Against a background of neoliberal precarity, the yoga industry promotes a practice experienced by, and inscribed on, the body that is meant to transcend physiological boundaries and expand individual and collective awareness. In this context, research on contemporary yoga has shed light on how women, and specific notions of womanhood, are key to a promise of wellness, healing, and self-realisation that is materialised by White, monied, slender female practitioners as embodiments of the proper way of undertaking self-care. The yoga industry, (...) thus, participates in a politics of the body, embedded in the intricate structures of the current neoliberal politico-economic regime. Based on these observations, this article sets out to interrogate how the yoga industry’s mandate of tending to the body enters the way female teachers and practitioners navigate, experience, and express their journey into yoga. By analysing selected interviews conducted with women yoga instructors and practitioners in the city of Genoa, the article examines how they frame yoga as a way of caring for the self while navigating personal issues and bodily ailments. As a path of self-scrutiny and self-realisation, yoga is talked about as providing some relief from life’s predicaments and embodied vulnerabilities while also accommodating gender normativity. The article develops a critique of the problematic appropriation of self-care by the yoga industry’s mainstream cultural repertoires as a sociologically neutral individual response to living with neoliberal precarity. The article contends that feminist politics of care provide a framework to re-inscribe yogic self-care within a broader process of collectively subverting neoliberal injunctions about tending to the body. Edmund Husserl often characterizes essences and eidetic laws in normative terms. Many of his statements to this effect are however highly puzzling as they appear at odds with Husserl’s general understanding of normativity. In this paper I focus on this puzzle and I argue that we can reconcile most of the apparent tensions between these two dimensions of Husserl’s philosophical thought. In the first part of the paper, drawing on the contemporary literature on kinds of norms, I focus on Husserl’s (...) work on the varieties of normativity. I submit that, on his view, essences and eidetic laws are never intrinsically normative, and that not all essences and not all corresponding eidetic laws can function as norms for their instances. Crucially, however, I argue that, according to Husserl, essences and eidetic laws can function as norms for a range of the subject’s acts. In the second part of the paper I further examine this thesis, thus explaining in what sense Husserl thinks that essences and eidetic laws can have this function. I show that formal eidetic laws can engender deontic and evaluative norms for correct or rational judgments, evaluations, desires, and acts of the will. I also contend that material essences and material eidetic laws also have a normative function for judgments. I conclude that this shows how Husserl’s view makes room for norms that are not context-dependent or subjectively grounded. (shrink)

In Italy in recent years, an exponential increase in the frequency of medical malpractice claims relating to the issue of informed consent has substantially altered not only medical ethics, but medical practice as well. Total or partial lack of consent has become the cornerstone of many malpractice lawsuits, and continues to be one of the primary cudgels against defendant physicians in Italian courtrooms. Physicians have responded to the rising number of claims with an increase in ‘defensive medicine’ and a prevailing (...) preoccupation with the purely formal aspects of consent. The result is a plethora of consent forms, believed to be a guarantee of ‘informed consent’, as well as a growing reliance on informed consent as a shield against judicial action brought by the patient. Physicians ‘inform’ patients without really sharing information, often delegating the task of communication to other professionals who are not doctors. Italian judges always condemn the physician when information to the patient has been inadequate, thus leading insurance companies to consider the lack of valid informed consent as the total responsibility of the physician and/or the hospital. It is necessary to change tack, to remove this idea of consent which permeates the defensive culture of medical practice. Italian physicians need to be trained, first of all, to become aware that information and consent are two distinct processes, albeit closely connected. Valid communication demands a higher level of professionalism from physicians. (shrink)

Contemporary societies are riddled with moral disputes caused by conflicts between value claims competing for the regulation of matters of public concern. This familiar state of affairs is relevant for one of the most important debates within liberal political thought: should institutions seek to realize justice or peace? Justice-driven philosophers characterize the normative conditions for the resolution of value conflicts through the establishment of a moral consensus on an order of priority between competing value claims. Peace-driven philosophers have concentrated, perhaps (...) more modestly, on the characterization of the ways in which competing value claims should be balanced, with a view to establishing a _modus vivendi _aimed at containing the conflict. _Interactive Justice _addresses an important question related to this debate: on what terms should the parties interact _during_ their conflict for their interaction to be morally acceptable to them? Although largely unexplored by political philosophers, this is a main area of concern in conflict management. Building on a proceduralist interpretation of "relational" concerns of justice, the author develops a liberal normative theory of interactive justice for the management of value conflict in politics grounded in the fundamental values of fair hearing and procedural equality. This book innovatively builds a bridge between works in political philosophy and peace studies to propose a fresh lens through which to view the normative responses liberal institutions ought to give to value conflict in politics, and moves beyond the apparent dichotomy between pursuing end-state justice through conflict resolution or peace through conflict containment. Liberal theories of justice typically claim that political institutions should be justifiable to those who live under them – whatever their values. The more such values diverge, the greater the challenge of justifiability. Diversity of this kind becomes especially pronounced when the institutions in question are supra-national. Focusing on the case of the European Union, this paper aims to address a basic question: what kinds of value should inform the justification of political institutions facing a plurality of value systems? One (...) route to an answer is provided by John Rawls, who famously distinguishes between comprehensive and political values, and defends the exclusion of the former from the foundations of a political theory of justice. This paper questions the tenability of the Rawlsian solution, and draws attention to an alternative twofold conceptual distinction: that between minimal and non-minimal and between substantive and procedural values. Minimal values are meant to be as independent as possible of controversial conceptions of the good and views of the world, regardless of whether these are comprehensive or purely political. It will be argued that their endorsement may thus further specify the nature of what should be shared in order to justify political institutions in conditions of pluralism. In order to further refine the account of such basis of justification, two variants of minimalism will be presented according to whether they invest substantive or procedural values. Substantive values qualify the property of an outcome; procedural values qualify the property of a procedure. The latter part of the paper consists of a ‘face-off’ between minimal proceduralism and minimal substantivism, considering reasons in favour of the adoption of each. The result, we suggest, is a helpful reorientation of the political dimension of the value debates to which the multiplicity of values amid contemporary European horizons give rise. (shrink)

Can the quality of gender+ equality policies be defined in ways that apply across different policy contexts and different policy moments? In light of different scholarly debates and empirical material from gender violence policy debates especially in Southern and Central Eastern Europe, this article discusses dilemmas around defining the quality of gender+ equality policies. It proposes a two-dimensional model. The first dimension links quality to procedural aspects: empowerment of women’s rights advocates at different stages of the policy process, and transformation (...) with reference to prevailing contextual legacies. The second dimension is more substantive, and includes genderedness, intersectionality and the structurally transformative focus of policies. The article illustrates how within the framework set by these criteria, the quality of gender equality policies is constructed through policy debates in ways that are dependent on the different discursive, institutional and structural factors specific to various policy contexts. The corruption of public officials and institutions is one of the most obvious problems that affects developed and developing countries alike. Because this view is largely shared, most current studies of this phenomenon—‘political corruption’—have been dedicated either to measuring or counteracting the negative political, social, and economic effects that this form of corruption may have in society. Albeit significant and urgent, these studies have distracted the attention of commentators from a somewhat more basic analysis of the nature and wrongness of (...) this phenomenon. This lacuna has resulted in the formulation of a multiplicity of actions that address a very heterogeneous set of issues, including such diverse phenomena as bribery, embezzlement, institutional malfunctioning, the inadequacy of political leaders, and clientelism. This situation is unsatisfactory because it muddles important distinctions between different pathologies that may affect the public order. But it matters also for the design of anti-corruption strategies that risk to either misfire or be too vague by lacking a clear target and an account of the exact kind of wrong these strategies are meant to prevent and/or correct. In our research on this topic, we have addressed this issue by offering a normative analysis of political corruption as surreptitious public action. Our account explains the distinguishing traits of political corruption and makes sense of its inherent wrongness as a contradiction of the logic of publicity that undergirds political interactions in a rights-based system. In this chapter, we draw on this research and expand it with a view to enhancing the identification of relevant instances of political corruption and the design of policies to counteract them. This essay undertakes a reexamination of the notion of the receptacle/chōra in Plato's Timaeus, asking what its value may be to feminists seeking to understand the topology of the feminine in Western philosophy. As the source of cosmic motion as well as a restless figurality, labile and polyvocal, the receptacle/chōra offers a fecund zone of destabilization that allows for an immanent critique of ancient metaphysics. Engaging with Derridean, Irigarayan, and Kristevan analyses, Bianchi explores whether receptacle/chōra can exceed its reduction to (...) the maternal-feminine, and remain answerable to contemporary theoretical concerns. Whilst legitimacy is often thought to concern the processes through which coercive decisions are made in society, justice has been standardly viewed as a ‘substantial’ matter concerning the moral justification of the terms of social cooperation. Accordingly, theorization about procedures may seem appropriate for the former but not for the latter. To defend proceduralism as a relevant approach to justice, I distinguish three questions: (1) Who is entitled to exercise coercive power? (2) On what terms should the participants to a (...) scheme of cooperation interact? (3) How should the costs and benefits produced by cooperation be distributed? Legitimacy concerns (1), whereas justice applies to (2) and (3). Although the appropriateness of proceduralism is debatable in relation to (3), it seems well equipped to address the justice-related question in (2). And it does so by focusing on the inherent moral acceptability of the way in which persons are treated by the procedures through which they interact. (shrink)

The Italian code of medical deontology recently approved stipulates that physicians have the duty to inform the patient of each unwanted event and its causes, and to identify, report and evaluate adverse events and errors. Thus the obligation to supply information continues to widen, in some way extending beyond the doctor-patient relationship to become an essential tool for improving the quality of professional services.

The corruption of public officials and institutions is generally regarded as wrong. But in what exactly does this form of corruption consist and what kind of wrong does it imply? This article aims to take stock of the current philosophical discussion of the different senses in which political corruption is wrong in a general sense, beyond the specific negative legal, economic, and social costs it may happen to have in specific circumstances. Political corruption is usually presented as a pathology of (...) the public order. Therefore, the senses in which political corruption has been presented as wrong have varied depending on the normative theory of the public order that is presupposed. In this article, we offer a critical presentation of two major interpretations of the wrongfulness of political corruption that draw respectively on a neo-republican and a liberal account of the public order. Finally, we show how the analytical distinction between these approaches has important normative implications for the identification of relevant cases of political corruption. (shrink)

This article offers a conceptual framework for discussing the role of envy within processes of transitional justice. Transitional justice importantly includes the transformation of intergroup dynamics of interaction in the aftermath of societal conflicts and upheavals. Such transformation aims to realise “interactive” justice in transitional justice by reshaping belief and value systems, and by moulding emotional responses between the involved parties. A nuanced understanding of the emotions at play in intergroup antagonistic dynamics of interaction is thus essential to transitional justice. (...) Among the many emotions that we could address in such scenarios, we target envy. Envy, in its various forms, features prominently in many societal conflicts and upheavals, and has, therefore, the potential to undermine or, conversely, support just intergroup interactions. However, the ambivalent role of this emotion has been scantly analysed in the philosophical literature on transitional justice. We make a start on filling this lacuna by developing a conceptual framework which is necessary to appreciate how envy and its varieties are epistemically and practically relevant to realising interactive justice in transitional justice processes. The idea of toleration (or tolerance—the terms are mostly used interchangeably) plays a paramount role in liberal theorizing with regard to the normative characterization of the relations between the state and citizens and between majority and minority groups in society. Toleration occurs when an agent A refrains from interfering negatively with an agent B’s practice x or belief y despite A’s opposition to B’s x-ing or y-ing, although A thinks herself to be in the position of interfering. So, the notion (...) of toleration necessarily incorporates the three following elements: (1) negative judgment—whether grounded in moral disapproval or “mere” dislike; (2) power to interfere—whether actual, perceived, or counterfactual; (3) reasons for noninterference—whether epistemological (fallibilism, skepticism), practical (balance of forces), or moral (value commitments). Is the forbearance of what one finds objectionable a strong enough normative ideal when it comes to establishing what we owe to each other in circumstances of moral disagreement? Does the request that we (possibly grudgingly) put up with someone’s objectionable lifestyle and convictions render toleration a condescending concession rather than the consequence of the recognition of everyone’s equal rights? In response, some have argued that we should interpret demands of toleration not as mere claims for noninterference but for the public recognition of the equal legitimacy of someone’s lifestyles and convictions (toleration as recognition). A recent line of debate concerns the kinds of relation that the ideal of toleration is apt to inform: is toleration primarily a political ideal qualifying the way in which liberal institutions should treat those who live under them or should toleration be invoked also to characterize horizontal relations between citizens? Whatever response is given to this question, limits to toleration must be established. As toleration is required of us vis-à-vis what we find objectionable, does it entail relativism? Liberals tend to think that reference to the harm principle should work as a limit for toleration: but what does count as a relevant (physical or symbolic) harm? Such questions acquire importance as the domain of toleration extends from the realm of religious conflicts, out of which it originated in the 16th and 17th centuries, to include a number of culture and ethics-related issues: should a liberal state permit pornography? What is the appropriate response to such cultural practices as female circumcision? Should neutral institutions prohibit the exhibition of religious symbols in public spaces? (shrink)

El presente trabajo propone un estudio de los dos poemarios de la poeta salvadoreña Tania Pleitez Vela, Nostalgia del presente (2014) y Preguerra (2017). Las dos colecciones comparten una poética de la memoria que adquiere rasgos diferentes que se van a analizar. Se aprecia que, de la imposibilidad de asumir el pasado y de nombrar el dolor, se llega al reconocimiento de una pertenencia. Así que en Nostalgia del presente (2014) se perfila el dolido proceso de la rememoración, a través (...) de un yo lirico desamparado e inquieto, mientras que en Preguerra (2017) una voz más ponderada y reflexiva transmite la narración de la memoria. This article explores EU gender policy through the lens of the `Wollstonecraft dilemma', a guiding conceptual device that helps to summarize women's difficult path towards equality in a patriarchal system. EU gender policy reflects the contradictions women must face in their struggle for equality, which are common to most public gender policies. All provisions devised to progress in gender equality have negative retroactive effects on women, due to the patriarchal context in which they are applied. Empirical evidence from the Spanish (...) case offers further support to the argument, showing how EU gender policy is still trapped in the `Wollstonecraft dilemma'. A more holistic approach to EU gender policy, able to tackle all the areas of which patriarchy is composed, and an improved monitoring of EU gender policy implementation in the member states, could both generate a more effective gender policy in the EU and make further progress in solving the dilemma. Mersenne presented Descartes with a series of objections to the Meditations. A careful analysis of these objections can throw light on the theological context in which those criticisms were grounded. Mersenne’s objections reproduce theses already advanced in the Quaestiones celeberrimae in Genesim. In this work, in which he intended to refute Vanini, Mersenne used some proofs of the existence of God derived from the Jesuit Lessius, and already used by Vanini himself. These same proofs, together with others developed by Mersenne, (...) were then taken up by the free thinker Pierre Petit. A reconstruction of the origin of the arguments used by Mersenne can provide important elements to evaluate the interweaving of apologetic and heterodox literature in the first half of the 17seventeenth century and to discuss Leo Strauss’s proposal to “read between the lines.”. The Cartesian dualism requires a type of knowledge appropriate to a mind separate from the body. This type of knowledge is present in angelic knowledge as opposed to beatific knowledge in the works of Thomas Aquinas and Duns Scotus. The beatific knowledge is the type of knowledge chosed by Malebranche and Spinoza.

Irigaray’s engagement with Aristotelian physics provides a specific diagnosis of women’s ontological and ethical situation under Western metaphysics: Women provide place and containership to men, but have no place of their own, rendering them uncontained and abyssal. She calls for a reconfiguration of this topological imaginary as a precondition for an ethics of sexual difference. This paper returns to Aristotelian cosmological texts to further investigate the topologies of sexual difference suggested there. In an analysis both psychoanalytic and phenomenological, the paper (...) rigorously traces a teleological and oedipal narrative implicit in the structure of the Aristotelian cosmos, in which desire for the mother is superseded by love for the father. Further, the paper argues that this narrative is complicated by certain other elements in the Aristotelian text—aporias involving the notion of boundary and the relationship between space and time, the fallenness of the feminine, and the ineliminably aleatory qualities of matter. The paper concludes that such elements may provide material for disrupting this teleology of gender, opening onto not merely an ethics of sexual difference, but providing space and place for a proliferation of non-normative, queer, transgender and intersex modes of sexed and gendered subjectivity. Acts of civil disobedience and conscientious objection provide valuable indications of the congruence of political outcomes with citizens’ conceptions of justice and the good. As their primary concern is substantive, their logic seems extraneous to procedural approaches to justice. Accordingly, it has often been argued that these latter condemn citizens to a ‘deaf-and-blind’ acceptance of the outcomes of agreed procedures. A closer analysis of such acts of contestation shall reveal that although, for proceduralism, the outcomes of just procedures cannot be (...) contested as unjust, they may be contested on the ground of values other than justice, such as someone’s religious/ethical allegiances. The WTO Dispute Settlement System (DSS) has been the object of many studies in politics, law, and economics focusing on institutional design problems. This paper contributes to such studies by accounting for the argumentative nature and sophisticated features of the DSS through a philosophical analysis of the procedures through which it is articulated. Jürgen Habermas's discourse theory is used as a hermeneutic device to disentangle the types of ‘orientations’ (compromise, consensus, and mutual understanding) pertaining to DSS procedures. We show that (...) these latter are oriented primarily to put the parties in a position to reach mutual understanding. Such an orientation is no mere idiosyncrasy of the DSS but is the only one consistently conducive to the WTO's general aims, in response to the various types of disputes that may arise between its Members. By reference to the illustrative case of the supranational regulation of local systems of food production, we aim to show the importance of identifying issues of international legitimacy as a discrete component – alongside issues of global distributive justice – of the liberal project of public justification of supranational collective decisions. Therefore, we offer the diagnosis of a problem but do not prescribe the therapy to cure it.

The study of the psychological effects of social media use on adolescents’ adjustment has long been the focus of psychological research, but results are still inconclusive. In particular, there is a lack of research on the positive and negative developmental outcomes and on possible moderating variables, especially concerning early adolescence. To fill these gaps in literature, the present study longitudinally investigated the relationships between social media use, depressive symptoms, affective well-being and life satisfaction, as well as the moderating role of (...) emotional self-efficacy and gender. The study involved 336 Italian early adolescents who completed an anonymous self-report questionnaire twice within a year. Main results showed that higher social media use was related to higher depressive symptoms, lower affective well-being and lower life satisfaction among girls with lower emotional self-efficacy. Conversely, high social media use was related to higher affective well-being and higher life satisfaction for girls with higher emotional self-efficacy. Results are discussed in relation to their implications for risk prevention and health promotion among early adolescents. In particular, our results suggest that promoting emotional self-efficacy can be very helpful in making the use of social media an opportunity for well-being and life satisfaction rather than a developmental risk. Hobbes refers to a state of "mere nature" to describe the condition of man without political organisation. The origin of this notion is identified in the theory of pure nature discussed by Suarez and its implications are shown.

The paper articulates a new understanding of individual responsibility focused on exercises of agency in reason-giving rather than intentional actions or attitudes towards others. Looking at how agents make sense of their actions, we identify a distinctive but underexplored space for assessing individual responsibility within collective actions. As a case in point, we concentrate on reason-giving for one's own involvement in systemic corruption. We characterize systemic corruption in terms of its public ‘unavowability’ and focus on the redescriptions to which corrupt (...) agents typically resort to vindicate their actions. Through a multidimensional approach to reason-giving, we show that the individual rationalisations these redescriptions point to are necessarily less-than-successful since they keep thedifferent categories of reasons involved in making sense of one’s own conduct misaligned. We argue that this involves a kind of tainted reasoning at the interface between epistemic vice and epistemic disadvantage. We then consider such test cases as self-deception, wilful ignorance, and actions on ‘autopilot’ to show that tainted reasoning is constitutive of systemic corruption, not merely caused by it. On this ground, we expound a new view of responsibility centred on reason-giving as the epistemic core which all responsibility assessments track. To demonstrate the interest of this view, we compare it with existing alternatives revolving around the ideas of accountability and attributability. We conclude by showing how our understanding of responsibility can shed new light on the analysis and normative assessment of an agent’s responsible ignorance. (shrink)

This article follows a previous study that has recently been published in Narrare I Gruppi and explored the reasons for the large numeric gap between the regions of the North and South of Italy, referring to the breast cancer screening program adherence rate sponsored by the Italian Healthcare System, that addresses all women living in Italy ranging in age between 48 and 69 years, and proposes a free mammogram every two years. The effectiveness of cancer early detections has been widely (...) demonstrated by medical research; this kind of diagnosis is particularly important in the case of breast cancer. A diagnosis of this form of cancer at its early phases in 97% of cases allows women to survive at least five years after it. However, the different level of trust women feel for healthcare structures is the discriminating element between the North and South of Italy for their access to the screening program.
