A recent preoccupation in scholarly research is the capacity of firms in developing country industrial clusters to comply with international corporate social responsibility policies and codes of conducts. This research is at an early stage and draws on several—often quite distinct—scholarly traditions. In this paper, we argue that future work in this area would benefit from a more explicit examination of the connection between cluster firms and human rights defined according to the 1948 Universal Declaration of Human Rights and subsequent (...) covenants and treaties. We argue that cluster firms’ adoption of CSR policies, often indiscriminately imposed by global buyers, should be differentiated from firms’ actual human rights practices. Based on this distinction, we elaborate a typology of industrial clusters and identify a set of factors likely to influence their practice. Against this background, we discuss an agenda for future research and elaborate on the potential methodological intricacies related to research on the interface between industrial clusters and human rights. This paper focuses on Confucian formulations of personhood and the implications they may have for bioethics and medical practice. We discuss how an appreciation of the Confucian concept of personhood can provide insights into the practice of informed consent and, in particular, the role of family members and physicians in medical decision-making in societies influenced by Confucian culture. We suggest that Western notions of informed consent appear ethically misguided when viewed from a Confucian perspective.

How do firms make sense of creating shared value projects? In their sense-making processes, do they extend the meaning spectrum to include human rights? What are the dominant cognitive frames through which firms make sense of CSV projects, and are some frames more likely to have transformative power? We pose these questions in the context of small-scale firms in a low-to-middle income country—a context where CSV policies have been promoted extensively over the last decade in the expectation of improved economic (...) competitiveness, growth, and sustainable development processes. We employ a grounded theory approach to identify three dominant cognitive frames used by our respondents to make sense of CSV. The most prevalent frame prioritizes economic over social and environmental goals, and considers social, environmental, and human rights benefits to trickle down from economic growth and wealth generation. In the second frame, economic actors follow a win–win logic according to which environmental sustainability is pursued only if there are clear and foreseeable economic payoffs. The third frame is a niche that emphasizes the attainment of certain human rights goals, despite a perceived lack of immediate economic returns. Our work casts doubt on the capacity of CSV projects to stimulate sustainable development processes without radically changing entrepreneurs’ cognitive frames from growth first to humanizing the business. We examine whether, relative to their global peers, the financial performance of firms from developing countries leads to increases in human rights abuses. We also study the institutional conditions that qualify this relationship. Based on a combination of behavioral and neo-institutional theories, we suggest there is a positive relationship between financial performance and human rights misbehavior as home country liabilities motivate firms to misbehave to achieve their primary goal of economic leadership. We also suggest that strong regulatory and normative pressures (...) attenuate the abovementioned positive relationship, as failure to comply with norms endangers such firms’ secondary goal of achieving international legitimacy. Our analysis, based on a sample of 245 large companies from eight developing countries studied over a 20-year period, supports our hypotheses. Our empirical results suggest that such companies misbehave when they endeavor to strike a balance between maintaining their global economic leadership and sustaining their social legitimacy. Il saggio presenta la definizione e l’interpretazione di Maimonide delle sette leggi noahidi come si trovano nel codice halakhico _Mishnè Torà, Hilkhot melakhim_, e come discusse ed elaborate dal pensatore ebreo contemporaneo (tedesco-americano) Steven S. Schwarzschild. Rispetto ad altre versioni rabbiniche, l’interpretazione di Maimonide aggiunge la condizione che l’osservanza di quelle leggi è valida solo se sono accettate e rispettate come leggi rivelate, non solo come _lex naturalis_. Su tale condizione esiste un disaccordo tra gli studiosi e i rabbini ebrei, (...) per esempio tra Marvin Fox e Aaron Lichtenstein (la loro posizione è un caso di studio presentato qui). Più specificamente, Schwarzschild argomenta a favore dell’interpretazione del Rambam e cerca di dimostrare che è coerente con la visione globale che Maimonide aveva dell’ebraismo in quanto tale. The essay presents Maimonides’ definition and interpretation of the seven Noahide laws as they are found in the halakhic code _Mishnè Torà, Hilkhot melakhim_, and as discussed and elaborated by the contemporary Jewish (German-American) thinker Steven S. Schwarzschild. In comparison with other rabbinical versions, Maimonides’ interpretation adds the condition that the observance of those laws is valid only if they are accepted and obeyed as revealed laws, not only as _lex naturalis_. About such a condition a disagreement exists among the Jewish scholars and rabbis, for example between Marvin Fox and Aaron Lichtenstein (their position is a case-study presented here). More deeply, Schwarzschild argues in favor of the Rambam’s interpretation and tries to demonstrate that it is consistent with the comprehensive vision Maimonides had on Judaism as such. (shrink)

The paper investigates various definitions of the concept of opinion as opposed to factual or evidence-based statements and proposes a taxonomy of opinions expressed in English as identified in selected social media. A discussion situates opinions in the realm of pragmatics and reaches to philosophy of language and cognitive science. The research methodology combines a thorough linguistic analysis of opinions, proposing their multifaceted taxonomy with the automatically generated lexical embeddings of positive and negative lexicon acquired from the analysed opinionated texts. As proposed, the definition of the concept of opinion is best apprehended when looked upon in terms of an opinion event, with a number of necessary conditions on the one hand, and those that are characteristic of an explicit opinion prototype on the other. Lists of opinion discourse markers show their preferential uses either in positive or negative opinionated texts; however, no sets of necessary and/or sufficient opinion markers properties have been acquired from the analysed texts. The conclusions indicate a polysemous understanding of naturally occurring social media opinionated texts and a definitional flexibility of the boundaries around lexical positive and negative types of opinion markers. This article describes research-based role-play on academic integrity. In the role-play, doctoral students negotiated the revision of an institutional integrity policy representing different groups of academics and students. On the one hand, role-play as a teaching method and learning activity demonstrated the difficulty of accommodating different perspectives; on the other, it showed the power and necessity of negotiation in matters that involve value judgments. The role-play is described in detail along with its underlying pedagogical foundations and its contextualisation in a (...) doctoral summer school where it took place. The purpose of the article is to describe how academic integrity was approached through role-play and to discuss theoretical and pedagogical foundations of role-play in teaching academic integrity. Although the article does not describe empirical research on role-play as a teaching method, it demonstrates how role-play in teaching academic integrity was developed based on prior research on the topic. Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. Current advances in assisted reproductive technologies aim to promote the health and well-being of future children. They offer the possibility to select embryos with the greatest potential of being born healthy (eg, preimplantation genetic testing) and may someday correct faulty genes responsible for heritable diseases in the embryo (eg, human germline genome modification (HGGM)). Most laws and policy statements surrounding HGGM refer to the notion of ‘serious’ as a core criterion in determining what genetic diseases should be targeted by these (...) technologies. Yet, this notion remains vague and poorly defined, rendering its application challenging and decision making subjective and arbitrary. By way of background, we begin by briefly presenting two conceptual approaches to ‘health’ and ‘disease’: objectivism (ie, based on biological facts) and constructivism (ie, based on human values). The basic challenge under both is sorting out whether and to what extent social and environmental factors have a role in helping to define what qualifies as a ‘serious’ disease beyond the medical criteria. We then focus on how a human rights framework (eg, right to science and right to the highest attainable health) could integrate the concepts of objectivism and constructivism so as to provide guidance for a more actionable consideration of ‘serious’. Ultimately, it could be argued that a human rights framework, by way of its legally binding nature and its globally accepted norms and values, provides a more universal foundation for discussions of the ethical, legal and social implications of emerging or disruptive technologies. The focus of this article is university teachers’ and students’ views of plagiarism, plagiarism detection, and the use of plagiarism detection software as learning support. The data were collected from teachers and students who participated in a pilot project to test plagiarism detection software at a major university in Finland. The data were analysed through factor analysis, T-tests and inductive content analysis. Three distinct reasons for plagiarism were identified: intentional, unintentional and contextual. The teachers did not utilise plagiarism detection to (...) support student learning to any great extent. We discuss the pedagogical implications and suggest that the contextual reasons for plagiarism require focus primarily on study strategies, whereas the intentional reasons require profound discussion about attitudes and conceptions of good learning and university-level study habits. A debate over the possibilities for foundations of knowledge has been a key feature of theoretical discussions in the discipline of International Relations. A number of recent contributions suggest that this debate is still active. This article offers a contribution to this debate by suggesting that the study of complexity may provide a contingent foundation for the study of international relations. En este artículo exploramos el rol del cuerpo en las filosofías de la India gracias a los trabajos de Lilian Silburn, focalizándonos en la idea de labrar el cosmos, véase de performances somáticas que poseen relevancia cosmológica. Comenzamos profundizando en su biografía, para luego estudiar sus análisis del pensamiento védico antiguo, el brāhmaṇa, el upanişad, y el budismo. De esta manera, recorremos diversos desarrollos conceptuales propios de estas tradiciones, intentando comprender las constantes tensiones entre lo discontinuo y lo continuo, lo (...) inagenciado y lo agenciado, lo múltiple y lo Uno, y, finalmente, entre el eternismo y el nihilismo. Concluimos nuestro recorrido con la manera particular que tiene el budismo de resolver estas tensiones en su teoría no-sustancial del karman. (shrink)

L’interpretazione dei testi è il cuore del giudaismo e lo studio in ebraico della Torà scritta e orale è uno dei suoi precetti fondamentali. Ma interpretare è un’arte sviluppatasi sulla base di regole precise che fissano dei limiti logici e insieme potenziano la fantasia dei maestri di Israele. In questi dodici capitoli si esplorano tali middot o norme ermeneutiche, la dialettica tra senso letterale e approccio midrashico, gli sviluppi dell’esegesi rabbinica soprattutto in età medievale, i dibattiti sul valore delle aggadot (...) nella prima modernità e, infine, i diverbi tra ortodossia e riforma sul posto da assegnare al metodo storico-critico nella lettura dei testi sacri: Torà, Talmud, Zohar... Ma idee e prassi dell’interpretazione si applicano anche al mondo dei sogni, all’elaborazione della memoria e alla vasta produzione poetica e letteraria, rifiorita in ebraico nel corso del Novecento, in particolare nella società israeliana. Questo percorso mostra come, da sempre e mai come oggi, il giudaismo sia una interpreting tradition nel solco di una lunga storia che combina rigore e innovazione. Secondo il Midrash, Dio stesso, tracciando corone sulle lettere della Torà, ha cominciato questa storia. (shrink)

Finalmente, una aproximación genealógica al aforismo, sus juegos de verdad y discursos de veridicción apunta a dos aportaciones del último Foucault, el decir verdad del parresiasta y los hypomnematas, así como a una consideración del aforismo como un ritual vivo de la verdad. Recent scholarship has focused on the effects of institutional design and constitutional provisions on human rights protections. Democratic institutions, like other manifestations of credible commitment to human rights, seem to play a role in human rights provisions across the world. Yet, there is still a great deal that we do not know about domestic institutions like the human rights ombudsman, an institution created specifically to protect human rights, on human rights provisions. We conduct an examination of the effects of the (...) human rights ombudsman (which may go by the name Defensor del Pueblo, Procurador de Derechos Humanos, or Comisionado Nacional de Derechos Humanos), on personal integrity violations across Latin America, 1982–2006. We find evidence that this understudied institution had significant and positive impacts on reducing such violations. (shrink)

The aim of this study was to investigate the consequences of the use of text-matching software on teachers’ and students’ conceptions of plagiarism and problems in academic writing. An electronic questionnaire included scale items, structured questions, and open-ended questions. The respondents were 85 teachers and 506 students in a large Finnish university. Methods of analysis included exploratory factor analysis, t-test, and inductive content analysis. Both teachers and students reported increased awareness of plagiarism and improvements in writing habits, as well as (...) concerns and limitations related to the system. The results suggest that teachers are inclined to think of plagiarism as part of a learning process rather an issue of morality, which may have consequences for how they understand the role of text matching. The introduction of text-matching software has supported teachers’ work, but at the same time teachers emphasized their own responsibility in detecting problems in student writing. The survey provides a limited sample of “Case Finland,” where implementation of text-matching software nationwide has been remarkably rapid; it offers a glimpse into one institution’s implementation of a newly introduced policy for mandatory plagiarism detection. Previous research has established that the success of strikes, and social movements more broadly, depends on their ability to garner support from the public. However, there is scant published research investigating the response of the public to strike action by healthcare workers. In this study, we address this gap through a study of public responses to UK nursing strikes in 2022–2023, using a data set drawn from Twitter of more than 2300 publicly available tweets. We focus on negative tweets, investigating (...) which societal discourses social media users draw on to oppose strike action by nurses. Using a combination of corpus‐based approaches and discourse analysis, we identified five categories of opposition: (i) discourse discrediting nurses; (ii) discourse discrediting strikes by nurses; (iii) discourse on the National Health System; (iv) discourse about the fairness of strikers' demands and (v) discourse about potential harmful impact. Our findings show how social media users operationalise wider societal discourses about the nursing profession (e.g., associations with care, gender, vocation and sacrifice) as well as recent crises such as the Covid‐19 pandemic to justify their opposition. The results also provide valuable insights into misconceptions about nursing, strike action and patient harm, which can inform strategies for public communication. (shrink)

Consequentialism is a moral philosophy that maintains that the moral worth of an action is determined by the consequences it has for the welfare of a society. Consequences of model design are a part of the model lifecycle that is often neglected. This paper investigates the issue using system dynamics modeling as an example. Since a system dynamics model is a product of the modeler’s design decisions, the modeler should consider the life cycle consequences of using the model. Seen from (...) a consequentialist perspective, the consequences of policies developed from system dynamics models determine the model’s moral value. This concept is explored by discussing model uncertainty from an engineering perspective. In this perspective, the ethical considerations shift from the behavior of the modeler to the model itself and the model’s inherent uncertainty. When the ethical considerations are taken away from the modeler and directed to what the model does, the ethical boundaries extend beyond the proximity of the model. This discussion renews the ethics conversation in system dynamics by considering this shift in philosophical perspective, and investigates how consequentialist moral philosophy applies to the modeling process and in communicating with decision-makers. A model of social assistance in Norway in the context of immigration pressures illustrates some possibilities for addressing these ethical concerns. ​Wie ist das diskursfähige Subjekt im Sinne Habermas zu denken? Unter welchen Bedingungen und Modalitäten entwickelt das Subjekt seine Diskursfähigkeit? Erika Edelmayer arbeitet die Denkfigur des diskursfähigen Subjekts aus der Grundlegung der soziologischen Theorie als „Theorie des kommunikativen Handelns“ heraus. Sie untersucht, was Diskursfähigkeit im Rahmen einer deliberativ verstandenen Demokratie bedeutet und zeigt die Konsequenzen auf, die sich daraus für die Pädagogik ergeben.
