A recent Supreme Court decision, Kumho Tire Co., Ltd. v. Carmichael, may have substantial impact on psychological expert testimony. Previous criteria for admissibility of scientific expert testimony now apply broadly to expert testimony, not just testimony narrowly grounded in scientific evidence. Judges will determine the relevance and reliability of all expert testimony, including that based on clinical experience or training. Admissible testimony will either satisfy the criteria established in Daubert v. Merrell Dow Pharmaceuticals, Inc. or meet similarly rigorous standards judged (...) appropriate to the particular field involved. Because psychological testimony has varied in its evidentiary basis, sometimes relying on science and otherwise on clinical training or experience, court decisions will gradually determine the precedent for its admissibility. This article examines the role of moral arguments in the delegitimation of transition policies. Previous research has highlighted attitudes and arguments that explain resistance against transition policies, including perceptions of unfairness; inefficiency and effectiveness; lack of trust; and ideology. This article provides further understanding of resistance to climate policies by zooming in on how social movements implicitly and explicitly use moral arguments to delegitimise low-carbon transition policies. Through a qualitative interview study with members of a Swedish social media movement against (...) low-carbon transport policies, we analyse central arguments against policies; how moral considerations figure in them; and how these strengthen argumentative delegitimation practices against transition policies in the transport sector. We show how moral arguments serve to legitimise protests both by instilling an urgency in the cause and generalising the demands to delegitimise mainstream transition policies, and suggest that recognition of this may contribute to both better analysis and policies. The way in which we produce and consume energy has profound implications for our societies. How we configure our energy systems determines not only our chances of successfully dealing with climate change but also, how benefits and burdens of these systems are distributed. In this paper, we set out to map the literature on conflicts related to the energy system in Sweden using a framework of energy justice. The purpose of this exercise is twofold: first, to identify and understand energy (...) conflicts in Sweden through the research that is published; and second, to identify gaps in the literature on energy justice in Sweden. This systematic review builds upon 40 scholarly articles focusing on energy conflicts in Sweden. All articles were written in the time period from January 2010 to January 2021. All articles were published in English in peer-reviewed scientific journals. The papers were analysed using a framework for energy justice that focused on the elements of distributional and procedural justice and recognition justice. The findings of the review suggest that there has been little explicit focus on energy justice in the literature on Sweden's energy system. Issues of distributional justice are most raised and procedural and recognition justice are often conflated in research. While conflicts over hydropower and nuclear have dominated in the past, wind energy in Sami territory is most problematised in the reviewed literature. The understanding of justice in the Swedish energy system is currently missing two elements: a rigorous handling of ecologically unequal exchange and restorative justice. (shrink)

The article draws a connection between three items preserved at the von Wright and Wittgenstein Archives at the University of Helsinki (WWA), namely a book by Wilhelm Busch and two copies of the photos of von Wright and Wittgenstein in Cambridge taken by Knut Erik Tranøy in 1950, by suggesting that the photos contain an allusion by Wittgenstein.

Self-fulfillment of theories is argued to be a threat to social science in at least two ways. First, a realist might worry that self-fulfillment constitutes a threat to the idea that social science is a proper science consistent with a realist approach that develops true and successful statements about the world. Second, one might argue that the potential self-fulfilling nature of social science theories potentially undermines the ethical integrity of social scientists. We argue that if one accepts that social science (...) theories are not based on laws akin to those that govern natural reality or acknowledges that if one can predict self-fulfillment via a meta-theory that explains the underlying regularities of the self-fulfilling change, the threat to realism is dismantled. Furthermore, on the basis of these arguments, we show that if one is unable to predict the consequences of a theory, it is difficult to ascribe moral responsibility at the individual level. It is, therefore, not the potential self-fulfillment of theories per se that poses an ethical challenge, in contrast to claims in the literature. (shrink)

Daoism's Multiple ModelsManhua Li, Yumi Suzuki, and Lisa Indraccola have offered evocative insights, questions, and alternatives in their contributions concerning the arguments of Daoism and Environmental Philosophy: Nourishing Life (Nelson 2021). The present brief response and sketch of the book will not address every point in their essays, but I will strive to reply, directly and indirectly, (...) to their primary concerns.First, it should be noted that I take a pluralistic conception of 'Daoisms' as my point of departure. This is necessary since Daoist studies have been hampered by overly ahistorical and one-sided definitions that prioritize one philosophical or religious moment (such as skepticism or mysticism) in historically complex and varied transmissions that encompass a multiplicity of texts and perspectives. Due to the fact of the plurality of incompatible kinds of Daoism in Chinese antiquity and in subsequent history, my text considers a range of early Daoist and Daoist-related perspectives in the context of their potential consequences for environmental philosophy, ethics, and politics. The Daodejing and the Zhuangzi have provided elements for European thinking about civilization, technology, and nature from Martin Buber and Martin Heidegger (Nelson 2017) to Peter Sloterdijk's 'Euro-Taoism' (Sloterdijk 1989) to contemporary progressive Green movements (Joshi 2022) and even ecofascism (Lubarda 2020). Similarly, in the current Chinese context, Green Daoism has both critical and authoritarian ideological functions in visions of 'ecological civilization' (shengtai wenming 生態文明) (Schönfeld and Chen 2019) and fears of a 'green leviathan'. Accordingly, it is not accidental that my anarchistic and participatory democratic interpretation of one key thread, which I call 'ziranist' and clarify below, in early Daoist and Wei-Jin mysterious-learning (xuanxue 玄學) discourses, has led to the most intense discussions and controversies about this book. These include the contributions by Li, Suzuki, and Indraccola that propose questions and alternative possibilities concerning agency and responsiveness, authority and self-determination, freedom and fate, and adaptation and intervention, as well as purposive techniques and anti-purposive uselessness.Third, this hermeneutical strategy points toward the tertiary aspect of our preliminary definition of Daoism. It does not primarily name a philosophical theory or a religious worldview. It concerns shifting, overlapping, and diverging ensembles of discourse and practice. This is not the vague ahistorical idea of 'a way of life' but rather refers to how philosophy is enacted through a specific configuration of—to adopt early Greek expressions—logos as dis-course (e.g., argumentation, hermeneutics, logic, rhetoric), ethos (e.g., comportment, orientation, a way of dwelling), and praxis (practices of the self, with others, and with things and nature). Thus, the Laozi 老子 and Zhuangzi collections can be analyzed textually and conceptually as having multiple threads (drawing on a variety of authors and sources) that form constellations in the received texts with better and worse historical, practical, and conceptual readings. My interpretive strategy in this discussion, which does not exclude other approaches, is that these texts express forms of practical instead of merely speculative philosophy. Despite apparently holding diametrically opposed attitudes toward dialectical logic, both George Santayana and the early Frankfurt School critical theorists posit a close link between the concepts of reason and domination. It is argued that a broadly-speaking Hegelian philosophical project can survive Santayana’s critiques, albeit by benefitting from the latter’s, as well as from the Frankfurt School’s, re-centering of nature in the history of domination. In this paper I clarify what Newton could have meant when he insisted that gravity is a real force. I interpret Newton’s speculative treatment of gravity as a relational, accidental quality of matter that arises through what Newton calls “the shared action” of two bodies. I argue that when Newton drafted the first edition of the Principia in the mid 1680s, he thought that (at least a part of) the cause of gravity is the disposition inherent in any individual body, (...) but that the force of gravity is the actualization of that disposition; a necessary condition for the actualization of the disposition is the actual obtaining of a relation between two bodies having the disposition. The cause of gravity is not essential to matter because God could have created matter without that disposition. Nevertheless, at least a part of the cause of gravity inheres in individual bodies and were there one body in the universe it would inhere in that body. On the other hand, the force of gravity is neither essential to matter nor inherent in matter, because (to repeat) it is the actualization of a shared disposition. A lone part-less particle would, thus, not generate a gravity field. (shrink)
