The article aims to analyze the semantic fields of two Korean terms in the field of a specialized judicial terminology, i.e. court and tribunal, which are usually reflected in English by one hypernym term court. This analysis, although carried out on limited Korean data, is intended to indicate the differences between the use of these two different Korean terms and to indicate the reasons why court is currently the most common English equivalent. At the same time, the author, by pointing (...) to the historical and cultural background, explains the reasons why the term court is not always correct. The methods used in compiling the data are to highlight differences in the semantics of Korean terms covered by an English hypernym court. (shrink)

The main purpose of this paper is to investigate and reconstruct the philosophical thoughts in Marian Smoluchowski’s papers. He was an outstanding Polish physicist, who lived at the turn of the XIX and XX century. Smoluchowski was particularly interested in theoretical physics. His achievements in this discipline, some even very significant, have caused him to be perceived mainly as a physicist. His work in the theory of fluctuations and kinetic theory of gases, especially in the theory of Brownian motions, is (...) well known to physicists. My attention in this paper is focused on the metascientific problems which dominated his philosophical reflections. His analysis in the fields on philosophy of science ought to be perceived in light of physics. Philosophical reflections were at the margins of science which he practiced – physics was always the background to his deliberations. An important limit to our deliberations was set by concentrating on issues typical of the philosophy of science. In Smoluchowski’s case, however, it is difficult to say that his branch of philosophy is characterized by systematic reflection. It is difficult to classify his reflection in the framework of any given philosophical trend. (shrink)

We could ask: how national could be a culture or another? The modernist or postmodernist perspectives seems to be unilateral here. Could be transmodernism the right sollution? The distictions between modernism, postmodernism and transmodernism are actually a pretext to set into discussion again the old dispute between Culture, regarded as a humanity universal feature and national cultures, perceived as a human community tradition symbol (community that claims a territory, a language, a religious belief and a certain government form).

In his recent work, Leonard Lawlor draws attention to the problem of “violence,” which is the “problem that provides the most food for thought.” This emphasis on the problem of violence and its connections to metaphysics understood as philosophy has been remarkably consistent over his career, and thinking through responses to “violence” has sustained Lawlor’s continued effort to think about what he calls “violent” relations between event and repeatability and ground these upon a critical phenomenology. This contribution to the discussion (...) of Lawlor’s work focuses on his most recent book, From Violence to Speaking Out (2016), so as to suggest three important directions for this project and for philosophy’s response to violence. I first briefly trace the theme of violence in From Violence to Speaking Out, contextualizing it against the rest of his work, so as to draw out what he means by violence and its provocation to philosophy, with special attention to the way that the violence in question is figured as disrupting the transcendental and confronting philosophy with what Lawlor calls the “ultratranscendental.” Second, I link it to the theme of time by tracing Lawlor’s point about violence in relation to the breaking up of the transcendental subject from Kant into Heidegger. Third, I link these points to the negative movement of the dissolution of modes of repeatability. This dissolution is captured in a kind of “speaking‐out” that Lawlor detects in Foucault, Derrida, and Deleuze and Guattari, involving an excess over and above expression, which Deleuze calls “hyperbologic.”. Is medicalization always harmful? When does medicine overstep its proper boundaries? The aim of this article is to outline the pragmatic criteria for distinguishing between medicalization and over-medicalization. The consequences of considering a phenomenon to be a medical problem may take radically different forms depending on whether the problem in question is correctly or incorrectly perceived as a medical issue. Neither indiscriminate acceptance of medicalization of subsequent areas of human existence, nor criticizing new medicalization cases just because they are medicalization (...) can be justified. The article: (i) identifies various consequences of both well-founded medicalization and over-medicalization; (ii) demonstrates that the issue of defining appropriate limits of medicine cannot be solved by creating an optimum model of health; (iii) proposes four guiding questions to help distinguish medicalization from over-medicalization. The article should foster a normative analysis of the phenomenon of medicalization and contribute to the bioethical reflection on the boundaries of medicine. (shrink)

The article presents an attempt to reconstruct the axiological contents of Marx’s –concept of justice In the broadest terms, the axiological content of Marx’s concept of justice consists, in the author’s opinion, in the eternal conviction of man that it is just to render unto man what is rightfully due to him, while to deprive man of his due rights is a wrong. Accordingly, every man, by reason of his work or merits, rightly deserves the use and enjoyment of the (...) material goods he has produced, or of the good reputation he has won, etc. That formulation, however, does not exhaust the full sense of Marx’s idea of ‚justice’. Man in his capacity as a human being rightfully deserves over and above all that, a chance to draw on the full stock of human achievement, in order to develop and satisfy his manifold needs, inclinations and talents. The International Society for Universal Dialogue is one among other philosophical schools, societies and organizations which promote the idea of universal dialogue. It tries to solve problems associated with language and ideological barriers, strengthening professional and friendly ties and implementation, through joint efforts, of a peaceful and fair (...) world order. The phenomena of truth, truthfulness, veracity and “truthiness” discussed widely in logic, epistemology as theory of science and gnoseology as general theory of knowledge, have received many interpretations—and not a single one to be generally accepted. Discussions continue not only upon narrow technical, operational questions of the predicate calculus and/or propositions calculus, but also on logic-gnoseological problems, one of which casts doubt on the maxim “logic is the house of truth,” and the other highlights the laxity of the opposition of (...) “truth—falsehood” meanings as the main categories of the two-valued logic. These evaluations of proposition do not in fact oppose each other in the sense of a contradiction. Verity and falsity are controversial (opposite), but not contradictory (antithetical) concepts; it is truth and non-truth that are contradictory. Therefore, there is not only the possibility, but also the reality of the existence of a field, or zone, of transition between the values “true—false.”. (shrink)

Using Kleinian theory to examine the debate as it is manifested in the main philosophical themes of this century, Steuerman argues that a rational and ethical theory of justice must take into account that which is not rational, symmetrical or transparent--namely a primitive world of love and hatred which colors and shapes our perceptions. _The Bounds of Reason: Habermas, Lyotard & Melanie Klein on Rationality_ is a highly original yet accessible study of the debate between modernity and postmodernity. Emilia Steuerman clearly explains the modernity/postmodernity dispute by examining the problem that has driven the whole debate: whether the use of reason is an emancipatory or enslaving force. Steuerman clearly sets out this debate by critically examining the arguments of two of its key proponents, Jurgen Habermas and Jean-François Lyotard. She clearly explains Habermas' defence (...) of modernity and his attempt to salvage Enlightenment ideas of truth, justice, and freedom through the use of reason. She contrasts this with Lyotard's postmodernism and his scepticism about the use of reason, and its claims to universalism and objectivity. Throughout, Steuerman contrasts the Habermas-Lyotard debate with important insights from psychoanalytic theory, and shows how Habermas' notions of intersubjectivity and a community of shared language users can be compared and contrasted with Melanie Klein's theory of object relations. We believe with the publication of our Lexicon Spinozanum, that we are meeting a need in Spinoza historiography which has been pointed out by scholars, but has never before been satisfied. In the intro duction of his Spinozas philosophische Terminologie (Leipzig, 1913), G. T. Richter promised "a Spinozistic Lexicon in which the meaning of each term is set out on an historical basis in alphabetical order". In 1924, in the Report, i.e., Nachbericht, of his four volume edition of the complete (...) works of Spinoza (Heidelberg), C. Gebhardt promised a complementary volume comprising, among other things, a general index. However, neither the one nor the other were ever published. The hope of seeing this gap quickly filled has been reiterated recently by Di Vona: "The compilation of a Spinozistic index is a task of the history of philosophy, the execution of which would gratify all scholars". (Di V on a, Studi suIt' ontologia di Spinoza, Florence, 1960). We do not know how closely our Lexicon Spinozanum corresponds to what Richter and Gebhardt projected. We believe, however, that there are common requirements at the basis of works of this sort. In our procedure and in the delimitation of our scope, we have set for ourselves two main criteria: that of clarity and that of completeness. We hope we hav:e not deviated from them too much. Avec l’entrée massive dans l’usage du nom « émotion » comme nom générique de toutes les manifestations psychologiques, due à la vulgarisation du discours de spécialité de la psychologie, des arts, etc., il existe la tentation de considérer ce nom, du point de vue linguistique, uniquement comme un hyperonyme et même comme un « nom général », du sommet ou des fondements du lexique. Cet article présente un point de vue nouveau : il montre que, par ses propriétés morphologiques, syntaxiques (...) et anaphoriques, le nom émotion est aussi un nom de base, du même niveau lexical que peur, joie, tristesse, etc., que l’on a pu considérer comme ses hyponymes. Heidegger’s Kant and the Problem of Metaphysics controversially claims that the A deduction is superior to the B deduction because the imagination, as the“common root” of understanding and sensibility, opens the first Critique to metaphysical ground. Drawing on Dieter Henrich, this paper reinterprets Heidegger’sreading by moving beyond the Analytic and taking the Dialectic into account. This suggests a continuity between the A and B deductions, namely that the imagination, as more than an ontic faculty, remains a basic power that keeps (...) open a metaphysics of being in Kant—a metaphysics whose site is a radicalized unity of transcendental apperception. Revisiting Heidegger in this way shows how Kant is both linked to and differentiated from German Idealism’s debate about the imagination, a position suggested in both Heidegger and recent scholarly discussion. This review of an edited collection, Reading Kant’s Geography, discusses a series of critical essays on Kant’s physical geography, a topic to which he devoted many years of intellectual energy. The volume is the first of its kind for it appears in anticipation of the first ever publication into English of Kant’s own lectures on physical (...) geography, which lectures he held for over forty years, alternating with lectures on anthropology. Today, scientific research is seen as being largely dominated by the short-term, and by the constant need to gain legitimacy in the eyes of society. This text analyzes the existing literature on the concept of future and seeks to explore some of the main meanings it has for scientists. Based on interviews with researchers working on different projects in Portuguese research centers, the authors scrutinize some of the implications of the recurrent reference to the future in their research agendas. Starting (...) with a review of the literature on the relations between science, time, and future, they show that nowadays, scientists experience some difficulty when dealing with the long-term in science, mostly due to the pressure of the market on innovation. In view of their profiles and discourses, what must be stressed are the risks and challenges playing out in the conflict between the short and the long term in scientific research. (shrink)

Leftist Critique or Fight for Democracy? Contimporanul Covering the Trial from Dealul Spirii. The general knowledge about the political dimension of the Romanian historical avant-garde places the groups on the left of the political spectrum. However, there is little work on what this means precisely when it comes to the concrete historical situations. It may well be that Contimporanul, the main press organ of the avant-garde supported a political agenda of socialist origin, but what does it mean specifically? In order (...) to give a complete historical-intellectual picture of the Romanian avant-garde, specifically of Contimporanul, one must also account for the first couple of years of its appearance, when it published a large number of political opinion articles, written mainly by the same authors that would become central for the artistic movement as well. We aim to fill this gap in the scholar writings by giving a detailed account of the reactions found in the pages of Contimporanul related to the political events of that time, notably those that involved the socialist movement. The case in point is the Trial of Dealul Spirii and the alleged political assassinations against socialist leaders committed or condoned by the state authorities. The overall image of the political ideology of Contimporanul from those years shows rather a marked democratic attitude towards the events, and a great deal of journalistic objectivity behind the attacks against the liberal establishment. The Dynamic of the Avant-garde Group around Unu Literary Magazine. Going through the history of Unu literary magazine, the article describes the dynamic relationship of its group members taking into account their artistic and cultural-political stance. The evolution of the group towards a radical approach and its ideology is grasped on taking on two study cases: the Contimporanul– unu debate and the relationship carried among the group’s members. The purpose of the study is to point to how the group’s ideology (...) had an impact on its progress and dynamic constitution. Moreover, finally, the study indicates how the internal and exterior pressure led to the magazine’s dissolution. (shrink)

Frente a la perspectiva antropológico-jurídica dominante, fundada en la desconfianza, la sospecha y el temor, abordamos un paradigma alternativo, basado en la necesidad de fiarse del otro y en el establecimiento de lazos cooperativos, cuyo núcleo reside en (...) un sentido profundo de la responsabilidad, el compromiso y la solidaridad. La fiabilidad y la fidelidad aparecerán, a lo largo de este breve diálogo con el autor, como elementos internos e incluso constitutivos del derecho y, por tanto, algo así como su “centro de gravedad permanente”.
