Diez años desde la entrada en vigor de la Ley Orgánica 5/2000, de 12 de enero, de la Responsabilidad Penal de los Menores han servido para mucho. Desde que se optó por legislar los ilícitos penales cometidos por aquellos menores con edades comprendidas entre los 14 y los 18 años, muchas y variadas son las certezas e incertidumbres que, al respecto de un tema tan complejo y tortuoso, han visto la luz en nuestro entramado social.

Neste artigo nos apoiamos em testemunhos diversos de Francis Bacon a respeito da relação entre sua filosofia e o ceticismo filosófico para estender o exame desse ponto ao âmbito de sua ?Doutrina dos Ídolos?. Pretendemos mostrar que, se por um lado as semelhanças revelam-se aí significativas , pode-se também observar, de outra parte, que já nessa Doutrina Bacon prepara uma via diversa da que atribui aos céticos, tanto em vista do modo como compreende a noção de natureza humana, como do (...) encadeamento metódico a que ele submete o material que toma dos céticos. The body of Eva in Thomas Aquinas The constitution of the first female body or the body of Eva presents several physical and metaphysical problems, problems that have gone through the centuries and reach the present, generating social and cultural consequences for women. The non-existence of parents demands from Aquino answers that go beyond the anthropological and biological and lead to the search of philosophical answers intertwined with the theological ones. Thomas Aquinas provides rational answers although the background is of (...) faith, and even, with literal interpretations of the Sacred Scriptures now abandoned. The Aquinate makes an intellectual effort to find answers in a rational field because the matter of the body of the first woman brings difficulties for its elucidation and understanding. As in other parts of his extensive work, Thomas Aquinas, follows the biological and physical works of Aristotle. Although the Aristotelian background is in line with Christian thought, Aquinas shows his extraordinary capacity for synthesis between the faith received and reason argued, between revelation and the principles of reason. La Suma Teológica de Santo Tomás permite categorizar términos tecnológicos y establecer ontologías en clave filosófica. Con esta metodología de la Suma se va a estudiar aquí el término “metaverso” y sus implicaciones éticas. There is considerable support for the idea that an atmosphere of safety can foster learning in groups, especially during ethics training courses. However, the question how safety dynamics works during ethics courses is still understudied. This article aims to investigate safety dynamics by examining a critical incident during a military ethics train-the trainer course during which safety was threatened. We examine this incident by means of a four-factor analysis model from the field of Theme-Centered Interaction (TCI). We show that during (...) ethics training courses a safety paradox can occur, involving a tension between honesty and openness to other perspectives and values. There is increasing interest in determining what impact having women in management positions may have on corporate social responsibility initiatives. Various authors suggest that gender equality practices should be factored into the broader framework of CSR. This paper examines how the presence of women on corporate boards, in top and middle management and as heads of CSR departments, influences gender equality practices in the field of CSR. Using information collected from companies that have signed up to Women's Empowerment Principles in (...) Spain, we show that the presence of women in the aforesaid posts has a positive impact on CSR activities with gender equality objectives. We thus supplement the justice, business and moral arguments with further arguments in support of the incorporation of women into not only corporate boards but all management positions. Finally, we provide a view of how gender equality can be included in the broader framework of CSR. (shrink)

La Universidad de París en la Europa de finales del siglo XIII fue centro de acaloradas discusiones acerca del alma del hombre. La cuestión del alma es el punto doctrinal central y se muestra decisivo porque en la resolución de este único punto puede verse el trasfondo antropológico y metafísico de toda una cosmovisión filosófica e incluso teológica del universo. Una de las más problemáticas cuestiones que se plantearon acerca del alma es el problema de la unidad del intelecto para (...) todos los hombres. Parecería contradictorio pensar que todos los hombres piensan con un único intelecto, pero a su vez suena absurdo afirmar que un principio espiritual, inmaterial, se una a un cuerpo por un tiempo determinado para luego separarse. O presente artigo visa demonstrar que os fins da política podem ser considerados como fins transpolíticos na medida em estão imbricados com o fim último do homem. O pensamento político de Tomás de Aquino (1225-1274) está exposto na sua filosofia prática ou moral, por exemplo, nas suas questões sobre as virtudes, de um modo especial quando trata da prudência e da justiça, bem como nas discussões sobre as formas de governo, as leis, o bem comum e o direito. Santo Tomás, (...) de certa forma, retoma as ideias de Aristóteles, todavia, trata da civitas ou melhor do regnum christiano, e não da polis grega. Os fins principais da política são: o bem comum, a vida virtuosa dos cidadãos e a felicidade (beatitude) na fruição divina. Demonstrar-se-á que o fim último do homem é um só, sendo os demais antecedentes ou meios para alcançar aquilo que todos desejam: a felicidade. Sem desconsiderar as diversas obras em que o autor trata de temas políticos, contudo, este artigo abordará as ideias da obra De regno. (shrink)

On 11 September 2019, the verdict was read in the first prosecution of a doctor for euthanasia since the Termination of Life on Request and Assisted Suicide (Review Procedures) Act of 2002 was installed in the Netherlands. The case concerned euthanasia on the basis of an advance euthanasia directive (AED) for a patient with severe dementia. In this paper we describe the review process for euthanasia cases in the Netherlands. Then we describe the case in detail, the judgement of the (...) Regional Review Committees for Termination of Life on Request and Euthanasia (RTE) and the judgement of the medical disciplinary court. Both the review committees and the disciplinary court came to the conclusion there were concerns with this case, which mainly hinged on the wording of the AED. They also addressed the lack of communication with the patient, the absence of oral confirmation of the wish to die and the fact that the euthanasia was performed without the patient being aware of this. However, the doctor was acquitted by the criminal court as the court found she had in fact met all due care criteria laid down in the act. We then describe what this judgement means for euthanasia in the Netherlands. It clarifies the power and reach of AEDs, it allows taking conversations with physicians and the testimony of the family into account when interpreting the AED. However, as a practical consequence the prosecution of this physician has led to fear among doctors about prosecution after euthanasia. (shrink)

With the increasing adoption of artificial intelligence (AI) technologies in the news industry, media organizations have begun publishing guidelines that aim to promote the responsible, ethical, and unbiased implementation of AI-based technologies. These guidelines are expected to serve journalists and media workers by establishing best practices and a framework that helps them navigate ever-evolving AI tools. Drawing on institutional theory and digital inequality concepts, this study analyzes 37 AI guidelines for media purposes in 17 countries. Our analysis reveals key thematic (...) areas, such as transparency, accountability, fairness, privacy, and the preservation of journalistic values. Results highlight shared principles and best practices that emerge from these guidelines, including the importance of human oversight, explainability of AI systems, disclosure of automated content, and protection of user data. However, the geographical distribution of these guidelines, highlighting the dominance of Western nations, particularly North America and Europe, can further ongoing concerns about power asymmetries in AI adoption and consequently isomorphism outside these regions. Our results may serve as a resource for news organizations, policymakers, and stakeholders looking to navigate the complex AI development toward creating a more inclusive and equitable digital future for the media industry worldwide. From past research it is well known that social exclusion has detrimental consequences for mental health. To deal with these adverse effects, socially excluded individuals frequently turn to other humans for emotional support. While chatbots can elicit social and emotional responses on the part of the human interlocutor, their effectiveness in the context of social exclusion has not been investigated. In the present study, we examined whether an empathic chatbot can serve as a buffer against the adverse effects of social (...) ostracism. After experiencing exclusion on social media, participants were randomly assigned to either talk with an empathetic chatbot about it (e.g., “I'm sorry that this happened to you”) or a control condition where their responses were merely acknowledged (e.g., “Thank you for your feedback”). Replicating previous research, results revealed that experiences of social exclusion dampened the mood of participants. Interacting with an empathetic chatbot, however, appeared to have a mitigating impact. In particular, participants in the chatbot intervention condition reported higher mood than those in the control condition. Theoretical, methodological, and practical implications, as well as directions for future research are discussed. (shrink)

The forceful impact of Michel Foucault’s work in the humanities and social sciences is apparent from the sheer abundance of its uses, appropriations, and refigurations. This article calls for greater self-conscious reflexivity about the relationship between our uses of Foucault and the opportunities afforded by his work. We argue for a clearer distinction between analytics and concepts in Foucault-inspired work. In so doing we draw on key moments of methodological self-reflection in Foucault’s Collège de France lectures and elsewhere. This distinction (...) helps identify different ways that Foucault might be put to productive use today as well as what can go wrong therein, a concern we develop with reference to Giorgio Agamben’s post-Foucaultian contributions to political theory. We are eager to open up a possibility that has been infrequently explored despite Foucault’s contemporary influence—-the idea that critique in and through Foucault is empirical critique. This idea can help facilitate a gain in reflexivity in the broader landscapes of contemporary theory, inquiry, and critique. (shrink)

La afectividad humana es compleja y muchas veces se ha cometido el error de considerarla como desligada de otras facultades, especialmente de la inteligencia, como si fueran actos completamente separados e independientes. Las manifestaciones afectivas son de diverso grado, ya en mi tesis doctoral mostré la conveniencia de hablar al menos de tres dimensiones afectivas, cada una de ellas según su relación más o menos directa con las facultades superiores y con la persistencia de su presencia a lo largo de (...) nuestra vida. -/- La primera dimensión trataría de los afectos inferiores, más conocidos como pasiones o emociones. Su característica principal consiste en ser intensas, pasajeras y causar inmutaciones corporales en nosotros. La segunda trata de los afectos intermedios, donde intervienen más directamente tanto la voluntad como la inteligencia. Son más continuos y estables en el tiempo, y suelen presentar aspectos positivos o negativos desde un punto de vista ético; son los sentimientos. Así, la amistad es un sentimiento, pero también lo son los celos o el rencor. Finalmente, la tercera dimensión afectiva está dada por los afectos superiores del hombre, son los que se encuentran tan radicalmente asentados en nosotros que, de alguna manera, indican nuestra forma de ser y ordenan y desordenan los afectos de niveles inferiores. Aquí estaríamos hablando, por ejemplo, del amor espiritual, aquél que lleva a dar la vida por algo alguien. Y también de la desesperación que impulsa al hombre a la sensación de vacío existencial que cierra su horizonte y muchas veces lo lleva por la senda de la depresión psicológica. -/- En este estudio nos centramos en los afectos de la primera dimensión: los afectos inferiores. BackgroundNormality is both a descriptive and a normative concept. Undoubtedly, the normal often operates normatively as an exclusionary tool of cultural authority. While it has prominently found its way into the field of medicine, it remains rather unclear in what sense it is used. Thus, our study sought to elucidate people’s understanding of normality in medicine and to identify concepts that are linked to it.MethodsUsing convenient sampling, we carried out a cross-sectional survey. Since the survey was advertised through social media, (...) we employed an online survey. We performed descriptive and inferential analyses. Predictors were chosen in a theory-driven manner.ResultsIn total, 323 persons from 21 countries completed the survey. Analysis revealed that the overall acceptance of normality in medicine was associated with notions of injustice, authority, discrimination, and with having a medical profession. More precisely, for the field of mental health, injustice insensitivity, genderism and transphobia, and authority were positively associated with a person’s acceptance of normality; and, for the field of physical health, injustice insensitivity and having a medical profession were positively associated with a person’s acceptance of normality. Finally, participants’ acceptance of the use of normality in the area of mental health was lower than in the area of physical health.ConclusionsWhat is considered normal has implications for clinical practice, both at an individual and at a policy-level. Acknowledging its normalistic condition, the discipline of medicine has to confront itself with its own contribution to the augmentation of social inequalities through the excessive reliance on the concept of normality. Research that centers the lived experiences of those who are being systematically marginalized because they are deemed abnormal is needed. By empirically elucidating the conceptual relationships between normality in medicine and other variables, we provide points of leverage to deprive normality of its normative power. La relación entre veracidad y “verdad de la vida” abre una perspectiva interesante que puede prestarse (...) al diálogo con los filósofos contemporáneos sobre el tema de la autenticidad.The expression veritas vitae or “truth of life” means, in the writings of Thomas Aquinas, the realization of each person’s life according to the plan of the Creator. A study of the texts shows that the syntagma veritas vitae belongs to the so-called “ three-fold truth” and is of a deeper kind than the virtue of truthfulness. For contemporary philosophers, the relationship between truthfulness and “truth of life” opens up an avenue for dialogue regarding the topic of authenticity. (shrink)

This study focuses on the application of multicriteria decision-making techniques, specifically the analytic hierarchy process (AHP), to identify corporate socialresponsibility information which both companies and stakeholders consider relevant and material. This work explains how the AHP methodology was applied in the selection of material indicators in corporate social responsibility reporting, the interpretation of these indicators and their relative importance. The results of this study are summarized in 60 indicators distributed in four areas: environment, economy, corporate governance and social. ObjectiveLoss of control eating has been directly related to the core aspects of the psychopathology of eating disorders and to different dimensions of emotion and behavior regulation and self-criticism. This study investigates a model representing the interplay between these dimensions to understand LOC eating among a nonclinical sample.MethodsA total of 341 participants, recruited in a college campus, completed a set of self-report measures assessing LOC eating, weight suppression, psychopathology of eating disorders, depression, negative urgency, emotion regulation difficulties, and self-criticism. Path (...) analysis modeling tested a hypothesized model with 3 paths for LOC eating as follows: psychopathology of eating disorders; emotion and behavior regulation; and interplay between these paths.ResultsWe found goodness-of-fit indexes to our data: χ2 = 17.11, df = 10, Comparative Fit Index = 0.99, Tucker-Lewis index = 0.98, Root Mean Square Error Approximation = 0.045, Standardized Root Mean Square Residual = 0.041, suggesting that: participants with higher weight suppression showed higher degrees of the psychopathology of eating disorders, which was linked to higher levels of LOC eating; self-criticism was a mediator between emotion regulation and depression/negative urgency; self-criticism was a mediator between emotion regulation and disorder eating, which was significantly associated with LOC eating via increased negative urgency.ConclusionOur model shows that LOC eating occurs for individuals with the psychopathology of higher eating disorders who experience depressive symptoms and act rashly under distress for their inability to cope adequately with negative feelings of self-devaluation. These findings point to the importance of negative self-evaluations and feelings of inadequacy or worthlessness to understand LOC eating among college students. (shrink)

Uma análise sobre as obras De Magistro de Santo Agostinho e Tomás de Aquino Resumo: O presente artigo tem como objetivo investigar nas obras De Magistro de Santo Agostinho e Tomás de Aquino a possibilidade do ensino através da figura do mestre e/ou de um agente externo ao discípulo ou indivíduo. Agostinho defende a tese da qual só Deus ensina e a figura do mestre torna-se apenas como um auxiliador no processo de (...) aprendizagem para a verdade interior do discípulo, tese essa formulada através da sua Teoria da Iluminação. Tomás de Aquino não contradiz completamente Agostinho, mas defende o papel e a importância do mestre sobre o tipo de conhecimento que o mesmo pode fornecer ao discípulo, tendo papel substancial para o processo de aprendizagem para adquirir conhecimento. Ambos se preocupam em que medida o mestre pode ensinar, o que ensina e como ensina, visando compreender como se dá o processo de conhecimento do ser humano o relacionando-o com a verdade das coisas. An analysis of the works De Magistro of Saint Augustine and Thomas Aquinas Abstract: This article aims to investigate in the works De Magistro of Saint Augustine and Thomas Aquinas the possibility of teaching through the figure of the master and / or an external agent to the disciple or individual. Augustine defends the thesis that only God teaches and the figure of the master becomes only as a helper in the learning process for the disciple's inner truth, a thesis formulated through his Theory of Enlightenment. Thomas Aquinas does not completely contradict Augustine, but he defends the role and the importance of the master on the type of knowledge that he can provide to the disciple, having a substantial role in the learning process to acquire knowledge. Both are concerned with the extent to which the master can teach, what he teaches and how he teaches with a view to understanding how the human being's knowledge process takes place, relating it to the truth of things. This study provides insight into the experiences of young adults born with variations of sex characteristics to identify aspects of care and social support that need improvement. Semi-structured interviews with intersex youths in Switzerland were analyzed using interpretative, phenomenological analysis. Young adults desire timely, patient-centered information about their diagnoses. Peer support is key to delivering high-quality care but rarely systematically implemented. Intersex youth often face misrepresentation, stigma, and discrimination in medical settings and in society. Increased visibility alone cannot tackle these (...) issues, but a feminist curiosity of care will enable health providers and society to overcome preconceptions of body normativity. (shrink)

Der vorliegende Band enthält eine Sammlung von Beiträgen zum Problem der Wechselwirkung zwischen Geist und Materie, einem der zentralen Probleme europäischer Geistesgeschichte. Die Blickwinkel, die dabei eingenommen werden, sind vorrangig die der Physik und der Psychologie. Die Wechselwirkung dieser Gebiete wird so deutlich wie nie zuvor im Dialog zwischen zwei Forscherpersön lichkeiten dieses Jahrhunderts sichtbar: dem Physiker Wolfgang Pauli (1900- 1958) und dem Psychologen Carl Gustav Jung (1875-1961). In zahlreichen Brie fen und Manuskripten Paulis, die erst in den letzten Jahren (...) allgemein zugänglich wurden, finden sich bemerkenswerte und wichtige Beiträge zu diesem Dialog, die das Verständnis des Zusammenhanges von Geist und Materie in einem neuen Licht erscheinen lassen. Um den durch Pauli und Jung begonnenen Dialog fortzusetzen und weiter fruchtbar zu machen, ist das interdisziplinäre Gespräch zwischen Physikern und Psychologen nötig. Diesem Zweck diente eine von der Eidgenössischen Techni sehen Hochschule Zürich (der Hochschule, an der Pauli tätig war) und dem C.G.Jung-Institut Zürich (das Jung gegründet hat) gemeinsam veranstaltete Tagung im Centro Stefano Franscini (Monte Verita, Ascona) vom 13. bis 18. Juni 1993. Sie stand unter dem Thema Das Irrationale in den Naturwissenschaften: Wolf gang Paulis Begegnung mit dem Geist der Materie und wurde von Pier Luigi Luisi initiiert und organisiert. Als Berater fungierten Paul Brutsehe, Hans Primas und Eva Wertenschlag-Birkhäuser. Berichte und Kommentare zu dieser Tagung wurden in Heft 4/1993 der Zeitschrift Gaia veröffentlicht. (shrink)

The aim of the study is to rethink the ethics of advanced motherhood. In the literature, delayed childbearing is usually discussed in the context of reproductive justice, and in relationship to ethical issues associated with the use and risk of assisted reproductive technologies. We aim to go beyond these more “traditional” ways in which reproductive ethics is framed by revisiting ethics itself through the lens of the figure of the so-called “older” mother. For this purpose, we start by exploring some (...) of the deep seated socio-cultural discourses in the context of procreation: ageism, ableism and the widespread bias towards geneticism and pronatalism. Afterwards, we provide a critical overview of the key arguments against or in support of advanced motherhood. We then briefly discuss how entrenchment by both sides has produced an impasse in the debate on the ethics of advanced motherhood and proceed by arguing that it is fundamental to bring about a change in this narrative. For this purpose, we will revisit the feminist usage of the concept of vulnerability which will allow us both to criticize culturally prescribed norms about motherhood and to address the painful reality of age-related fertility decline. In the last section, we argue that instead of defining “older” motherhood as an ethical problem, we should problematize the fact that female reproductive ageing is an understudied and ill-sourced topic. We believe that allocating resources to research to better understand female reproductive ageing is not only ethically permissible, but might even be ethically desirable. (shrink)

Durante siglos lo que era un hecho que daba consistencia a la vida humana –cuidar– ha parecido ser sistemáticamente descatalogado y descargado de todo rango y categoría ética. La profusa presencia del cuidado en las fuentes griegas de la antigüedad desde la palabra epiméleia nos ha obligado a profundizar en los sentidos que la cura latina posee en la obra de Santo Tomás dada la preeminencia de esta para la teología moral posterior vinculada a la d– en el catálogo de (...) las virtudes junto con la misericordia, la beneficencia y la limosna que hacen operativa la caridad. El cuidar en su realización del amor irá más allá de socorrer las necesidades cuya forma verbal subvenio oscureció la cura y su sentido de atención, preocupación y ocupación activa por el prójimo.For centuries, what gave consistency to human life –to take care of- has seemed to be systematically discontinued and discharged of all rank and its ethical category. The abundant presence of care in the Greek sources of antiquity since the word epimeleia, has forced us to go deeper into the different meanings that the Latin word cura has in St Thomas’ work, given its prominence in a subsequent moral theology linked to charity. This requires a careful review of care as a virtue - to give it the majority of age- in the catalog of virtues together with mercy, beneficence and alms that make charity operational. Caring, in their realization of love, will go beyond needs help whose verbal form subvenio obscured its meaning of attention, concern and active occupation for the neighbor. (shrink)

Con estas palabras se inicia una relación educativa entre Virgilio y Dante que manifiesta de manera concreta una visión sobre el maestro de permanente validez y actualidad. El viaje de Dante permite descubrir en la Divina Comedia la existencia de unos principios universales que fundamentan la acción del maestro. No obstante, dichos principios no son del todo originales, sino que permiten evidenciar la influencia que Tomás de Aquino ha ejercido en Dante. El Aquinate (...) no solo es mencionado en el Paraíso en los cantos X al XIV, sino que los principios pedagógicos tomistas, especialmente los contenidos en la Suma de Teología, informan la relación concreta entre los dos poetas. En este estudio intentaremos explicitar la visión del maestro propuesta por Dante, a la vez que se buscará mostrar que Tomás de Aquino es la fuente principal de la que Dante se nutre para labrar esa específica relación entre maestro y discípulo. Analizar la suficiencia y pertinencia de las muestras en tesis de maestría es el objetivo del artículo, resultado de un estudio descriptivo con enfoque documental, cuya población fueron tesis de maestría en acreditación de la calidad educativa de cuatro Universidades de Lima, 2020-2022. Se recurrió a la observación para el recojo de datos, encontrándose como resultados que en las tesis realizadas mayormente con enfoque cuantitativo no es frecuente observar muestras adecuadas ni representativas, al no ofrecer una justificación lógica ni metodológica (...) sobre cómo se determinó el tamaño muestral y el uso de técnicas de muestreo; mientras que en las escasas investigaciones cualitativas, tampoco se presentan argumentos para asegurar la pertinencia y suficiencia de la muestra, lo que en ambos casos afecta la calidad de la información recogida y el volumen conveniente para obtener resultados fiables.
