We present an algorithm that can anticipate tax evasion by modeling the co-evolution of tax schemes with auditing policies. Malicious tax non-compliance, or evasion, accounts for billions of lost revenue each year. Unfortunately when tax administrators change the tax laws or auditing procedures to eliminate known fraudulent schemes another potentially more profitable scheme takes it place. Modeling both the tax schemes and auditing policies within a single framework can therefore provide major advantages. In particular we can explore the likely forms (...) of tax schemes in response to changes in audit policies. This can serve as an early warning system to help focus enforcement efforts. In addition, the audit policies can be fine tuned to help improve tax scheme detection. We demonstrate our approach using the iBOB tax scheme and show it can capture the co-evolution between tax evasion and audit policy. Our experiments shows the expected oscillatory behavior of a biological co-evolving system. (shrink)

This truth conduciveness claim is the cornerstone of the popular coherence theory of knowledge and justification. Erik Olsson's new book is the most extensive and detailed study of coherence and probable truth to date. Setting new standards of precision and clarity, Olsson argues that the value of coherence has been widely overestimated. Suppose there is no God. This might imply that human life is meaningless, that there are no moral obligations and hence people can do whatever they want, and that the notions of virtue and vice and good and evil have no place. Erik J. Wielenberg believes this view to be mistaken and in this book he explains why. He argues that even if God does not exist, human life can have meaning, we do have moral obligations, and virtue is (...) possible. Naturally, the author sees virtue in a Godless universe as different from virtue in a Christian universe, and he develops naturalistic accounts of humility, charity, and hope. The moral landscape in a Godless universe is different from the moral landscape in a Christian universe, but it does indeed exist. The counterfactual comparative account of harm faces problems in cases that involve overdetermination and preemption. An influential strategy for dealing with these problems, drawing on a suggestion made by Derek Parfit, is to appeal to _plural harm_—several events _together_ harming someone. We argue that the most well-known version of this strategy, due to Neil Feit, as well as Magnus Jedenheim Edling’s more recent version, is fatally flawed. We also present some general reasons for doubting that the overdetermination and preemption problems (...) for the counterfactual comparative account can be satisfactorily solved by appealing to plural harm. We have argued that the counterfactual comparative account of harm and benefit (CCA) violates the plausible adequacy condition that an act that would harm an agent cannot leave her much better off than an alternative act that would benefit her. In a recent paper in this journal, however, Neil Feit objects that our argument presupposes questionable counterfactual backtracking. He also argues that CCA proponents can justifiably reject the condition by invoking so-called plural harm and benefit. Environmental, social and ethical issues have become increasingly important for businesses due to changed customer expectations, more regulation and stakeholder pressure, amongst others. This led to the development of concepts such as sustainability management, corporate social responsibility, stakeholder management and business ethics. Though mostly developed in isolation, scholars have increasingly worked on their integration. This editorial sheds light on overlaps between these concepts. We find that sustainability management and CSR have become more integrated and are increasingly grounded in an “embedded (...) view“ in which business and society is part of the natural environment. In contrast, business ethics has not been integrated to the same extent, expect for the subfield of environmental ethics. After this general overview, we introduce the individual contributions to the special issue which are advancing the conceptual and empirical foundation of sustainability management, CSR, and business ethics. Bioethicists frequently call for empirical researchers to engage participants and community members in their research, but don't themselves typically engage community members in their normative research. In this article, we describe an effort to include members of the public in normative discussions about the risks, potential benefits, and ethical responsibilities of social and behavioral genomics (SBG) research. We reflect on what might—and might not— be gained from engaging the public in normative scholarship and on lessons learned about public perspectives on (...) the risks and potential benefits of SBG research and the responsible conduct and communication of such research. We also provide procedural lessons for others in bioethics who are interested in engaging members of the public in their research. (shrink)

How should scarce healthcare resources be distributed? This is a contentious issue that became especially pressing during the pandemic. It is often emphasised that studies exploring public views about this question provide valuable input to the issue of healthcare priority setting. While there has been a vast number of such studies it is rarely articulated, more specifically, what the results from these studies would mean for the justification of principles for priority setting. On the one hand, it seems unreasonable that (...) public values would straightforwardly decide the ethical question of how resources should be distributed. On the other hand, in a democratic society, it seems equally unreasonable that they would be considered irrelevant for this question. In this paper we draw on the notion of reflective equilibrium and discuss the relevance and roles that empirical studies may plausibly have for justification in priority setting ethics. We develop a framework for analysing how different kinds of empirical results may have different kinds of implications for justification. (shrink)

This book is a comprehensive account of what it means to try to quantify health in distributing resources for health care. It examines the concept of QALYs which supposedly makes it more accurate to talk about life in terms of both quality and quantity of years lived when referring to health care policy. It offers an elegant new approach to comparing the costs and benefits of medical interventions. Cost-Utility Analysis is a method designed by economists to aid decision makers distribute (...) scarce resources to areas of health care where they will yield the greatest benefits. Erik Nord questions the feasibility of measuring patients' quality of life meaningfully in numerical terms, as CUA presupposes. He presents an alternative approach called cost-value analysis in which representative samples of the general public express preferences between different health-care programs. In this approach, subjects are allowed to include concerns for fairness that go beyond concerns for efficiency of conventional health economics. (shrink)

Evidence-based management (EBMgt) is a relatively recent approach to management, developed by Denise Rousseau in a series of articles and in a book that she co-authored with Eric Barends (Barends & Rousseau 2018). It is based on the idea that good-quality management decisions require both critical thinking and use of the best available evidence. In this paper we want to contribute to the scholarship on evidence-based management by showing how its central concept – evidence – can and should be defined (...) more strictly. Barends and Rousseau define evidence as a two-place relation between information and a claim that is at stake. Starting from insights from the methodology of the social sciences we argue that evidence is a three-place relation between a method, information and a claim. We offer a guiding principle for adequately characterising what counts as evidence (the inclusion of a procedural component which describes how the information should be collected and reported) and apply it to Barends and Rousseau’s concepts of (i) evidence from practitioners, (ii) evidence from the organization and (iii) evidence from stakeholders. We think that by treating evidence as a three-place relation we can develop an improved account (which we call EBMgt+) of what evidence-based management can and should be. (shrink)

Imagination is often considered the pinnacle of representational cognition. Looking at the concrete details of imagining in context, this paper aims to contribute to the emerging literature that is challenging this representational view by offering a relational and radically situated alternative. On the basis of observing architects in the process of making an architectural art installation, we show how to consider imagination not as de-contextualized achievement by an individual but as an opening up to larger-scale “affordances,” i.e. the unfolding possibilities (...) for action. We show how the architects coordinate the enactment of multiple affordances across different timescales, from small-scale affordances of picking up a mobile phone to the large-scale affordance of making the installation that takes months to unfold. These affordances get co-determined as they are jointly enacted. It is within this determining process that imagination too finds its place. On our view it is the indeterminacy of multiple affordances unfolding in action simultaneously that can be experienced as imaginative. The indeterminate character of this coordinative process allows activities to widen and open up, letting new possibilities for action enter into them. (shrink)

Artificial intelligence (AI) is becoming increasingly influential in most people’s lives. This raises many philosophical questions. One is what responsibility we have as individuals to guide the development of AI in a desirable direction. More specifically, how should this responsibility be distributed among individuals and between individuals and other actors? We investigate this question from the perspectives of five principles of distribution that dominate the discussion about responsibility in connection with climate change: effectiveness, equality, desert, need, and ability. Since much (...) is already written about these distributions in that context, we believe much can be gained if we can make use of this discussion also in connection with AI. Our most important findings are: (1) Different principles give different answers depending on how they are interpreted but, in many cases, different interpretations and different principles agree and even strengthen each other. If for instance ‘equality-based distribution’ is interpreted in a consequentialist sense, effectiveness, and through it, ability, will play important roles in the actual distributions, but so will an equal distribution as such, since we foresee that an increased responsibility of underrepresented groups will make the risks and benefits of AI more equally distributed. The corresponding reasoning is true for need-based distribution. (2) If we acknowledge that someone has a certain responsibility, we also have to acknowledge a corresponding degree of influence for that someone over the matter in question. (3) Independently of which distribution principle we prefer, ability cannot be dismissed. Ability is not fixed, however and if one of the other distributions is morally required, we are also morally required to increase the ability of those less able to take on the required responsibility. I examine the debate between substantivalists and relationalists about the ontological character of spacetime and conclude it is not well posed. I argue that the hole argument does not bear on the debate, because it provides no clear criterion to distinguish the positions. I propose two such precise criteria and construct separate arguments based on each to yield contrary conclusions, one supportive of something like relationalism and the other of something like substantivalism. The lesson is that one must fix an (...) investigative context in order to make such criteria precise, but different investigative contexts yield inconsistent results. I examine questions of existence about spacetime structures other than the spacetime manifold itself to argue that it is more fruitful to focus on pragmatic issues of physicality, a notion that lends itself to several different explications, all of philosophical interest, none privileged a priori over any of the others. This chapter deals with an area of study sometimes called “formal value theory” or “formal axiology”. Roughly characterized, this area investigates the structural and logical properties of value properties and value relations, such as goodness, badness, and betterness. There is a long-standing controversy about whether goodness and badness can, in principle, be measured on a cardinal scale, in a way similar to the measurement of well-understood quantitative concepts like length. Sect. 28.1 investigates this issue, mainly by comparing the properties of (...) the relations “longer than” and “better than”. In Sect. 28.2, some attempts to define goodness and badness in terms of the betterness relation are discussed, and a novel suggestion is made. The influential social model understands disability in terms of oppression instantiated in a material environment that disables bodily impaired people. Many of the demands of disability activists for what we might call equal material access have since been satisfied. Yet oppression of subtler psychological and emotional forms persists for many disabled people. We will argue that the results of these psychosocial forms of oppression is that scaffolding which was set up to provide access to disabled people may become disabling. We (...) introduce the concept of “disabling scaffolding” to refer to environmental structures that inhibit the disabled person’s abilities because of social structures of intersubjective and material oppression. We borrow Iris Marion Young’s concept of “inhibited intentionality” to describe the effects of oppression, which come to operate “from within” the disabled person, deeply affecting the person’s experience of the body as an “I-can”. Disabling scaffolding is a consequence of material and intersubjective oppression that leads to inhibited intentionality, gradually leading to a pathologization of the disabled person’s embodiment. Feminists are divided on whether consent should be employed in legal definitions of rape. Catharine MacKinnon has criticized the usefulness of consent in enabling legal systems to recognize and prosecute instances of rape (MacKinnon 1989, 2005, 2016). In a recent article in this journal, Lisa H. Schwartzman defends the use of affirmative consent in rape law against MacKinnon’s critique (Schwartzman 2019). In contrast to MacKinnon, Schwartzman claims our understanding of rape must include both force and consent components. In this paper, (...) I will argue in agreement with Schwartzman and against MacKinnon that the legal definition of rape should include an affirmative consent component. I will take Schwartzman’s discussion as my point of departure and consider whether she has responded adequately to MacKinnon’s criticisms of consent. I will argue that her responses are not fully adequate. In particular, she has not successfully rebutted the argument that an appeal to consent is unnecessary once we have accepted an expanded definition of coercion. I will then provide a more affirmative defense of affirmative consent in response to MacKinnon’s most challenging criticism. (shrink)

Normative error theorists maintain the view that normative judgements ascribe normative properties, but these normative properties don’t exist. Many philosophers have tried objecting to this view, like Case (Australasian Journal of Philosophy, 98(1), 92–104, 2019) arguing that it faces self-defeat. Others, like Streumer (Journal of Philosophy, 110(4), 194–212, 2013), have argued that it can’t even be believed because beliefs (in the full, rational sense) possess certain normative requirements. So, there is no self-defeating ‘belief’ in normative error theory. Recently, Taccolini (European (...) Journal of Analytic Philosophy, 20(1), 131-154, 2024) has accepted that Streumer’s response to self-defeat might work, and builds a stronger self-defeat argument. The argument attempts to illustrate that one cannot defend the normative error theory, regardless of whether they believe it or not. In response, we illustrate various plausible interpretations of ‘defense’ that are consistent with error theory, thereby diffusing the modal objection that one can’t defend error theory. (shrink)

In a recent article in this journal, Justin Klocksiem proposes a novel response to the widely discussed failure to benefit problem for the counterfactual comparative account of harm (CCA). According to Klocksiem, proponents of CCA can deal with this problem by distinguishing between facts about there being harm and facts about an agent's having done harm. In this reply, we raise three sets of problems for Klocksiem's approach.

Although prisons provide on-site primary care, the corrections system relies on external hospitals to provide a variety of healthcare services. Compared to the general population, incarcerated patients experience higher rates of chronic medical conditions, mental illness, substance abuse, cancer, traumatic brain injury, assault, and communicable disease. Certain specialties of clinicians are likely to encounter patients who are incarcerated, which makes it important for clinicians to understand how medical decision-making may differ when the patient is a prisoner. The corrections system retains (...) custody of inmates and is responsible for their welfare, including facilitating necessary medical care. However, this does not permit corrections personnel or a warden to automatically assume the role of the patient's medical decision-maker. Except for narrow exceptions, prisoners do not lose their rights to medical decision-making. In some instances, corrections staff or the prison warden have improperly asserted authority to act as the patient's medical decision-maker, such as when the patient lacks decision-making capacity. This violates ethical principles of bodily integrity, respect, and fairness. This paper provides an overview of medical decision-making for incarcerated patients, how surrogate decision-maker hierarchies apply to incarcerated patients without decision-making capacity, and special considerations for this subset of patients. The EU is often considered to be a unique entity. This assertion rests on assessments of its institutional character more than on assessments of its social constituency, i.e., the structure of demands and expectations that citizens and groups place on the EU. Establishing the character of the latter is important both to understand the EU as polity and to understand its democratic deficit. It is also of theoretical interest given the increased focus on recognition politics, not only within nation-states but (...) also within the transnational realm. This article develops a conceptual-methodological framework with a set of structured tests so as to permit us to establish the character of the EU’s social constituency. This framework combines a philosophical approach to recognition with a sociological approach to contentious politics. A central element is the notion of ‘recognition order’, and the article briefly examines whether the EU might be said to make up a unique recognition order. (shrink)

The Peter Principle states that employees tend to be promoted until they reach their level of incompetence. In a sophisticated simulation study, Pluchino et al confirmed a version of the principle. However, they also noted that their model has the counterintuitive consequence that “the best ways for improving the efficiency of a given organization are either to promote each time an agent at random or to promote randomly the best and the worst members”. We argue that what promotion rule is (...) used can in general influence employee productivity. Accommodating this psychological aspect of promotion is noted as an open problem by Pluchino et al. Using an amended simulation model we verify that if the incentive induced by promoting the best is strong enough, then that strategy will be optimal. In a final simulation experiment we consider the effect on the efficiency of an organization of using “double standard” promotion strategies, i.e., strategies that depend on the official promotion rule being different from the de facto promotion rule. We show that double standard promotion strategies can be highly efficient, although we also note that in using such strategies the employer may take an unacceptable medium to long term risk. This essay uses concepts from Adam Smith’s The Theory of Moral Sentiments to develop ideas about choice and welfare. I use those ideas to offer several challenges to common approaches to behavioral welfare economics and new paternalist policy making. Drawing on Smith’s dialectical concept of practical reason, which he develops in expositing ideas about self-awareness and self-judgment, I first argue that inconsistency need not be viewed as pathological. Inconsistent choices might indicate legitimate context-dependencies as individuals reflect over disjointed perspectives and (...) act accordingly. Understanding inconsistency as reasonable raises epistemic difficulties for identifying errant choices and designing corrective policies. Second, I draw on Smith’s theory of the impartial spectator to discuss dynamic aspects of welfare. Welfare is not simply a matter of preference satisfaction but involves a sense of progress and improvement towards better preferences. Smith’s account suggests that economists interested in welfare should focus on institutional arrangements that facilitate self-development. (shrink)

One of Heidegger’s main targets of criticism in History of the Concept of Time is Husserl’s theory of intentionality. This criticism, however, has roots in Heidegger’s earliest thinking over the course of his student years and pertains to what Ernst Tugendhat called the problem of encounter as such. In this article I present how the critical appropriation of Rickert’s and Lask’s ideas shaped a unique interpretation of the subject’s existence in the early stages of Heidegger’s career, contributing to the (dis)solution (...) of the encounter problem and anticipating an independent version of phenomenology more than a decade before the publication of Being and Time. These alternative sources of influence illuminate Heidegger’s own path, which is significantly different from Husserl’s from the very start. In particular, I show in the article how Heidegger’s critical appropriation of Neo-Kantian sources allows him already during the 1910s to see the derivative status of the theoretical subject-object dichotomy and to realize the need to investigate living subjectivity in its embeddedness in the world.
