generation, born during or shortly after the violent conflicts, are young adults dealing with the recent past. Based on findings from life-story interviews that are examined and interpreted using the approach of (...) sequence analysis, I elaborated a model of the transregional post-Yugoslavs’ communication system regarding the wars. I identified three communication practices on war-related topics by actively reflecting on the “Other,” which I present in this paper. During their adolescent years, post-Yugoslavs created their own narratives, and thus their own, authentic communication strategies in response to the “invisible war,” which still continues today, according to the post-Yugoslav generation. This chapter provides an overview of the structure and purpose of the book. It introduces the philosophical context and motivations of the debate between conceptualism and nonconceptualism. The book is a defense of the nonconceptualist claim that experience is nonconceptual and has nonconceptual content. In particular, it defends what I call ‘Modest Nonconceptualism,’ which is briefly introduced in this chapter. On this view, all perceptual experiences are at least partly nonconceptual, i.e., involve the exercise of at least some concepts. It (...) involves an argument that enables the Modest Nonconceptualist to bridge the gap between the state view and the content view of nonconceptualism. ‘Concept’ talk is taken to be anchored in conceptual abilities that the subject possesses and exercises. Nonconceptual perceptual content is taken to consist in scenario content (see Peacocke, A study of concepts. MIT, Cambridge, 1992), which is both nonconceptual and non-propositional; externally conceived, the content of an experience consists in the worldly states of affairs it represents. The latter content is needed for the Modest Nonconceptualist’s account of perceptual justification. The view claims that the Autonomy Thesis is correct: A perceiver’s experiences may have nonconceptual content even if she possesses no concepts whatsoever. The Modest Nonconceptualist account of the representational content of perceptual experience is based on the subpersonal-level organization of the underlying representational states. (shrink)

Zusammenfassung Die sekundäre Forschungsnutzung von Behandlungsdaten hat Potenzial, medizinisches Wissen zu erweitern und die Patientenbehandlung zu verbessern. Für eine systematische sekundäre Forschungsnutzung spielen Krankenhäuser eine wichtige Rolle: sie erzeugen große Mengen an Behandlungsdaten und müssen für deren Forschungsnutzung die notwendigen Strukturen aufbauen. Damit stellt sich die ethische Frage: Haben Krankenhäuser eine moralische Pflicht, sekundäre Forschungsnutzung von Behandlungsdaten zu unterstützen, indem sie dafür notwendige Ressourcen und Infrastrukturen aufbauen und betreiben? Ziel ist es, eine konzeptionelle Herangehensweise zur Erörterung dieser Frage zu skizzieren (...) und eine erste normative Positionierung vorzuschlagen. Auf Beiträge aus der Wirtschafts- und Organisationsethik zurückgreifend, erarbeiten wir einen begrifflichen Rahmen, der Krankenhäuser als moralische Akteure versteht. Die normativ-ethische Analyse basiert auf einem rekonstruktiven Stakeholder-Ansatz, in dessen Rahmen wir folgende Pflichten von Krankenhäusern ausmachen: Orientierung am Patientenwohl, Kosteneffizienz, Ermöglichung von professionellem Handeln, Unterstützung von öffentlicher Gesundheit, Förderung von Forschung. Es wird untersucht, ob diese allgemeinen Pflichten Gründe für eine spezielle Pflicht von Krankenhäusern darstellen, sekundäre Forschungsnutzung von Behandlungsdaten zu unterstützen. Mögliche Einwände gegen eine solche Pflicht, welche sich u. a. aus anderen, potenziell konfligierenden allgemeinen Pflichten der Krankenhäuser (z. B. Datenschutz), aus der Praxis (z. B. Aufwände) oder eventuellen Ansprüchen (Dateneigentum) ergeben, werden diskutiert. Bestimmte allgemeine Pflichten (Orientierung am Patientenwohl, Kosteneffizienz, Unterstützung öffentlicher Gesundheit) begründen eine Pflicht von Krankenhäusern, sekundäre Forschungsnutzung von Behandlungsdaten zu unterstützen. Die Pflicht zur Ermöglichung professionellen Handelns ist nur ein indirekter Grund; die Pflicht zur Forschungsunterstützung trifft nur auf Universitätskliniken zu. Mögliche Einwände haben teilweise Gewicht, können aber durch gezielte Maßnahmen eingedämmt werden. (shrink)

As occupational health management (OHM) and work health promotion (WHP) become increasingly prominent in companies worldwide, little is known about consumers' attitudes towards work health‐related issues. Do consumers consider the health of employees in German companies to be important? Do German companies consider consumers to be relevant stakeholders in voluntary occupational health (OH) and well‐being activities? In the first of two qualitative interview studies, German consumers were asked which actors they consider to be responsible in OH contexts and whether or (...) not they prefer OH‐related product attributes to other socially desirable ones. During a second qualitative interview study with representatives from German companies, suppliers, institutions, and organizations concerned with voluntary and legally mandatory OH, participants were asked about their expectations regarding whether or not consumers are interested in such OH activities. Both studies highlight the difference between the consumers' perspective on OH issues and responsibilities on the one hand and what companies and stakeholders believe consumers think about OH issues and responsibilities on the other. The findings show that consumers can recognize non‐mandatory OH and well‐being activities as elements of their own social responsibility (ConSR), while companies usually do not consider this perspective in their corporate social responsibility (CSR).
