This is a book about food, philosophy, and intellectual property rights. Taken separately, these are three well-known subjects; but it is uncommon to consider them together. Delivering a rich field of disputes, the book is comprised of 50 case studies, organized around eight themes: images; genericity and descriptiveness; language traps; procedures; menus, recipes, and creativity; boundaries; biotech; and empowerment. The introductory chapter frames the selection of cases and encourages readers to look beyond them, envisaging new lenses to look at food (...) vis-à-vis intellectual property. The terrain encompassed is wide-ranging and reaches out to fine-grained aspects of food products, recipes, and cooking. Conceived for a wide scope of readers, the volume ultimately interrogates the links between food and cultural identity, bringing to the fore the ethical, political, aesthetic worth of culinary arts and gastronomic experiences. Emotionally arousing events may disrupt the ability to bind together different features of items to their context; this holds true both for spatial binding and temporal binding. Nonetheless, memory for emotional events may be enhanced in certain situations. A key factor that might explain the memory–emotion relation is represented by individual differences in cognition. The present study investigated temporal binding for neutral and negative events in a group of 50 undergraduate students, focusing on the role of individual differences in working (...) memory. Temporal binding was assessed with sorting accuracy of various pictorial scripted events, 24 h after encoding. Results showed that higher backward digit span predicted higher binding accuracy; importantly, this was qualified by the interaction with valence, such that higher backward digit span predicted better performance for negative, but not neutral, events. It is concluded that working memory facilitates binding of emotional events to their temporal context during encoding, creating a strong representation, and favouring later retrieval of such bound representations. What aesthetic interest do we have in watching films? In a much debated paper, Roger Scruton argued that this interest typically comes down to the interest in the dramatic representations recorded by such films. Berys Gaut and Catharine Abell criticized Scruton’s argument by claiming that films can elicit an aesthetic interest also by virtue of their pictorial representation. In this article, we develop a different criticism of Scruton’s argument. In our view, a film can elicit an aesthetic interest that does (...) not come down to an interest in the dramatic representation or in the pictorial representation. We will argue that this is a distinctively cinematic interest. In section I we outline Scruton’s argument. In section II we point out an interest in how the cinematic medium presents the portrayed subject as detached from the spectator’s environment. In section III, by referring to Wittgenstein’s account of the contemplation from outside, we contend that the interest in films introduced in section II can count as an aesthetic interest. In section IV we argue that both documentaries and fiction films can elicit this kind of interest. In section V we compare the three different kinds of aesthetic interest that, in our view, a film can elicit. In section VI we describe the corresponding kinds of cinematic achievements. (shrink)

Notwithstanding fundamental methodological advancements, scientific information about disorders of consciousness (DOCs)—e.g. Vegetative State/Unresponsive Wakefulness Syndrome (VS/UWS) and Minimally Conscious State (MCS)—is incomplete. The possibility to discriminate between different levels of consciousness in DOC states entails treatment strategies and ethical concerns. Here we attempted to investigate Italian clinicians’ and basic scientists’ opinions regarding some issues emerging from the care and the research on patients with DOCs. From our survey emerged that Italian physicians working with patients with DOCs give a central role (...) to ethics. Current Italian regulation regarding basic research conducted in patients with DOCs apparently risks to be inadequate to support scientific advancement, and would deserve a different assessment compared to ordinary treatments. We think the results of our survey deserve attention from an international audience because they exemplify the difficulty to define a shared approach to the issues related to patients with DOCs and the necessity to better assess both the ordinary and experimental treatment of patients with DOCs at the ethical and legal level. Introduction: Schools have become a primary setting for providing mental health care to youths in the U.S. School-based interventions have proliferated, but their effects on mental health and academic outcomes remain understudied. In this study we will implement and evaluate the effects of a flexible multidiagnostic treatment called Modular Approach to Therapy for Children with Anxiety, Depression, Trauma, or Conduct Problems on students' mental health and academic outcomes.Methods and Analysis: This is an assessor-blind randomized controlled effectiveness trial conducted across five (...) school districts. School clinicians are randomized to either MATCH or usual care treatment conditions. The target sample includes 168 youths referred for mental health services and presenting with elevated symptoms of anxiety, depression, trauma, and/or conduct problems. Clinicians randomly assigned to MATCH or UC treat the youths who are assigned to them through normal school referral procedures. The project will evaluate the effectiveness of MATCH compared to UC on youths' mental health and school related outcomes and assess whether changes in school outcomes are mediated by changes in youth mental health.Ethics and Dissemination: This study was approved by the Harvard University Institutional Review Board. Bergson concebe o surgimento da sociedade como algo natural, isto é, como um artifício da natureza para que o homem pudesse perseverar no mundo; assim, sua pesquisa visa encontrar e analisar os caminhos que a vida mesma armou no interior do humano, em sua constituição biológica, (...) para que ele pudesse se apegar de diversas formas à existência. Descortinando os motivos pelos quais as variadas sociedades, bem como suas mais diferentes morais se constituem como fechadas ou visando aos interesses da espécie, e abertas, tendo na humanidade uma referência por onde o amor criativo passaria, o filósofo nos mostra como determinados homens, excepcionais, vêm ao mundo encarnado em múltiplos sentidos uma nova atitude criadora, ainda não expressa, que se revela através de uma intuição despertada por uma emoção profunda. Dessa forma, a relação entre moral, vida e emoção é o que cumpre aqui estabelecer, uma vez que as leis morais seguidas pela humanidade são, no limite, necessidades vitais colocadas pela natureza e que só alcançam um desenvolvimento melhor graças à inteligência humana que, mesmo atrelada à necessidade imposta, também pode encontrar dentro de si a abertura para uma liberdade possível. . “The Notebook Corner,” edited by Enrico Pattaro, makes its first appearance here as a new section of Ratio Juris. This new section can be described in a sense as an offshoot of the project for A Treatise of Legal Philosophy and General Jurisprudence, a work still in progress composed of five theoretical volumes and six historical ones. The theoretical volumes receive a brief presentation in the paper immediately below, with a specific focus on Volume 1, entitled The Law (...) and the Right: A Reappraisal of the Reality That Ought to Be. The idea of an ?inversion principle?, and the name itself, originated in the work of Paul Lorenzen in the 1950s, as a method to generate new admissible rules within a certain syntactic context. Some fifteen years later, the idea was taken up by Dag Prawitz to devise a strategy of normalization for natural deduction calculi (this being an analogue of Gentzen's cut-elimination theorem for sequent calculi). Later, Prawitz used the inversion principle again, attributing it with a semantic role. Still working (...) in natural deduction calculi, he formulated a general type of schematic introduction rules to be matched ? thanks to the idea supporting the inversion principle ? by a corresponding general schematic Elimination rule. This was an attempt to provide a solution to the problem suggested by the often quoted note of Gentzen. According to Gentzen ?it should be possible to display the elimination rules as unique functions of the corresponding introduction rules on the basis of certain requirements?. Many people have since worked on this topic, which can be appropriately seen as the birthplace of what are now referred to as ?general elimination rules?, recently studied thoroughly by Sara Negri and Jan von Plato. In this study, we retrace the main threads of this chapter of proof-theoretical investigation, using Lorenzen's original framework as a general guide. (shrink)

Conceiving of fictional characters as types allows us to reconcile intuitions of sameness and difference about characters such as Batman that appear in different fictional worlds. Sameness occurs at the type level while difference occurs at the token level. Yet, the claim that fictional characters are types raises three main issues. Firstly, types seem to be eternal forms whereas fictional characters seem to be the outcome of a process of creation. Secondly, the tokens of a type are concrete particulars in (...) the actual world whereas the alleged tokens of a fictional character are concrete particulars in a fictional world. Thirdly, many fictional characters, unlike Batman, only appear in one work of fiction, and therefore one can wonder whether it does make sense to treat them as types. The main aim of this paper is to address these issues in order to defend a creationist account of fictional characters as types. (shrink)

Collective entities and collective relations play an important role in natural language. In order to capture the full meaning of sentences like The Beatles sing Yesterday, a knowledge representation language should be able to express and reason about plural entities — like the Beatles — and their relationships — like sing — with any possible reading (cumulative, distributive or collective).In this paper a way of including collections and collective relations within a concept language, chosen as the formalism for representing the (...) semantics of sentences, is presented. A twofold extension of theA–C concept language is investigated: (1) special relations introduce collective entities either out of their components or out of other collective entities, (2) plural quantifiers on collective relations specify their possible reading. The formal syntax and semantics of the concept language is given, together with a sound and complete algorithm to compute satisfiability and subsumption of concepts, and to compute recognition of individuals. The myth in Plotinus is a constitutive element of his metaphysics, as it is present in several treatises of the Enneads as an element aimed at justifying certain metaphysical theses through recourse to an analogy with the ancient tradition. In the case of the divine triad Ouranos‑Kronos‑Zeus, the relationship is extremely problematic since, from a Platonic perspective, these figures relate to two dialogues in particular : the Cratylus and the Timaeus. Regarding the Cratylus, the greatest difficulty for Plotinus lies in (...) matching the Socratic etymological method with the actual nature of the hypostases. From this point of view, the role of Ouranos appears particularly problematic since the very nature of the first principle is incompatible with Platonic etymology. As far as the Timaeus is concerned, a fundamental role is that of Zeus as demiurge, which respects all the problematic nature of the Plotinian perspective, which is unable to precisely delineate the role of the demiurge, for which Zeus is twofold : Intellect and Soul. It thus emerges how the role of the Cratylus and Timaeus are merely strategic for Plotinus, called upon only to justify his metaphysical theses. The myth thus has the role of justifying an analogy between the metaphysics of hypostasis and the archaic tradition, but it presents problems of interpretative oscillation that Plotinus himself does not seem able to resolve. In section 1 we argue that the adoption of a tenseless notion of truth entails a realistic view of propositions and provability. This view, in turn, opens the way to the intelligibility of theclassical meaning of the logical constants, and consequently is incompatible with the antirealism of orthodox intuitionism. In section 2 we show how what we call the potential intuitionistic meaning of the logical constants can be defined, on the one hand, by means of the notion of atemporal provability (...) and, on the other, by means of the operator K of epistemic logic. Intuitionistic logic, as reconstructed within this perspective, turns out to be a part of epistemic logic, so that it loses its traditional foundational role, antithetic to that of classical logic. In section 3 we uphold the view that certain consequences of the adoption of atemporal notion of truth, despite their apparent oddity, are quite acceptable from an antirealist point of view. L’analisi di un periodo storico attraverso la sua narrazione, sia esso il Medioevo o persino un’epoca più recente, considera una moltitudine di fonti, assai eterogenee e di forma non sempre immediata. In alcuni casi uno studioso può nutrire un interesse perfino secondario per un documento storico in sé, rivolgendo l’attenzione alle _motivazioni_ e al _contesto_ che hanno portato alla creazione e alla conservazione di una testimonianza, sia essa scritta, orale o iconografica. La lettura del passato apre diverse prospettive: è possibile (...) rintracciare un genere narrativo che più di ogni altro meglio descrive il Medioevo? In quale senso una fonte arricchisce la nostra conoscenza del passato? È sensato estendere lo studio a testimonianze non strettamente testuali o iconografiche, come le mappe geografiche? La riflessione che poggia su questi quesiti rivela un Medioevo in parte inventato, una fantasia che non è tuttavia l’ombra del passato storico, bensì il suo complemento. _Analysing an historical period, such as the Middle Ages, or a more recent era, through its narration, must take into consideration many heterogeneous sources, whose form is not always immediately identifiable. In some cases, scholars may even have a secondary interest in a specific historical document, preferring to study the _motivations_ and _context_ behind its creation and conservation of historical testimony, either written, spoken or iconographic._ _Interpreting the past opens up different perspectives: is it possible to determine a single narrative genre able to describe the Middle Ages better than others? In what sense does a historical source enrich our knowledge of the historical past? Does it make sense to include in the study of history, sources that are not strictly textual or iconographic, such as a geographical map?_ _Reflecting on these questions reveals an invented aspect of the Middle Ages, a fictional portrait that not only brings into view history__’s shadow but also complements it_. Segundo o autor, os ideais democráticos são frutos da abertura de que as sociedades necessitam para seu progresso, o (...) qual, aos poucos, abrandaria a pressão das exigências impostas pela natureza para a conservação da vida em sociedade e possibilitaria aos homens conviverem mais livremente e mais afetuosamente com vistas a uma sociedade mais justa e sem tantos conflitos e mortes. Contudo, como escapar às determinações que a natureza impôs para que a vida em sociedade se mantivesse e conseguir que os homens se abram a outro tipo de vivência em conjunto? This paper develops Richard Wollheim’s claim that the proper appreciation of a picture involves not only enjoying a seeing-in experience but also abiding by a standard of correctness. While scholars have so far focused on what fixes the standard, thereby discussing the alternative between intentions and causal mechanisms, the paper focuses on what the standard does, that is, establishing which kinds, individuals, features and standpoints are relevant to the understanding of pictures. It is argued that, while standards concerning kinds, individuals (...) and features can be relevant also to ordinary perception, standards concerning standpoints are specific to pictorial experience. Drawing on all this, the paper proposes an ontology of depiction according to which a picture is constituted by both its visual appearance and its standard of correctness. (shrink)

Both perception and imagination seem to play a crucial role in our engagement with fiction films but whether they really do so, and which role they possibly play, is controversial. On the one hand, a fiction film, as film, is a depiction that invites us to perceive the events portrayed. On the other hand, as fiction, it invites us to imagine the story told. Thus, after watching the film Alien, one might say that one saw Ripley fighting the monster but (...) one might also say that one imagined Ripley fighting the monster. Are these two reports compatible? If they are, how can we combine them so to make sense of them? If, instead, they are not, which of them should we give up? (shrink)

Works of art are usually meant to elicit psychological effects from their audiences whereas paradigmatic technical artifacts such as hammers or cars are rather meant to produce physical effects when used. This suggests that works of art and technical artifacts are sharply different entities. However, recent developments in the cognitive sciences and the philosophy of technology have individuated special artifacts, namely cognitive and affective artifacts, which also generate psychological effects. In particular, affective artifacts, which have the capacity to alter the (...) affective condition of agents, seem to share crucial features with works of art. Can we subsume works of art under that kind? I will argue that we cannot. Still, comparing art with affective artifacts will help us to clarify the relationship between art and technology, and to introduce a new category, namely the experiential artifact, which can properly encompass works of art. Enrico Müller legt hier die erste philosophische Gesamtdarstellung zur Bedeutung der Griechen für Nietzsches Denken vor. Er zeigt, wie sich in Auseinandersetzung mit dem Griechentum Nietzsches eigene Philosophie entwickelte, und problematisiert deren Abgrenzungen von der Logosphilosophie der griechischen Klassik. Müller kommt dabei zu dem Schluss, dass auch Nietzsches Philosophie letztlich auf die Vorgaben der sokratisch-platonischen Dialektik angewiesen bleibt.

This paper considers two issues raised by the claim that fictional characters are abstract artifacts. First, given that artifacts normally have functions, what is the function of a fictional character? Second, given that, in experiencing works of fictions, we usually treat fictional characters as concrete individuals, how can such a phenomenology fit with an ontology according to which fictional characters are abstract artifacts? I will indirectly address the second issue by directly addressing the first one. For this purpose, I will (...) rely on the notion of a mental file. I will argue that the function of fictional characters is the generation of mental files of a special kind. I will show that our experience of fictional characters as concrete individuals depends on the kind of mental files that are generated by fictional characters as abstract artifacts. I will conclude that an appreciator of a work of fiction can open two files about a certain fictional character; one about the character as an individual in the fictional world, and the other about the character as an abstract artifact in the actual world. In this sense, our relation to a fictional character is characterized by a duality of files or ‘twofileness’. (shrink)

A rigorous ab initio derivation of the (square of) Dirac’s equation for a particle with spin is presented. The Lagrangian of the classical relativistic spherical top is modified so to render it invariant with respect conformal changes of the metric of the top configuration space. The conformal invariance is achieved by replacing the particle mass in the Lagrangian with the conformal Weyl scalar curvature. The Hamilton-Jacobi equation for the particle is found to be linearized, exactly and in closed form, by (...) an ansatz solution that can be straightforwardly interpreted as the “quantum wave function” of the 4-spinor solution of Dirac’s equation. All quantum features arise from the subtle interplay between the conformal curvature acting on the particle as a potential and the particle motion which affects the geometric “pre-potential” associated to the conformal curvature itself. The theory, carried out here by assuming a Minkowski metric, can be easily extended to arbitrary space-time Riemann metric, e.g. the one adopted in the context of General Relativity. This novel theoretical scenario appears to be of general application and is expected to open a promising perspective in the modern endeavor aimed at the unification of the natural forces with gravitation. With respect to Parmenides’ thought Melissus was regarded as a dissident thinker already in antiquity. His polemical introduction of the concept of void and the relative idea of infinite Being seemed particularly controversial. The aim of the present paper is to examine the origins of the Melissian understanding of void in order to trace its philosophical genesis to the criticism of the Atomist Leucippus. According to the philosopher from Abdera, the Eleatic fundamental principles had to conform to the obviousness of (...) bodies’ motion, which is why the Eleatic not-Being had to be understood as void. Melissus took issue with this view and criticized the idea of the void’s reality by means of a methodical argument. In the course of doing so, the philosopher from Samos distorted the original Parmenidean ontology, which is why his theories were often criticized severely as theoretically weak. (shrink)
