We argue that the mandatory moral bioenhancement of psychopaths is justified as a prescription of social morality. Moral bioenhancement is legitimate when it is justified on the basis of the reasons of the recipients. Psychopaths expect and prefer that the agents with whom they interact do not have certain psychopathic traits. Particularly, they have reasons to require the moral bioenhancement of psychopaths with whom they must cooperate. By adopting a public reason and a Kantian argument, we conclude that we can (...) justify to a psychopath being the recipient of mandatory moral bioenhancement because he has a reason to require the application of this prescription to other psychopaths. Elvio Fachinelli was a leading Italian psychoanalyst of the 1960s-80s whose clinical, theoretical, and radical work resonated well beyond his discipline. In The Still Arrow, Fachinelli launched an interdisciplinary investigation ranging from anthropology to politics and the history of religions to the critique of ideology. From a psychoanalytic standpoint, individual obsessional neurosis is firmly connected to a process of repudiation of death. But Fachinelli argued that similar elaborations on time are also present at the group level, in disparate social (...) and historical contexts, for instance, in the archaic transformation of the dead into ancestors and in what he named "the fascist phenomenon." Originally written in Italian in 1979, this book displays Fachinelli's eclectic methodology, which came to serve as a precursor to Slavoj Zizek's work. Fachinelli differs from Freud's attempt in Totem and Taboo to equate individual psycho-libidinal predicaments with those of whole societies, and he points out an unbridgeable difference between the two. At the same time, for Fachinelli, that difference always remains one of degree, not of principle. He explores many questions about time, such as history's status not only as the sum of all possible histories but also of impossible ones. This first English translation of Fachinelli's work, The Still Arrow introduces a major critical European voice to the larger readership. (shrink)

Il volume, inserito nella collana diretta da Franco Todescan “Lex naturalis. Testi scelti di filosofia del diritto medievale”, presenta una sezione antologica di testi marsiliani introdotta da uno studio di Elvio Ancona sulla letteratura critica che nell’ultimo cinquantennio si è occupata del pensiero del Patavino. Lo studio bibliografico, in particolare, nella rivisitazione delle più recenti interpretazioni del Defensor pacis, trova occasione per interrogarsi su alcuni problemi giusfilosofici fondamentali che in quell’opera furono sollevati e sulle soluzioni che vi furono prospettate. In questa prospettiva, dunque, viene esaminata innanzitutto la discussione relativa all’ispirazione di fondo della riflessione di Marsilio, riassumibile nella domanda se egli si debba ritenere “magis aristotelicus” o “magis christianus”, e a quale tipo di aristotelismo o di cristianesimo eventualmente si riferisca. Vengono successivamente considerate le principali teorie fiorite intorno alle grandi tematiche “istituzionali” del Defensor pacis, concernenti l’origine, l’organizzazione e la legislazione della civitas sive regnum, tematiche che sono state affrontate dagli studiosi ricorrendo a concezioni che andavano di volta in volta dal naturalismo al convenzionalismo, dal repubblicanesimo all’assolutismo, dalla teonomia al giuspositivismo. Ci si sofferma quindi sulla diuturna controversia che, con riguardo alla politica religiosa del legislator marsiliano, ha fatto parlare, con linguaggio spesso consapevolmente anacronistico, di “secolarismo” o addirittura “laicismo” e, alternativamente, di “cesaropapismo”. Si conclude infine con la disputa storiografica sulla collocazione del Mainardini tra medioevo e modernità, e con la valutazione delle indicazioni che, in termini di “ideologia marsiliana”, la complessa vicenda ermeneutica esaminata offre per una comprensione unitaria del significato della sua opera. According to the Thomistic reflection on contingent matters, a conclusion is probabilis when it is arrived to through “dialectical” arguments, in the Aristotelician sense. In particular, for Aquinas dialectics is a method for searching truth also in the specific realm of judicial context, which represents a particular case of probable knowledge. Dialectics, as attends non only to value the reliability of testimonies, but aims more in general to the verification of the facts at stake, ensures the highest probability of the (...) solution to be reached. From the Thomistic perspective, then, one can claim that, if in a trial the acquired evidence is sufficient, the solution arrived to through the dialectical method is, among the many possible, the one which most probably “corresponds” to reality. Two issues in Cowley’s book Medical Ethics, Ordinary Concepts and Ordinary Lives are discussed. The first is methodological and it concerns the relation between the personal and the impersonal perspectives. An apparent problem is represented by some uncertainties in the interpretation of their relation in Cowley’s proposal. In some cases presented by Cowley, although the agents do not give up the requirements of the personal perspective, their actions correspond to the requirements of the impersonal perspective. The question is how did (...) the agent make the decision? The other issue is that the personal perspective, as described in some cases, seems to be concerned only by reasons relevant to the subject herself. The question is whether such a perspective may be properly called moral, or it rather deserves to be qualified as prudential, egocentric or egoistic.The second issue regards organ donation, where Cowley contrasts the cultural discourse endorsed by people personally involved because of their links to the dead person, and the bioethicists’ discourse. Some empirical data seem to challenge this distinction. (shrink)

James Allan’s book A Sceptical Theory of Morality and Law is an interesting and first–rate attempt of using a humean theory as a model for a contemporary sceptical view in ethics and philosophy of law. In presenting Hume’s theory, Allan explicitly declares that he is not interested in an exegeses of Hume’s theory, but he intends to use it as a critical tool for contemporary moral discussions. Allan’s books surely represents a major contribution to contemporary moral discussions, and some of (...) his topics deserves a further discussion, as his discussion of Thomas Nagel, his criticism to moral intuitionism, the fact of whether his naturalistic reduction leads to scepticism or to naturalistic realism. The epistemological ideal would aim to respect the different scientific traditions from which the scientist can be fed, which may not follow the hegemonic lines. Interpersonality in science would mean a scientific multiculturality that respects the different paradigms developed in epistemology. We will see which epistemological conception has a closer relation with the dimensions that trialism proposes, according to which law is composed with sociologic, normologic and dikelogic elements. In the end, it will be possible to have a clearer idea (...) of the complexity in a more diverse sense, which develops trialism not only as the vision of the lawyer’s profession, but also as a research perspective. The complex thought, as an epistemological attitude which is open to the different methodological tools provided by the different epistemological perspectives in the philosophy of science, allows a better coexistence of contradictory positions within a single epistemological posture. Thus, a scientist can profit from the different tools in each of them. Having proved the close relation between the trialistic theory and the complex thought, a scientist of law will be able to develop deeper research lines, having more respect for his tendencies in the trialism. El ideal epistemológico apuntaría a que se respeten las distintas tradiciones científicas en las que pueda abrevar el científico, que pueden no seguir las líneas hegemónicas. La interpersonalidad en la ciencia significaría una multiculturalidad científica respetuosa de los distintos paradigmas que se desarrollan en la Epistemología. Veremos qué concepción epistemológica se relaciona más con las dimensiones que plantea el trialismo según el cual el Derecho está compuesto de elementos sociológicos, normológicos y valorativos (dikelógicos). Al final de lo cual se hará más clara la complejidad, en el sentido de diversidad, que desarrolla la teoría trialista como perspectiva de investigación, y no sólo como herramienta para la profesión abogadil. El pensamiento complejo, como actitud epistemológica abierta a las distintas herramientas metodológicas que provienen de las diversas perspectivas en filosofía de la ciencia, permite una mayor convivencia de posiciones contrarias al interior de una misma postura epistemológica. Y así, un científico podrá aprovechar las distintas herramientas de cada una de ellas. Habiéndose probado la estrecha relación entre la teoría trialista y el pensamiento complejo, un científico del Derecho podrá desarrollar más líneas de investigación y con mayor profundidad, respetándose más sus tendencias, en el trialismo. The methodology of this paper is documentary, compiling textbooks and scientific articles related to Argentine scientific history, mainly referring to CONICET. The purpose is to show that a complete epistemological study cannot be done without giving an account of its sociological and historical context, in this case, specifically referred to the management of science. The perspective of this paper is more philosophical than historical, doing discourse analysis and interpretation. Management, a sociological element, has a close relationship with science, and its (...) study is part of epistemology. So, first, we must be careful to use the classification of basic and applied science in order to prioritize the latter with funding. Secondly, science should be autonomous but not independent from society and the market in which it is embedded, and the private sector should be harmonized with the public sector as regards scientific production. Third, betting on scientific production by Argentina helps demystify the classification of developed and underdeveloped countries, or the first and the third world. Fourth, in the management of science, university plays a key role, so management of university and the centralized management of the scientific bodies should be harmonized. Fifth, regarding the strengthening of the human component, subsidies offering should be balanced with the professionalization of research based on dedication. La metodología de este ensayo es documental, recopilando libros y artículos científicos que hacen referencia a la historia científica argentina, principalmente referida al CONICET. El propósito es mostrar que no puede realizarse un completo estudio epistemológico sin dar cuenta de su contexto sociológico e histórico, en este caso, precisamente referido a la gestión de la ciencia. La perspectiva del trabajo es más filosófica que histórica, realizando análisis del discurso e interpretación. La gestión, elemento sociológico, tiene una relación estrecha con la ciencia, y su estudio forma parte de la epistemología. Por lo que, en primer lugar, hay que cuidarse de utilizar la clasificación de ciencia básica y aplicada para priorizar con financiamiento a la última. En segundo lugar, hay que autonomizar pero no independizar la ciencia de la sociedad y el mercado en los que está inmersa, así como armonizar la iniciativa privada con la pública en el ámbito de la producción científica. En tercer lugar, apostar a la producción científica por Argentina contribuye a desmitificar la clasificación entre países desarrollados y subdesarrollados, o del primer o tercer mundo. En cuarto lugar, en la gestión de la ciencia, juega un papel clave la universidad, por lo que habría que armonizar la gestión de la universidad y de los organismos centralizados en la administración de la producción científica. En quinto lugar, en relación al fortalecimiento del componente humano, debería equilibrarse el ofrecimiento de subsidios con la profesionalización de la investigación en función de la dedicación. Empirical methods interact with moral philosophy in several ways. In this paper I remark the role of experience, as well as formative experience, in moral epistemology. I defend the thesis that abstract reasoning is not sufficient in morality. Experiences are needed for refined moral judgments. In particular, I focus on experience and formative experience through engagement with artworks. I endorse a form of art cognitivism, the thesis that we can learn through experiences of artworks, but here I remain neutral toward (...) whether the cognitive value of artworks contributes to their artistic value. In my view, learning from artworks is not detached from abstract reasoning, but complementary to it. This is needed in order to reply to an objection directed at art cognitivism, one which appeals to the fact that the properties of artworks can improve our moral cognitive capacities, as well as reduce them. I reply to this objection by saying that although art is one resource of moral learning, it is not the only resource. This is why we must not passively endorse insights that are derived from experiences of artworks. We must critically analyse these by comparing them with other beliefs and experiences. Experiences of artworks are a source of moral learning, but insights that are derived from them must be reflective and critically examined. The model is a kind of reflective equilibrium, where various sources of learning interact and support, as well as check, each other for moral learning. (shrink)

This paper extends Alan John Simmons?s conceptual distinction between Lockean and Kantian conceptions of legitimacy that he applied to the question of the legitimacy of states, to the issue of legitimacy of public decisions. I criticise the consent conception of legitimacy defended by Simmons, and I defend the Rawlsian version of the justificatory conception of legitimacy from his objection. The approach of this paper is distinctive because the two conceptions are assessed by investigating, using the method of reflective equilibrium, their (...) respective prescriptions concerning the treatment of antisocial personality disorder and epidemiologic measures. I argue that the method of reflective equilibrium does not support the consent conception. Considering the issues of treatment of APD and of epidemiologic measures, I argue that the consent conception of legitimacy is not well-equipped for the evaluation of norms that are not strictly self-regarding. This causes a deficit of prescriptions for relevant social responses. Further, by considering the case of responses to epidemics, I argue that such a conception can avoid harmful consequences only by recurring to additional, and independent, premises. This does not cause incoherence but reduces the coherence of a normative system. Finally, the consent conception is not equipped to support social cooperation in an optimal way, which has proved to be necessary in critical conditions, like a pandemic. On the other hand, I argue that the method of reflective equilibrium supports the Rawlsian version of justificatory conception of legitimacy, because of its advantages in handling the indicated issues. In addition, I maintain that this justificatory conception is respectful of freedom and equality of agents as moral self-legislators, and, thus, it is not vulnerable to Simmons?s main criticism. Rawlsian public reason requires public decisions to be justified through reasons that each citizen can accept as reasonable, free and equal. It has been objected that this model of public justification puts unfair burdens on marginalized groups. A possible version of the criticism is that the alleged unfairness is constituted by what Miranda Fricker and other authors call epistemic injustice. This form of injustice obtains when some agents are unjustly treated as not reliable, or when they are deprived of epistemic (...) resources to utter their claims or burdened when they need to express demands. I show that the Rawlsian model can stand the objection. Restricting justificatory reasons, at least when basic issues of human rights, liberties and opportunities are at stake, is needed in order to warrant a stable society as a fair system of cooperation among free and equal citizens. U recentnoj knjizi Christopher Cowley je problematizirao shvaćanje racionalnosti koje se nalazi u utilitarističkoj raspravi o samoubojstvu, kao i općenito shvaćanje racionalnosti koje se usmjerava ustanovljavanju vanjskih razloga. Suprotno tome, Cowley zastupa unutarnju perspektivu kao jedinu vjerodostojnu u takvim odlukama. Izravno ću razmotriti njegovu kritiku Richarda Brandta i Davida Humea. Intencija je teksta nuđenje preciznije interpretacije Humea te usporediti argumente za i protiv unutarnjih i vanjskih razloga. Zaključak je uvjetovano prihvaćanje perspektive unutarnjih razloga.In a recent book, Christopher Cowley has expressed (...) the problems of the concept of rationality related to the utilitarian discussion about suicide, as well as in general the concept of rationality which is directed by the appeal to external reasons. Contrary to this, Cowley defends the internal perspective as the only trustworthy in such decisions. I will analyze directly his criticism of Richard Brandt and David Hume. The intention of the paper is to offer a more precise interpretation of Hume and compare the arguments for and against internal and external reasons. The conclusion is a conditioned acceptance of the perspective of internal reasons. (shrink)

In this chapter, we investigate whether psychopathy is a mental disorder. We argue that addressing this question requires engaging, at least, with three principal issues that have conceptual, empirical, and normative dimensions. First, it must be established whether current measures of psychopathy individuate a unitary class of individuals. By this we mean that persons classifed as psychopaths should share some relevant similarities that support explanation, prediction, and treatment. Second, it must be proven that psychopathy harms the person who has it. (...) Third, it must be established that the harm associated with psychopathy is relevant for the ascription of disorder status. Regarding this latter issue, we argue that psychopathy should be considered a disorder if its harmfulness derives from certain incapacities or limited capacities. These incapacities should affect basic competences that are justifably required for conducting a preferable type of life. Within this framework, we tentatively advance the hypothesis that some normatively justifed conclusions and empirical evidence about psychopathy, that needs nonetheless to be further investigated, might support the claim that people with psychopathy have a mental disorder. The Thomistic doctrine of adequatio seems to endure as a current topic in contemporary debates on the accessibility of truth in trials, since it can account for the objectivity of our knowledge, while avoiding anti-correspondence objections. It can, thus, offer an important contribution to forensic epistemology, in particular in force of the fact that, in conjunction with Thomistic reflections on the certitudo probabilis of witnesses, it allows us to combine the claim that, in legal matters (like in all variable and (...) contingent subjects), we can never reach absolute certainty, with the conviction that one can nonetheless know what, with more probability, really happened. The research started with a definition of the general ethical background to be applied in bioethical discussions, particularly regarding aspects of morality that have to be enforced by the community. Only those moral beliefs that can be accepted by consensus in a free discussion can be enforced. It follows that the basic principle of a well ordered society is the equality (and possible upwards extension) of the basic liberties. Therefore, whenever it is possible to respect the principle of autonomy in (...) matters of bioethics (here including questions of abortion, assisted procreation, genetics, organ transplantation and euthanasia) this must be done. On the other hand, there are some common values that can be defended in a free dialogue, values that are needed in order to guarantee stable cooperation in a political society. These values include the respect for human life, which implies the respect for human life in all its forms. This leads to the conclusion that people who are able to be part of the system of cooperation in a political society have rights which are dominant in moral considerations. In all cases where there is no conflict between these rights and the value of life as manifested in human individuals who are not able participate in social cooperation, considerations of the value of the life of the latter must be an important moral consideration. This implies that embryo experimentation should be permitted in order to develop scientific advances needed to save human life, but embryos must not be used for trivial reasons or for the cosmetic industry. Cremaschi’s book presents a critical exposition of the development of contemporary moral philosophy. A virtue of the book rarely found in other philosophical survays is the parallel representation of the themes discussed both in the Anglo-Saxon tradition and in the continental one. The final part of the book is devoted to recent developments in applied ethics.

Pitanje ovoga članka jest treba li nacionalnu pripadnost uvrstiti na popis primarnih dobara, odnosno, postoji li snažna veza između nacionalne pripadnosti i primarnih dobara o kojima se govori u klasičnoj liberalnoj formulaciji do mjere da njezina zaštita zaslužuje uvrštenje među njih. O ovom pitanju, na izravan ili manje izravan način, raspravljaju vodeći autori liberalne nacionalističke paradigme. U ovom tekstu posebno se raspravlja pretpostavljena veza između zaštite nacionalne pripadnosti i primarnog dobra društvenih osnova samopoštovanja. Unatoč određenoj potrebi javnog priznanja nacionalne pripadnosti, (...) utemeljenje njezine zaštite na razini primarnih dobara, barem kada je riječ o argumentu koji se poziva na društvene osnove samopoštovanja, nije uvjerljivo.The issue regarded in this article is whether we have to include national belonging in the list of primary goods, i.e., whether there is a strong connection between national belonging and primary goods about which the classical liberal theory speaks, such that the protection of national belonging must be included in the list of primary goods. Leading authors in the liberal nationalist paradigm, more or less directly, discuss about this issue. In this paper, the supposed connection between the protection of national belonging and the social bases of selfrespect is specifically discussed. Despite the reasons for some public protection of national belonging, its foundation at the level of primary goods, at least as far as it concerns the argument that relies on the social bases of selfrespect, is not plausible. This paper is about the notions of the artistic, aesthetic, cognitive and moral value of art and their interconnectedness. The main concern is to try to advocate the cognitivist claim about the artistic value of artworks’ contribution to the advance of knowledge, as well as for the relevance of the moral dimension for artistic value. This is a discussion of the intersection of the debate about moral and aesthetic value. The central part of the paper is focused on a debate (...) with Peter Lamarque. The problem of immoral art-works and their cognitive value is discussed at the end of this paper in order to show that they are counterexamples of the thesis of artistic relevance of the moral dimension. In the first part of the paper, Gaus’ ground for the ideal of persons as free and equal is described. Doubts are raised about the appropriateness of the use of his account of this ideal as endogenous to our moral practice. Th e worries are related to the use of the concept of having a reason that Gaus makes in his book, as well as to the aptness of his account of our moral practice from the viewpoint of our moral (...) phenomenology. Some doubts are raised in relation to the pertinence of Gaus’ concept of having a reason from the perspective of the motivation of the public reason project. In the second part of the paper, a summary is off ered of Gaus’ model of public justification and some of its consequences are discussed. Th e primary intention here is to show that, contrary to Gaus’ view, egalitarian liberalism, and not classical liberalism, is the most appropriate result of such a model of justification. (shrink)

All’origine della sovranità is a critical reflection on the complex and articolated sequence of events which, in the first half of the fourteenth century, brought to the crisis of Dyonisian hierarchical system and to the modern conception of sovereignty. In fact, the principle superiorem non recognoscere appears for the first time in juridical experience during the dispute about the two powers, when opponents of papal claims perceived the need to create new models of order, by which to replace the hierocratic (...) representation of the hierarchical system. After having considered the different conceptions of Dyonisian order in the late Middle Ages, the Author dwells on the two main contrasting paradigms: Marsilio’s organicism and Dante’s humanism. The first was coupled with clearly conventionalist theses, and led to the supremacy of the sovereignty principle and to a total submission of citizens to the public will; on the contrary, the second heightened persons’ capacity for self-regulation in accordance with a law that is given them with their being, and that directs them both to the beatitudo huius vite and, above all, to the beatitudo vite ecterne. Because of this contrast, through the philosophical arguments of the disputants, the problem of the relation between the two powers emerges in all its dramatic complexity. It wasn’t only a question to recognize preeminences or supremacies, autonomies or subjections, but to pronounce upon the conception itself of political community, of its ordering principle, and of its juridical shape. For this reason the alternative between Dante and Marsilio will mark out the whole subsequent juridical and political experience, up to our days. (shrink)

Must liberalism, in dealing with issues of basic rights and primary goods, take into account national belonging as a particularly important form of cultural belonging? The paper first discusses liberalism which is frequently defined as difference-blind and which considers citizens solely on the basis of some of their abstract and common features. The alternative position is liberal nationalism, according to which individuals and their primary goods stand at the center of considerations of justice, but which also finds it impossible to (...) ignore cultural belonging when discussing primary goods and basic rights of individuals. In discussing the strategy which affirms national cultural belonging as a precondition for autonomy, an attempt is made to show that this is not a sufficient basis for the role of a special national cultural belonging in the definition of primary goods, because even if a national cultural belonging is needed for practicing autonomy, specific national cultural belonging isn’t. Review on Timothy Chappell , Values and Virtues: Aristotelianism in Contemporary Ethics, Clarendon Press, Oxford, 2006.

In this paper we want to explore different epistemological benefits that we gain by dealing with some artworks, and our focus is on narrative arts. We claim that there is a sense in which narrative arts can be similar to testimony, in that they provide information which can be epistemologically valuable for cognitive agents such as we are. We identify at least two broad categories of these epistemological benefits, the first one includes ‘facts stating’ and in that sense is parallel (...) to the paradigmatic case of testimony in which what the testifier says can be a source of knowledge as mere acquisition of facts for his audience . This, however, is not the most peculiar and distinctive kind of epistemological benefits we can gain from art. The other one has to do with raising awareness, of deepening our understanding about some issues either by a specific, powerful and involving way of providing us facts , or by presenting us the stance, the attitude, the opinion of the artist that can be enlightening, or challenging for us. In contemporary debates on euthanasia, physician assisted suicide and withholding and withdrawing life prolonging treatments, besides commonly used reasons, which are based on presumption of freedom and avoidance of pain, there is also an idea of a duty to die. Given that individuals are also members of society, and that they have families and loved ones, it is necessary to discuss cases when illness causes severe burdens for lives of loved ones. We consider that patient’s just assessment of duty to (...) die can be legitimate candidate for justification of procedure of acceleration of death, taken care of necessary conditions of justified social support for patients and necessary aliment from family and society. In this paper we examine main features of duty to die thesis, extract objections, and offer guidelines for continued discussion. We also want to express the importance of establishing social circumstances and preconditions for protecting the individuals.U suvremenim raspravama o eutanaziji i liječnički potpomognutom samoubojstvu, te odustajanju od tretmana, osim uobičajenih razloga koji se temelje na slobodi i izbjegavanju patnje osobe koja traži ubrzavanje smrti, postoji i teza o dužnosti umiranja. S obzirom na to da je pojedinac ujedno i član zajednice, odnosno da ima obitelj i voljene, nužno je raspraviti o slučajevima kada bolest izaziva značajne teškoće za život njegovih bližnjih. Smatramo kako i pacijentova pravedna prosudba o dužnosti umiranja može biti legitiman kandidat za opravdanje postupaka ubrzavanja smrti, uz nužne preduvjete pravedne društvene podrške pacijentu i dužne skrbi od strane obitelji i društva. U ovom tekstu razlažemo osnovne značajke teze o dužnosti umiranja, izdvajamo prigovore i dajemo smjernice za nastavak rasprave te izražavamo važnost ustanovljavanja društvenih okolnosti i preduvjete za zaštitu pojedinaca. U ovom radu raspravljamo odnos Rawlsovog političkog liberalizma i istine. Budući da je politički liberalizam teorija koja izbjegava sva kontroverzna epistemološka i metafizička pitanja, jednako tako izbjegava i pitanje svoje istinitosti i koncept istine uopće. Usredotočili smo se na tri autora koji tvrde da politički liberalizam ne može izbjeći pitanje istine. Prvi autor je perfekcionist, Joseph Raz, koji pokušava pokazati da je Rawlsova teorija nekoherentna ukoliko se ne bavi pitanjem istinitosti neke moralne doktrine na kojoj mora počivati. Drugi, David Estlund, (...) tvrdi da je teorija filozofski neodrživa ako se ne poziva na istinitost svog fundamentalnog načela. Treći, Joshua Cohen, pokazuje nemogućnost izbjegavanja nekog koncepta istine ako se u političkoj teoriji pozivamo na vjerovanja i opravdanje. Nastojimo dokazati tvrdnju o praktičko-političkoj i filozofskoj ograničenosti njihove kritike Rawlsove teorije. Temeljna intencija članka je opovrgnuti kritike koje se upućuju Rawlsu te time ojačati njegov prijedlog političkog liberalizma. Pri tome nastojimo i nadopuniti nedorečenosti u Rawlsovom prijedlogu te zbog toga nudimo preciznije određenu sliku političkog liberalizma u odnosu na njegovu izvornu.In this paper we discuss the relation between Rawls’ political liberalism and truth. Since political liberalism is a theory that avoids all controversial epistemological and metaphysical questions, it equally avoids the question of its truth and a concept of truth generally. We are focusing on three authors which claim that political liberalism can not avoid the question of truth. First, Joseph Raz, a perfectionist who claims that Rawls’ political theory is incoherent unless it is not concerned with the truth of some moral doctrine on which it must be derived. Second, David Estlund, who claims that Rawls’ theory is philosophically untenable unless it does not consider its fundamental principle as true one. Third, Joshua Cohen, indicates the impossibility of avoiding some concept of truth if political theory is invoking concepts such as beliefs and justification. We are pointing on theirs practical-political and philosophical limited range in criticizing Rawls’ theory. The basic intention of the article is to confute criticisms addressed to Rawls and, in this way, to strengthen his proposal of political liberalism. At the same time, we try to resolve issues deriving from indeterminacies in Rawls’ proposal. For this reason we offer a picture of political liberalism that is more determinate than his original proposal. (shrink)
